3 Colorado Hemp Bills February 9, Hearing on SB-132, the Colorado Hemp Production Act From Special Agent in Charge Philip W. Perry: The Drug Enforcement Administration's views on Senate Bill its passage would send a harmful and dysfunctional message to the people of the State of Colorado Enactment of this legislation would add the force of a Colorado statute to the perception that marijuana is "OK. Calling it "hemp" on the basis of an artificial threshold level of psychoactive ingredient does not erase the fact that it is botanically and legally the same plant. This legislation is no more than a shallow ruse being advanced by those who seek to legalize marijuana. The people of Colorado deserve to be protected from this sort of subterfuge.

4 Colorado Hemp Bills Dear Mr. Perry:..My expectation was that the D.E.A. would accord me the courtesy of two or three hours...your words, arriving by fax just 2 1/2 hours prior to the committee vote, are arrogant and insulting. You have been on the taxpayer's payroll for so long, you have become like many bureaucrats who have forgotten the basic employer - employee relationship. You are the employee and the taxpayers are the employer. I believe my 68 years, which includes WWII service on a destroyer in the South Pacific, a master's degree in Theology, seven children, twelve grandchildren and forty-six years of community service, makes me an expert in recognizing a shallow person playing the role of a bureaucratic big shot. 5 Colorado Hemp Bills House Joint Resolution "Concerning the recognition of industrial hemp as a valuable agricultural commodity, and, in connection therewith, urging Congress to clarify the federal definition of industrial hemp, facilitate domestic production of industrial hemp, and remove barriers to state regulation of the production of industrial hemp. "Industrial hemp is a high-value, low-input crop..." and "...can be dry land-farmed, and uses less fertilizer than wheat and corn..." and "...Industrial hemp provides a practical transition to sustainable agricultural practices and the conservation of precious groundwater resources in the state."

8 Industrial Hemp Remediation Pilot Program Average copper uptake per plant 1.5 X 10-4 grams copper. (78 cm height) Extrapolating to plants grown in the field (average height 150 cm), each plant grown outdoors should accumulate 2.9 X 10-4 grams copper.

10 Amendment 64 NOT LATER THAN JULY 1, 2014, THE GENERAL ASSEMBLY SHALL ENACT LEGISLATION GOVERNING THE CULTIVATION, PROCESSING AND SALE OF INDUSTRIAL HEMP INDUSTRIAL HEMP MEANS THE PLANT OF THE GENUS CANNABIS AND ANY PART OF SUCH PLANT, WHETHER GROWING OR NOT, WITH A DELTA-9 TETRAHYDROCANNABINOL CONCENTRATION THAT DOES NOT EXCEED THREE-TENTHS PERCENT ON A DRY WEIGHT BASIS.

11 SB Repealed the industrial hemp remediation pilot program in the Department of Public Health and Environment. Replaced the pilot program with a program in the Department of Agriculture Renamed the Industrial Hemp Remediation Pilot Program Committee, established pursuant to House Bill , as the Industrial Hemp Committee. Requires a person seeking to engage in industrial hemp cultivation for commercial purposes or to grow industrial hemp for research and development purposes to register with the department. The commissioner is to develop rules requiring registrants to submit crop samplings for testing and verification of delta-9 THC levels and establishing a process for waiving delta-9 THC limits.
