Procedure followed f the re-evaluation process This review rept has been established as a result of the re-evaluation of pyrethrins, made in the context of the wk programme f review of existing active substances provided f in Article 8(2) of Directive 91/414/EEC concerning the placing of plant protection products on the market, with a view to the possible inclusion of this substance in Annex I to the Directive. Commission Regulation (EC) No 1112/2002( 2 ) laying down the detailed rules f the implementation of the fourth stage of the programme of wk referred to in Article 8(2) of Council Directive 91/414/EEC, and Regulation (EC) No 2229/2004( 3 ) have laid down the detailed rules on the procedure accding to which the re-evaluation has to be carried out. Pyrethrins is one of the existing active substances covered by this Regulation. In accdance with the provisions of Article 4 in Regulation (EC) No 1112/2002, Serbios S.r.l. Alfarin Quimica S.A., FIbl Berlin e.v., Pyco SA, MGK Europe (MGK), Procesos Bioquimicos Claramunt-Fner, S.L., Kenya Pyrethrum Infmation Centre, Capiscol, Samabiol SA, BRA Europe (BRA) and rganic Insecticides notified to the Commission of their wish to secure the inclusion of the active substance pyrethrins in Annex I to the Directive. In Annex I to Regulation (EC) No 2229/2004 the Commission, designated Italy as rappteur Member State to carry out the assessment of pyrethrins on the basis of the dossiers submitted by 1 n 16 July 2013, the Standing Committee on Food Chain and Animal Health has taken note of the revision of the review rept taking into account the EFSA conclusions referred to in points 1, 2, 3, 4 and 5 of this rept (cfr. infra) and the entry into fce of Regulation (EC) No 1107/2009. As already stated in Chapter 1 of this review rept, documents providing clarifications on the assessment finalised after a decision has been taken shall be considered as background document C and as such they are part of this review rept. 2 J No L 168, , p J No L 379, , p.13. In Article 12 of Regulation (EC) No 2229/2004 the Commission specified furtherme that the deadline f the notifiers with regard to the submission to the rappteur Member States of the dossiers required, as well as f other parties with regard to further technical and scientific infmation was 30 June Kenya Pyrethrum Inf. Centre, Austria, together with the company Copyr S.A., Italy submitted by the deadline a dossier to the rappteur Member State which did not contain substantial data gaps, taking into account the suppted uses. Also, the EU Pyrethrins 91/414 Task Fce, consisting of Botanical Resources Australia (BDA) and McLaughlin Gmley King Company (MGK) Europe submitted by the deadline a dossier to the rappteur Member State which did not contain substantial data gaps, taking into account the suppted uses. Therefe Kenya Pyrethrum Infmation Centre and CPYR S.p.A., as well as the EU Pyrethrins 91/414 Task Fce, consisting of Botanical Resources Australia (BDA) and McLaughlin Gmley King Company (MGK) Europe were considered to be the sole data submitters. In accdance with the provisions of Article 21(1) of Regulation (EC) No 2229/2004, Italy submitted in November 2007 to the EFSA the rept of their exaation, hereafter referred to as the draft assessment rept, including, as required, a recommendation concerning the possible inclusion of pyrethrins in Annex I to the Directive. In accdance with the provisions of Article 24 of Regulation (EC) No 2229/2004 as last amended by Regulation (EC) 1095/2007, the EFSA ganised the consultation on the draft assessment rept by all the Member States as well as by Kenya Pyrethrum Infmation Centre and CPYR S.p.A., and by the EU Pyrethrins 91/414 Task Fce being the sole data submitters, on 18 June 2008 by making it available. In accdance with the provisions of Article 24a of Regulation 2229/2004 as last amended by Regulation (EC) 1095/2007 the Commission exaed the draft assessment rept, the recommendations by the rappteur Member State and the comments received from other Member States in consultation with experts from Member States. In accdance with the provisions of Article 24b and Article 25 (1) a of Regulation (EC) No 2229/2004 as last amended by Regulation (EC) 1095/2007, the Commission referred on 28 ctober 2008 a draft review rept to the Standing Committee on the Food Chain and Animal Health, f final exaation. The draft review rept was finalised in the meeting of the Standing Committee on 28 ctober Regulation (EC) No 1107/ repealed and replaced Directive 91/414/EEC and the active substance pyrethrins is deemed to be approved under that Regulation and included in the Annex to Regulation (EC) No 540/ Finally, in compliance with the provisions of Article 25a of Regulation (EC) No 2229/2004, EFSA delivered its conclusions on pyrethrins on 18 December The Commission referred 4 J No L309, , p.1 5 J No L 153, , p. 1

3 3 on 16 July 2013 an updated review rept to the Standing Committee on the Food Chain and Animal Health, f exaation. The present review rept contains the conclusions of the final exaation by the Standing Committee. 2. Purposes of this review rept This review rept, including the background document appendices thereto, has been developed in suppt of the Directive 2008/127/EC 7 concerning the inclusion of pyrethrins in Annex I to Directive 91/414/EEC, as amended by Commission Implementing Regulation (EU) No 798/ The Commission requested EFSA to deliver its view on the draft review rept. When the Member States decide on individual plant protection products containing pyrethrins they shall take into account this review rept in accdance with the provisions of Regulation (EC) No 1107/2009, and in particular the provisions of Article 4(1), (2) and (3) of that Regulation and unifm principles laid down in Regulation (EC) No 546/2011. This review rept provides also f the evaluation required under Section A.2.(b) of the above mentioned unifm principles, as well as under several specific sections of part B of these principles. In these sections it is provided that Member States, in evaluating applications and granting authisations, shall take into account the infmation concerning the active substance in Annex II of the directive, submitted f the purpose of inclusion of the active substance in Annex I, as well as the result of the evaluation of those data. In accdance with the provisions of Article 26 of Regulation (EC) No 2229/2004, Member States will keep available make available this review rept f consultation by any interested parties will make it available to them on their specific request. The infmation in this review rept is, at least partly, based on infmation which is confidential and/ protected under the provisions of Regulation (EC) No 1107/2009. It is therefe recommended that this review rept would not be accepted to suppt any registration outside the context of Regulation (EC) No 1107/2009, e.g. in third countries, f which the applicant has not demonstrated to have regulaty access to the infmation on which this review rept is based. 3. verall conclusion in the context of Directive 91/414/EEC The overall conclusion from the draft assessment rept, the recommendations by the rappteur Member State and the result of the exaation in accdance with the provisions of Article 24a of Regulation 2229/2004 is that there are clear indications that it may be expected that pyrethrins does not have any harmful effects on human animal health on groundwater any unacceptable influence on the environment, as set out in Annex VI of regulation (EC) 2229/2004 as last amended by Regulation (EC) 1095/ European Food Safety Authity; Conclusion on the peer review of the pesticide risk assessment of the active substance pyrethrins. 4 4 These indications are however subject to compliance with the particular requirements in sections 4 and 5 of this rept, as well as to the implementation of the provisions of Article 29(1) of Regulation (EC) No 1107/2009 and the unifm principles laid down in Regulation (EC) No 546/2011, f each pyrethrins containing plant protection product f which Member States will grant review the authisation. Furtherme, these indications were reached within the framewk of the uses which were proposed and suppted by the main data submitter and mentioned in the list of uses suppted by available data (attached as Appendix II to this review rept). Extension of the use pattern beyond those described above will require an evaluation at Member State level in der to establish whether the proposed extensions of use can satisfy the requirements of Article 29(1) of Regulation (EC) No 1107/2009 and of the unifm principles laid down in Regulation (EC) No 546/2011. Pending the conclusions of assessment of confirmaty infmation, the following reference values f the pyrethrins have been agreed: ADI: ARfD: AEL: 0.04 mg/kg bw/day 0.2 mg/kg bw 0.07 mg/kg bw/day With particular regard to residues, considering the no residues situation (all values < LQ) f the majity of suppted uses, pending the final definition of residues and on the basis of the actual exposure, the review has established that the residues arising from the proposed uses, consequent on application consistent with good plant protection practice, have no harmful effects on human animal health. The Theetical Maximum Daily Intake (TMDI )f a 60 kg adult is less than 2% of the Acceptable Daily Intake (ADI), based on the WH Cluster diet B considering pyrethrins residues only. Additional intake from water and products of animal igin are not expected to give rise to intake problems. Estimates of acute dietary exposure of adults and toddlers revealed that the Acute Reference Dose (ARfD) would not be exceeded 8 % with Highest value ( Lettuce DE child) considering pyrethrins residues only. With respect to operat, wkers and bystanders risk assessment: pending the confirmaty infmation on specific local effects due to inhalation, the preliary conclusions are that, the substances are considered unlikely to be genotoxic based on a complete standard battery tests in vitro. The review has concluded that there are acceptable exposure scenarios f consumers, operats, wkers and bystanders which require however to be confirmed f each plant protection products in accdance with the relevant sections of the above-mentioned unifm principles. It has also been concluded that under the proposed and suppted conditions of use there are no unacceptable effects on the environment, as provided f in Article 4 (1) (b) (iv) and (v) of Directive 91/414/EEC, provided that certain conditions are taken into account as detailed in section 6 of this rept.

5 5 However, pending confirmaty infmation, risk mitigation measures have to be included as detailed in section 6 of this rept. 4. Identity and biological properties The main properties of pyrethrins are given in Appendix I. It has been established that f the active substance notified by the main data submitter none of the manufacturing impurities considered are, on the basis of infmation currently available, of toxicological environmental concern. 5. Endpoints and related infmation In der to facilitate Member States, in granting reviewing authisations, to apply adequately the provisions of Article 29(1) of Regulation (EC) No 1107/2009 and the unifm principles laid down in Regulation (EC) No 546/2011, the most imptant endpoints were identified during the re-evaluation process. These endpoints are listed in the EFSA Conclusions and in section 3 of this rept. 6. Particular conditions to be taken into account on sht term basis by Member States in relation to the granting of authisations of plant protection products containing pyrethrins n the basis of the proposed and suppted uses (as listed in Appendix II), the following issue has been identified as requiring particular and sht term attention from all Member States, in the framewk of any authisations to be granted, varied withdrawn, as appropriate: a) the risk to operats and wkers; b) the risk to non target ganisms. Conditions of use shall, where appropriate, include the application of adequate personal protective equipment and other risk mitigation measures. 7. List of studies to be generated Further studies were identified which were at this stage considered necessary in relation to the approval of pyrethrins under the current approval conditions. The applicant shall submit confirmaty infmation as regards: (1) the specification of the technical material, as commercially manufactured including infmation on any relevant impurities and its equivalence with the specifications of the test material used in the toxicity studies; (2) the risk from inhalation; (3) the residue definition; (4) the representativeness of the maj component pyrethrin 1 as regards the fate and behaviour in soil and water.

6 6 The applicant shall submit to the Commission, the Member States and the Authity the infmation set out in points (1) by 31 March 2014 and the infmation set out in points (2) (3) and (4) by 31 December ther endpoints may require the generation submission of additional studies to be submitted to the Member States in der to ensure authisations f use under certain conditions. The complete list of studies to be generated, still ongoing available but not peer reviewed can be found in the relevant part of the EFSA Conclusion (page 20). 8. Infmation on studies with claimed data protection F infmation of any interested parties, the rappteur Member State will keep available a document which gives infmation about the studies f which the main data submitter has claimed data protection and which during the re-evaluation process were considered as essential with a view to annex I inclusion. This infmation is only given to facilitate the operation of the provisions of Article 13 of Directive 91/414/EEC and Articles 59 to 62 of Regulation (EC) No 1107/2009 in the Member States. It is based on the best infmation available but it does not prejudice any rights obligations of Member States operats with regard to its uses in the implementation of the provisions of Article 13 of the Directive 91/414/EEC and Articles 59 to 62 of Regulation (EC) No 1107/2009 and neither does it commit the Commission. 9. Updating of this review rept The infmation in this rept may require to be updated from time to time in der to take account of technical and scientific developments as well as of the results of the exaation of any infmation referred to the Commission in the framewk of Articles of Regulation (EC) No 1107/2009. Any such adaptation will be finalised in the Standing Committee on the Food Chain and Animal Health, in connection with any amendment of the inclusion conditions f pyrethrins in Annex of the Regulation (EC) No 540/2011.
