2 AFFIDAVIT FOR ARREST WARRANT The Affiant (hereafter referred to as "I"), Detective Brannon Winn, is a duly commissioned Police Officer for the City of Boulder, located in the County of Boulder, State of Colorado, being duly sworn, deposes and states: I am currently assigned to the Detective Section of the Boulder Police Department and investigate crimes occurring within the City of Boulder, County of Boulder, State of Colorado. On 05/08/13, I met in person with, at the Boulder Police Department. told me that as she was growing up, she lived with her patents at a residence locate e t which is located within the City and County of Boulder, State of Colorado nily attended VineLife Church, located at 7845 Lookout Road, in Boulder County. As she grew older decided that she wanted to pursue a career within the church. began seeking out internships and work opportunities within the church. As she sought out these opportunities, became friends with Jason Roberson. Jason was the youth pastor at VineLife church. In 2005, when was fifteen years old, she began trading text messages with Jason. The messages related to the friendship that had formed with Jason, through the church youth group. The text messages quickly led to phone calls, which quickly grew both in frequency and intimacy. By the end of 2005, was receiving calls from Jason per week. Jason began to confide a great deal of personal information during these phone calls. As time passed Jason began to show up at I school and would call her between classes so they could talk. In 2005, while was alone in a room at the church, Jason entered, Ton told that there was a picture on his phone that he was anxious to erase, but couldn t. grabbed the phone from Jason s hand to help him erase it. Wher viewed the photo, she saw an image of a renis. Jason toic that it was a photo of his penis, and that he had taken the photo himself quickly handed the phone back to Jason and told him that it was gross". Jason told that the photo was not meant for her to see. Jason explained that he had taken the photo to send to a male friend as a joke, because "that s what guys do". was unsure what to make of this incident at the time and did not tell anyone what had happened Approximately one year into their relationship Jason called and told her that he was suicidal.. spent several hours on the phone talking to Jason and reassuring him that she cared for him From time to time after this incident, Jason would call and tell her that he was suicidal estimated that Jason expressed suicidal thoughts on at least five additional occasions always talked to Jason and reassured him that she cared for him. began to feel increasingly responsible for Jason s emotional needs told me that because she was raised in the church, she saw Jason as an authority figure trusted Jason, and although she felt a unique friendship with Jason, she viewed him as a "spiritual guide", who could be trusted to place her best interests first told me that she was very "naive" when she began her friendship with Jason had never had a boyfriend before and knew little about intimate relationships told me that now, looking back, she realizes that Jason was able to take her reality and twist it for his own personal use In October of 2006 was a scheduled speaker at an event at the church, for young girls. Just prior to the event, Jason told that she was not dressed properly and convinced her to change in his office went into Jason s empty office at the church and changed her clothes. told

3 me that she stripped down to --r underwear as she changed. Within, hour of changing, received a phone call from Jason. Jason was crying and told that he had been watching her change through a WiinidoJason told - that he had not wanted to watch her change, but had been unable to help himself. told me that Jason was a wreck during this phone call and she began to feel responsible for Jason s behavior, apologized to Jason and told him that it was not his fault and that it would be alright. Jason promised never to behave in this manner again, told me that after this phone call she began to feel very manipulated by Jason, and could not explain in her own mind why she would feel sorry for him. In spite of his promises, told me that Jason s behavior not only continued, but started to escalate, as did the emotional manipulation that went along with Jason s behavior. Jason began showing up unexpectedly both at school and at her home. Sometime in the late fall of 2006, Jason let himself into residence after everyone had gone to bed. found Jason, in her home around midnight. Jason and had a brief conversation, after which Jason quickly left the residence. After leaving the residence Jason called on the phone. Jason and had a brief phone conversation, during which Jason was again able to convince, that the t-shirt she had 1, worn to bed was not appropriate. After speaking with Jason on the phone, changed her bed clothes and then went back to sleep.. was not wearing a bra underneath her bed clothes when she changed. Jason later called to confess that he had been standing outside her house watching her change. does not know how Jason gained entry to her house on this occasion, told me that her family normally locks the door to their house at night. There is a dog door at the rear of the residence, which is not locked, told me that prior to this, Jason had begun to show up at her house unannounced. Jason was iriends with father and would regularly go out for beers with father. Jason would frequently stop by the house to socialize with parents. In 2007 Jason began making sexual comments when speaking with I These comments became increasingly frequent. On one occasion while. was in the church, setting up for an event, Jason told that when she touched his arm, it was the same as if he touched her breasts. told me that this comment and the ensuing discussion took place in church, with other people around. Although there were other people around, Jason s comments were directed solely at.. told me that because other people were nearby, she felt nt the time that the discussion must be alright. Although this suggestion initially seemed absurd to over time, as Jason continued to make sexual comments, this comment began to make sense to her. Jason frequently discussed masturbation and orgasms with These discussions took place at home, Coffee shops in Boulder and at the church. told me that at the time she was very naive about sexuality. Although she had attended a sex education class in high school she had never discussed these topics openly with anyone. Jason told that masturbation was normal and that he did it all the time. Jason encouraged to masturbate and explained the physical sensation of orgasm. Jason also told that when she had sex for the first time, the man that she would be with, would not "last long", because she was so beautiful. This comment confused. Jason explained that attractive women excite men sexually and that any man that she has sex with will be so excited that they will quickly ejaculate. In 2007, approximately two years into her relationship with Jason, he touched her in a sexual manner for the first time.. entered Jason s office at the church. Jason entered the office behind closing the door as he entered. Jason came up behind and reached over her shoulder. Jason placed his right hand down the front of shirt and grabbed her breast. recalled that

4 Jason was shaking as he.toucud her. Jason then "played with" both, breasts. told me that she did not know how to, react. stood still and stared up at the ceiling as Jason touched her. recalls, "Just staring up at the ceiling, hating it, knowing it was wrong, but not moving, staring up at the ceiling and standing still." recalls feeling, "violated" and wanting to "get out of my skin", recalls just standing still "waiting for it to be over", estimated that Jason touched her breasts for less than a minute. Jason abruptly removed his hand from shirt. stood and talked to Jason briefly after he withdrew his hand from her breasts. Jason did not apologize, but told that he thought this contact was "normal". felt uncomfortable talking to Jason after this incident and quickly left, to go home. told me that she was not totally surprised by this incident, told me that Jason does everything in "baby steps", and that there had been a lot of sexual talk leading up to this event. Although was not totally surprised by the contact, she was not expecting it. told me that Jason always pushed the boundaries of their relationship a little bit at a time, so that she was never completely shocked by his behavior, told me that she felt guilty about this incident and did not tell anyone what had happened. told me that the second time that Jason touched her breasts she was at her parents house, where she was living, had just woken up. Jason came to her house to hang out and talk, when no one else was home. was lying on the living room couch and Jason was seated on the floor beside her. was wearing a tshirt, no bra and shorts, as this is what she had slept in. As was lying on her back, Jason noted and then commented on the fact that her breasts were lying off to the side. Jason then reached up under shirt and began fondling her breasts. told me that although she was uncomfortable with this contact, she did not ask Jason to stop. continued to lie on her back as Jason touched her breasts. As Jason touched he continued to talk about how "weird" it was that her breasts were lying to the side of her chest. told me that she did not feel any sexual attraction to Jason and his touch felt odd and out of place.. estimated that Jason continued to touch her breasts for approximately five minutes. Jason did not attempt to kiss or touch other parts of her body. does not recall what caused Jason to stop touching her, but thinks she may have sat up because she was uncomfortable. Jason then departed house. A short time after Jason departed her house, received a phone call from Jason noted that after every uncomfortable situation, Jason always called her to see if she was upset. During the phone call Jason noted that looked uncomfortable as he was touching her and asked if she was alright with what had happened. told Jason that everything was fine. was unsure of the dates for the above examples of sexual contact. told me that she knows these examples occurred in 2007, while she was seventeen, told me that she is sure she had not turned eighteen, because she was still living at home with her parents, when the sexual contact occurred moved out of her parent s house shortly after her eighteenth birthday told me that prior to the time she turned 18, Jason touched her breasts on approximately ten other occasions. told me that these touches were usually very brief and occurred as they passed in a hallway at church or in other settings, where they would briefly come in contact with each other. could not recall the details of these other physical encounters.: told me that Jason did not touch her every time they were together, but that it was not unusual... recalled that the majority of the times that Jason touched her breasts they were at the church, but he also touched her breasts at her home. told me that Jason s office at the church is located at the end of a hallway and is somewhat secluded.. Just prior to graduating from high school, found herself alone with Jason in his office at the church. knew that in similar situations in the past, Jason had used these types of opportunities

5 to touch her breasts, which niue her uncomfortable and upset. ;old Jason that she did not want him to touch hr again. Jason. complied with this request for a while, but eventually he resumed his attempts at sexual contact and emotional manipulation. eventually distanced herself from both Jason and Vinelife Church.. moved to Aspen. Eventually moved back to the Boulder area and began attending a new church. began telling people she works with at the new church about her experiences with Jason. These friends encouraged 1 to report this matter. On or about March 15th, 2013 net with the VineLife Church Elders. During this meeting told church elders about her relationship with Jason, who is still a pastor at Vinelife church. After met with Church Elders, Vinelife church placed Jason Roberson on suspension and initiated an internal investigation of the matter. Through interviews with various church leaders, including Vinelife Executive Pastor Robert Young, and through documents I have received from Vinelife Church using a court order, I have learned that Jason Roberson has repeatedly confessed to church officials that he has touched breasts on multiple occasions. Jason has been unclear with Church Officials about when this contact occurred or how old was at the time. As part of their internal investigation, VineLife Church referred Jason to Baseline Associates Inc, for a polygraph examination. Pursuant to a court order, VineLife Church has provided me with a copy of the senior polygraph examiner s written report to VineLife Church. During the pre-examination interview, Jason Roberson, admitted that he had sexual contact with The report reads in part, "The sexual 18th contact began when the female was one month away from her birthday. The sexual contact consisted of him touching her clothed and bare breast; her touching his clothed penis one time; her touching his clothed buttocks during hugs. The sexual contact occurred in his office, at her residence and in a vehicle parked at a park". On 07/03/13, I met in person with Jason Roberson at the Boulder Police Department. During my interview with Jason, he admitted to having touched breasts on several occasions. Initially Jason told me that this sexual contact had occurred prior to the time had started classes at the University of Colorado (CU). Later in the interview Jason told me that he had misspoken and that the sexual contact had occurred after had begun attending classes at CU. was eighteen when she started classes at CU. Jason recalled that was not living at home with her parents at the time he touched her breasts. Jason denied ever touching breasts, while at her parent s residence. Jason admitted that at one point he had a photo of his penis on his phone and that. photo. Jason denied that he had intentionally shown the photo of his penis. Jason told me that on two occasions he had stood outside and started to watch clothes through a window. According to Jason this occurred at the church and at told me he had stopped watching prior to seeing her nude. had seen the change her house. Jason Jason admitted that on one occasion he had gone to house, reached in through a dog door and unlocked the rear door to the residence to let himself in. Jason could not clearly recall why he had done this, but told me he thought he was trying to scare as a joke.

Jason Roberson has no prior identifiable arrest history. Based upon the above information, I believe sufficient probable cause has been presented to the court to believe that the crimes of: 1) Sexual Assault on a Child by One in a Position of Trust, as outlined in Colorado Revised Statute (CRS) (2)(b), as amended a class 3 Felony; 2) Sexual Exploitation of a Child, as outlined in C.R.S (3)(d), as amended a class 3 Felony; 3) Unlawful Sexual Contact, as outlined in C.R.S (1.5), as amended a class 1 Misdemeanor; Were committed in the City of Boulder.
