This letter advises NHS Boards of the publication of an amendment to the Statement of Dental Remuneration (SDR), Amendment No 93, which takes effect from 1 April It also asks NHS Boards to complete and submit a return on salaried dentists and joint CDS/GDS appointments. Background 2. Agreement has been reached with representatives of the dental profession on new allowances for salaried dentists employed by NHS Boards. Details of the new allowances are contained in the amendment to Determination II (rates of remuneration for a salaried dentist and the provision of emergency dental services) brought into effect by Amendment No 93 to the SDR attached to the Memorandum to this letter. 2 4. Responsibility for paying the new allowances to the salaried dentists will rest with NHS Boards. The allowances should be paid monthly in arrears. These allowances can be re-charged to the GDS budget, via Practitioner Services, in the normal way. 5. It has also been agreed that a pro-rata recruitment allowance (Part IV of Determination II of the SDR) should be payable to those dentists who are employed as salaried dentists either within 3 months of completion of training (as defined in Determination II) or who are not currently employed, except as a locum, in the salaried service, ie either as a salaried dentist or as a dental officer within the community dental service. The amount of allowance to be paid should be calculated on the basis of a wholetime week of 37 hours. This amendment is also brought into effect by Amendment No 93 to the SDR attached to the Memorandum to this letter. 6. In order that the Scottish Executive has an up-to-date picture of the number and distribution of salaried dentists, salaried plus bonus dentists and joint CDS/GDS appointees, all NHS Boards are asked to complete the return attached at Annex B for staff in these categories of employment as at 31 October Action 7. NHS Boards are asked to: note the information about the new allowances for salaried dentists contained in the Annex A to this letter and make any necessary backdated payments; note that eligible part-time salaried dentists are entitled to a pro-rata recruitment allowance and make any necessary backdated payments; copy and distribute the attached Memorandum and Amendment No 93 to the SDR to all salaried general dental practitioners employed by them; and send completed returns to Lynne Morrison by 22 November Nil returns are required. 3 ANNEX A TO NHS: 2004 PCA(D)9 Out of Hours Allowance Part V of Determination II 1. This allowance is payable to those salaried dentists, including senior and specialist, who provide, to the extent required by the NHS Board, out of hours emergency treatment to registered patients or take part in out of hours rotas to provide such treatment. 2. The amount of the allowance is determined by the number of dentists who provide the out of hours cover. Those dentists who provide out of hours emergency treatment singlehanded will receive a higher allowance than those who take part in out of hours rotas. This is to reflect the extra commitment of those who provide cover single-handed. The allowance to be paid to those dentists taking part in out of hours rotas will be on a sliding scale depending on the number of dentists taking part in the rota, the more dentists that take part, the lower the payment. Again this is to reflect the level of commitment of those who provide out of hours emergency cover in rotas. 3. A single-handed salaried dentist will be entitled to an allowance of 4,500 per annum. Those dentists taking part in an out of hours rota will be entitled to: Band No of Dentists in rota Allowance High 2 4 3,500 Medium ,500 Low > 10 1, The appropriate allowance should be paid by NHS Boards to each salaried dentist providing, to the extent required by the NHS Board, out of hours emergency cover on or after 1 April The allowance should be paid monthly in arrears. Remote Areas Allowance Part VI of Determination II 5. This allowance is payable to those salaried dentists, including senior and specialist, who are classed as remote dentists. A remote dentist is a dentist who has to travel 90 minutes of more, as determined by the Microsoft Auto-Route 2002 package (using default settings), by car from the address at which he is employed as a salaried dentist to his local postgraduate education resource centre in Scotland. 6. The amount of allowance to be paid to a remote dentist will be 3,000 per annum on employment rising to 6,000 per annum after 3 years continuous employment as a remote dentist. 7. Those salaried dentists employed prior to 1 April 2004 who are remote dentists will have their previous service taken into account when determining the level of allowance which they should receive from 1 April Salaried dentists employed otherwise than full-time as remote dentists are entitled to a pro-rata allowance calculated on the basis of a whole-time week of 37 hours. abcde abc a 1 LM

The appropriate level of allowance should be paid by NHS Boards to each salaried dentist classed as a remote dentist employed by the Board on or after 1 April The allowance should be paid monthly in arrears. Only one allowance is payable to a salaried dentist in a year. Vocational Training Allowance Part VII of Determination II 10. This allowance is payable to basic grade salaried dentists who supervise vocational trainees employed by the NHS Board. It is not payable to senior or specialist salaried dentists. 11. The amount of the allowance to be paid is 3,400 per annum. Where a salaried dentist supervises a trainee otherwise than full-time, eg if 2 salaried dentists supervise 1 vocational trainee between then, then the salaried dentist will receive a pro-rata allowance calculated on the basis of a full-time week of 37 hours. 12. The allowance should be paid by NHS Boards to each basic grade salaried dentist supervising a vocational trainee on or after 1 April The allowance should be paid monthly in arrears. abcde abc a 2 LM

8 SALARIED DENTISTS NATIONAL HEALTH SERVICE GENERAL DENTAL SERVICES MEMORANDUM TO NHS: 2004 PCA(D)9 AMENDMENT NO 93 TO THE STATEMENT OF DENTAL REMUNERATION RATES OF REMUNERATION FOR A SALARIED DENTIST 1. This Memorandum advises of the publication of an amendment to the Statement of Dental Remuneration (SDR), Amendment No 93, which takes effect from 1 April Agreement has been reached with representatives of the dental profession on new allowances for salaried dentists employed by NHS Boards. The new allowances will be payable for those: salaried dentists providing out of hours emergency treatment; salaried dentists classified as remote dentists; and basic grade salaried dentists who supervise vocational trainees. 3. The amount of the allowance is determined by the number of dentists who provide the out of hours cover. Those dentists who provide out of hours emergency treatment singlehanded will receive a higher allowance than those who take part in out of hours rotas. 9 Remote Areas Allowance Part VI of Determination II 7. This allowance is payable to those salaried dentists, including senior and specialist, who are classed as remote dentists, as defined in Determination II. This allowance is payable in recognition of the particular problems experienced by salaried dentists who work in remote areas, eg professional isolation. 8. The amount of allowance to be paid to a remote dentist will be 3,000 per annum on employment rising to 6,000 per annum after 3 years continuous employment as a remote dentist. 9. Those salaried dentists employed prior to 1 April 2004 who are remote dentists will have their previous service taken into account when determining the level of allowance which they should receive from 1 April Salaried dentists employed otherwise that full-time as remote dentists are entitled to a pro-rata allowance calculated on the basis of a whole-time week of 37 hours. Vocational Training Allowance Part VII of Determination II 11. The increased allowance is payable to basic grade salaried dentists who supervise vocational trainees employed by the NHS Board and is in recognition of the increased duties imposed by the latest arrangements for training. It is not payable to senior or specialist salaried dentists. 12. The amount of the allowance to be paid is 3,400 per annum. Where a salaried dentist supervises a trainee otherwise than full-time, eg if 2 salaried dentists supervise 1 vocational trainee between then, then the salaried dentist will receive a pro-rata allowance calculated on the basis of a full-time week of 37 hours. Payment 13. The new allowances come into effect on 1 April 2004 and will be paid to eligible salaried dentists by NHS Boards monthly in arrears. NHS Boards will make backdated payments, where appropriate. Recruitment Allowance Part IV of Determination II 14. It has also been agreed that a pro-rata recruitment allowance should be payable to those dentists who are employed as salaried dentists either within 3 months of completion of training (as defined in Determination II) or who are not currently employed, except as a locum, in the salaried service, ie either as a salaried dentist or as a dental officer within the community dental service. The amount of allowance to be paid shall be calculated on the basis of a whole-time week of 37 hours. This amendment is also brought into effect by the attached Amendment No NHS Boards will make backdated payments, where appropriate. abcde abc a 2 LM

11 AMENDMENT NO 93 STATEMENT OF DENTAL REMUNERATION Pursuant to Regulation 22(3) of the National Health Services (General Dental Services) (Scotland) Regulations 1996, as amended, Scottish Ministers have amended on 1 April 2004 the Statement of Dental Remuneration. Amendment No The amendments to Determination II shall take effect from 1 April This amendment shall not affect any rights or liabilities acquired or incurred under or by virtue of any provisions of the Statement of Dental Remuneration amended or replaced by this amendment. 3. The attached pages 72, 73, 78, 79A and 79B should be inserted in Amendment No 91. Existing corresponding pages, where appropriate, should be destroyed. abcde abc a LM
12 Statement of Dental Remuneration DETERMINATION II RATES OF REMUNERATION FOR A SALARIED DENTIST AND THE PROVISION OF EMERGENCY DENTAL SERVICES Part I General Application 1. (1) The provisions of Parts I, IV, V, VI and VII of this Determination shall apply to a salaried dentist including such a dentist who is employed by a Health Board in accordance with the salary plus bonus scheme. (2) The provisions of Part II of this Determinatio n shall apply to a salaried dentist except where such a dentist is employed by a Health Board in accordance with the salary plus bonus scheme. (3) The provisions of Part III of this Determination shall apply to a salaried dentist where he is employed by a Health Board in accordance with the salary plus bonus scheme. Interpretation 2. (1) In this Determination, unless the context otherwise requires: "appropriate salary scale" means for the period from 1 April 2004, the salary scale set out in paragraph 3; "community dental service" means the dental service in Scotland provided under section 1 and 39(2) of the National Health Service (Scotland) Act 1978; "dental officer" means any dentist employed within the community dental service; "dentist" means a registered dental practitioner whose name is included on a dental list prepared by a Health Board in accordance with regulation 4(1) of the National Health Service (General Dental Services) (Scotland) Regulations 1996; "designated area" means the areas of Borders, Dumfries & Galloway, Grampian, Highland, Orkney, Shetland and Western Isles Health Boards and within the area of Argyll & Clyde Health Board, Campbletown, Dunoon, Lochgilphead, Lochgoilhead, Oban, Rothsay, Tarbet, and the Isles of Mull, Iona, Colonsay, Tiree, Islay and Jura; "EEA" means European Economic Area; "local postgraduate education resource centre" means the postgraduate centres in Aberdeen, Dundee, Edinburgh, Glasgow and Inverness; "registerable higher qualification" means any dental qualification held by the dentist (other than the dental qualification which entitled him to be registered as a dental practitioner under section 14 of the Dentists Act 1984) which is registerable pursuant to section 19(1)(c) of that Act; 72
13 "remote dentist" means a dentist who has to travel 90 minutes or more, as determined by the Microsoft Auto-Route 2002 package (using default settings), by car from the address at which he is employed as a salaried dentist to his local postgraduate education resource centre in Scotland; "salaried dentist" means a dentist, employed by a Health Board who undertakes to provide general dental services at a health centre, hospital or from any vehicle or moveable facility; "salaried plus bonus dentist" means a salaried dentist employed by a Health Board in accordance with the salary plus bonus scheme; "trainee" means a dentist who is employed by a Health Board as an assistant to a salaried dentist in accordance with paragraph 19 of this Determination; "trainer" means a salaried dentist who supervises a trainee as an assistant in accordance with paragraph 19 of this Determination. "training" means a period of one year's vocational training or two year's general professional training or in the case of a dentist who is registered by virtue of section 15(1)(b) or (2A) of the Dentists Act 1984 (registration of nationals of a EEA State who hold an appropriate European diploma) or is in any way a person in respect of whom a member State is prohibited by Common law from imposing such a requirement, evidence of suitable postgraduate experience as approved by NHS Education for Scotland; "year" means the period beginning on 1 April in one year and ending on 31 March in the next year. (2) In this Determination, a reference to a numbered paragraph is to the paragraph bearing that number in this Determination and a reference in a paragraph to a numbered sub-paragraph is to the sub-paragraph bearing that number in that paragraph. 73
14 Amount of Allowance 12. (1) The amount of allowance to be paid in accordance with paragraph 11(1) shall with effect from 1 April 2004 be 10,000 paid over a 2 year period at 5,000 per annum. (2) The amount of allowance to be paid in accordance with paragraph 11(2) shall with effect from 1 April 2004 be 5,000 paid over a 2 year period at 2,500 per annum. (3) The amount of the additional allowance to be paid in accordance with paragraph 11(3) shall be an amount equal to that calculated in accordance with sub-paragraph (1) or (2) and shall be payable in the same manner. (4) Payments under sub-paragraph (1) or (2) shall terminate if the dentist ceases to be employed by a Health Board as a salaried dentist. (5) Payments under sub-paragraph (3) shall terminate if the dentist ceases to be employed by a Health Board as a salaried dentist or, subject to paragraph 14(1), if he ceases to be employed as a salaried dentist in a designated area. (6) The amount of allowance to be paid by a Health Board under sub-paragraph (1), (2) or (3) to a salaried dentist who is employed otherwise than full-time shall be a pro-rata sum calculated on the basis of a whole-time week of 37 hours. Failure to Meet Conditions of Allowance 13. (1) Where a salaried dentist ceases within 3 years of receiving the first payment under paragraph 12 to be employed as a salaried dentist he shall be required to repay to the Health Board the full amount of any allowance received. (2) Where a salaried dentist ceases within 3 years of receiving the first payment under paragraph 12 to be employed as a salaried dentist in a designated area but he remains employed as a salaried dentist he shall be required to repay to the Health Board the full amount of the additional allowance received. (3) The Health Board may waive repayment in any case where it considers that the salaried dentist was unable to meet any of the conditions because of exceptional circumstances. Changes to Status of Designated Area 14. (1) A salaried dentist who is in receipt of an additional allowance in accordance with paragraph 11(3) will continue to be eligible to receive payments in respect of that allowance if the area in which he is employed as a salaried dentist for which he is receiving the additional allowance ceases to be classes as a designated area and he shall not be liable to return the sum received. (2) A salaried dentist is receipt of an allowance under paragraph 11(1) or (2) will not be entitled to receive an additional allowance in accordance with paragraph 11(3) where the area in which he is employed as a salaried dentist is subsequently classed as a designated area. 79
15 Part V - Out of Hours Allowance Conditions of Entitlement 15. A salaried dentist who provides, to the extent required by the NHS Board, out of hours emergency treatment to registered patients or takes part in an out of hours rota to provide such emergency treatment shall be entitled to an allowance of an amount ascertained in accordance with paragraph 16. Amount of Allowance 16. The amount of allowance to be paid by a Health Board to a salaried dentist per annum shall be: 16.1 where a salaried dentist is required to provide out of hours emergency treatment as a single-handed practitioner - 4,500; 16.2 where a salaried dentist takes part in an out of hours rota: Payment Band No of dentists in rota Allowance High 2-4 3,500 Medium ,500 Low > 10 1, The allowance at paragraph 16 shall be paid monthly in arrears in 12 equal installments. Part VI - Remote Areas Allowances Conditions of Entitlement 18. A salaried dentist who is a remote dentist shall be entitled to an allowance of an amount ascertained in accordance with paragraph 19. Amount of Allowance 19. (1) The amount of allowance to be paid by a Health Board where a salaried dentist has satisfied the condition in paragraph 18 shall be 3, per annum payable on the date of commencement of employment on or after 1 April 2004 until the dentist has been so employed for a continuous period of 3 years when the amount of allowance shall be 6,000 per annum. (2) Where a salaried dentist was employed as a remote dentist immediately before 1st April 2004 and continues to be so employed after that date, the amount of allowance to be paid by a Health Board shall be 3,000 per annum payable only from 1st April Once the period of 3 years continuous employment from the date of commencement of employment has been reached, the amount of allowance shall be 6,000 per annum, but the allowance is only payable from a date not earlier than 1st April (3) The amount of allowance to be paid by a Health Board to a salaried dentist who is employed otherwise than full-time as a remote dentist shall be a pro-rata sum calculated on the basis of a whole - time week of 37 hours. 79A
16 (4) Only one allowance shall be payable to a salaried dentist in a year. Payment 20. The allowance at paragraph 19 shall be paid monthly in arrears in 12 equal installments. Part VII - Vocational Training Allowance Entitlement 21. (1) A salaried dentist who is a trainer who satisfies the conditions specified in sub-paragraph (2) shall be entitled to the allowance specified in paragraph 22. (2) The conditions referred to in sub-paragraph (1) are: (a) (b) (c) (d) the trainer is employed as a salaried dentist by a Health Board; the trainer's applicatio n to act as a trainer in a vocational training scheme for general dental practice has been approved by the Postgraduate Dental Dean; the Health Board has engaged a trainee under a contract of employment as an assistant who will be supervised by the trainer for a period of one year's full time employment (or an equivalent period of part-time employment) or for such additional period, not exceeding three months' full-time employment or the part-time equivalent, as the Postgraduate Dental Dean has authorised as necessary for the completion of vocational training and the trainee is for the time being employed by the Health Board under such a contract; and the trainer agrees to meet all the conditions of the assessment system required for satisfactory completion as set down by NHS Education for Scotland. Amount of Allowances 22. (1) The allowance referred to in paragraph 21 to be paid by a Health Board to a salaried dentist who is a trainer is 3,400 per annum. (2) The amount of allowance to be paid by a Health Board to a salaried dentist who is a trainer otherwise than full-time shall be a pro-rata sum calculated on the basis of a whole-time week of 37 hours. Payment (3) No allowance under sub-paragraph (1) is payable to a senior or specialist salaried dentist. 23. The allowance at paragraph 22 shall be paid monthly in arrears in 12 equal installments. 79B
