This has included car, snowmobile, boating and aircraft accidents and injuries arising from dangerous conditions on roads, sidewalks, and premises. As a former client recently said in a letter to Dan, I was very impressed with your empathy as well as your professional skills. A. T. Selected Cases/Matters Bannon v. City of Thunder Bay Dan represented Laura Bannon for claims against the City of Thunder Bay resulting from a fall on an icy sidewalk. The legal issue was whether her incapacity due to medication post-surgery delayed the commencement of the seven day notice period under the Municipal Act for falls on icy sidewalks. Dan had the great honour to argue this case on Laura s behalf at the Supreme Court of Canada ([2002] 1 S.C.R. 716, 2002 SCC 20) and later at Trial for Mrs. Bannon s assessment of damages. 2

3 Summer Beaver/ Niminamik First Nation Airplane Crash v. Wasaya Airways In September 2001, seven members of the Nibinamik First Nation died in a plane crash. These seven deceased were survived by over 100 family members, including spouses and children, many of whom relied upon the deceased for financial support in the usual sense and for support from traditional harvesting. The community wanted the support needs addressed quickly in a manner that was consistent with traditional approaches to problem solving and retained Carrel +Partners. Dan created a program to assess and address all claims for compensation that resulted in all claims being resolved at mediation in less than one year from the time of retainer. All steps, including discoveries and mediation, were completed within the community. Dan spent over 40 days in Nibinamik working with the clients and the Chief and Council to achieve settlement in a manner that was appropriate to the financial and cultural needs. Decision No. 2175/08, 2008 ONWSIAT 2745 (CanLII) A worker ended up having to have back surgery 13 years after the initial work injury. As a result, the worker was disabled. Dan was able to put the evidence together to prove that the resulting disability was related to the work injury and the worker was entitled to benefits relating to the work injury 13 years earlier. 3

4 Coroner s Inquest: Jamie Goodwin - Kashechewan First Nation 19-year-old Jamie Goodwin died in a fire at the NAPS detachment in Kashechewan. Dan represented the Goodwin family at the Coroner s Inquest that was held in Toronto for over five weeks and represented the family in their claim for damages for loss of guidance, care, and companionship for the loss of their son.
