3 Introduction The Fair Registration Practices Act (FRPA) mandates that regulating bodies carry out registration practices that are transparent, objective, impartial and procedurally fair. 1 The FRPA review process was designed to fulfill the obligations of the legislation; it allows the FRPA Review Office and the regulating bodies to review existing registration practices for current compliance with the FRPA as well as continuous improvement of transparent, objective, impartial and procedurally fair registration practices. 2 The purpose of the Fair Registration Practices Act (FRPA) Progress Report is twofold. First, it allows the Provincial Dental Board of Nova Scotia to review and report on its current registration practices. Second, it shares the PDBNS s progress on previously-identified areas for improvement, and highlights the exemplary practices that have been developed by the PDBNS since their previous review. Through the 2017 FRPA Progress Report, the FRPA Review Officer aims to build on the progress made by the PDBNS to date and identify opportunities to further improve and evolve registration practices. 1 The Fair Registration Practices Code is delineated in Sections 6-12 of the Fair Registration Practices Act. 5 Exemplary Practices Orientation to Canadian Dental Practice Workshop: The orientation workshops were interactive sessions held in April 2014 and April 2017 to inform foreign trained dentists about what the practice of dentistry looks like in Nova Scotia. A video developed by the Nova Scotia Dental Association was shown with a discussion afterwards. Participants from several different countries with varied levels of experience in the dental profession and at different stages of the licensing process attended the sessions. Hands on Practice Program (HOPP): A hands on practice program (HOPP) was developed for internationally educated dentists to help them prepare for the NDEB Assessment of Clinical Skills (ACS) exam and held at the Dalhousie Faculty of Dentistry in May Observership Program : In November 2017 the Provincial Dental Board supported the development of an Observership Program. There are Internationally Educated Dental Professionals (IEDPs) living in Nova Scotia who are permanent residents in Canada and are currently pursuing their licence to practice dentistry in this province. Many IEDPs are preparing to take the NDEB examinations and/or are applying to the Qualifying Program. In order to prepare for the written and practical assessments, and ultimately to practice successfully and effectively in Canada, IEDPs need a solid understanding of the realities of dental practice here. The Observership Program provides the opportunity for IEDPs to get first hand contact with dental care as practiced in Nova Scotia. It is not intended to fill gaps in knowledge or dental training but rather to familiarize and acculturate IEDPs to the practice of dentistry in Nova Scotia including but not limited to dayto-day activities, policies & protocols, the dental care team, and the culture of the workplace. Designed to expose IEDPs to the environment of Canadian dental practice, the Observership is a volunteer arrangement between an IEDP Observer and a Host Dentist. The program is highly flexible and the time frame may be customized to the needs and availability of the observer and the host dentist. The program has been reviewed by the Provincial Dental Board, is promoted by the Nova Scotia Dental Association, is advised by the IEDP Multi-stakeholder Work Group and is operated by the Immigrant Services Association of Nova Scotia (ISANS). Board legislative amendments are being undertaken Registration & Licensing Requirements - General Dentist In order to be registered and licensed to practice dentistry in Nova Scotia, the following requirements must be met and submitted: A completed application form, signed by a Commissioner of Oaths, with an attached photograph; A copy of your National Dental Examining Board of Canada certificate; For the purposes of labour mobility under the Agreement on Internal Trade, an applicant with a non-restricted license from another Canadian licensing jurisdiction obtained prior to July 1, 2001, who does not hold a National Dental Examining Board of Canada certificate will be recognized as holding a qualification equivalent to a National Dental Examining Board of Canada certificate. A copy of your graduation certificate from a dental program accredited by the Commission on Dental Accreditation of Canada, or the American Dental Association Commission on Dental Accreditation, or effective March 30, 2010, general dentistry programs accredited by CDAC or the Australian Dental Council (ADC), or effective December 15, 2011, general dentistry programs accredited by CDAC or the Dental Council of New Zealand (DCNZ), or effective December 5, 2012, general dentistry programs accredited by CDAC or the Irish Dental Council; A letter from the Dean certifying your graduation from the dental program; A copy of your birth certificate; 7(d), 16(3)(b) Provincial Dental Board of Nova Scotia Page 10 FRPA Progress Report

13 Applicants who have been declined licensure may appeal the Registrar's decision to the Registration Appeal Committee. Dentists who previously did not meet the continuous practice requirement in Nova Scotia, by are not eligible to re-license are required to complete the application form. 15 Photocopy of certificate of graduation from a dental assisting program which has been accredited by the Commission on Dental Accreditation of Canada or the American Dental Association Commission on Dental Accreditation; Photocopy of your birth certificate; Letter of Good Standing from the Registrar of your previous jurisdiction (if currently or previously licensed); If not a new graduate, one must have proof of continual practice defined as a minimum of having worked as a Level II assistant within the preceding five-year period. Verification of active membership in the Nova Scotia Dental Assistants' Association (Contact: Ms. Lynda Foran, ); or Completed application form; If licensing for the first time in Nova Scotia, effective April 1, 2007, the National Dental Assistants Examining Board Certificate will be a requirement. If you do not have the Certificate, a Conditional License will be issued and you will have one year to complete the National Exam before the annual renewal. For the purposes of labour mobility under the Agreement on Internal Trade, a person with a non-restricted license obtained in any Canadian licensing jurisdiction prior to July 1, 2001, who is able to demonastrate 900 hours of clinical practice in the field of dental assisting during the last 3 years, will be recognized as holding the necessary qualifications for licensure as a dental assistant and will be eligible to be registered in the Dental Assistants' Register. Dental Assistants who previously did not meet the continuous practice requirement in Nova Scotia, but are not eligible to relicense are required to complete the application form. Temporary Authorization Introduction The Provincial Dental Board of Nova Scotia is established by the Dental Act to represent and protect the interests of the public in the practice of dentistry. The mandate of the Dental Board is fulfilled by ensuring that only properly trained, qualified and licensed personnel render treatment that is of a reasonable standard. Mandatory Continuing Dental Education (MCDE) is a statutory requirement for most Dental Regulatory Authorities. There are MCDE educational programs which are designed to provide clinical education experiences through direct patient care. Dentists who wish to engage in these patient care programs but are currently licensed outside of the jurisdiction of the Provincial Dental Board must obtain a Temporary Authorization. Part-time faculty members at Dalhousie University who are licensed in another jurisdiction and reside outside Nova Scotia also require a Temporary Authorization from the Provincial Dental Board for clinical activities at the Faculty of Dentistry. 17 Provincial Dental Board of Nova Scotia Page 16 FRPA Progress Report This policy outlines the process and requirements to determine if a dentist is eligible to obtain a Temporary Authorization for the purpose of serving as a part-time instructor at Dalhousie University, participation in a Continuing Dental Education Course involving patient care, or participation in a Provincial Dental Board approved study club involving patient care. To be eligible an individual must be a licensed generalist or specialist in good standing in Canada or the United States. Applicability 1. Part-time Faculty involved in patient care activities - Dentists who reside outside Nova Scotia and hold a licence in another jurisdiction (Maximum of 30 days per 365 day cycle from date of issue or renewal). 2. Dentists who hold a licence in another jurisdiction, do not have a licence to practice in Nova Scotia and are involved in patient-based Continuing Dental Education courses (Maximum of 10 days per 365 day cycle from date of issue or renewal). 3. Dentists who hold a licence in another jurisdiction, do not have a licence to practice in Nova Scotia and are involved in patient-based study clubs that have been approved by the Provincial Dental Board (Maximum of 10 days per 365 day cycle from date of issue or renewal). Process The applicant is required to complete an application form. The application form and all required documents are to be submitted to the Registrar of the Provincial Dental Board at least one month in advance of the date for Temporary Authorization. The Registrar shall review the candidate s application and decide whether or not to issue a Temporary Authorization. If a Temporary Authorization is not granted to the applicant; the applicant can appeal the Registrar s decision to the Registration Review Committee. The Registrar will issue a Temporary Authorization for an applicant who: (a) completes an application in a form satisfactory to the Board; (b) provides a Certificate of Good Standing from each jurisdiction the applicant holds a license; (c) verifies malpractice insurance through CDSPI - minimum of $ 3 million coverage;

18 6 If you require translation of specific documents how is the applicant informed? 7 Do you have a streamlined registration process for those applicants already registered in another Canadian jurisdiction (as per Chapter 7 Agreement on Internal Trade / Canada Free Trade Agreement)? 8 Does your organization make accommodation for applicants (d) provides a copy of their dental license from each jurisdiction the applicant is registered; and (e) provides payment of the Temporary Authorization fee to the Provincial Dental Board. The holder of the Temporary Authorization must ensure that arrangements have been made with a dentist, licensed in Nova Scotia, to provide any follow up care which may be needed by the patient as a result of the treatment provided by the dentist holding the Temporary Authorization. Dentists who wish to renew a Temporary Authorization must satisfactorily complete a Temporary Authorization Renewal form and provide copies of all licence cards for every jurisdiction in which the applicant is currently licensed and a copy of current malpractice insurance coverage which is valid in the Province of Nova Scotia. Approved by the Board: May 29, 2015 Reviewed and approved by the Board: September 30, Telephone Contact is always made with applicants to discuss the requirements and documentation needed. At that time the applicant will inform us if any of their documents need to be translated and always the applicant is prepared by having the translation already done by the time they meet with us to finalize the licensing process. For those who do not have the translations already done then we would provide a translation service for them at their cost. 19 with physical or mental disability? NDEB, NDAEB and RCDC provide accommodation for individuals with disabilities who challenge the certification exams. The Provincial Dental Board will develop a registration policy which will address issues such as disability and fitness to practice. 9a 9b Is any of your assessment process conducted by a third party (i.e. national bodies, credential assessment agencies, etc.)? If so, please specify the name of the organization and describe their role. NDEB is the 3rd party who certifies dentists. NDAEB is the 3rd party who certifies dental assistants. RCDC is the 3rd party who certifies dental specialists. 16(3)(i) 9c Please indicate the types of activities that they assist with. Data Collection Data Storage Credential Assessment Verification of Documents Examinations Recognition of Prior Learning Other The RCDC develops content for and administers specialty level competency examinations in all recognized dental specialties. The outcomes of those examinations are utilized by the PDBNS as a component of its dental specialty licensing and registration process. 9d 9e Can you describe how they adhere to the General Duties of the Regulatory Body as outlined in the Act, including transparency, objectivity, impartiality and procedural fairness? Are you informed of all decisions made by third parties on applicants? Participation of Board Other - The RCDC provides a voting position for the PDBNS on its Education Committee. This position enables direct input and collaboration with the core bodies of the RCDC that are responsible for the development and administration of the national dental specialty examinations. - This includes the activities of RCDC Credentials committee, the RCDC Chief Examiners' Committee and the RCDC Appeals Committee. 26 Further Recommendations / Next Steps The Provincial Dental Board of Nova Scotia has completed all of the action items stemming from their 2014 FRPA Review. The PDBNS supports international applicants through dedicated webpages on their new website targeted to international applicants, relevant links to their national examining boards, ISANS, Nova Scotia START, and the FRPA Review Office, as well as through mutual recognition and accreditation recognition agreements with many international regulatory bodies, and their Observership program. The PDBNS also works closely with its national examining boards (NDEB, NDAEB and RCDC) to ensure that registration requirements are transparent and objective for potential dentists and dental assistants across Canada. 48 Becoming a licensed dentist in Canada In Canada, dentistry is a regulated profession. To become a licensed dentist in Canada you must have a BDS/DDS/DMD degree and be certified by the NDEB. There are different pathways to licensure depending on where you obtain your dental degree. Share this: 710 Accredited Qualifying/Degree Completion Programs are well established and have provided a predictable pathway to integrate into practice for graduates of non-accredited general dentistry programs for over 20 years. These programs are specifically designed to orient international graduates to dentistry and dental practice in Canada and should be considered by most applicants as the primary pathway to certification.

49 Policy on Licensing and Licensing Appeals for Dentists Application for Licensure The Registrar shall examine the credentials of candidates for registration and licensing and approve for registration and licensing those candidates qualified to be licensed and registered. The Registrar shall enter the name of a person in the Dentists Register who: (a) holds a certificate of the National Dental Examining Board of Canada or a Limited Specialty Certificate; (b) (c) (d) pays the registration fee as prescribed by the Board; is of good moral character and a fit and proper person to be registered as a dentist; is not the subject of any pending complaint or sanctions in another licensing jurisdiction; (e) if the subject of a previous written complaint in another licensing jurisdiction, provides full details to the Registrar; (f) completes an application in a form satisfactory to the Board. The application form must have: an attached photograph of the applicant; a signature by a Commissioner of Oaths; a copy of the applicants National Dental Examining Board of Canada generalists' certificate; a copy of the applicant s graduation certificate from a dental program accredited by the Commission on Dental Accreditation of Canada (CDAC); or the American Dental Association Commission on Dental Accreditation; or one of the following general dentistry programs : o Effective March 30, 2010, general dentistry programs accredited by CDAC or the Australian Dental Council; o Effective December 15, 2011, general dentistry programs accredited by CDAC or the Dental Council of New Zealand; o Effective December 5, 2012, general dentistry programs accredited by CDAC or the Irish Dental Council. a copy of the applicant s birth certificate; a Certificate of Good Standing form if the applicant has been engaged in practice in another jurisdiction before moving to NS; Consent for Release of Information; verification of active membership in the Nova Scotia Dental Association; verification of malpractice insurance - minimum of $ 3 million coverage; proof of continual practice, if the applicant is not a new graduate, defined as a min. of 450 hours within the last three years preceding the date of application (letter from employer or singed affidavit); a Criminal Record Check and Vulnerable Sector Check ; two written character references from individuals who are non-family members and who have known the applicant for the past four years; and (g) meets any other reasonable conditions of the Board or the Registrar.

50 Appeal of Licensing Decision A person who is dissatisfied with a decision of the Registrar respecting registration, licensing or otherwise relating to entries into the Dentists Register may appeal the decision to the Registration Appeal Committee. If an agreement is reached under the Regulated Health Professions Network Act to hold an appeal under that Act, the provisions of the Regulated Health Professions Network Act apply. Composition of the Registration Appeal Committee The Board must appoint a Registration Appeal Committee to hear and determine appeals respecting registration, licensing or otherwise relating to entries into the Dentist Register. The Board must appoint a Chair and may appoint a Vice-chair of the Registration Appeal Committee. The Registration Appeal Committee must be composed of at least three persons, one of whom is a public representative. The Vice-chair must act as Chair in the absence of the Chair. If neither the Chair nor the Vice-chair is available, the Registrar must name a member of the Registration Appeal Committee to act as Chair. A quorum of the Registration appeal Committee is a majority of its members. Registration Appeal Procedure Notice of an appeal to the Registration Appeal Committee must be filed in writing with the Registrar within thirty days after service of the Registrar s decision that is being appealed. On receipt of notice of an appeal, the Registration Appeal Committee must: set a date for the hearing of the appeal; and serve written notice of the date, time, and place of the hearing of the appeal on the appellant and the Registrar. The date set for the hearing of an appeal must be no later than ninety days following receipt of written notice of the appeal. The parties to an appeal before the Registration Appeal Committee are the Board and the appellant.

51 An appeal to the Registration Appeal Committee is limited to the matters set out in the notice of appeal filed with the Registrar. An appellant may be heard in person, by counsel, or both. The procedure of the Registration Appeal Committee must be consistent with the requirements of the Fair Registration Practices Act. Registration Appeal Committee Powers and Decision The Registration Appeal Committee may make any determination that could have been made by the Registrar and may: Direct the Registrar to register an appellant, with or without conditions; Direct the Registrar to issue a license to the appellant, with or without conditions; or Dismiss the appeal. The Registration Appeal Committee must give its decision in writing and send a copy of the written decision by registered mail or personal service to the Registrar and to the appellant. The decision of the Registration Appeal Committee is final. Approved by the Board: March 31, 2015
