1 Alaska Smokefree Air Ordinances Anchorage Date Passed: July 1, 2000 Date Effective: January 1, 2001 Ordinance# AO No (S) Smoking is prohibited in all enclosed public places within the Municipality of Anchorage, including: 1. Elevators 2. Restrooms, lobbies, reception areas, hallways, and any other common-use areas 3. Buses, taxis, and other means of public transportation under the MOA, including ticket, boarding, and waiting areas of public transit depots 4. Service lines 5. Retail stores 6. All areas available to the general public (attorney s offices, Laundromats, attorney s offices, banks, etc. 7. Restaurants 8. Public areas of galleries, libraries, museums, when open to the public 9. Theaters 10. Sports arenas and convention halls, bowling facilities, pool halls 11. Chamber, assembly facilities 12. Public areas of health facilities 13. Common areas of apartment buildings, condos, retirement facilities, nursing homes, etc. 14. Polling places 1. Private residences, including those used as places of employment, except during hours used as a day care, adult care, or health care facility 2. Places of employment with four or less employees 3. 25% of hotel and motel rooms rented to guests 5. Restaurants, hotel and motel conference rooms, when used for private functions 6. Bars 7. 3 Dillingham Date Passed: October 7, 2003 Smoking is prohibited in all enclosed public places within the City of Dillingham, including, but not limited to: elevators, restrooms, reception areas, hallways and any other commonuse areas. Buses, taxis, and other public transit, as well as waiting areas, service lines, retail stores, all areas available and used by the general public (banks, law offices, Laundromats, hotels, motels), **restaurants, galleries, libraries, museums open to the public, any facility primarily used for exhibiting any motion picture, stage, drama, lecture, musical recital or other similar performance, sports arenas and convention halls, including bowling facilities and pool halls; meeting places and public assemblies; waiting rooms, hallways, wards and semiprivate rooms of health facilities, including hospitals, clinics, physical therapy facilities, doctor s offices, dentist s offices, health care facilities and licensed child care facilities; lobbies, hallways, and other common areas in apartment buildings, etc; polling places; building entrances. Reasonable Distance: Smoking may occur when otherwise prohibited by the property owner but only at a reasonable distance outside any enclosed area within which smoking is prohibited, or when conditions allow. Smoking may be permitted within an area prohibited when conditions are down wind of the entrance. Exempt: private residences, including residents used as places of employment, except during hours used as child care, adult care, or health care facility; places of employment of two or less employees; twenty-five percent of hotel and motel rooms rented to guests; retail tobacco stores; restaurant, hotel and motel conference or meeting rooms and public and private assembly rooms, while these places are being used for private functions; bars; bingo halls and pull tab establishments where a non-smoking section which is an enclosed area is also offered to patrons, provided that smoke from these places does not infiltrate into areas where smoking is prohibited under the provisions of the article. **The term restaurant shall include a bar area within a restaurant. Smoking would still be permissible in stand-alone bars. 4 Homer, Continued Smoking prohibited in public buildings, public vehicles and watercraft; includes airport terminal, City Hall, Police Station, Fire Hall, Public Works Facilities, Animal Shelter, Library, Port and Harbor Buildings Reasonable Distance: A smoking area shall be situated no closer than 15 ft. from premise entrances, open doors or windows. **There is currently an updated ordinance on the table in Homer that would include restaurants and bar-restaurants. Juneau Date Passed: October 1, 2001 Date Implemented: January 2002 Smoking is prohibited in enclosed public places, enclosed places of employment, public vehicles. Exempt: Private residences, including those used as places of employment, except when used as a child, adult, or health care facility; places of employment with four or fewer employees; retail tobacco stores; performers smoking as part of a stage performance; enclosed areas used for conferences or meetings in restaurants, hotels, etc. when used for private functions; private enclosed areas in nursing homes/assisted living facilities; bars and bar-restaurants, provided that for bars, no tobacco smoke might infiltrate into a dining room through a passageway, ventilation system, etc., federal or state property, or those portions of buildings leased by the federal or state government; private property used for residential incarceration under contract to a federal or state correctional agency. Reasonable Distance: No smoking within ten feet of any entrance, open window, or ventilation system intake. Kenai Date Passed: April 16, 2003 Date Implemented: October 2, 2003 Smoking is prohibited in all eating establishments in the city. Smoking will still be allowed in bars and bar areas of restaurants as long as the bar section is enclosed and separately ventilated. Smoking also is allowed in eating establishments while they are used for private functions and in any patio area that is open to the sky. Exempt: Bars, restaurants with bar areas separately ventilated, bowling alleys, bingo halls, private clubs, such as the Elks, Moose, etc. Koyuk Date Passed: June 9, 2003 Date Implemented: July 14, 2003 Smoking is prohibited in Village Council Facilities, places of employment, City of Koyuk Facilities, including vehicles; public places, including bingo facilities and restaurants, including attached bars.
