4 CHAPTER ONE 1. INTRODUCTION In line with Turkey s European Union (EU) accession process, a letter of intent was submitted by the Turkish government in 2000 with a view to ensure Turkey s participation into EMCDDA (European Monitoring Centre for Drugs and Drug Addiction) activities. In the next stage, the Anti-Smuggling and Organized Crime Department (KOM) of the Directorate General for Security (EGM) was authorised by the Prime Ministry to act as the EMCDDA National Contact Point, through an official notice No of 16 May A twinning project to establish a national structure for ensuring Turkey s active participation into EMCDDA activities and for a more efficient struggle against drugs and drug addiction, was launched within the framework of the EU 2002 Pre-accession Financial Assistance Programme. The EU twinning project on Establishment of Turkish Monitoring Centre for Drugs and Drug Addiction, Development and Implementation of National Drugs Strategy was implemented between 25 August September The Turkish Monitoring Centre for Drugs and Drug Addiction (TUBIM) was established upon the approval of the Prime Ministry and launched its activities in 2002 under EGM- Department of KOM, as an output of this twinning project. The National Policy and Strategy Paper on Combating Drugs and Drug Addiction is yet another important output of the EU twinning project. The paper covering a period of was prepared under the leadership of TUBIM with the input and upon agreement of relevant agencies; and was accordingly signed by the Prime Ministry on 20 November 2006 and was put into effect. This strategy paper encompasses targets to be met within All the actions needed to be taken for attaining those targets have been specified in a detailed manner in the action plan, as stated in the strategy paper. The period of Turkey s First National Action Plan, which covers and which was prepared with the input and upon agreement of all the relevant agencies and units, has now expired. Upon the completion of First Twinning Project, another EU project on Strengthening Turkish Monitoring Centre for Drugs and Drug Addiction covering was prepared in 2007 in order to strengthen Turkey s legal, institutional and technical capacity for fight against drugs. In the scope of the project, some activities were made on the evaluation the First National Plan and preparation of the Second National Plan. During the meetings that were held with the participation of international experts and the authorized staff of the relevant agencies, the Second National Plan covering was prepared with the contributions and agreement of all relevant agencies. As in the case of the First National Action Plan, the primary objective of the Second National Action Plan is to prevent use of illicit drugs amongst people and drugrelated crimes, to reduce harmful effects of drugs on people and public health and to improve treatment facilities. The Accession Partnership Documents, National Programmes and Progress Reports prepared in the course of the Turkey-EU accession process do also refer to the preparation of a National Strategy and Action Plan as well as

5 enhancing the administrative capacity of the Turkish Monitoring Centre for Drugs and Drug Addiction. In this respect, the action plan will eliminate the deficiencies in this area. The First National Action Plan has adopted a balanced approach both towards demand reduction in illicit drugs as well as prevention of drug-trafficking and street supply. The activities set forth in the First National Action Plan, which was prepared in line with the National Policy and Strategy Paper on Combating Drugs and Drug Addiction under the leadership of TUBIM with the joint efforts and upon agreement of KUTEMs (Institutional Focal Points), are envisaged to be carried out on specified dates as coordinated by the specified liable agencies. Unlike the First Action Plan, no coordinator agency was appointed in the Second National Plan. So, things have come in line with both the EU Action Plan and the Action Plans of many other EU Member States. Also, possible hesitations have been prevented that may emerge regarding the issues that require the coordination of more than one agency. As activities foreseen within the framework of the First National Action Plan covering are being implemented, the Second National Action Plan to cover is to be prepared in the light of emerging needs and upon the evaluation of the First National Action Plan Purpose The purpose of this action plan is to ensure planning of struggle against drugs and drug addiction including prevention and protection measures against drug-trafficking and drug abuse as well as treatment, rehabilitation and reintegration in drug addiction in line with the National Policy and Strategy Paper on Combating Drugs and Drug Addiction covering , in compliance with the EU acquis, in conformity with the EU Drugs Strategy and Action Plan, at national level while having an international effect. The objectives and targets of the Second National Action Plan, which will in turn help with the evaluation of the National Strategy outputs, are listed down as follows: 1. National Coordination Council which was established for combatting drugs and drug abuse will continue its activities. 2. To establish and ensure operation of a multi-disciplinary structure. 3. To protect and improve public health against drugs, to ensure demand and supply reduction and to prevent drug abuse. 4. To encourage more effective measures to be taken so as to prevent the entry of illicit drugs into the country. 5. To encourage participation of all relevant combating agencies and units in a more effective struggle against drug abuse and addiction. 6. To ensure that the entire national data collection is carried out by TUBIM, and to analyze and publish country evaluation in the form of reports. 7. To enhance capacity and accessibility of national treatment units or centres.

6 8. To conduct required researches on priorities, to identify priority fields of action in the light of these findings. 9. To strengthen information infrastructure and national information network. 10. To raise public awareness amogst people on the dangers of drugs through education and information campaigns. 11. To increase efficiency and quantity of operational and other types of activities geared towards combating illicit trafficking in drugs. 12. To develop multi-dimensional activities at national and international level. 13. To efficiently support the cooperation developed in the course of the European Union process so that the cooperation would gain a dynamic and functional structure serving for common benefits. 14. To help with strengthening of TUBIM in an organizational aspect, which is in charge of the preparation and coordinating the implementation- of national strategies. 15. To ensure that the culture of joint work and sharing is perceived as an indispensable system for a successful combat. 16. To ensure development of community-based combat. 17. To evaluate the outcome of all the activities to be carried out for achieving the objectives and targets. The abovementioned measures are expected to satisfy the following criteria: 1. Measures to be taken should have a clear contribution in the combat; the outputs of measures should be realistic and measurable. 2. Measures should contribute in achieving the targets or priorities set forth in the Strategy. 3. The quantity of measures to be taken in each field should be realistic. 4. Measures should be feasible and applicable; they should yield tangible outputs as a result of the evaluation Scope The Second National Action Plan ( ) encompasses a number of agencies being currently engaged in combating drugs and drug addiction in the framework of conformity with the EU acquis or agencies to be engaged in the future during Turkey s European Union accession negotiations and the further stages of the membership process. These agencies are listed as follows: 1. Other agencies and organizations operating in the field of fight against drugs, drug abuse and addiction (public and private) Priorities of Action Plan The priorities of the First National Action Plan include the priorities set forth in the National Policy and Strategy Paper on Combating Drugs and Drug Addiction and are listed below: 1. Reduction in demand and supply of substances,

8 2. Balanced execution of operations towards reducing the demand and supply of substances 3. Sustaining the combat in an effective manner, 4. Increasing necessary measures to prevent entry of drugs into the country as a part of the struggle for supply reduction, 5. Protection of risk groups, 6. Creation of a capacity that will contribute in combating and prevention activities through informing public about the existing threats, 7. Fostering values, attitudes and behaviours that are for the benefit of community, 8. Developing official, voluntary and private institutional structures with a view to prevent illicit trafficking in drugs and drug abuse, 9. Strengthening the structure and operation of existing units in all sectors in all aspects, 10. Enhancing the capacity and functionality of the Turkish National Contact Point in the scope of all relevant activities at national and international level, 11. Improving scientific and technologic hardware and equipment, 12. Increasing the quality and quantity of human resources, 13. Putting into practice all the abovementioned efforts and structures in compliance with the common policy and strategy Definitions about Combating Drugs and Drug Addiction Supply Reduction: Any activity or effort to prevent the supply of illicit drugs to individuals including trafficking at national and international level as well as street supply. Addiction: The state of continuing drug intake and the failure to stop the desire for drug intake despite the physical, psychological and social problems arising from use of drugs that are leading to a fake state of euphoria. Drug: Any natural or artificial substance not vital or essential for living, which affects neurological functions and overall body structures, leads to permanent changes in organ systems, creates psychological and behaviour disorders and evokes a fake state of euphoria, which is not essential for life. ILTEM: TUBIM contact persons and liaison officers who are working at Sections for Monitoring and Preventing Drug Abuse which is inside the provincial KOM/narcotics units which reports to EGM KOM Department, and who have previously got the Fundamental Training on Fight against Drug Abuse and who provide services of raising awareness which are needed in their respective regions and areas.

9 KUTEM: Public agencies and organisations, local authorities and non-governmental organisations that provide data to TUBIM and take part in TUBIM activities. Drug Abuse: The pattern of drug consumption by an individual in terms of quantity, frequency and duration, regardless of an existing drug addiction. Drug abuse can also be explained as all kinds of use of illicit drugs and use of legal drugs outside the scope of their intended purpose in an uncontrolled manner. Liable Party(Parties): Public agencies/organizations, which contribute to the activities to be performed in accordance with the Action Plan, or which perform the activities on its own behalf. Demand Reduction: The act of reducing an individual s demand for drugs and keeping him/her from such drugs. Drug: Any substance which, when taken in certain amounts, affects the nervous system and causes mental, physical and physchological balance, causes economic and social collapse within a person or amongst society, leads to addiction and are not according to the law- allowed to be used, possessed or sold. 2. BACKGROUND/ JUSTIFICATION 2.1. Importance of Combating Drugs and Drug Addiction Drugs and drug abuse, just as in all other countries, is one of the problems in our country which requires priority. Our country welcomes and support national and international cooperation in supply reduction, demand reduction, treatment and rehabilitation activities. Turkey officially recognises the supply of illicit drugs as a crime against humanity and considers drug addicts and abusers as patients in need of treatment. Being a transit country for various drugs, Turkey has also become a destination country for drug abuse, ecstasy in particular, due to its geographical position. There is an observed increase in drug-related crimes, the number of incidents, and accordingly the number of detained suspects and the quantity of seized drugs and narcotics. The Constitution of Republic of Turkey also refers to the necessity and significance of combating drugs. Article 58 of the Constitution, which reads as, The State shall take relevant measures to protect young people from alcohol and drug addiction, from criminal activities, gambling and similar vicious practices habits as well as illiteracy, acknowledges it as an obligation for the state to protect young people against hazardous activities including smoking, alcohol, drugs /volatile substances and gambling. The multi-dimensional nature of this problem requires a combat involving a multitude of actors, with a more effective cooperation and coordination among relevant agencies. Our country, which already has a highly effective struggle programme for fight against supply, also needs to create a better national coordination structure in the field of prevention and other relevant fields. This necessity has been repeatedly underlined in the

10 Accession Partnership Document and the EU Regular/Progress Reports prepared in the course of Turkey s EU accession; the lack of a National Drugs Strategy and Action Plan Document as well as appointment of a national drugs coordinator was also pointed out. A big deficiency in this field has been substantially eliminated along with the Strategy Paper taking effect on November 20, 2006, and it is aimed that a strong foundation should be provided for national coordination through the Action Plans, prepared in compliance with the Strategy. In accordance with the First Action Plan, a Scientific Board And Coordination Council was created, thus an important step has been taken. Additionally, Provincial Coordination Boards against Drugs were created in 80% of all provinces and coordination at provincial level became possible, thus, required support -at provincial level- to the national struggle has been provided Accession Partnership Document Under the heading Cooperation in the Fields of Justice and Home Affairs in Short- Term in the Fourth Chapter of the Accession Partnership Document which was ratified on 14 April 2003 for Turkey, a reference has been made to Continuing to strengthen the fight against organised crime, drugs, trafficking in persons, forgery, corruption and money-laundering, particularly through legislative alignment, improved administrative capacity and enhanced cooperation between various law-enforcement bodies. Under the heading The Fields of Justice and Home Affairs in Middle-Term ; the following are envisaged The financial interests of Euro and of the Community should be protected in the framework of criminal law, adoption and implementation of acquis in the fields of corruption, fight against drugs, organized crime, money laundering, and judicial cooperation in criminal and civil matters; further strengthening the administrative capacity and the cooperation between the various law enforcement bodies and intensify international cooperation in these fields as well as Development and implementation of a national drug strategy in line with the EU Drugs Strategy And Action Plan. In paragraph 3.1 of the Accession Partnership Document approved by the EU Council on 23 January 2006 for Turkey, it is envisaged - under the heading of Ability to assume obligations of membership Justice, Freedom and Security of the chapter Short-Term Priorities- that the fight against organised crimes, drugs, trafficking in persons, fraud, corruption and money-laundering should be strengthened and a national drug strategy should be prepared and implemented in line with the EU Drugs Strategy and Action Plan. whereas in paragraph 3.2., section Medium-Term Priorities, Ability to assume obligations of membership Justice, Freedom and Security heading, it is envisaged that Strengthening the national focal point in the field of drugs should continue, and the acquis should be adopted and implemented in the fields of corruption, fight against drugs,

11 organised crime, money laundering, judicial cooperation in criminal and civil matters, criminal law protection of the euro and of the Community s financial interests. The main heading of Priorities of the Accession Partnership Document approved by the EU Council on 23 January 2006 for Turkey, includes the statement; National Strategy about Organized Crime should be put into application. There should be inreased fight against organized crime, drugs, human trafficking, fraud, corrupton and money laundering under the heading Ability to assume obligations of membership Justice, Freedom and Security, in the chapter of Short-Term Priorities Turkish National Programme for the Adoption of EU Acquis Communautaire "Turkish National Programme for the Adoption of EU Acquis Communautaire as well as the Decision on the Implementation, Coordination and Monitoring of the Turkish National Programme for the Adoption of of EU Acquis Communatuaire were approved by the Cabinet on 23 June 2003 upon the Ministry of Foreign Affairs letter no of 19 June The Legal Alignment Schedule No 2, under the heading Priority Adoption and Implementation of the EU Acquis in the Field of Fight against Drugs, as a part of the priority list in the field of Justice and Home Affairs of the National Programme published on 24 July 2003 in the Official Gazette numbered 25178, envisages the Ministry of Interior to make necessary legal amendments in compliance with the Council Regulation (EEC) No 302/93 of February 1993 on the establishment of a European Monitoring Centre for Drugs and Drug Addiction, Council Regulation (EC) No 3294/94 of 22 December 1994 amending Regulation (EEC) No 302/93 on the establishment of the European Monitoring Centre for Drugs and Drug Addiction and the Council Regulation (EC) No 2220/2000 of 28 September 2000 amending Regulation (EEC) No 302/93 on the establishment of a European Monitoring Centre for Drugs and Drug Addiction. In this respect, as stated in the Institutional Structuring Schedule for Legal Alignment and Implementation, the Directorate General for Security affiliated to the Ministry of Interior envisages to strengthen the capacity of European Monitoring Centre for Drugs and Drug Addiction National Focal Point so that the Focal Point will be able to fully perform its expected function and duties and to develop a national drugs strategy in compliance with the EU Drugs Strategy and Action Plan Regular/Progress Reports 2007 Progress Report states that Progress has been made in fight against drugs. In November 2006, a National Strategy was accepted which is in conformity with EU Drug Strategy and EU Drug Action Plan Some successful operations were conducted by the Turkish Police in cooperation with some member states and other

12 states, which were followed by seizure of substantial amounts of drugs. Shared actions continued regarding the delivery under control. Human resources of National Drug Center (Reitox Focal Point) were strengthened. An information and document center for drugs were put into operation. Turkey submitted its national report to the European Monitoring Center for Drugs and Drug Addiction (EMCDDA). Accepting an action plan towards the implementation of a new National Strategy for Fight against Drugs, and making progress in demand reduction and data collection are the key issues. Strengthening the human resources of National Drugs Centre is of importance. The capacity of curing centers is not sufficient. When fully participated in the activities of the European Monitoring Center for Drugs and Drug Addiction, Turkey will need to develop a data collection network which is in conformity with the EMCDDA standards. The cooperation amongst the relevant agencies should be strengthened. Turkey has submitted its willingness to become a member in the Central Dublin Group. No progress has been made regarding the establishment of a mini-dublin group in Ankara 2008 Progress Report states that Some progress has been made in fight against drugs. Upon the acception of a National Strategy which is in conformity with the EU Drug Strategy and EU Drug Action Plan , an Action Plan ( ) was put into effect. Reitox National Focal Point is the coordinator of the Action Plan and chairs the quarterly meetings of coordination board in order to monitor the implementation. The agreement on Turkey s participation into the European Monitoring Center for Drugs and Drug Addiction was signed. It is of utmost importance that Turkey should take required steps shortly after the approval of the agreement- in order the agreement to be put into practice with no delay. A parliamentary commission was established in order to examine the problems related to drug addiction and reduce the supply of those substances. Some successful operations were conducted by the Turkish Police, which resulted in seizures of drugs in substantial amounts. Shared actions were made with regards to controlled delivery, however, the powers of National Drug Center are limited and the human resources is weak. Also, it still does not have an autonomous budget. There is the need for a more balanced approach towards reduction in supply and demand by means of strengthening inter-agency cooperation, creating a network of centers of treatment and rehabilitation, developing the system of data collection. As Turkey is an important transit country, drug problem is continuing to remain as a serious problem 2009 Progress Report states that Some progress has been made in fight against crime. The coordination board and the Scientific Committee has continued to meet quarterly. Action plans at provincial leves were accepted in the provinces of Aksaray, Edirne, Kırklareli, Kırıkkale, Kütahya, Osmaniye, Sakarya, Sinor, Tunceli,

13 Yozgat and Kastamonu. The relevant Parliamentary Commission submitted a report in November 2008 covering the recommendations in organizational and legal aspects on fight against drugs and reduction in demand for drugs. The Turkish Law Enforcement conducted eight operations in which kg or opium and kg of heroin were seized, and they have continued with their joint operations about deliveries under control In October 2008, Reitox National Focal Point was developed in the form of a Section which is directly affliated to the Department of Anti-Smuggling and Organized Crime of the Turkish National Police, however, the human resources capacity of the unit is quite small and it still lacks an autonomous budget. The agreement on Turkey s Membership to the European Monitoring Center for Drugs and Drug Addiction has not been ratified yet. A balanced approach has not been maintained yet between the reduction in supply and demand of drugs. Prevention, treatment, rehabilitation facilites should be developed further 2.5. National Policy and Strategy Paper on Combating Drugs and Drug Addiction The National Policy and Strategy Paper on Drugs and Drug Addiction ( ) was prepared by taking into consideration the opinions of the EU experts and relevant agencies from our country and was accordingly approved by the Prime Ministry taking effect on 20 November The Paper consists of various chapters on General Policy, Coordination, Policy- Related Issues (Demand Reduction, Supply Reduction, International Cooperation, Data Research, and Evaluation), Action Plan, Evaluation Methods, Conclusion, Effect and Enforcement principles.

14 CHAPTER TWO 1.COORDINATION General purpose: To maintain the activities of fight against drugs under the coordination and cooperation of a single center, supported by the relevant national and international agencies and organizations, and with an understanding of simultaneous harmony between enlargement and deepening. 15 4- Catch-up and evaluation meetings will be organized at least once in a year for NGOs which work in the field of substance addiction and drug abuse. - TUBIM - NGOs National Report 5- Annual reports to be prepared by TUBIM and the international developments will be presented to the political authority and to other relevant parties. - TUBIM National Report 2- Maximum conformity to EMCDDA standards during the activities. 6- Working groups established under the roof of TUBIM in line with EMCDDA will come together at least once in a year under the presidency of National Experts of Working Groups. - TUBIM - KUTEMs Constantly -National Report 7- EWS(Early Warning System) which was established with the aim of monitoring the recently emerged drugs will come together twice a year. - TUBIM Justice(Forensic Medicine) Health (General Directorate of Pharmacy and Pharmaceuticals) - EGM - JGK - GMGM - SGK Constantly -National Report

The boards will come together unde the chairmanship of the Asistant Governor and will include the participation of one representative from the the following units; from the Municipality, fom the Provincial Directorate of Healt, from the Pronvicial Directorate of Education, from the TUBIM provincial Contact Points, from the Provincial Command of Gendarmarie, from the Provincial Directorate of Youth and Sport, from the Pronvicial Directorate of Social Services, from the Section of Controlled Freedom and Assistance Center, from the universities, Non-Governmental Organizations and other agencies and organizations to be determined optionally by the Chief of the Board which are located in the relevant province. Upon the approval of the Chief of the Board, the secretary services will be performed by the Provincial Directorate of Health. The report to be prepared every six months by the agency that performs the secretarial services will be submitted to the Headquarters, and then the Headquarters will submit the report to the TUBIM. 18 2. DEMAND REDUCTION General purpose: A measurable reduction is targeted regarding drug abuse, addiction and health as well as social risks related to drugs. In this framework, the purpose is to fight against demand in all aspects and to maintain a balanced approach between the supply and the struggle of police against it. The nongovernmental organizations will be guided for a more-productive use of resources related to the issue. 16- Efficient Parents Training Program, consisting of eight modules and being intended for raising awareness amongst parents with children aged (7-19), will continue. 17- Training program on Skills for Living which is based on the education from peer to peer will be developed and its implementation will continue. 18- Treatment centers for drug addiction will be improved in terms of quantity and quality. In addition to the treatment centers for adolescents, the numbers of treatment centers for children will be increased.
