THE COURT DECLINED THE OFFER FOR THE REASONS STATED ON THE RECORD, BUT WANTED TO GIVE THE PARTIES AN OPPORTUNITY TO PROVIDE INPUT. THE PARTIES GENERALLY AGREE WITH THE COURT. ACCORDINGLY, CHMIP HAS ASKED THE PARTIES TO OBTAIN AN ORDER FROM THE COURT STATING THAT ANY PHYSICIAN-PATIENT/PSYCHOLOGIST-PATIENT PRIVILEGE HAS BEEN WAIVED PURSUANT TO SECTION (2)(A), C.R.S. (2012). THE DEFENSE HAS PREPARED A PROPOSED ORDER, WHICH IT TENDERS TO THE COURT. THE PEOPLE DO NOT OBJECT TO THE PROPOSED ORDER, BUT ASKS THAT THE ORDER BE SUPPRESSED SO THAT IT IS NOT ACCESSIBLE TO THE PUBLIC. THE DEFENSE LIKEWISE ASKS THAT THE ORDER BE SUPPRESSED.
