1 Peoples Community Health Clinic 905 Franklin Street Waterloo, IA Manual: Human Resources Page 1 of 5 Subject: Drug-Free Workplace Code Purpose: To establish and maintain a safe and productive drug and alcohol-free work environment. Policy: Peoples Community Health Clinic prohibits the use and/or possession, sale, purchase, manufacture, distribution, and dispensation of intoxicants, including alcohol or controlled substance (drugs), other than over-the-counter drugs or lawfully-prescribed drugs, on Corporate premises (including all work sites) or in Corporate vehicles during work hours, including breaks and meal periods, whether on or off site in accordance with Wheaton Franciscan Services, Inc.(WFSI) policy. People s Community Health Clinic reserves the right to test for the use of alcohol, drugs, or other controlled substances. Testing is conducted as outlined in the WFSI Substance Abuse Program with the following exception: People s Community Health Clinic does not conduct blood alcohol testing. Blood alcohol testing is done only at the request of a medical care provider as needed for treatment. This policy applies to all employees, contractors, visitors, volunteers, auxilians, and applicants. The types of testing performed by Peoples Community Health Clinic include: Pre-placement screening for job applicants Post-accident screening for current employees involved in a work accident meeting guidelines specified in policy Reasonable cause screening: o Based upon evidence that en employee is under the influence of a controlled substance or alcohol while at work. o Pursuant to an investigation relating to drug theft, diversion or other transfer Post-treatment screenings as a condition of a return to work program Designated Management Official (DMO): Director of Medical Services Senior Accountant Executive Director Medical Review Officer (MRO): Dr. David Kirkle, Occupational Health Partners, Sartori Hospital

2 Procedure: See Flowchart and Quick Reference guide, page 3 Enforcement: Security staff is empowered to conduct a search, and arrest employees who are believed to have participated in the illegal use, possession and/or distribution of drugs or alcohol. Such a search may result in the detention of an employee when, in the officer s opinion, a felony has been committed. Re-employment: Employees who are terminated for violation of this policy may re-apply after 12 months. Applicants who do not successfully complete the pre-placement process may re-apply after 12 months. Approval Date 04/2003 Original Date 12/99 Revised Date 03/03

I agree to abide by the terms outlined in my employer s policy regarding maintenance of a drug-free workplace. These policies entitled: Substance Abuse Program from Wheaton Franciscan Services, Inc. and Drug-Free Workplace policy from PCHC. Signed Date C: Human Resources file

4 Procedure Flowchart Page 3 of 5 Reasonable Suspicion and Post-accident Testing Testing is considered based on incident / behavior. Manager reviews policy and contacts a Designated Management Official (DMO). Is reasonable cause established or have post-accident guidelines been met? NO Determine appropriate action and pursue. END Document observations and reasons for screening. Review Quick Reference Guide to proceed with testing. Place employee on suspension with regular pay pending the results. Is result positive? NO Pursue action Appropriate to behavior. Refer Employee to EAP if necessary. END Refer to page 4 Page 4 of 5

5 Page 3 Continue suspension using paid leave hours until employment status is determined. DMO sends certified letter to employee regarding results, employee s right to obtain a confirmatory test and availability of EAP program. Positive for alcohol: Greater than or equal to.04 gm/210l breath or its equivalent. Positive for controlled substances. Has employee completed 12 months of employment NO Immediate within the preceding 18 Discharge. months? END Has the employee previously violated the substance abuse policy? NO Page 5 Page 5 of 5

6 Page 4 Refer employee to EAP ( hrs/day) for evaluation and treatment plan. Place employee on medical leave of absence pending recommendations of treatment program and successful completion. (Position is held for 12 weeks of FMLA leave) Does employee successfully complete treatment NO Immediate Discharge program? END Return to work following recommendations of treatment program. Drug screens are provided for Peoples Community Health Clinic by Occupational Health Partners at the following location: Kimball Ridge 7am 5pm Sartori Memorial Hospital 7am 5pm Covenant Clinic Oelwein 8am 7pm MWF 8am 5pm Tu, 8am 8pm Th Convenient Care 1pm 9pm Daily After the hours posted above, employees are referred to the Lab at Covenant Medical Center and the Emergency Room at Sartori Memorial Hospital and Mercy Hospital in Oelwein.
