1 The Bronx Defenders Snapshot of Accomplishments, In the grant period, our Civil Action staff provided legal services to 3,159 clients on 3,690 matters benefitting more than 6,286 people. By preventing the eviction of 167 families with more than 407 household members, we achieved over $6,000,000 in shelter cost savings for taxpayers. Forty-five families obtained subsidized housing through our legal advocacy, benefitting 128 family members. We preserved the unity of 116 families by preventing the deportation of a parent or child, affecting more than 216 family members. Fifty-two others obtained legal immigration status. We preserved hard-earned jobs or employment licenses for the breadwinners of 107 families, secured health insurance for more than 73 families, and obtained at least $2,505,984 for clients in awards ranging from consumer matters to annualized public benefits. In December 2011, we became an official FEPS enroller to help hundreds of additional clients preserve their homes with this long-term housing supplement. As a Single Stop site funded by the Robin Hood Foundation, we provide free financial counseling as well as public benefits screening and application assistance to our clients, backed up by our comprehensive civil legal services. The IOLA Fund provided critical support to these efforts by sustaining full-time legal staff who were able to provide more extensive representation to our clients. In addition, through our Reentry Net initiative ( we provided intensive training and support for advocates statewide on civil legal problems related to reentry. We delivered substantive training to over 1,000 attorneys, direct service providers, and other advocates and responded to over 450 hotline calls and information requests from over 100 organizations. Examples... Outcomes for Clients hen we met Callie, she owed her landlord W more than $22,000, her public assistance case had been closed, and she had just been served with eviction papers. Our attorney fought in Housing Court while a paralegal successfully reopened her public assistance case and obtained some retroactive benefits for arrears. But it would not have been enough. Months into the case while reviewing Callie's benefits activity, our paralegal saw, buried in government paperwork, an indication that our client was HIV positive. The Department of Social Services had completely ignored her status and failed to link her with the vast infrastructure of medical and social services dedicated solely to this special community in NYC. When our team of advocates approached Callie compassionately, she acknowledged she was ignoring her status - just too scared to deal with it. She agreed to apply for benefits from the HIV/AIDS Services Administration's (HASA) and to go to the Callen Lourde clinic for a medical evaluation. Today, Callie sees a doctor and therapist every week. She is on a powerful medication regimen to improve her numbers and has experienced only minimal side effects. She is informed about her condition and attending a support group. She has been accepted to HASA and recently received the keys to her own 2 bedroom apartment. 3 Other Services Legal Services Other Than Direct Legal Representation Legal problems never exist in a vacuum. The Bronx Defenders has pioneered a model of providing integrated legal and social services by connecting clients to interdisciplinary teams of attorneys, social workers, parent advocates, and investigators. Each member of the team brings unique training and expertise and is able to identify and address different aspects of each legal issue faced by a single individual or an entire family. Over the past fifteen years, The Bronx Defenders has demonstrated the effectiveness of comprehensive services both for addressing immediate crises and for finding long-term solutions. Our social workers assess the needs underlying legal problems and leverage a vast network of treatment and other service providers in the Bronx and citywide to identify the best possible referrals. By building relationships with clients and families, social workers often identify information that is crucial to legal cases, and might otherwise have gone unnoticed. Our civil legal services attorneys rely on in-house investigators to collect documents and evidence and help evaluate allegations when clients are facing criminal charges. With a team behind them, our clients are empowered to overcome the crises that led them into, or grew out of, involvement with the legal system. Holistic advocacy means going beyond individual clients and cases to address systemic issues that underlie legal services needs and can foreclose opportunities for clients in the future. Our community programs engage clients and families to address these issues and ensure that the voices of South Bronx residents are heard loud and clear in policy debates. Our Voter Enfranchisement Project dispels myths about barriers to civic participation for individuals with felony convictions, actively registers eligible voters with criminal histories, and provides meaningful nonpartisan information about candidates and the political process to clients and families. Through our internships and client engagement activities, we are training new leaders to understand and reform the systems that impact their lives. As a community-based provider, The Bronx Defenders is committed to providing basic services, to the extent that we are able, to every person who walks through our doors. We staff community intake every weekday during business hours, and guarantee that every walk-in client will, at minimum, receive individual attention to her problem and an assessment by an intake paralegal. Over 1,000 community members visit the office each year presenting an incredibly wide range of issues. Depending on the nature of each one, we provide pro se assistance, general legal information, brief services, a high-quality referral or, in some cases, full representation. IOLA Project Grants Civil Legal Services IOLA Funding Amount: $100,000 We received IOLA funds to provide comprehensive civil legal services and community education to poor families in Bronx County. Legal services included representation on the full range of issues, from housing and public benefits to disability and family law. We also sought funding to provide advocate training and support statewide on proven strategies for addressing these problems. 4 Other Services, continued In addition to community intake, we partner with elected organizations, community-based organizations, and our own clients to challenge the broken systems underlying our clients' court involvement using a wide range of tools. We achieved the following during the grant period: Community Legal Education: Provided legal training to over 540 community members on navigating legal systems. In partnership with the New York City Department of Correction, informed thousands of incarcerated individuals about their voting rights; helped hundreds of eligible voters complete registration forms and absentee ballot applications. Maintained the People's Guide to the Consequences of Criminal Charges and migration of the Guide to an interactive resource hosted on the Reentry Net homepage ( which was downloaded over 2,000 times during the grant period. Client and Community Leadership Development: Initiated BxD Advocates, a new project that engages clients and provides them with leadership and skills training to become advocates for policy reform. Held two focus groups with clients and two with staff to determine structure and identify potential clients to join the group. Held monthly meetings of BxD Advocates. Held six client outreach and engagement events, including our annual Community Block Party, which draws over 400 neighborhood residents. Hosted a six-week internship program for 10 Bronx public high school students. Students surveyed over 200 South Bronx residents about police-community relations and shared their findings with NYPD officers at local precinct roll call training. Hosted 10 additional high school, college, and community interns. Legislative and Administrative Reform: In coalition with other groups in Communities United for Police Reform, drafted and introduced the Community Safety Act, a package of legislation now pending before the City Council that would increase accountability from the New York City Police Department (NYPD). Continued to advocate for passage of the Charitable Bail Organizations bill in the New York State legislature. This bill, which ultimately passed the Senate and Assembly but was vetoed by the Governor, would allow nonprofit organizations to post bail free of charge and offer pre-trial services to low-income clients who can't afford small amount of bail. Documented citywide issues related to criminal history record errors and accessing Certificates of Relief from Disabilities; continued communication with Office of Court Administration to advocate for systemic changes. 5 Other Services, continued Support for Other Service Providers With the goal of providing training and support to advocates on civil legal barriers to reentry statewide, we collaborated with dozens of partner organizations, as well as Pro Bono Net, to create Reentry Net ( Since its launch in 2005, Reentry Net has fundamentally improved advocacy for individuals with criminal records by collecting, vetting, and disseminating the most useful tools and materials for advocates, training attorneys and other service providers on best practices, and facilitating cross-sector collaboration. The online resource center hosts a library with more than 1,400 individual resources, a calendar of training and events, a links page for fast help, and extensive overviews of common issues. Our monthly newsletter highlights policy updates, new resources, news, events, and opportunities in the field. Reentry Net staffmembers provide back-up for the website, working with users to find answers to more complex questions. Since making all non-sensitive library materials open to the public in 2008, we have significantly increased usage. Outcomes during the grant period include: Maintained an average of over 8,500 site visits and 21,000 resource downloads per month Provided substantive training to more than 1,000 attorneys, direct service providers, and other advocates Responded to over 450 hotline calls and information requests from over 100 organizations Pro Bono Private Attorney Involvement The Bronx Defenders continues to have significant pro bono partnerships. In the past year, we have worked on civil matters with approximately sixty-five attorneys from at least twenty New York City law firms. Pro bono attorneys recently have worked on appeals and housing, immigration, family and forfeiture, among other cases. We serve as co-counsel on nearly all of our pro bono cases, which both ensures continuity of representation to our clients and provides oversight and supervision to pro bono attorneys practicing outside of their regular areas. We also supervise pro bono attorneys who assist with our community intake program. We attempt to match our opportunities to law firms' interests, placing cases in as targeted a way as possible. We encourage firms to take on similar matters, thereby developing a cadre of knowledgeable public interest pro bono attorneys, reducing current staff workloads on current cases and enabling them to serve more clients. We are in the process of setting up "projects" with two firms, in which the firms will co-counsel a substantial number of the same type of case with Bronx Defenders attorneys, developing institutional knowledge and expertise in those areas. Our pro bono partnerships continue to grow in strength and number. We employ a Pro Bono Coordinator, who is also an attorney, to monitor case placement, place cases appropriately, and help with supervision of the pro bono attorneys, making the program as efficient and useful to our staff and clients as possible. Paralegals have volunteered their services for litigation support, and we have a well-established summer intern program for undergraduate investigators. Nonlegal volunteers, including high school students, undergraduate interns, and community members, assist with outreach, events, and community intake. As part of our Voter Enfranchisement Project, they do voter outreach and education and contribute to our Better Ballots Voter Guides. Volunteers play an important role planning and staffing our annual community block party in the summer, our Thanksgiving feast for clients and their families, and other events for clients throughout the year. They also support our community intake advocates, particularly in helping people apply for Certificates of Relief from Disabilities and Good Conduct. Each volunteer is trained and supervised by attorneys on staff. The Bronx Defenders - 5

6 Outcomes for Clients continued from page 2 M s. Peralta was referred to The Bronx Defenders through a social services agency in the Bronx. A mother of five, she came to our office in a panic, having been served an eviction notice. She met with our Community Intake Advocate, who identified that she was being evicted under the "Bawdy House" laws because of false allegations that her apartment was being used to sell drugs. Within hours, Ms. Peralta met with a Civil Action Practice attorney, delving into the details of her case. The landlord claimed that Ms. Peralta was using her apartment to sell drugs, but she had never been arrested, and drugs had never been found in her apartment. The Bronx Defenders immediately put together a motion to dismiss, and the Judge took the rare step of dismissing Ms. Peralta's case directly from the bench. Ms. Peralta and her five children are now safe in their apartment rather than in the shelter system. The Bronx Defenders - 6
