3 1 The Swiss import and export regulations for processed agricultural products 1.1 Introduction In order to compensate for the cost disadvantages resulting from agricultural policy measures and to improve the international competitiveness of the food industry, Switzerland has adopted the policy of price compensation measures aiming at equalising the difference between the domestic and the foreign market prices for the raw materials incorporated in processed agricultural goods. With respect to imports, this policy consists in the levying of a duty (agricultural element). The agricultural element is meant to equalise the differences between the domestic and the foreign market prices (basic amounts) for the agricultural raw materials contained in foodstuffs. On imports from countries with which Switzerland has not concluded free trade agreements covering processed agricultural goods, an industrial element is levied in addition to the agricultural element. The duty applied to imports from such countries is thus higher. With respect to exports, the Swiss policy consists in the granting of refunds corresponding to these price differences according to the raw materials actually utilised. Regarding raw materials that are mainly imported, the export refunds are replaced by the inward processing regime. In this case, exporters of processed agricultural products are allowed to import raw materials duty free. In this way Switzerland reduces the budget outlays for export refunds in line with the obligations of the WTO. 1.2 Import regulation Finished goods In the nomenclature of the Harmonised System, the Swiss import regulation is applied to goods classified in chapters 4 (yoghurt, dairy spreads), 7 (sweet corn), 15 (margarine) 17 (sugar confectionery), 18 (chocolate and other food preparations containing cocoa), 19 (pastrycooks' products and preparations of cereals, flour, starch or milk), 20 (preparations of vegetables, fruit, nuts, or other parts of plants), 21 (other food preparations), 29 (Mannitol), and 35 (Casein, caseinates and other casein derivateives; casein glues). see: TABLE 1: List of finished goods covered by the price compensation system on imports (p. 9) Raw materials and basic amounts For the calculation of the agricultural elements, Switzerland considers only those raw materials of which the price can be established without difficulty and for which there is a significant difference between the domestic and foreign market price. The basic amounts correspond to the differences between the domestic and the foreign market prices. -3-

4 The following raw materials are taken into account for the calculation of the agricultural elements: whole milk powder skimmed milk powder butter eggs fresh potatoes common wheat durum wheat rye barley maize wheat flour vegetable fats white sugar Standard recipes After careful investigations by the Swiss customs administration of the quantities of raw materials incorporated in processed agricultural goods, groups of comparable products were constituted. Each group comes under a proper tariff heading in the Swiss. The agricultural element for each tariff heading is calculated according to a standard recipe, which is determinant for the whole group. These standard recipes are reconsidered periodically or at the request of the interested circles with a view to avoid under- and overcompensations. The calculation of the import levy is based on the gross weight according to the specific customs system in force in Switzerland. In order to avoid overcompensation, the agricultural elements of the individual tariff heading are reduced by an appropriate tare rate. see: TABLE 2: List of standard recipes and tare rates (p.20) Basic amounts and reference prices The basic amounts correspond to the differences between the domestic and the foreign market prices. As a rule, the calculation of the agricultural element is reconsidered at least once a year. Basic regulations The Swiss import regulations are based on the articles 1 and 2 of the Federal Law of 13 December 1974 on the importation and the exportation of processed agricultural products (a), on the Federal Law of 9 October 1986 on the tariff (b), and on the Ordinance of 22 December 2004 on industrial elements and the agricultural elements upon the importation of processed agricultural products (c). -4-

5 References: Swiss applied customs tariff: Implementation The General Directorate of is responsible for the implementation, in agreement with the State Secretariat for Economic Affairs. 1.3 Export regulation Finished goods Contrary to the import regulation, the Swiss law on the importation and the exportation of processed agricultural products does not include an exhaustive list of the processed agricultural products eligible for export refunds. Refunds are granted for the exportation of raw materials when they are exported as processed agricultural products falling under chapters 15 to 22 of the Swiss tariff. However, the following specific groups are not eligible for subsidies: Mixtures of raw materials or raw materials filled in retail packings; Raw materials processed into unusual foodstuffs; Imported mixtures not falling under chapters 4 and 11 of the Swiss. Raw materials The agricultural raw materials for which export refunds are granted are the following: fresh skimmed milk fresh whole milk fresh cream whole milk powder skimmed milk powder cream powder condensed milk condensed skimmed milk butter eggs sugar flour and other products of the milling industry as well as germs of wheat, mixed corn, rye and triticale. Standard recipes The export refunds are calculated on the quantities of raw materials used for the manufacturing of the processed goods. Contrary to the import regulation, where standard recipes are applied, the export refunds are fixed on the basis of a strict control of the quantities of raw materials incorporated (real raw material content). -5-

6 Basic amounts and reference prices The basic amounts correspond to the differences between the domestic and the foreign market prices. The basic amounts of milk-fat and milkprotein are derived from the basic amounts of skimmed milk powder, whole milk powder and butter. The basic amounts applicable to eggs, vegetable fats, sugar and germs of wheat correspond to the import charges. As a rule, the calculation of the agricultural elements is verified every three months. Basic regulations The Swiss export regulations are based on the articles 3 and 4 of the Federal Law of 13 December 1974 on the importation and the exportation of processed agricultural products (accepted by popular vote on 7 December 1975) (a), on the Federal Law of 9 October 1986 on the (b) and on the Ordinance of 22 December 2004 on the export refunds for processed agricultural products (c). References: Implementation The General Directorate of is responsible for the implementation, in agreement with the State Secretariat for Economic Affairs. 1.4 Inward processing Inward processing is applied to raw materials mainly imported, e.g. sugar, vegetable fats, durum wheat. These raw materials are imported duty free in case they are processed in Switzerland and re-exported afterwards. There are no additional refunds granted on the export. This procedure is based on Article 12 of the Federal Law of 18 March 2005 on. -6-

7 Reference: Relation with the EU Agreement on processed agricultural products signed on 26 October 2004 The agreement on processed agricultural products between Switzerland and the European Community, signed on 26 October 2004, entered into force on March 30 th, It has been provisionally applied since 1 February It revises the Protocol N 2 of the Free Trade Agreement between Switzerland and the European Community. This agreement is published by the Swiss authorities (in German, French and Italian): Reference: Product coverage The revised Protocol N 2 covers the products listed in its Table I and II. All provisions of the Free trade agreement between Switzerland and the EU of 1972 apply. As regards to customs duties, products listed in Table I are subject to price compensation measures wheras products listed in Table II are generally duty free. Price compensation system Net price compensation For products listed in Table I of the revised Protocol N 2, Switzerland limits its price compensation measures in trade between Switzerland and the EC according to the difference between the domestic and the EC market prices of the raw materials. Having lower market prices, the EC abolishes all its price compensation measures in trade between Switzerland and the EC. 1.6 Other measures affecting agricultural price compensation None. 1.7 Authorities The Directorate General of is responsible for the implementation, in agreement with the State Secretariat for Economic Affairs.
