AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, ADOPTING ZONING ORDINANCE AMENDMENT 11-02, A REQUEST TO AMEND THE SIGNAL HILL MUNICIPAL CODE BY LISTING MEDICAL MARIJUANA DISPENSARY AS A PROHIBITED USE IN ALL ZONING DISTRICTS INCLUDING CHAPTER 20.20, ENTITLED COMMERCIAL DISTRICTS, CHAPTER 20.30, ENTITLED SP- 10, PACIFIC COAST HIGHWAY SPECIFIC PLAN, CHAPTER 20.32, ENTITLED SP-12, FREEWAY SELF-STORAGE SPECIFIC PLAN, CHAPTER 20.39, ENTITLED SP-19, GENERAL INDUSTRIAL SPECIFIC PLAN, CHAPTER 20.40, ENTITLED SP-1, TOWN CENTER EAST SPECIFIC PLAN, CHAPTER 20.45, ENTITLED SP-3, TOWN CENTER WEST SPECIFIC PLAN, CHAPTER 20.47, ENTITLED SP-4, AUTO CENTER SPECIFIC PLAN, CHAPTER 20.49, ENTITLED SP-6, COMMERCIAL CORRIDOR SPECIFIC PLAN, AND PROHIBITING THE USE AS A HOME OCCUPATION IN ALL RESIDENTIAL ZONING DISTRICTS UNDER CHAPTER DEFINITIONS WHEREAS, in 1996, the voters of the State of California approved Proposition 215 (codified as Health & Safety Code Section et seq. and entitled The Compassionate Use Act of 1996 (CUA) ); and WHEREAS, the intent of Proposition 215 was to enable seriously ill Californians to legally possess, use, and cultivate marijuana for medical use under state law; and WHEREAS, as a result of Proposition 215 and the subsequent Medical Marijuana Program Act, (MMPA) adopted by the State Legislature in 2003 (Health & Safety Code Section et seq.), many individuals have established storefront medical marijuana dispensaries in various cities and counties throughout the state; and 1
2 WHEREAS, the Chief of Police of the City of Rocklin and the California Police Chiefs Association have conducted studies of several California cities with established medical marijuana facilities (Exhibits A & B) and have noted the following negative secondary impacts: Sales of marijuana to dispensary customers by illegal street vendors who are attracted to dispensary locations and who intentionally undercut dispensary pricing Increased street level resale of marijuana to persons without doctors recommendations Increased marijuana DUIs by dispensary patrons Burglary attempts at dispensaries Robberies of dispensary patrons upon leaving the dispensary by street criminals seeking drugs Smoking of marijuana in public around dispensaries Failure of dispensaries to report crimes so as not to bring negative publicity to themselves Detrimental impacts on neighboring businesses due to attraction of large criminal element around dispensaries Increases in pedestrian and vehicular traffic and noise Proliferation of residential grow houses resulting in fire hazards Sale of other illegal drugs in dispensaries WHEREAS, after discovery of two dispensaries operating illegally in the City, on July 7, 2009, the City Council adopted Urgency Ordinance No imposing an interim 45-day moratorium on the establishment or operation of medical marijuana dispensaries pending the completion of a study to consider zoning and other amendments to the Signal Hill Municipal Code to regulate such establishments and declaring the urgency thereof; and WHEREAS, on August 18, 2009, after proper notice and review of a progress report, the City Council extended the moratorium for an additional 10 months and 15 days; and WHEREAS, on June 15, 2010, after proper notice and review of a progress report, the City Council deemed that an additional extension of the temporary 2
3 moratorium on the establishment or expansion of medical marijuana dispensaries was needed to complete a study to consider zoning and other amendments to the Signal Hill Municipal Code to regulate such establishments and declaring the urgency thereof; and WHEREAS, Urgency Ordinance No is set to expire on June 28, 2011; and WHEREAS, the medical marijuana dispensary use creates negative secondary land use and other impacts that similar permitted uses, such as the pharmacy or medical clinic uses, do not, and thus medical marijuana dispensaries are distinct from, and should not be treated as one of, such permitted uses; and WHEREAS, pharmacies and medical clinics are permitted uses in certain zoning districts in the City, such as the pharmacies inside Costco, Target, and Food-4-Less in the City, but such uses do not exhibit the tendency to increase crime, traffic, noise, and illegal drug sales that have occurred in the areas surrounding medical marijuana dispensaries in other jurisdictions, as described above. Such permitted pharmacies and/or medical clinics generate on average only about 1 police call for criminal activity per year (typically prescription fraud) and have generated no calls to the City regarding noise or traffic complaints; and WHEREAS, the potential establishment of dispensaries, pose a current and immediate threat to the public health, safety, and welfare in the City due to the negative secondary land use and other impacts of such dispensaries as described above; and WHEREAS, approval of business licenses, subdivisions, use permits, variances, building permits, or any other applicable entitlement for the medical marijuana dispensary use will result in the aforementioned threat to public health, safety, or welfare; and 3
4 WHEREAS, City staff undertook a study to consider zoning amendments and/or other measures to regulate the establishment and operation of medical marijuana dispensaries in the City, and have decided that it is in the interest of the public health, safety and welfare to prohibit said dispensaries in all the City s commercial and industrial zoning districts and residential districts as home occupations because of all the negative secondary impacts associated with same; and WHEREAS, the City Attorney s office has advised staff of recent case law (City of Claremont v. Kruse, 2009, 177 Cal. App. 4 th 1153) which allows for such regulation. The case has determined that 1) there is no state law pre-emption of a local moratorium as the CUA and MMPA do not mandate that cities must permit dispensaries, and 2) the dispensary use is not a fundamental right or protected by the First Amendment; and WHEREAS, a Zoning Ordinance Amendment was prepared to prohibit the medical marijuana dispensary use in all commercial and industrial zoning districts, commercial and industrial specific plan areas and residential zones as home occupations; and WHEREAS, pursuant to Signal Hill Municipal Code, Chapter 20.86, entitled Amendments, the subject is properly a matter for Planning Commission review and recommendation for City Council adoption; and WHEREAS, on March 25, 2011, notice of Planning Commission and City Council public hearings regarding Zoning Ordinance Amendment and associated Negative Declaration 03/25/11(1) was published in the Signal Tribune newspaper (no less than 1/8 page) and posted in accordance with Signal Hill Municipal Code Section ; and 4
5 WHEREAS, on April 11, 2011, after proper notice and public hearing, the Planning Commission recommended City Council approval of Zoning Ordinance Amendment 11-02; and WHEREAS, the City Council has adopted Negative Declaration 03/25/11(1) relative to Zoning Ordinance Amendment 11-02, in satisfaction of requirements of the California Environmental Quality Act; and WHEREAS, on April 19, 2011, a public hearing was held before the City Council and all interested parties were given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: 1. That Zoning Ordinance Amendment is consistent with applicable state law. 2. That the City Council has reviewed Zoning Ordinance Amendment and found the proposed amendment to be in the best interest of the community and its health, safety and general welfare in that it is consistent with the following Goal(s) and Policies of the Signal Hill General Plan: LAND USE ELEMENT--GOAL 3 Assure a safe, healthy, and aesthetically pleasing community for residents and businesses. Policy 3.7 Maintain and enhance the quality of residential neighborhoods. Finding regarding Policy 3.7 Prohibiting medical marijuana dispensaries will safeguard residential neighborhoods from crime and other secondary effects shown to be caused by dispensaries within close proximity and/or as home occupations. Policy 3.9 Safeguard residential neighborhoods from intrusion by nonconforming and disruptive uses. 5
6 Finding regarding Policy 3.9 Medical marijuana dispensaries have been shown to have harmful secondary effects such as increases in crime. Prohibiting them will safeguard residential neighborhoods from this disruptive use. Policy 3.13 Reinforce Signal Hill s image and community identity within the greater Long Beach Metropolitan Area. Finding regarding Policy 3.13 By prohibiting medical marijuana dispensaries, Signal Hill will improve its image as a safe community to live in and work. It should not be viewed as being uncompassionate towards those who need medical marijuana because there are plenty of dispensaries already located in the neighboring community of Long Beach. SAFETY ELEMENT--GOAL 2 Provide an environment that is safe and secure and as free from criminal activity as possible for Signal Hill residents, businesses, employees, visitors and property. Policy 2.1 Intensify the City s crime prevention programs. Finding regarding Policy 2.1 Prohibition of medical marijuana dispensaries is consistent with the City s efforts to prevent crime as it has been shown that these facilities have negative secondary effects that include increases in criminal activities. 6
7 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DOES HEREBY FURTHER ORDAIN AS FOLLOWS: Section 1. That Chapter , Use classifications, is hereby amended to read as follows: Medical marijuana dispensary. Medical marijuana dispensary means any for-profit or not-for-profit facility or location, whether permanent or temporary, where the owner(s) or operator(s) intends to or does possess and distribute marijuana, or allows others to possess and distribute marijuana, to more than one (1) person such as a qualified patient, primary caregiver, or a person with an identification card issued in accordance with California Health and Safety Code Sections , et seq. A medical marijuana dispensary includes a collective or cooperative as described in Health and Safety Code Section A medical marijuana dispensary shall not include the following uses, provided that the location of such uses is permitted by the Signal Hill Municipal Code and that the uses comply with all applicable state laws including Health and Safety Code Section et seq.: a clinic licensed pursuant to Chapter 1 of Division 2 of the Health and Safety Code, a health care facility licensed pursuant to Chapter 2 of Division 2 of the Health and Safety Code, a residential care facility for persons with chronic life-threatening illness licensed pursuant to Chapter 3.01 of Division 2 of the Health and Safety Code, a residential care facility for the elderly licensed pursuant to Chapter 3.2 of Division 2 of the Health and Safety Code, a residential hospice or a home health agency licensed pursuant to Chapter 8 of Division 2 of the Health and Safety Code. 7

Unlisted uses shall be prohibited including the following unlisted uses that are expressly prohibited: Auto body repair, auto painting, towing, towing dispatch office, auto wrecking, dismantling, junk yard, trucking yard, transit yard, truck repair, bus, ambulance or van storage, auto shipping, storage of shipping containers, tire recapping, trailer for office use, medical marijuana dispensary, medical office, dental office, optometrist office, chiropractic office, hazardous waste management facilities, schools including trade schools, gyms or sports clubs, public storage and vendor food sales. Section 6. That Chapter , Use classifications, is hereby amended to read as follows: E. Prohibited uses. That Chapter 20.45, SP-3 TOWN CENTER WEST SPECIFIC PLAN DISTRICT, is hereby amended to revise the text of the document entitled Town Center West Specific Plan to read: B. SPECIFIC PLAN AREA ONE 1. That Chapter 20.47, SP-4 Auto Center Specific Plan, is hereby amended to read as follows: Prohibited uses. The uses stated below shall be strictly prohibited in the auto center specific plan: A. There shall be no employment of help other than the members of the resident family. 2. There shall be no use of material or mechanical equipment not recognized as being part of normal household or hobby uses. on the premises. 3. There shall be no sales of products or services not produced 4. The use shall not generate pedestrian or vehicular traffic beyond that normal to the district in which it is located. 5. It shall not involve the use of commercial vehicles for delivery of materials to or from the premises, other than a vehicle not to exceed one ton, owned by the operator of such home occupations, which shall be stored in an entirely enclosed garage. 6. There shall be no excessive or unsightly storage of materials or supplies, indoor or outdoor, for purposes other than those permitted in the district. 7. It shall not involve the use of signs or structures other than those permitted in the district of which it is a part. 8. Not more than one room in the dwelling shall be employed for the home occupation. 9. In no way shall the appearance of the structure be so altered or the conduct of the occupation within the structure be such that the structure may be reasonably recognized as serving a nonresidential use either by color, materials or construction, lighting, signs, sounds or noises, vibrations, etc. 12
