2 The Food Information for Consumers (FIC) Regulation (EU) No. 1169/2011 What s it About? (1) A nutrition declaration is now required on pre-packaged products*. This must include energy, fat, saturated fat, carbohydrate, sugars, protein and salt per 100g/ 100ml and may also be expressed per portion (2) It is a legal requirement to identify 14 specified food allergens in written format when they are used in the production or preparation of both packaged and non-packaged foods. When Did This Happen? (1) Enforced since December 13th 2016 (2) Enforced since December 13th 2014

3 (1) Nutrition Declaration What Does This Mean For Your Business? If you supply prepacked food, you will need to analyse your recipes and provide a nutrition label declaration on your product package. You also need to provide a Quantitative Ingredients Declaration (QUID) which highlights allergens in your products. This includes foods/ingredients made at one site for use at other sites within your own business

4 (1) Nutrition Declaration Could I be Exempt from this Requirement? There are a list of exemptions in Regulation EU No 1169/2011. These mainly relate to foods of little nutritional value, such as waters, herbs and chewing gum. 5 What Information is Required? (1) Nutrition Declarations The nutrition declaration must include energy, fat, saturated fat, carbohydrate, sugars, protein and salt per 100g/100ml, and also may be expressed per portion Supplemental information can include mono & poly unsaturated and vitamins and minerals fats, polyols, starch, fibre >Check out our Nutrition Declaration Information Guide to see exactly what info you need< Does My Product Need To Be Lab tested? No. Lab testing is not a legal requirement* and can be costly. Analysing your product or recipe using appropriate nutrition composition databases and software is both accurate and economical *In some cases lab testing might be more appropriate (e.g. for deep fried foods). Our experts will always tell you if lab testing is recommended over database analysis

6 Presenting A Nutrition Declaration Is There A Specific Layout? Your nutrition declaration must be in table form where space permits, if space does not permit, a linear form is acceptable Numbers must be aligned. Energy must be in kilojoules (kj) and kilocalories (kcal) while other nutrients should be in grams(g) The label must indicate portion size and number of portions contained in the product >Download our Nutrition Declaration Labelling Guide to see more design tips and templates<

7 (2) Allergen Declarations What Does This Mean For Your Business? If your business supplies prepacked or non-prepacked* food or beverages, you will need to adapt your processes so that you can identify and trace these 14 food allergens from point of entry to your business to the point of supply, and inform consumers in writing of their presence in related dishes. *Non-prepacked food applies to food that is sold directly to consumers (cafes, restaurants & take away) or mass caterers including food that is provided free of charge (samples / tasters etc.)

8 Quantitative Ingredient Declarations (QUID) A QUID is a list of ingredients used to make your product which is arranged in descending order of weight A QUID is required when a product has two or more ingredients Ingredients that are allergenic are required to be highlighted in bold Subrecipe ingredients must be included e.g. A ham sandwich must have the QUID for bread included in the overall QUID for the sandwich Percentage values must be listed for any ingredients named in the title and description of your product (other percentage values are optional) An example of a QUID for a Banana Smoothie is shown below; (banana % value is required) Ingredients

9 Presenting Allergen Information for non-prepacked foods What are the 14 Allergens that Require Labelling? Gluten listed as wheat, barley, rye, oats and products thereof; Tree Nuts listed as hazelnuts, macadamia, pecans, walnuts, almonds, cashew, pistachio, brazil/queensland nuts Does Allergen Information Have To Be Written? Allergens must be declared in written format. It can be provided either as a hard copy or electronically Is There A Specific Layout? No, the layout and style can vary, but it must be legible and easily understood by the consumer i.e. number coding, plain text / symbols can be used to display allergens so long as it is easily understood. When there is no QUID/ ingredients list on your food (i.e. nonprepacked food), the allergen name must be proceeded by the word Contains e.g. Contains Egg

10 Presenting Allergen Information for non-prepacked foods Where Do I Put The Allergen Information? This information should be at the point of presentation, point of sale or point of supply for all foods and drinks sold loose/fresh or pre-packed. The allergen information must be at an easily identified and accessible location on the premises., and can either be in general view or permanently available. Where the location of allergen information is not conspicuous, it must be clearly signposted, so that consumers can locate and access it easily. Essentially the consumer should not have to ask where the allergen list / menu is, it should be easily accessible without asking any staff member.

11 Exceptions to Allergen Declarations; (2) Allergen Declarations Allergen Is In Food Name: Where the allergen is explicit in the name e.g. Egg Mayonnaise There is no need to declare this allergen (Egg). However! be careful that the composite food doesn t contain any other allergen that is not explicit in the name e.g. mustard in the mayonnaise, as this must be declared. Contaminants: If the allergen is present as a contaminant and not an ingredient then there is no allergen declaration required. An ingredient is used in the production or preparation of a food while a cross contaminant is inadvertently present at low levels in a food. This means that a 'May Contains' statement is no longer allowed on your menus. Highly Processed Foods: No allergen declaration is required for highly processed ingredients, such as soybean oil, where the allergen is removed in processing (note: peanut oil must still be labelled as an allergen)

12 What About Calories? Calorie labelling legislation for non-prepacked food is expected to come into effect in There is no requirement to display calories for your dishes at this time. What NOT To Do A general statement saying that all foods may contain a specific allergen can not be used, the allergen information must be specific to your individual recipes and ingredients. Likewise, a general statement saying ask your server if you have any food allergy can not be used. The food allergen information must be readily available in written format, and should be easily accessible by consumers without asking any staff member.
