37 Statistics 2,402 simple possession misdemeanor cases filed in 2016; 2,459 to date in misdemeanor under the influence cases in 2016; 199 to date in 2017** ** under the influence as a standalone charge is rarely filed 572 possession for sale in 2016; 475 to date in 2017 (felony)

38 Immediate Consequences If misdemeanor (possession or U/I) most often not arrested but instead given a citation to appear in court If felony (possession for sale) the suspect is arrested and remains in jail until bail is posted

39 Long Term Consequences Court appearances that take time and cost money Simple possession or U/I charges Participate in treatment program Or will serve 15 days in jail (usually work project/ankle monitor), be placed on probation, and be subject to search and drug terms Search terms = police can come into your home with or without a warrant Felony possession for sale charges: remain incarcerated if cannot afford bail Lost time at work Potential job loss Away from family Children may end up visiting while in jail Face up to 3 years in custody **Both felony and misdemeanor drug charges can have significant immigration consequences for non-citizens

40 Community Consequences Trash and environmental hazards Health costs Alienation of family members Property crimes such as theft, burglary, identity theft, bad checks, and shoplifting often finance habits Robbery can also finance habits Meth dealers often carry firearms debt disputes end in shootings Police officers are at risk every time they make an arrest or serve a search warrant

41 2 primary goals Criminal Justice System Goals 1) Help people stop using methamphetamine; and 2) Prosecute those selling methamphetamine These 2 goals are not always independent of each other Sellers are often users

42 How the system collaborates to help people stop using If a misdemeanor defendant does not want help: 15 days and probation If a misdemeanor defendant wants help, then: First criminal drug case: Diversion (PC 1000). If complete, case dismissed. If fail to complete Diversion: Prop 36 program. If complete, case dismissed. If fail to complete Prop 36: Adult Drug Court. If complete, case dismissed. If fail all 3 programs, conviction stands and sentence is imposed. The defendant s progress is monitored by the Court, the District Attorney, the defendant s attorney, and the Probation Department to different extents throughout participation in the various programs

43 The programs are Real Diversion: hours of education and group classes, plus 6 months of monthly meetings and support group work Prop 36: 12 weeks of group education and treatment plus 2-4 individual treatment sessions per month Adult Drug Court: Level 1: 4-12 weeks, 5 groups per week, 1 individual session; 3 self-help meetings/week Level 2: 12 weeks, 3 groups per week, 3 self help/week Level 3: 12 weeks, 2 groups/week, 3 self/week Level 4: 12 weeks, 2 groups/week, 3 self/week ALL of the programs have a drug testing component, and relapses are expected and do not automatically result in deletion from the programs. Instead, people may be reinstated within the discretion of the Court.

44 Sales Enforcement Quite often a methamphetamine supplier will be selling simply to support his or her habit. Defense attorney will discuss the case with the defendant, and if it appears that the sale activity is related to a use problem will communicate that to the prosecution In those cases the prosecution allows the defendant to proceed on a simple possession charge and participate in the appropriate program

45 Sales Enforcement Con t. With large quantity suppliers, the D.A s office works closely with local state and federal agencies to prosecute offenders. Keeping repeat sales offenders off the streets has recently become more difficult with the passage of Senate Bill 180 which eliminated the 3 year enhancement for a prior sales conviction
