1 MINUTES OF THE MEETING OF THE CADDO PARISH COMMISSION HELD ON THE 6 th DAY OF OCTOBER, 2016 The Caddo Parish Commission met in legal and regular session on the above date at 3:30 p.m. in the Government Chamber with Mr. Matthew Linn, President, presiding, and the following members in attendance, constituting a quorum: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Epperson, Gage-Watts, Jackson, Linn, Middleton, and Smith (11). ABSENT: Commissioner Johnson (1). The invocation was given by Mr. Dominick, and Mr. Jackson led the Commission in the Pledge of Allegiance. CITIZENS COMMENTS Mrs. Irma Rogers, 1920 Michoud Street, Shreveport, 71107, came before the Commission to give an update on the MLK Community Development Corporation. Mrs. Rogers stated that the funds have been spent on tutoring services and senior citizens activities. She stated that the bulk of their funds go towards helping the children and the senior citizens of this community. It was moved by Mr. Jackson, seconded by Mr. Chavez, to adopt the Regular Session Minutes from September 22, Motion carried. COMMUNIQUES AND COMMITTEE REPORTS Notice is hereby given that at its meeting to be held on Thursday, November 17, 2016 at 3:30 p.m. at Government Plaza Building, 505 Travis Street, Shreveport, Louisiana, the Caddo Parish Commission plans to consider adopting a resolution ordering and calling an election to be held in Caddo Parish to authorize the renewal of ad valorem taxes and/or the issuance of general obligation bonds in the Parish and to authorize the rededication of a sales and use tax in Sales Tax District Number One of the Parish. Mr. Jackson commended the LA Film Prize. He stated that it was a very successful and well-attended event. He also commended the Fuller House for dedicating two houses in the Allendale area. He stated that they are dedicating more houses in the future. Mr. Jackson also announced that there are several events going on this weekend, such as the Revel. Re-Form Shreveport will be taking place this Friday at the Central Art Station. There is also a day party at the Penthouse which will host a voters registration drive. On October 10 th, there will be a YPI Lunch & Learn and the topics to be discussed will be regarding the UDC. He also announced that SUSLA s 50 th Anniversary will be held on Friday at 10:30 a.m., Independence Stadium Mr. Linn asked that Administration look into the amendments on the mail-in ballots. Mr. Cawthorne also commended the LA Film Prize for an entertaining weekend. Mr. Epperson thanked Administration and Animal Services for participating in National Night Out and providing animals for adoption. He also announced that the Attorney Henry Bernstein will be at the Bill Cockrell Community Center on October 3 at 10:00 a.m. explaining the Constitutional amendments. Mr. Epperson informed the Commission about the passing of Ms. Tina Strickland. He said that her services will be held on Friday, October 7 th from 12:00 noon until 5:00 p.m. at the Winnfield Funeral Home. Her funeral will be held on Saturday, October 8 th at 11:00 a.m. at Lake Bethlehem Baptist Church. Mr. Epperson commended the Public Works Department on the completion of the parking lot of the Caddo Community Action Agency. Mr. Chavez announced that the Youth Challenge Program from Minden will be in town to help pick up the litter on Mansfield Road and Bert Kouns. He invited the Commission and any other citizens to help volunteer. He also announced that Mayor Tyler will be at Southwood High School on October 22 nd. The topic to be discussed is It s Everyone s Concern: A Conversation on Crime & Violence. He encouraged everyone to attend. at 6:00 p.m. Mr. Middleton reminded the Commission of the BNA fish dinner on Tuesday, October 11 th 90

2 PRESIDENTS REPORT Mr. Linn reiterated the details of Re-Form Shreveport. He stated that the event will start on Friday, October 7 th at 5:30 p.m. at the Central Art Station. Mr. Charles Marohn with Strong Towns will be the keynote speaker. Mr. Linn also announced that Centenary College is taking submissions for a second PSA about why it is good to live, work, shop, or play in Highland. He stated that they will record these PSA s at KSCL on October 19 th at 5:00 p.m. PUBLIC HEARING ON ZONING ORDINANCES Zoning Case P-10-16, in regards to Ordinance No of 2016, amending the zoning of property located on the SW corner of North Market and Pine Hill Road, Caddo Parish, LA, from R-A, Residence-Agriculture District to B-3, Community Business District. John Harris, Applicant. Zoning Case P-12-16, in regards to Ordinance No of 2016, amending the zoning of property located 680 feet south of Fountainbleau Road, Caddo Parish, LA, from R-A, Residence-Agriculture District to B-2, Neighborhood Business District. Zoe Interests, LLC, Applicant. Zoning Case P-13-16, in regards to Ordinance No of 2016, amending the zoning of property located on the NE side of North Market, 1075 feet south of LA 538, Caddo Parish, LA, from R-A, Residence-Agriculture District to B-3, Community Business District. Mohr Associates, Inc., Applicant. There being no one to speak further for or against ordinances, the President declared the public hearing on ordinances to be concluded. PUBLIC HEARING ON ZONING ORDINANCES Ordinance No of 2016, amending Section of the Caddo Parish Code of Ordinances relative to Solicitation, to change the times during which solicitation is allowed. ORDINANCE NO OF 2016 AN ORDINANCE TO AMEND CHAPTER 54 OF THE CODE OF ORDINANCES OF THE PARISH OF CADDO, AS AMENDED, THE CADDO PARISH ZONING ORDINANCE, BY AMENDING THE ZONING OF PROPERTY LOCATED ON THE SW CORNER OF NORTH MARKET AND PINE HILL ROAD, CADDO PARISH, LA, FROM R-A, RESIDENCE-AGRICULTURE DISTRICT TO B-3, COMMUNITY BUSINESS DISTRICT AND TO OTHERWISE PROVIDE WITH RESPECT THERETO BE IT ORDAINED by the Caddo Parish Commission in due, legal and regular session convened, that Chapter 54 of the Code of Ordinances of the Parish of Caddo is hereby amended and reenacted to read as follows, to wit: The official Zoning Map of the Shreveport Metropolitan Planning Area of Caddo Parish, Louisiana, be amended by rezoning property located on the SW corner of North Market and Pine Hill Road, Caddo Parish, LA, more particularly described below, be and the same is hereby amended from R-A, Residence-Agriculture District to B-3, Community Business District: A tract of land in Lot 5 of the partition of Julie & Charles Walker lands in the SE/4 of Section 4, T18N, R14W, Caddo Parish, LA, described as follows: Beginning 50 feet south & feet east of the NW corner of said Lot 5, thence S89 47 E 91

Mr. Middleton stated that his reasoning for this ordinance is so that people cannot solicit before 10:00 a.m. At this time, Mr. Middleton s motion carried, as shown by the following roll call votes: AYES: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Epperson, Gage-Watts, Jackson, Linn, Middleton, and Smith (11). 5 AN ORDINANCE AMENDING SECTION OF THE CADDO PARISH CODE OF ORDINANCES RELATIVE TO SOLICITATION, TO CHANGE THE TIMES DURING WHICH SOLICITATION IS ALLOWED AND TO OTHERWISE PROVIDE WITH RESPECT THERETO. WHEREAS, door to door solicitation necessarily means entry upon private property by uninvited persons; WHEREAS, persons in their homes have a greater expectation of privacy and to be free from the intrusive nature of a stranger demanding their personal attention at their threshold during certain hours; WHEREAS persons in their homes are not in a traditional public forum and have a right to not listen to speech which they do not desire; and day. WHEREAS, solicitation earlier than 10:00 a.m. is more intrusive than at later times in the NOW, THEREFORE, BE IT ORDAINED, by the Caddo Parish Commission in due, legal and regular session convened, that Section of the Code of Ordinances is amended to read as follows: SECT SOLICITATION * * * * * * (i) Restrictions on solicitation. * * * * * * (9) Hours of solicitation. RESOLUTIONS It was moved by Mr. Dominick, seconded by Mr. Bowman, that Resolution No. 74 of 2016, to authorize design exception to Blanchard Furrh Road Bridge which is in the Federal Off-System Bridge Rehabilitation & Replacement Program be adopted. Substitute motion by Mr. Jackson, seconded by Mr. Dominick, to englobo and adopt the following resolutions: Resolution No. 74 of 2016, to authorize design exception to Blanchard Furrh Road Bridge which is in the Federal Off-System Bridge Rehabilitation & Replacement Program Resolution No. 76 of 2016, to authorize the Caddo Parish Administrator to approve the assignment, sublease, bill of sale, and conveyance of State Lease to Aethon United BR LP and PEO Haynesville Holdco, LLC Resolution No. 77 of 2016, to authorize the Caddo Parish Administrator to approve the assignment, sublease, bill of sale, and conveyance of that certain pipeline right-of-way agreement to Aethon United BR LP and PEO Haynesville Holdco, LLC At this time, Mr. Middleton s motion carried, as shown by the following roll call votes: AYES: Commissioners Atkins, Bowman, Cawthorne, Chavez, Dominick, Epperson, Gage-Watts, Jackson, Linn, Middleton, and Smith (11). 6 A RESOLUTION TO AUTHORIZE DESIGN EXCEPTIONS TO BLANCHARD FURRH ROAD BRIDGE WHICH IS IN THE FEDERAL OFF-SYSTEM BRIDGE REHABILITATION AND REPLACEMENT PROGRAM, AND OTHERWISE PROVIDING WITH RESPECT THERETO WHEREAS, the Parish of Caddo has been notified by the State of Louisiana, Department of Transportation and Development that the Blanchard Furrh Road bridge (Recall ) in Caddo Parish requires two design exceptions for final design completion and replacement in the Federal Off- System Bridge Replacement and Rehabilitation Program; and WHEREAS, the exceptions are: 1. Provide for 28 clear roadway width rather than the required 40 width as per LADOTD Design Guidelines with ADT above 2000 VPD. 2. Provide for no shoulders rather than the required 8 wide shoulders as per LADOTD Design Guidelines with ADT above 2000 VPD. WHEREAS, the Caddo Parish Commission has determined that these design exceptions for this bridge replacement and rehabilitation project provides a public benefit to the citizens of Caddo Parish; and NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened, that the Caddo Parish Commission does hereby authorizes the above listed exceptions into the final design of the Blanchard Furrh Rd Bridge (Recall ) Federal Off-System Bridge Replacement and Rehabilitation Project. BE IT FURTHER RESOLVED that the Caddo Parish Commission does hereby authorize the Parish Administrator or his designee to do any and all things necessary to authorizes the above listed exceptions into the final design of the Blanchard Furrh Rd Bridge (Recall ) Federal Off-System Bridge Replacement and Rehabilitation Project, and to execute any and all documents in a form acceptable to the Caddo Parish Attorney necessary to effectuate the purposes set forth herein. BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications which can be given effect without the invalid provisions, items or applications, and to this end, the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that this resolution shall take effect immediately. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are RESOLUTION NO. 76 OF 2016 A RESOLUTION TO AUTHORIZE THE CADDO PARISH ADMINISTRATOR TO APPROVE THE ASSIGNMENT, SUBLEASE, BILL OF SALE AND CONVEYANCE OF STATE LEASE TO AETHON UNITED BR LP AND PEO HAYNESVILLE HOLDCO, LLC, AND OTHERWISE PROVIDING WITH RESPECT THERETO WHEREAS, the Parish of Caddo is the Lessor in that certain oil, gas and mineral lease from the Caddo Parish Police Jury to Wessely Energy Corporation, in State Agency Lease 10564, dated December 15, 1982 and recorded at registry No of the conveyance records of Caddo Parish, Louisiana; and WHEREAS, State Agency Lease has been conveyed by assignment and merger to J-W Operating Company; and WHEREAS, the Parish of Caddo has received a written request from J-W Operating Company, seeking approval from the Caddo Parish Commission of an Assignment Sublease, Bill of Sale and Conveyance of State Agency Lease from J-W Operating Company to Aethon United BR LP and PEO Haynesville Holdco, LLC. NOW, THEREFORE, BE IT RESOLVED by the Caddo Parish Commission in due, regular and legal session convened, that the Administrator is hereby authorized to approve the Assignment Sublease, Bill of Sale and Conveyance of State Agency Lease from J-W Operating Company to Aethon United BR LP and PEO Haynesville Holdco, LLC. 95

BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are RESOLUTION NO. 77 OF 2016 A RESOLUTION TO AUTHORIZE THE CADDO PARISH ADMINISTRATOR TO APPROVE THE ASSIGNMENT, SUBLEASE, BILL OF SALE AND CONVEYANCE OF THAT CERTAIN PIPELINE RIGHT-OF-WAY AGREEMENT TO AETHON UNITED BR LP AND PEO HAYNESVILLE HOLDCO, LLC, AND OTHERWISE PROVIDING WITH RESPECT THERETO WHEREAS, the Parish of Caddo is the Grantor in that certain Pipeline Right-of-Way Agreement from the Police Jury of Caddo Parish to J-W Operating Company, dated April 1, 1975 and recorded at registry No of the conveyance records of Caddo Parish, Louisiana; and WHEREAS, the Parish of Caddo has received a written request from J-W Operating Company seeking approval from the Caddo Parish Commission of an Assignment, Sublease, Bill of Sale and Conveyance of the above described Pipeline Right-of-Way Agreement to Aethon United BR LP and PEO Haynesville Holdco, LLC. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are It was moved by Mrs. Gage-Watts, seconded by Mr. Bowman, Resolution No. 78 of 2016, proclaiming October as Breast Cancer Awareness Month in Caddo Parish be adopted. Mrs. Gage-Watts stated that everyone is affected by cancer, and she would like everyone to be aware of cancer. She also asked that everyone wear pink and purple at the next meeting. Mr. Epperson stated that his mother has been in remission for fourteen years. He reiterated the importance of early detection. Mr. Jackson provided some facts regarding the Medicaid expansion. He also stated one thousand women have received mammograms due to the Medicaid expansion. Twenty-four enrollees have tested positive for cancer. He too reiterated the importance of early detection. A Notice of Special Election shall be published in the Caddo Citizen a newspaper of general circulation within the Parish, published in Vivian, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as Exhibit A and incorporated herein by reference the same as if it were set forth herein in full. SECTION 3.Canvass. This Governing Authority shall meet at its regular meeting place, the Government Plaza Building, 505 Travis Street, Shreveport, Louisiana, on THURSDAY, JANUARY 12, 2017, at THREE-THIRTY O CLOCK (3:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of the said special election.
