14 NASN Consensus Statement National Association of School Nurses on Marijuana Legalization School nurses promote wellness and disease prevention to improve health outcomes for our nation s children. It is the opinion of the National Association of School Nurses (NASN) that marijuana is properly categorized by the United States Drug Enforcement Agency (DEA) under Schedule I of the Controlled Substances Act (CSA), 21 U.S.C. 801, et seq. NASN concurs with the DEA that the clear weight of the currently available evidence supports this classification, including evidence that smoked marijuana has a high potential for abuse, has no accepted medicinal value in treatment in the United States, and evidence that there is a general lack of accepted safety for its use even under medical supervision. -March, 2013

15 Synthetic Drugs First detected in the U.S. in 2008, synthetic drugs are perceived as being legal alternatives to marijuana, cocaine, and other drugs. Synthetic cannabinoids (e.g. K2 or Spice ) and synthetic stimulants such as bath salt products are often sold as herbal incense and plant food, respectively, and labeled not for human consumption to mask their intended purpose and avoid FDA oversight of the manufacturing process. One in nine 12 th graders in America reported using synthetic cannabinoids in Most regions have reported that synthetic drugs are readily available.

16 Synthetic Drugs Federal Response: o Synthetic Drug Abuse Prevention Act of 2012 o ONDCP Interagency coordination State Response o Most states have enacted legislation banning synthetic cannabinoids and bath salts. o o o 44 states have passed legislation to control bath salts, and 5 states have instituted permanent bans through regulatory authority. 43 states have adopted laws to control synthetic cannabinoids, and 5 states have instituted permanent bans through regulatory authority. Eighteen of these states have enacted legislative bans that mirror the Federal law by defining synthetic cannabinoids and substituted cathinones broadly. Challenges: o As state and Federal laws ban synthetics, suppliers create new variations to replace the old. o Testing: Testing suspected users is difficult because synthetic substances are not a regular part of most drug tests. Crime labs are challenged with trying to identify an explosion of different synthetic substances. o Internet Sales: Retail and Wholesale
