1 Executive Order on fertiliser and soil improvers, etc. 1) The following is laid down in accordance with Sections 2 to 4, Section 7, Section 9 and Section 13(2) of Act No 318 of 31 March 2007 on fertiliser and soil improvers, etc. and following authorisation: Scope etc. Section 1. This Executive Order shall apply to the following products: fertilisers, compost preparations, soil improvers, growth mediums and seed stocks, cf. Section 2(1) of the Act on fertiliser and soil improvers, etc. Section 2. Fertiliser and soil improvers etc. may only be sold in accordance with the rules of this Executive Order. (2) If requirements are laid down in Annexes 1 to 6 regarding the products' quality, content of specific analytical constituents (measurable quantities) or regarding packaging and marking, these rules shall be complied with when the products are sold. (3) The provisions in Sections 6 to 14 shall not apply to products that are marketed as fertilisers under the designation EC FERTILISER. The rules in Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers shall apply to these fertilisers. Section 3. The provisions concerning sale shall also apply to possession with a view to sale, offering for sale, advertising, display on signs, distribution, supply and any other form of transfer with or without remuneration. Registration Section 4. Anyone who imports, produces, packages or distributes fertiliser and soil improvers, etc. shall be registered with the Danish Plant Directorate. (2) The obligation to register shall not apply to anyone who: 1) imports fertiliser and soil improvers, etc. for his own use, or 2) distributes only packaged fertiliser and soil improvers, etc., cf. Section 7(2), and resells the product without breaking the seal, (3) Notwithstanding subsection 2, anyone who imports or distributes fertiliser, whether straight or compound, containing more than 16 percent by mass of in relation to ammonium nitrate shall be registered. (4) On registration in accordance with subsection 1, details shall be provided of the name and address of the party responsible for the product. The responsible party shall have an address in Denmark or another EU Member State. 1) The Executive Order has been notified in draft form in accordance with Directive 98/34/EC of the European Parliament and of the Council (Information Procedure Directive), as amended by Directive 98/48/EC. The Executive Order includes certain provisions from Regulation No (EC) 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers (OJ 2003, L 304, page 1). In accordance with Article 249 of the EC Treaty, a regulation is directly applicable in all Member States. The reproduction of these provisions in the Executive Order is therefore justified solely on practical grounds and does not affect the direct applicability of the regulation in Denmark.

2 Notification Section 5. Fertilisers and soil improvers, etc. that are intended to be sold within Denmark shall be notified in writing to the Danish Plant Directorate. (2) The notification shall be submitted by the party who, with a view to sale in Denmark, 1) marks the product, or 2) imports the product already marked. (3) A copy of the printed accompanying document or a description of the marking that is intended to be used shall be sent together with the notification. (4) Growth mediums produced in accordance with an agreement with the final user and which are sold direct to this user only, may be notified by the producer or the party importing the products into the country under the designation: Horticultural products. Subsections 3 shall apply accordingly. Marking and packaging Section 6. When sold, fertiliser and soil improvers etc. shall be marked as specified in Annexes 1 to 6 for the relevant product type. (2) When sold within Denmark, the marking shall be written in Danish and shall be readily visible and easy to read, and it shall not be possible to remove it. (3) If the fertiliser or soil improver etc. is packaged, the marking shall be placed on the packaging or the label. For unpackaged fertiliser or soil improvers etc., the marking shall be found in the accompanying documents. Section 7. Sticky labels shall be attached to the package or its closing device. If this device consists of a seal, that seal shall bear the name or mark of the packager. (2) As regards packaged fertiliser and soil improvers, etc., the package shall be closed in such a way or by such a device that, when it is opened, the fastening, fastening seal or the package itself is irreparably damaged. Valve sacks may be used. Section 8. The specified content of analytical constituents etc. shall, when sold, correspond to the content that can be demonstrated using official analysis methods or using analysis methods approved by the Danish Plant Directorate. Blends Section 9. The provisions of Sections 5 to 8 and Section 10 shall not apply to blends of products referred to in Section 1(1), provided 1) that the blend is produced to the order of the final user, 2) that the blend is designated as: Blend of [products], 3) that the quantity of each individual product included in the blend is stated on the accompanying document and the invoice, and 4) that the blend is sold direct to the relevant user only. Fertilisers Section 10. Fertilisers which do not comply with the requirements pertaining to the fertiliser types referred to in the table in Annex 1 shall comply with the requirements in Annex 2. The type designations in Annex 1 must not be used for fertilisers that are subject to Annex 2, except for types NPK, NP, NK and PK. 2

3 (2) In addition to the declaration of the nutrient content, the ingredients added to the fertiliser in quantities above 1% of the weight of the fertiliser shall be stated in the marking. If the fertiliser consists of several ingredients, these shall be stated in descending order of weight. Ammonium nitrate fertiliser of high content Section 11. Ammonium nitrate fertilisers of high content, straight or compound, are products manufactured for use as fertilisers and containing more than 28% by mass of in relation to ammonium nitrate. This type of fertiliser may contain inorganic or inert substances. Substances used in the manufacture of this type of fertiliser must not increase its sensitivity to heat or its tendency to detonate. Section 12. Anyone who imports, produces, packages or distributes ammonium nitrate fertilisers as referred to in Sections 14 and 15 shall ensure that the fertiliser complies with the provisions of Annex 7 or Chapter IV of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers. (2) Ammonium nitrate fertilisers of high content may only be sold to the final user in packaged form. Section 13. Ammonium nitrate fertilisers of high content that do not comply with the provisions of Annex 7 or the provisions of Chapter IV of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers must not be handled or sold without a licence from the Danish Emergency Management Agency. Section 14. The party importing, producing, packaging or distributing ammonium nitrate fertilisers of high content shall ensure that each type of fertiliser that is intended to be sold has undergone a detonation test, cf. Annex 7. (2) The results of the detonation test shall be submitted to the Danish Plant Directorate no later than 5 days before the fertiliser is sold. In the case of imports, the results of the test shall be received by the Danish Plant Directorate not later than 5 days before the fertiliser arrives in Denmark. All subsequent deliveries of the relevant type of fertiliser shall satisfy the requirements of the above-mentioned test. (3) Importers of ammonium nitrate fertilisers of high content shall notify the Danish Plant Directorate in writing of the import no later than 5 days before the fertiliser arrives in Denmark. The notification shall contain information regarding the form in which the batch is transported and where and when it arrives in Denmark. Section 15. Information relating to EU ammonium nitrate fertiliser with a high content, must be reported to the Danish Plant Directorate at least 5 days before the fertiliser is sold in Denmark in accordance with Article 27 of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers. Traceability Section 16. Anyone who is subject to the obligation to register in accordance with Section 4 shall maintain records of the origin of fertilisers in order to ensure the traceability of fertilisers and soil improvers, etc. The records shall be available for inspection by the Danish Plant Directorate for as long as the fertiliser or soil improver, etc. is being imported, produced, distributed, packaged or retailed and for a further period of 2 years thereafter. 3

4 (2) For fertilisers with more than 16% in relation to ammonium nitrate, the records shall also state who it has been sold to, stating their CVR [Central Business Register] number. In addition, the fertiliser s declaration and the quantity sold shall also be stated. Control Section 17. The Danish Plant Directorate shall carry out control measures to verify that the provisions of the Act on fertilisers and soil improvers, etc., the provisions of this Executive Order and of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers are complied with. (2) When referring to the Directorate s control measures, the following shall be stated: The Danish Plant Directorate carries out control measures by analysing samples to ensure that (company s/undertaking s) products comply with the requirements of the legislation relating to fertilisers and soil improvers. Penalty provisions etc. Section 18. Contravention of the following provisions shall be punished with a fine: 1) Section 2(1)-(2), Sections 4 to 7, Section 10 and Sections 12 to 16. 2) Articles 3, 4, 6, 7 to 13, 17 to 19, 21, 23, 24 and 26 to 28 of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003 relating to fertilisers. (2) Companies etc. (legal persons) are liable to be punished in accordance with the rules in Chapter 5 of the Penal Code. Section 19. This Executive Order shall enter into force on 1 September (2) At the same time, Executive Order No 960 of 16 December 1998 on fertilisers and soil improvers, etc. shall be rescinded. (3) Notwithstanding the provision in subsection 2, products subject to Annexes 4 to 6 may nevertheless continue to be sold until 1 year after the entry into force of this Executive Order, even if the products are marked in accordance with the rules of Executive Order No 960 of 16 December 1998 on fertilisers and soil improvers, etc. The Danish Plant Directorate, 27 August 2008 OLE P. 6 Annex 1 Marking of fertilisers General provisions Fertilisers marketed as EC FERTILISER are not covered by the provisions of this Annex, as the provisions of the Fertiliser Regulation are directly applicable to these products. A. Compulsory and optional declaration I. Names of nutrients a) The, phosphorus and potassium content of fertilisers shall be stated in the form of the element (N, P and K). Phosphorus and potassium may be stated in the form of both the element (P, K) and the oxide (P 2 O 5, K 2 O) at the same time. b) When declaring calcium, magnesium, sodium and sulphur, the content is stated in the form of the element (Ca, Mg, Na, S) or in the form of both the element (Ca, Mg, Na, S) and oxide (CaO, MgO, Na 2 O, SO 3 ). c) The content of the micro-nutrients boron, cobalt, copper, iron, manganese, molybdenum and zinc is stated in the form of the element (B, Co, Cu, Fe, Mn, Mo, Zn) II. Special remarks concerning the declaration of micro-nutrient 1) For the fertilisers listed in points A, B, C and D of the table in Annex 1, the content of one or more of the micro-nutrients boron, cobalt, copper, iron, manganese, molybdenum or zinc shall be declared if: a) the micro-nutrients are added in quantities equal to or greater than the minimum content given in points E.2.2 and E.2.3 of the table in Annex 1, and b) the fertiliser complies with the requirements in points A, B, C and D of the table in Annex 1. 2) Where the micro-nutrients occur naturally in the raw materials supplying the primary nutrients (N, P, K) and secondary nutrients (Ca, Mg, Na, S), declaration is optional, provided that the micro-nutrients are present in quantities equal to or greater than the minimum content stated in points E.2.2 and E.2.3 of the table in Annex 1. 3) The micro-nutrient content is declared as follows: a) For fertilisers containing one micro-nutrient as listed in point E.1 of the table in Annex 1 declarations are made in accordance with the requirements listed in column 6 of the table under point E.1. b) For blends of the fertilisers referred to under a) containing two or more different micro-nutrients and complying with the requirements in point E.2.1 of the table in Annex 1, and for fertilisers containing primary and/or secondary nutrients, the following is stated: i) the total content and ii) the water-soluble content when this constitutes at least half 6

7 the total content, or iii) the water-soluble content only, where a micro-nutrient is fully soluble in water. 4) Where a micro-nutrient is chemically bound to an organic molecule, the content of the micro-nutrient in the fertiliser is declared immediately after the water-soluble content as a percentage of the fertiliser by mass followed by either of the phrases chelated by or complexed by and the name of the organic molecule as listed in point E.3 of the table in Annex 1. The abbreviation of the organic molecule may be used instead of its name. III. Compulsory and optional indications Packages, labels and accompanying documents shall bear the following indications: 1) Compulsory indications a) Indication of the type of fertiliser as set out in the table in Annex 1. b) For mechanically blended fertiliser, the words mechanical blend shall be added after the type designation. c) Additional indications as referred to in Sections B I point 2, B II point 1 and B III point 1. d) Nutrients are indicated both by name and by their chemical symbol in the following order: (N), phosphorus (P), potassium (K), calcium (Ca), magnesium (Mg), sodium (Na), sulphur (S), boron (B), cobalt (Co), copper (Cu), iron (Fe), manganese (Mn), molybdenum (Mo) and zinc (Zn). e) For fertilisers containing micro-nutrients of which all or part are chemically bound to an organic molecule, the name of the micronutrient shall be followed by one of the following qualifiers: i) chelated by (name of the chelating agent or its abbreviation as set out in point E.3.1 of the table in Annex 1) ii) complexed by (name of complexing agent as set out in point E.3.2 of the table in Annex 1) f) Specific directions for use for those products listed in points E.1 and E.2 of the table in Annex 1. g) Indication of the quantity, express by net or gross mass. If the gross mass is given, the tare mass shall be stated. h) For fluid fertilisers, additional information concerning storage temperature and prevention of accidents during storage shall be given. i) The name and address in Denmark of the party responsible for the indications given. j) Identification number, if assigned by the Danish Plant Directorate. 2) Optional indications a) The following information may be provided: i) As set out in the table in Annex 1. ii) Directions for storage and handling, and for fertilisers not 7

8 listed in points E.1 and E.2 of the table in Annex 1, specific directions for the use of the fertiliser. iii) Indication of the dose rates and conditions of use suitable for the soil and crop conditions under which the fertiliser is used. iv) Indication of the quantity of fluid fertiliser, expressed by volume or mass per unit volume (kg per hectolitre or g per litre). v) The mark of the importer, producer, distributor, packager or retailer of the fertiliser and the trade description of the product. b) The optional indications must not conflict with the compulsory indications and shall be clearly separated from them. B. Special provisions for specific types of fertilisers I. Inorganic primary nutrient fertilisers This section shall apply to all inorganic primary nutrient fertilisers, including those containing secondary nutrient and/or micro-nutrients. 1) Special remarks concerning the declaration of secondary nutrients a) The calcium, magnesium, sodium and sulphur content may be declared as secondary nutrient content of the types of fertiliser listed in points A, B and C of the table in Annex 1, provided that these elements are present in quantities that are equal to or greater than: i) 1.4% Ca ii) iii) 1.2% Mg 2.2% Na iv) 2% S. b) In such a case, the additional indications specified in B.I, point 2(b) shall be added to the type designation. c) The declaration of the magnesium, sodium and sulphur content of the fertilisers listed in points A, B and C of the table in Annex 1 shall be expressed by means of: i) the total content and ii) the water-soluble content where this constitutes at least a iii) quarter of the total content, or the water-soluble content only, where the secondary nutrient is fully soluble in water. d) The content of calcium shall be declared if it is soluble in water, and it shall be expressed as a percentage of the fertiliser by mass, cf. however the table in Annex 1. 2) Additional compulsory indications a) In addition to the compulsory indications referred to in A. III, point 1, the indications set out in points b, c, d, e, f and g of this section shall be stated. b) The following shall be stated after the type designation of compound fertilisers: i) The chemical symbols of the declared secondary nutrients, 8

9 between brackets and after the symbols of the primary nutrients. ii) Whole numbers indicating the primary nutrient content. Following this, the declared secondary nutrient content shall be indicated in whole numbers between brackets. c) The type designation shall only be followed by figures indicating primary and secondary nutrient content. d) Where micro-nutrients are declared, the words with micronutrients or the word with followed by the name or names and chemical symbols of the micro-nutrients present shall be given. e) The declared content of primary nutrients and secondary nutrients shall be given as a percentage by mass, as whole numbers or, where an appropriate method of analysis exists, to one decimal place. f) Where the micro-nutrient content is declared, the name and symbol of each micro-nutrient shall be given, indicating the percentage by mass, cf. points E.2.2 and E.2.3 of the table in Annex 1. g) The forms and solubility of the nutrients shall also be expressed as a percentage by mass, except where the table in Annex 1 provides otherwise. Figures shall always be given to one decimal place, except for micro-nutrients where the provisions in points E.2.2 and E.2.3 of the table in Annex 1 shall be followed. II. Inorganic secondary nutrient fertilisers This section shall apply to inorganic fertilisers that do not contain any primary nutrients, only secondary nutrients and, where relevant, micro-nutrients. 1) Additional compulsory indications a) In addition to the compulsory indications referred to in A. III point 1, the following shall also be stated: i) Where micro-nutrients are declared, the words with micronutrients or the word with followed by the name or names and chemical symbols of the micro-nutrients present shall be given in the type designation. ii) The declared content of secondary nutrients shall be given as a percentage by mass, as whole numbers or, where an appropriate method of analysis exists, to one decimal place. Where the fertiliser contains more than one secondary nutrient, the following order shall be used: Ca, Mg, Na and S. iii) Where the micro-nutrient content is declared, the name and symbol of each micro-nutrient shall be given, indicating the percentage by mass, cf. points E.2.2 and E.2.3 of the table in Annex 1. iv) The forms and solubility of the nutrients shall be expressed as a percentage by mass, except where the table in Annex 1 provides otherwise. Figures shall always be given to one decimal place, except for micro-nutrients where the provisions in points E.2.2 and E.2.3 of the table in Annex 1 shall be followed. v) The content of calcium shall be declared if it is soluble in water, and it shall be expressed as a percentage of the fertiliser 9

10 by mass, cf. however the table in Annex 1. 2) Additional optional indication. The chemical symbols for the declared secondary nutrients may be stated after the type designation, cf. point D of the table in Annex 1. The content, expressed as whole numbers in brackets, may also be stated. III. Inorganic fertilisers containing only micro-nutrients This section shall apply to inorganic fertilisers containing only micro-nutrients. 1) Additional compulsory indications: In addition to the compulsory indications referred to in A. III. point 1, the following shall also be stated: a) For fertilisers containing one micro-nutrient, the type designation, as set out in point E.1 of the table in Annex 1 shall be given. b) For fertilisers containing more than one micro-nutrient, the type designation mixture of micro-nutrients shall be given, followed by the names of the micro-nutrients present and their chemical symbols. The content, expressed as whole numbers in brackets, may also be indicated. c) For fertilisers containing only one micro-nutrient, cf. point E.1 of the table in Annex 1, the declared micro-nutrient content shall be given as a percentage by mass, in whole numbers or, where necessary, to one decimal place. d) The forms and solubility of the micro-nutrients shall be expressed as a percentage by mass, except where the table in Annex 1 provides otherwise. The number of decimal places for micro-nutrients shall be as specified in point E.2.1 of the table in Annex 1. e) Below the compulsory and optional declarations the following shall be entered on the label and accompanying documents with regard to the products listed in points E.1 and E.2.1 of the table in Annex 1: To be used only where there is a recognised need. Do not exceed the appropriate dose rates. 2) Packaging requirements Fertilisers covered by the provisions of this section (B.III) shall be packaged. 10

For this type 2a fertiliser, the sample quantity for determining solubility (3) shall be 3 g. 2b. An NPK fertiliser containing aluminiumcalcium phosphate must be free 34

It shall be declared in accordance with solubilities (1) and (7), the latter applying after deduction of the solubility in water. This type of fertiliser shall meet the following requirements: - contain at least 0.9% watersoluble P (solubility (1)); - contain at least 2.2% P according to solubility (7).
