4 Background > ONRSR commenced its Drug and Alcohol Testing Program in South Australia in 2013 and progressively rolled out across Australia > RSNL (Queensland) came into effect on 1 July 2017 ONRSR s D&A Testing Program to commence in Queensland shortly. > Industry will still continue to do the large majority of D&A testing > D&A Management Review currently being undertaken by ONRSR: > Nationally consistent framework; > Type of testing methods; > Amount of testing by operators; > Testing to an evidentiary standard; > Post incident testing; > Offence provisions tampering or interfering with a sample; > Aligning confirmatory D&A testing requirements nationally.

6 ONRSR and RTO D&A testing What is the difference between ONRSR s D&A testing and testing undertaken as part of your DAMP? > ONRSR s D&A testing program - Tests for compliance with the law by the Rail Safety Worker (RSW) > Testing undertaken as part of your DAMP - An RTO undertakes testing as part of its DAMP in order for the RTO to comply with the law and mitigate risk Office of the National Rail Safety Regulator 6
7 D&A testing program Objectives of the program: > To improve safety by reducing risks associated with RSWs undertaking work while under the influence of drugs and/or alcohol (ie. by being a deterrent) > To monitor compliance with the law > To monitor the effectiveness of an RTO s DAMP Office of the National Rail Safety Regulator 7
8 D&A testing program > Post-incident testing - in response to Category A incidents > Programmed testing - non-incident related testing intelligence-led risk-based testing random testing Office of the National Rail Safety Regulator 8
9 D&A offences There are a number of offences in relation to the D&A testing program: > Presence of drugs or alcohol > If a RSW refuses a test > If a RSW does not follow the direction of an authorised person Maximum penalty for these offences is $10,000. 10 Medvet Science Pty Ltd ONRSR has contracted Medvet to undertake drug and alcohol testing. > Medvet testers will be authorised persons. > Medvet testers will carry identity cards. Office of the National Rail Safety Regulator 10
11 Testing types Drug testing > saliva screening tests on site > saliva analysis if required Alcohol testing > breath tests on site > breath analysis if required Office of the National Rail Safety Regulator 11
12 Testing process Medvet arrives on site Identify facility for testing Medvet completes site induction Medvet undertakes sampling process Medvet undertakes drug & alcohol testing Testing complete: Medvet departs site Office of the National Rail Safety Regulator 12
13 Confirmatory drug testing What happens if a non-negative drug screening test result is received? Medvet will undertake confirmatory test Medvet will take a saliva sample for laboratory testing. DAMP is activated Medvet will notify your representative that a non-negative result has been received. Your representative will need to manage potential safety implications and trigger your DAMP, e.g. remove the RSW from rail safety work, review the potential for any error in work already undertaken, and other processes as per your DAMP. Test results from laboratory ONRSR will normally advise you of test results within 10 working days. You are required to advise the RSW of the test results. 14 Confirmatory alcohol testing What happens if a non-negative alcohol screening test result is received? Medvet notifies of non-negative result Medvet will notify your representative that a non-negative result has been received. Your representative will need to manage the potential safety implications and trigger your DAMP. Medvet tester and your representative accompany the RSW to the police station for breath analysis. 15 RTO involvement Rail Transport Operator assistance is sought with the following: > Accompany Medvet & provide site induction. > Identify a room or facility for testing. > Gather RSWs for sampling process. > Supervise RSWs selected for testing. > Accompany RSW & Medvet if breath analysis is required.
