1 RATING STATE AND LOCAL TOBACCO POLICIES The purpose of our study is to examine the importance and effectiveness of state and local policies in discouraging youth tobacco use in 50 California cities. The survey has two parts. With your help, we want to understand three related issues. In Part I, we want to understand how important you think each tobacco policy is for discouraging youth smoking, compared to other tobacco policies. In Part II, we want to understand: a) How effective you think each California state tobacco law (where a law exists) is for discouraging youth smoking. b) How effective you think a local policy that is stricter than the California state law is for discouraging youth smoking. Current California state tobacco laws are considered here as baseline policy levels in all of the cities. By discouraging youth smoking, we are referring both to preventing youth from smoking initiation and encouraging youth who do smoke to quit. Thank you for your help!! What is your gender? 6 PART II Please review the following state and local policies and rate their effectiveness. Assume that the policies are adequately enforced. Indoor Areas CLEAN AIR LAWS Workplaces: California law prohibits smoking by employees, employers, customers, and the general public in many, but not all, enclosed places of employment. There are a few places, such as employee break rooms, that are exempted from the law. 1a. How effective do you think this law is for discouraging youth smoking? Question no 1a: b. Question no 9b: Smoke-Free Housing Indoor Common Areas: In California, smoking is prohibited in 100% of indoor common areas of apartments and condominiums only if the areas are places of employment (that is, if there is an employee who works on the property such as an on-site property manager, security guard or maintenance worker). 10a. Question no 10b: Outdoor Common Areas: There is no state law prohibiting smoking in outdoor common areas of apartments or condominiums. 11a. How effective for discouraging youth smoking do you think a local policy would be that requires that 100% of outdoor common areas of apartments or condominiums be smoke-free? Question no 11a: b. Question no 11b: Nonsmoking Units: There is no state law requiring apartments or condominiums to have nonsmoking units. 12a. How effective for discouraging youth smoking do you think a local policy would be that requires that some percentage, but less than 100% of units, be smoke-free? Question no 12b:

12 SALE OF TOBACCO PRODUCTS Retail Licensure: In California, all retailers, distributors, wholesalers, manufacturers, and importers must be licensed by a state board. The law requires vendors to pay a one-time licensing fee of $100 per location; wholesalers and distributors are required to pay $1,000 per year. Tobacco retailers are required to renew their licenses on an annual basis for no fee. A retailer s license is suspended if the retailer has been convicted of selling to minors four times in one year. 13a. How effective do you think this law is for discouraging youth smoking? Question no 13a: Local Retail Licensure: Local jurisdictions can pass local licensing ordinances with stronger public health provisions and include fees and penalties to support enforcement of these ordinances. The American Lung Association defines a strong tobacco retailer licensing as one that includes all the following components: (1) requirements that all retailers that sell tobacco products must obtain a license and renew it annually, (2) a fee set high enough to sufficiently fund an effective program including administration of the program and enforcement efforts. An enforcement plan, that includes compliance checks, should be clearly stated, (3) coordination of tobacco regulations so that a violation of any existing local, state or federal tobacco regulation violates the license, and (4) a financial deterrent through fines and penalties including the suspension and revocation of the license. Fines and penalties should be outlined in the ordinance. 13b. How effective for discouraging youth smoking do you think a local policy would be that requires all of these four components? Question no 13b: Sales of Tobacco Products in Pharmacies: There is no California law that restricts pharmacies from selling tobacco products. 14a. How effective for discouraging youth smoking do you think a local policy would be that restricts 100% of pharmacies from selling tobacco products? Question no 14a:

13 Target Age for Photo Identification: California state law requires retailers to check the identification of tobacco purchasers who reasonably appear to be under 18 years of age. 15a. How effective do you think this law is for discouraging youth smoking? Question no 15a: b. How effective for discouraging youth smoking do you think a local policy would be that requires retailers to check the identification of tobacco purchasers who reasonably appear to be under 27 years of age? Question no 15b: Outlet Density: There is no California law that restricts the number and/or location of tobacco retailers. 16a. How effective for discouraging youth smoking do you think a local policy would be that limits the number and/or location of tobacco retailers? Question no 16a: b. How effective for discouraging youth smoking do you think a local policy would be that prohibits tobacco retailers near schools? Question no 16b: UNDERAGE POSSESSION Minor in Possession: California state law requires a minimum age of 18 for purchasing and possessing of tobacco products. The state authorizes a civil penalty of $75, or 30 hours of community service to youth for purchase or possession of tobacco products.

Question no 17a: ADULT PURCHASE FOR MINORS There is no California law that prohibits minors from asking adults to purchase cigarettes or other tobacco products for them. 18a. Question no 18a: ADVERTISING AND PROMOTION Outdoor Tobacco Advertising: California law prohibits tobacco advertising on any outdoor billboard located within 1,000 feet of any public or private elementary, junior high, or high school, or public playground. 19a. Question no 19b: Storefront Signage: California state law mandates that no more than 33% of windows and clear (e.g., glass) doors of retail stores may have any advertising signs, including tobacco.

Question no 20b: Sampling of Tobacco Products: In California, the distribution of free or low-cost tobacco products is limited. There are, however, a few locations, products, and sampling methods that are exempted. For example, coupons, promotional offers, discounts, and rebates for tobacco products are allowed, as is the distribution of low-cost cigarettes. Sampling of smokeless tobacco products is allowed in adult-only facilities and at some sporting events. 21a. How effective do you think this law is for discouraging youth smoking? Question no 21a: b.
