1 Sexual Misconduct on Campus: Prevention and Response Efforts at CU-Boulder Valerie Simons Executive Director and Title IX Coordinator, Esq. Office of Institutional Equity and Compliance April 23, 2016

2 Office of Institutional Equity and Compliance Restructured campus offices and staff in fall 2014 to create a comprehensive approach to addressing sexual misconduct, discrimination and harassment for students, faculty and staff Civil rights prevention and response office: including but not limited to Title IX, Title VI, Title VII, Violence Against Women Act, and ADA matters Four unit approach: education/prevention, remedial/protective, investigations and ADA compliance

4 Focus on Sexual Misconduct: What are we talking about pursuant to campus policy? Sexual assault (non-consensual contact or penetration) Sexual harassment (hostile environment and/or quid pro quo) Intimate partner abuse (violence or threat in past/current relationship) Stalking (repeated course of conduct) Sexual exploitation (taking sexual advantage) Retaliation (adverse action with nexus to protected activity)

5 Investigations Focus on Sexual Misconduct Progress Since Fall 2014 Designated Director of Investigations/Deputy Title IX Coordinator New Sexual Misconduct Policy pursuant to Title IX, Title VII and VAWA: Covers sexual assault; harassment, exploitation; exploitation; intimate partner abuse (domestic or dating violence); stalking; and retaliation New Process and Procedures containing all procedures and policies in one place Hired three more investigators Added more procedural protections for participants in process including Written Evidence Summary and access to witnesses Increase trauma informed training Partnered with DA and others to fund Sexual Assault Nurse Examination at Boulder Community Health Developing MOUs with law enforcement (CUPD for now)

6 Focus on Sexual Misconduct Progress Since Fall 2014 Remedial and Protective Measures Designated Director of Remedial and Protective Measures/Deputy Title IX Coordinator Highlighted availability of: Remedial Measures which are designed to address complainant s well-being and facilitate continued access to employment or educational opportunities: examples include arranging for complainant to re-take course, excuse related absences, withdraw from class without penalty, or employment modifications Protective Measures which address individual and community safety: examples include no contact orders, exclusions, re-locations, interim suspensions or administrative leave Sexual Misconduct Rapid Response Team Off Hours, dedicated phone line to ensure response nights and weekends

7 Focus on Sexual Misconduct Education and Prevention Progress Since Fall 2014 Designated Education and Prevention Director/Deputy Title IX Coordinator New online course and required quiz and updated, in-person bystander course for all incoming students Updating employee training and moving towards yearly requirement Dozens of public forums focusing on sexual misconduct for employees and students (new office, where and how to report, definition of consent) Its on Us Video and Vice President Biden visit Updated and new resources for sexual misconduct matters (Title IX Brochure, You have Options, Report It campaign, Guidelines for victims) Dozens of training sessions for departments regarding improving climate Dozens of training sessions for student groups, including new course for fraternities Sexual Misconduct Survey (41% response rate)

8 Investigation Remedial Protections Prevention Team approach Trauma informed Parallel process for students, staff and faculty Dramatic increase in reporting, particularly student complaints Immediate protections and remedies for all parties After hours response Rapid Response Team coordinated across issues and units to identify problem areas and trends New initiatives for improving overall campus climate Online policy course and quiz required for ALL new students Required bystander training for ALL new students

9 Next Steps Priorities Reduce gap between reports and incidents Increase reporting ( Report It website and campaign) Decrease overall victimization rates (increased education/prevention programming) Review and release Phase II Data of Sexual Misconduct Survey in June Identify patterns: when, where, by whom Evaluate current policies, programs, and procedures in OIEC and other campus partner offices Assess current model for effectiveness MOUs with law enforcement
