4 Federal and State Regulations Retain internal or external legal counsel specializing in drug testing to review drug and alcohol testing laws in the states where their applicants reside and states where they have physical locations. 4

5 Key Drug Testing Statistics 16% of organizations saw a decrease in employee turnover rates after the implementation of drug testing programs. 9% of organizations reported high absenteeism rates (more than 15%). After implementation of a drug testing program, only 4% of organizations reported high absenteeism rates, a decrease of approximately 50%. 14% of organizations reported highworkers compensation incidence rates prior to a drug testing program, whereas only 6% of organizations reported similar rates of workers comp after the implementation of a drug testing program, a decrease of approximately 50%. 7 Pre hire drug testing More than one half of respondents indicated they perform drug testing on ALL candidates. 29% of respondents don t conduct any type of pre employment drug testing. Larger organizations (2,500 or more employees) are more likely to conduct preemployment drug testing for all job candidates compared with smaller organizations (fewer than 2,500 employees). Publicly owned for profit organizations are more likely to conduct pre employment drug testing for all job candidates compared with privately owned organizations, nonprofit organizations and government agencies. 9 Post hire drug testing 64% of respondents do not conduct post hire testing Drug Test Used 2011 Post-accident testing (administered to all employees who are or may have been involved in a workplace accident) Random testing (conducted on an unannounced basis using a neutral selection process and has the highest deterrence and detection impacts; a certain portion of the employee population is randomly selected periodically throughout the year) Reasonable suspicion testing (occurs when an employer has reason to believe that an employee is under the influence of drugs and/or alcohol) Follow-up testing (conducted during and after an employee has been referred to an employee assistance or other rehabilitation program) For-cause testing is based on indicia that an employee may have a substance-abuse problem (e.g. excessive absenteeism, performance problems, dramatic mood swings, etc.). 22 Understanding dilute specimens Dilute: A dilute specimen is one where the creatinine and specific gravity levels are lower than expected for human urine. 2 types of Negative Dilutes: 1) Negative, Dilute (Minor): Creatinine greater than 5 mg/dl but less than 20 mg/dl 2) Negative, Dilute (Major): Creatinine > 2 mg/dl but > to 5 mg/dl and specific gravity > but < Depending on the type of Negative Dilute (DOT or Non DOT, Major or Minor Dilute) the MRO will recommend an immediate recollection under direct observation, or suggest a recollection.
