(Taku/Campbell Community Council) WHEREAS, on October 21, 201, KTUU Channel 2 published a story that Bryant Thorp, the owner of Arctic Herbery and holder of marijuana licenses #M03 and #M03, was giving away free samples of marijuana product, which was confirmed by Mr. Thorp to an Alcohol & Marijuana Control Office investigator; and WHEREAS, the Alcohol & Marijuana Control Office (AMCO) has filed a notice of violation on the licensee, alleging violations of various sections of state regulations, and the licensee is directed to respond to the AMCO director in writing; and WHEREAS, AMC.0.01D. states, The Assembly may impose other conditions or restrictions on a license issued under this chapter when it finds that it is in the interests of the public to do so; and WHEREAS, the Assembly finds that additional license conditions may be in the public interest; and WHEREAS, Mr. Thorp has requested a final inspection from the state of Alaska and is anticipated to request an inspection from the municipality; and WHEREAS, the Assembly believes the Arctic Herbery establishments should not open before the Assembly has the opportunity to hold a public hearing, anticipated to occur on November 1, 201, on whether to impose additional conditions on the licenses; now, therefore THE ANCHORAGE ASSEMBLY RESOLVES: Section 1. Municipal staff is directed not to inspect Arctic Herbery s marijuana cultivation and retail facilities until the Assembly has acted on two resolutions that propose modifications to the licenses of said facilities. The two resolutions were introduced on November 1, 201, and have the following titles: A RESOLUTION OF THE ANCHORAGE MUNICIPAL ASSEMBLY MODIFYING MARIJUANA CULTIVATION ESTABLISHMENT LICENSE NUMBER M03, PREVIOUSLY APPROVED FOR ARCTIC HERBERY, AND LOCATED AT ARCTIC BOULEVARD.

In addition to the three conditions placed on the marijuana establishment license for Arctic Herbery (located at Arctic Boulevard, in the I-1 district, within Lot, Block 2, Graham Subdivision, Addition Number 1) by AR as amended, Marijuana Cultivation Establishment License M03 is subject to the following condition:. The applicant shall report to the Assembly regarding resolution of the Notice of Violation (#AB1-03) by the AMCO Director and/or the Marijuana Control Board, to the satisfaction of the Assembly. Section 2. To fulfill the fourth condition on License M03, the applicant shall MJLicenses@muni.org with a report regarding the resolution of AMCO Notice of Violation #AB1-03. The Municipal Clerk shall prepare an Assembly Resolution for Assembly action with the applicant s report. Section 3. Upon review of the Assembly Resolution and the applicant s report, the Assembly may schedule a public hearing on the matter.

The approvals in sections 2 and 3 of this resolution are for a marijuana cultivation establishment with municipal license number M03, doing business as Arctic Herbery, located at Arctic Boulevard, in the 1-1 district, within Lot, Block 2, Graham Subdivision #1; generally located east of Arctic Boulevard, south of West 0 1 h 1 Avenue, west of Hart Street, and north of West 2nd Avenue, in Anchorage. 1 1 Section 2. The application submitted for the requested marijuana establishment 1 license generally meets the applicable provisions of Anchorage Municipal Code (AMC) 1 chapter.0. A marijuana cultivation establishment license is hereby approved for 1 Arctic Herbery, subject to the following conditions pursuant to AMC section.0.01: The licensee and his/her agents and employees shall conform to the narrative submitted with the license/special land use permit application, as modified by this ordinance, and with all applicable portions of Anchorage Municipal Code. All licensees, employees, and agents of the marijuana establishment who sell, cultivate, manufacture, test, or transport marijuana or marijuana product, or who check the identification of a consumer or visitor, shall obtain a marijuana handler permit from the Marijuana Control Board. The marijuana handler permit shall be kept in the holder's immediate possession or a valid copy shall be kept on the premises of the marijuana establishment at all times. If the licensee submits an application for license renewal consistent with AMC.0.03A, the Municipal Clerk's Office will include a copy of AR (as amended), which approved the initial marijuana license and special land use permit for marijuana, with the Assembly documents, considering the renewal, in the event the Assembly desires to review the conditions after the first year of operations. 1 Section 3. The application submitted for the requested special land use permit for 2 marijuana generally meets the applicable provisions of AMC section and AMC
8 AR 201-1, As Amended regarding Arctic Herbery Page 2 of 3 1 section A special land use permit for a marijuana cultivation facility is hereby 2 approved for Arctic Herbery, subject to the following conditions pursuant to AMC 3 subsection M.: All uses shall conform to the plans and narrative submitted with the license/special land use permit application, as modified by this ordinance, and with all applicable portions of Anchorage Municipal Code, and may be modified in accordance with AMC C.. A notice of zoning action shall be filed with the State of Alaska Recorder's Office before operation of the establishment. The establishment shall be open for inspection and examination by the municipality during municipal business hours and establishment business hours. The premises shall be ventilated so that the odor of marijuana cannot be detected at any lot line by a person with a normal sense of smell. Violation could lead to a requirement to increase air filtering and/or change the ventilation location in the establishment. The Conditions Certificate, issued by the Planning Department and containing conditions imposed by the Assembly on this special land use permit, shall be displayed in a visible location near the main entrance at all times. Signs advertising the marijuana establishment may be placed only in the marijuana establishment's window or attached to the outside of the licensed premises.. If the licensee submits an application for license renewal consistent with AMC.0.03A, the licensee's special land use permit, approved in AR (as amended), will be available and open for review before the Assembly. Section. The conditions contained in this resolution shall be met and shall be verified by inspection before the marijuana establishment can begin operations. Section. Failure to comply with the conditions of this license and special land use permit and the applicable provisions of Anchorage Municipal Code shall constitute grounds for modification or revocation of the license and/or the special land use permit. 3 Section. Notwithstanding AMC subsection.0.03 which would require a license renewal approximately a month after the potential approval, the marijuana license approved in section 2 above expires on August 31, 201. An application to renew the marijuana license may be submitted in 201 in accordance with AMC section The special land use permit for marijuana approved in section 3 above is valid until it expires in accordance with AMC subsection C..

Arctic Herbery is currently only stocked with a variety of pipes, rolling papers and bongs, but customers said even without cannabis for sale, they re still leaving satisfied. That s because the owner is giving away free samples of product to customers 21 years and older. Owner Bryant Thorp said because he s not officially using an operating marijuana license yet, he s allowed to give away free marijuana. When you hand someone a joint or a nug, they kind of get excited about it, said Thorp. Thorp said there s been near-constant construction inside and out of his business since it became the first marijuana store to be approved to operate in Anchorage. Although his storefront on Arctic Boulevard is easy to miss, a small open sign on the front is already attracting people into his parking lot. One guy saw the sign, he kept going and kept going and kept going. He says, I got all the way to Dimond and made a U-turn. I had to come back to enter, Thorp said, describing the excitement of people walking through his doors. The last major hurdle facing Alaska's legal marijuana markets was approved on Friday. /2/201

Thorp has two active marijuana establishment licenses with AMCO; Standard marijuana cultivation facility as of 0/1/1 and retail marijuana store as of /20/1. AMCO Investigators have yet to conduct final inspections of either license. Thorp confirmed that he did in fact introduce marijuana into the licensed premises for the purpose of providing free samples. The marijuana provided by Thorp was never part of the regulated market as it was not tracked in the marijuana inventory tracking system (metrc), was not subject to required testing and was not packaged and labeled as required. 19 AR regarding Arctic Herbery Retail Sales Establishment Page 2 of 3 1 AMC section A special land use permit for a marijuana retail sale 2 establishment is hereby approved for Arctic Herbery, subject to the following 3 conditions pursuant to AMC subsection M: All uses shall conform to the plans and narrative submitted with the license/special land use permit application, as modified by this resolution, and with all applicable portions of Anchorage Municipal Code, and may be modified in accordance with AMC C. A notice of zoning action shall be filed with the State of Alaska Recorder's Office before operation of the establishment. The establishment shall be open for inspection and examination by the municipality during municipal business hours and establishment business hours. The premises shall be ventilated so that the odor of marijuana cannot be detected at any lot line by a person with a normal sense of smell. Violation could lead to a requirement to increase air filtering and/or change the ventilation location in the establishment. The Conditions Certificate, issued by the Planning Department and containing conditions imposed by the Assembly on this special land use permit, shall be displayed in a visible location near the main entrance at all times. The retail sales establishment shall be closed to the public between midnight and :00 a.m. each day. No temporary signs are permitted. Signs advertising the marijuana establishment may be placed only in the marijuana establishment's window or attached to the outside of the licensed premises. 3 Section. The most recent approval shall govern over any inconsistencies 3 among all marijuana approvals (AR 201-1, As Amended) on this site. 3 3 Section. The conditions contained in this resolution shall be met and shall be o verified by inspection before the marijuana establishment can begin operations. 1 2 Section. Failure to comply with the conditions of this license and special land 3 use permit and the applicable provisions of Anchorage Municipal Code shall constitute grounds for modification or revocation of the license and/or the special land use permit. Section. The marijuana license approved in section 2 above expires on August 31, 201. Arctic Herbery is currently only stocked with a variety of pipes, rolling papers and bongs, but customers said even without cannabis for sale, they re still leaving satisfied. That s because the owner is giving away free samples of product to customers 21 years and older. Owner Bryant Thorp said because he s not officially using an operating marijuana license yet, he s allowed to give away free marijuana. When you hand someone a joint or a nug, they kind of get excited about it, said Thorp. Thorp said there s been near-constant construction inside and out of his business since it became the first marijuana store to be approved to operate in Anchorage. Although his storefront on Arctic Boulevard is easy to miss, a small open sign on the front is already attracting people into his parking lot.
