3 1. Introduction The (PCPA) in cooperation with the Pennsylvania Commission on Crime and Delinquency in accordance with the provisions of Pennsylvania ACT 139 is seeking to provide police departments in the Commonwealth with the drug naloxone. The purpose of the RFP is to establish one or more licensed drug distributor/pharmacies where the drug naloxone may be obtained by police departments under the provisions of PA ACT 139 while the pays the licensed drug distributor/pharmacies. This document defines the requirements for submitting a proposal. 1.1 PA ACT 139 Requirements Per Act 139 of 2014, which amended the act of April 14, 1972 (P.L.233, No.64), known as The Controlled Substance, Drug, Device and Cosmetic Act, a first responder organization) seeking to obtain, carry, and administer naloxone in the event of an opioid overdose must first enter into a written agreement with an Emergency Medical Services (EMS) agency. For purposes of this Guidance Document, a first responder organization is a law enforcement or firefighter agency that is not licensed by the Department of Health as an EMS agency. This written agreement is valid only under the consent of the EMS Medical Director or another physician. The consented written agreement must also include the following: HOW the first responder agency will obtain the supply of naloxone, i.e., direct prescription or by standing order. A standing order is a prescription written by the EMS medical director or another physician, allowing for a specific number of naloxone units with the ability to refill the medication when supplies have depleted or units have expired. As part of a first responder agency s naloxone protocol, standing orders will specify the route of administration, dosage, when to administer and under which circumstances a second dose of naloxone is necessary. Standing orders would need to be renewed at least annually. A standing order cannot be written for an individual, i.e., family member or loved one. WHO will be prescribing naloxone to your agency? WHAT method or route of administration will be prescribed and used by the agency? WHERE the medication will be obtained (such as a local pharmacy name, address) and with whom it will be stored after the supply is obtained. (For example, EMS can hold a surplus supply of naloxone until replenishment is needed OR your agency can store, manage, and replenish the entire supply, according to language in the standing order) 1.2 Scope of Work The selected licensed drug distributor/pharmacies would receive a prescription or a standing order from one or more law enforcement agencies along with a voucher from the Pennsylvania Chiefs of Police Association for the required units on naloxone with the nasal atomization device. The licensed drug distributor/pharmacies would invoice the on a monthly basis and receive payment within ten business days of receipt of the invoice. The drug can be mailed or distributed through local outlets. Rev: 1 Page 3 of 5
4 1.3 Pre-proposal Questions Proposers can submit any questions before February 5, Questions may be ed to or mailed to PCPA Naloxone RFP, 3905 N. Front St., Harrisburg, Pa The PCPA will issue written responses, to questions that materially impact upon the proposal documents. 1.4 Conditions of Submission Upon submittal of a Proposal in response to this RFP, the proposer acknowledges and consents to the following conditions relative to the submittal: All costs incurred in connection with submitting a proposal will be borne by the proposer The PCPA reserves the right to eliminate any proposers which submit incomplete or inadequate proposals The PCPA reserves the right to reject any proposals that fail to satisfy the submittal requirements The PCPA reserves the right to reject all proposals. The PCPA reserves the right to accept or reject, at any time prior to the PCPA s execution of a contract (or contracts) pursuant to this RFP, any or all proposals or any part of any proposal and to waive any defect or technicality and to solicit new proposals where the acceptance, rejection, waiver or solicitation would be in the best interests of the PCPA It shall be the proposer s responsibility to review and verify the completeness of its proposal The PCPA reserves the right, without prior notice, to supplement, amend or otherwise modify the RFP at any time The PCPA may request additional information or more detailed information from any proposer at any time, including information inadvertently omitted by a proposer All responses become the property of the PCPA and will not be returned All proposals shall remain open for acceptance and in full effect until at least ninety (90) calendar days from the date of opening of this proposal. 1.5 Preparation Costs All documents proposed in response to this RFP shall be prepared at the sole expense of the proposer, with the understanding that there may be no claims whatsoever for reimbursement from the PCPA for the expense of preparation. 1.6 Errors and Omissions in RFP Proposers will not be allowed to take advantage of any errors or omissions in this RFP and must promptly notify the PCPA of any errors, omissions, and inconsistencies that are discovered Rev: 1 Page 4 of 5

Proposal Submission 2.1 Contact Information Proposer must provide a contact for their proposal including name, address, phone and Cost Proposal The will be purchasing a minimum of $95, worth of naloxone over the next twelve months and potentially more as we seek additional partners. Therefore, licensed drug distributor/pharmacies proposal should provide a fixed cost or address fluctuation in cost over time. 2.3 Completeness and Omissions Vendors must submit a complete proposal. Vendors responding to this RFP must identify any omission that would prevent the successful implementation of their proposal. 2.4 Submission date All proposals must be received no later than February 6, 4:00PM.Proposal may be submitted as an attachment to an to cjbraun@pachiefs.org or sent USPS or other delivery service.
