3 SUMMARY OF TRANSITION PAYMENTS CLERICAL EMPLOYEES AWARD STATE TO CLERKS PRIVATE SECTOR AWARD 2010 The transitional provision allows employers to gradually convert to the new rates of pay over a 5 year period. We will update this summary every year during the Transition Period. The figures displayed in this document are applicable from the first full pay period on or after 1 July HOW TO USE THESE TRANSITION TABLES In order to find the rate of pay for each employee you must: 1) Determine whether they are a full-time/part-time or casual employee 2) Whether they are a Junior 3) Whether they are a Day worker or Shift worker 4) Then consult the Contents page to find the relevant section The first column of the tables will depict an employee s Old Classification and what Level they will be transferred to in the Modern Award. In order to determine this, employers will need to compare the definitions of the Old Classification against the Modern Award Levels. The percentage shown under the heading of each column is the percentage applied to the respective classification wage rate. This includes calculations for casual rates where the percentage has been adjusted so as to apply to the BASE rate of pay. ***NOTE: The span of ordinary hours in the Private Sector Award 2010 is 7am to 7pm Monday to Friday, and 7am to 12.30pm on Saturday (Clause 25). However, if a clerical employee works at a place where the majority of employees are covered by some other modern award, the ordinary hours are then determined by the other award (clause 25.1(b)). EG, if the majority of workers at the workplace are covered by the Food, Beverage and Tobacco Manufacturing Award 2010 (MA000073), the ordinary hours that in that award (6am to 6pm) apply instead of 7am to 7pm. 3

13 Allowances Transport of employees shiftworkers: When an employee working shiftwork commences or finishes work at a time other than the employee s normal time of commencing or finishing and when reasonable means of transport is nor available, the employer will reimburse the employee for transport costs. Clothing and Footwear: The employer will reimburse employees engaged in work damaging to clothing an amount equal to the cost of uniforms, except where uniforms and/pr protective clothing are provided free of charge by the employer. The employer will reimburse employees who are constantly required to work under conditions which are wet and damaging to footwear, an amount equal to the cost of appropriate footwear except where provided free of charge by employer. When an employee is required to wear and launder a uniform any cost of the uniform must be reimbursed and the employee must be paid $3.55 for laundry expenses per week. Meal Allowance: An employee required to work for more than one and a half hours overtime without being given 24hrs notice will be either provided with a meal or paid a meal allowance of $ where such overtime work exceeds four hours a further meal allowance of $10.92 will be paid. Vehicle Allowance: (a) An employee required by the employer to use the employee s motor vehicle in the performance of duties must be paid the following allowances: (i) Motor cars $0.75 per kilometre with a maximum payment as for 400 kilometres per week. (ii) Motorcycles $0.25 per kilometre with a maximum payment as for 400 kilometres per week. (b) The employer must pay all expenses including registration, running and maintenance where an employer provides a motor vehicle which is used by an employee in the performance of the employee s duties. First Aid Allowance: An employee who has been trained to render first aid, is the current holder of appropriate first aid qualifications and is appointed by an employer to perform first aid duty must be paid a weekly allowance of 1.5% of the standard rate. Higher Duties Allowance: An employee, when required to perform any of the duties in a classification higher than their usual classification for more than one day must be paid at least the rate which would be applicable if such duties were performed on a permanent basis.
