Ths matter s beng brought to Commttee and Councl gven the hstory of ths ste and Councl's prevous drecton concernng mprovements to the drve-through. Attachment No.1 s a map showng the subject ste and zonng for the area. Attachment No.2 s a copy of the 1992 ste plan whch formed part of the orgnal ste plan. agreement for the ste. ' Attachment No. 3 s a copy of a 2010 ste plan prepared by Tm Horton's showng a proposed sngle stacked drve-through desgn. Ths ste plan was prepared to address vehcle stackng ssues on the ste and was endorsed, n prncple, by Councl n Ths ste plan now forms part of the amended ste plan agreement but has never been mplemented. 2 Report to the Development Item: Servces Commttee (Contnued) 2 - Meetng Date: June 7, RECOMMENDATION That the Development Servces Commttee recommend to Cty Councl: That, pursuant to Report DS dated May 31,2012 and representatons from Tm Horton's, the 2012 ste plan generally shown on Attachment No. 4 to sad Report submtted by Tm Horton's for 1251 Smcoe Street North be endorsed n prncple n order to mprove the drve through queung desgn and reduce traffc safety ssues on Smcoe Street North. 3.0 EXECUTIVE SUMMARY Ths Report recommends endorsement, n prncple, of a revsed 2012 ste plan (Attachment No.4) whch s ntended to mprove vehcle stackng and safety concerns assocated wth the Tm Horton's restaurant at 1251, Smcoe Street North. 4.0 INPUT FROM OTHER SOURCES 4.1 Regon of Durham The Regon has revewed the proposed 2012 ste plan shown on Attachment NO.4 and s satsfed that t wll sgnfcantly mprove the operaton of the Smcoe Street North drveway and reduce traffc safety ssues on Smcoe Street North. 4.2 Audtor General The Audtor General. does not provde comments on reports of ths nature ANALYSIS 1251 Smcoe Street North s owned by Ontaro Ltd. Tm Horton's s a tenant n the plaza. Smcoe Street North, abuttng the subject ste, s under the jursdcton of the Regon of Durham (Regon). In the early 1990's, the Tm Horton's drve-through restaurant at 1251 Smcoe Street North opened based on a 1992 ste plan whch forms part of a ste plan agreement and only ncludes sx (6) dedcated vehcle queung spaces plus addtonal queung spaces.n the parkng asle and drveway (Attachment No.2). 57

3 Report to the Development Item: Servces Commttee (Contnued) Meetng Date: June 7, 2012 Snce 1992, Tm Horton's drve-throughs have become ncreasngly popular and n certan cases have "over-splled" stes and created on-street traffc safety ssues. In 2000 a study by SRM Assocates on behalf of Oshawa, the Regon and other local muncpaltes, revewed drve-through restaurants, ncludng certan Tm Horton's restaurants. SRM recommended that new drve-throughs contan a mnmum of 12 queung spaces (8 spaces before the menu order board and 4 spaces between the menu order board and the pck-up wndow). In addton, SRM recommended that queung spaces should not be located n asles whch are used to access parkng spaces and whch provde general vehcular crculaton. In 2001 the Cty and Regon began recevng complants concernng safety ssues as a result of the vehcle queung for the drve-through backng up onto Smcoe Street North. In addton, there have been complants that "access to the other uses/tenants n the plaza s restrcted due to the vehcle queung ssues related to the Tm Horton's drve-through. On March 25, 2010 Tm Horton's, wth the support of the owner, submtted an applcaton to amend the exstng ste plan agreement to mplement a sngle stacked queung desgn shown on Attachment NO.3. The 2010 ste plan was ntended by Tm Horton's to address vehcle stackng ssues and ncreased the number of on-ste queung spaces from 12 to 25 ncludng queung spaces n the parkng asle and drveway. Both the Regon and ths Department supported, n prncple, the 2010 ste plan showng as ts mplementaton would mprove the drve-through queung on-ste and would reduce the potental for vehcle back up onto Smcoe Street North. On June 28, 2010 Cty Councl endorsed n prncple the 2010 ste plan (Attachment No.3). The ste plan agreement was amended to nclude the 2010 ste plan. But t has not been mplemented/constructed by the owner or Tm Horton's. In May 2012 Tm Horton's submtted a new 2012 ste plan showng a prmarly sngle stacked drve-through wth double order boards and related lanes (Attachment No.4) and requested that the 2012 desgn be mplemented nstead of the Councl approved 2010 ste plan. Tm Horton's beleves that the restaurant at 1251 Smcoe Street North s a good opportunty to mplement ts new double order board staton, as explaned n Attachment NO.5. 58

4 Report to the Development Item: DS Servces Commttee (Contnued) Meetng Date: June 7, 2012 );> Accordng to Tm Horton's, mmedate and sgnfcant mprovements have been realzed at other stes that modfed the drve-through stackng lane to ncorporate double order board statons. );> The key dfferences between the 2010 ste plan approved by Councl n 2010 (Attachment No.3) and the new 2012 ste plan (Attachment No.4) are as follows: The drveway entrance from Smcoe Street North s no longer proposed to be shfted north. The 2012 ste plan retans the exstng drveway access and the exstng parkng on the north sde of the drveway throat. The total number of queung spaces wthn the dedcated drve-through lane(s) s ncreased from 11 to 16. SRM recommended a mnmum of 12 dedcated queung spaces. The number of queung spaces between the menu order board and the pck-up wndow s ncreased from 3 to 4 and now comples wthsrm's recommendatons. The number of queung spaces that can be accommodated between the pck-up wndow and Smcoe Street North would decrease from 25 to 21. The 2012 ste plan has 3 less parkng spaces than the 2010 desgn capacty but the overall ste comples wth the number of parkng spaces requred by the Zonng Bylaw. The 2012 ste plan proposes an outdoor pato area. );> Both the Regon and ths Department support, n prncple, the 2012 ste plan (Attachment No.4) and Tm Horton's representatons that t wll mprove the current ssues assocated wth the vehcle stackng. );> Detals of the revsed ste desgn can be addressed durng the processng of any amendment to the ste plan agreement n the event Councl approves n prncple the 2012 ste plan. );> Queung onto Smcoe Street North may stll occur durng peak perods or when drvers are watng for others to enter or ext the parkng spaces adjacent to the man drveway throat off of Smcoe Street North. 6.0 FINANCIAL IMPLICATIONS );>.There are no fnancal mplcatons 59

("TDL") s the operator and lcensor of the Tm Hortons system of restaurants n Canada and s responsble for ste development ntatves such as new restaurants, renovatons or specal projects across the chan. At ths tme, TDL s pursung mnor drve-through ste alteratons through our natonal Double Order Staton ("DOS") program to mprove the effcency of our exstng drve-throughs. In support of the DOS program, TDL has created a specal project team whom n 2012 s responsble for revewng elgblty at all exstng Tm Hortons restaurants wth drve-throughs across Canada and assessng each ste to determne f t can physcally and techncally accommodate a DOS. In addton, our team has been lasng wth local restaurant owners to ensure ther needs, as well as those of ther customers' are beng met. TDL has been retanng consultants throughout Canada n support of the DOS program. Ths ongong revew has determned that the restaurant locaton reflected on the enclosed applcaton wll beneft from a DOS. The DOS program ams to mprove the effcency of the Tm Hortons drve-through operaton by slghtly alterng the exstng drve-through wth the addton of ether a Sngle Double Drve-Thru or a Double Double Drve-Thru order staton confguraton resultng n potental smultaneous order takng. Addng a DOS system at a restaurant results n an ncrease to the stackng capacty and by relocatng the order staton from the 4th car poston to the 6 th and h car postons (some cases slghtly dfferent due to ste condtons), t allows addtonal tme for restaurant "team members" to prepare orders, reducng the guest's tme at the pck-up wndow. As a result of dual orderng, and ncreased preparaton tme, the DOS ncreases effcency by mantanng a flled stackng lane between the order staton and the pck-up wndow. Not only does the DOS program mprove drve-through effcency, but t also ntroduces new technologes to the restaurants; mproved operatonal standards; and standardzed nternal work flow, all leadng to mproved team work experences and the publc's experence as our guest. A secondary beneft of the DOS ntatve s to brng older restaurants n-lne wth DOS standards for new restaurants, creatng greater consstency throughout the Tm Hortons chan. 1 65
