4 Chief Inspector s Foreword Care and Social Services Inspectorate Wales (CSSIW) is the independent inspectorate and regulator for social care services in Wales. Our primary responsibility is to provide independent assurance to the public on the safety and quality of social care services and encourage the improvements of these services throughout our work. CSSIW reviews services at a national and local level so that we can act authoritatively when we advise Welsh Ministers and policy makers. We are able to tell the public where services are up to the required standard and where they need to improve. Working in partnership with Welsh inspectorates we can propose ways of delivering better services to help safeguard the interests of people who use services and their carers. We regulate and inspect services for everyone in Wales from the very young to older people. Our work will impact on the majority of people at sometime in their lives. CSSIW s Strategic Plan sets out how we will achieve our core activities over the next five years and takes account of the changes and developments across social care and other public services in Wales. This plan is aligned with the Welsh Government s policy statement for Inspection, Audit and Regulation in Wales 1, and the priorities set out in Sustainable Social Services for Wales: A Framework for Action 2 and links to the CSSIW s Modernisation Plan 3, Working Collaboratively to Support Improvement, a Strategic Agreement between CSSIW, Estyn, HIW and WAO 4 and their report Developing Our Work Together in a Climate of Change 5. Our plan sets out our direction of travel and provides clear messages about our priorities and what we plan to deliver. We have also taken into account the views expressed by people who use and need social care services, their families, carers and other key stakeholders in the design and development of our work programme. 5 CSSIW is part of the Welsh Government with arrangements in place to provide an independent professional inspection and advice service to the citizens of Wales and Welsh Ministers. CSSIW will continue to build upon government initiatives and legislation to ensure that its work promotes and champions improvement and change in social care in Wales. This plan sets out CSSIW s commitment to putting people and their experiences at the heart of our work as the body which regulates and inspects social care and social services in Wales. It focuses on the essential role of on-site external inspection and review; the benefit of strong sectoral inspectorates with professional authority in their own fields; the need for effective partnership across organisational boundaries; and expectation that external review plays a full part in a programme of promoting high performance, continuous improvement and innovation and promoting value for money. An important area for further development will be the involvement of lay and peer assessors in our work. We have worked with our staff to develop a set of organisational values to underpin our medium term change and modernisation work and longer term strategic plan. We value our staff and shall continue to invest in their professional training and development to underpin more streamlined, risk assessed and proportionate ways of working. We have developed an engagement strategy to ensure that we place service users experiences at the heart of our work and will seek the views of the public, providers and all stakeholders to receive their comments and suggestions on this plan. A key feature of our future engagement plans will be how we involve our stakeholders in the strategic and operational work of CSSIW. 6 Our Purpose We are here to: Provide independent assurance about improvement in the safety, quality and availability of social care, early years and social services to achieve better outcomes for people who use services. Safeguard people by protecting and promote the rights and wellbeing of citizens using social care and social services throughout our work. Improve care by encouraging and promoting improvements in the safety, quality and availability of social care services through the regulation and inspection of these services. Influence and inform policy, standards and provide independent professional advice to the public and social care sector. By: Acting to protect the rights of all people using health and social care. 7 Who We Are and What We Do We work across Wales. We review and inspect services at both a national and local level using a robust evidence base and rigorous analysis so that we inform the public whether services are up to standard and suggest ways of improving services. We take action if the safety and quality of social care does not meet required standards. We work in the interests of service users and their carers. We evaluate and make sure we learn lessons from our work to allow us to develop responsively to changes to the delivery of social care. We inspect and review the performance of local authorities on specific topics. Since April 2009 we have a new framework for local authority social services inspection, review and evaluation. It is designed to be citizen focussed and to encourage improvement, innovation and ownership of change by local government. We publish accessible and timely reports of our review and inspection work to inform service users, families and carers about the standards of social care services in Wales. CSSIW s core activity The principles of CSSIW s statement of purpose underpin all CSSIW registration, review and inspection work. Regulatory activity On the 31 March 2011, we regulated 6,226 settings. Regulation includes registering services that wish to provide care and social services, inspecting the services, responding to concerns about services, ensuring that they comply with the regulations and standards and taking enforcement action if services do not comply with the law. Regulated setting and services Care homes for adults, including care homes with nursing facilities. Nurses agencies. Domiciliary care agencies. Adoption support agencies. Adult placement schemes. Children s homes. Child minding and other day care settings for children under eight. Public sector and independent fostering agencies. Public sector and voluntary adoption agencies. Boarding schools, residential special schools and further education colleges which accommodate students under 18. Residential family centres. CSSIW spends a considerable amount of time on considering changes to conditions of registration. There were 104,093 places within these regulated settings at 31 March 2011, which is an increase of 1,736 places since 31 March Inspected settings and services Inspections of registered settings and services are both announced and unannounced and registered owners are required to complete an annual self assessment of their registered services to the inspectorate. We aim to be a knowledge driven inspectorate and assessments are based on evidence. Therefore inspectors analyse a range of information from service users, relatives and staff, commissioners of services, complaints investigations and outcomes, safeguarding investigations and outcomes as part of the CSSIW risk assessment process to determine the focus of our next inspection. The use of professional judgement to assess the evidence is also supported by our knowledge management system, which holds the information we require. Under the Care Standards Act 2000, our inspection activity covered: Care homes for older people. Care homes for younger adults. Full day care of children. Childminders. Domiciliary care agencies. An adult protection investigation is the responsibility of the local authority and the police. The record of CSSIW involvement in adult protection in regulated settings does not represent the full picture of adult protection in Wales. Where appropriate, CSSIW undertakes an immediate inspection in relation to an adult protection concern and this is recorded in the inspection report for the setting. Complaints During 2011 CSSIW undertook a review of the current complaints guidance, procedures, recording and practice in its handling of complaints. We reviewed the remit and role of CSSIW in complaints and aligned this work with our modernisation programme and the wider review of complaints procedures in social services and social care, and changes to the public services ombudsman remit. The new arrangements integrate and simplify processes, creating a seamless front door approach for our customers and stakeholders, improve the timeliness of the service we deliver and ensure that practice is consistent with our regulatory powers. 10 Local authority social services Our work to inspect and review local authority social services covers all service areas. In we put in place a new framework for that work which we are rolling out and reporting on in The Directors of Social Services each complete an annual report on the performance of social services within their local authority area together with their plans for improvement. This self assessment provides part of the evidence base for the annual cycle of review and analysis that is carried out by the CSSIW local authority inspectors. The inspectors analyse a range of information from the inspections of regulatory settings, review and service inspections carried out during the year, performance information data and the council s improvement plans. They also include the views of and evidence from service users, staff, other Welsh regulators and inspectorates and the outcomes of complaints and safeguarding investigations. The annual evaluation, assessment and review letters for each council s social services are published on the CSSIW website. The result of this work is an annual inspection plan for each social services authority in Wales. This plan will include specific activity in response to each authority s particular circumstances, and any survey or fieldwork done to inform national reviews or inspection by CSSIW in the year. The reports are published on the CSSIW website and the Local Authority inspectors monitor the progress of the social services action plans to ensure that improvement is being achieved. National and local authority service reviews and inspections A programme of national service reviews and inspections are determined each year following on from the analysis of the regulatory and local authority work. These also take account of national policy objectives, findings from research and national issues. We target our work on safeguarding those who are most vulnerable and national priorities, including inspection and improvement work detailed in the council s annual evaluation letters. We also conduct investigations in response to specific issues when these arise. The inspectorate has also undertaken significant inspection and improvement activity where services are failing. Recent examples include children s social services in the City and County of Swansea and the joint investigation by CSSIW and Estyn into the handling and management of allegations of professional abuse and the arrangements for safeguarding and protecting children in education services in Pembrokeshire County Council. The review and inspection framework and methodology is tailored to the requirements of the work that is being undertaken. This ensures that CSSIW can apply the appropriate and proportionate approach to its work. Increasingly, more of our work is being undertaken in collaboration and partnership with other inspectorates wherever appropriate in recognition of the inter-relationship and inter-dependency of service models. This enables a full account and understanding of the way authorities and organisations work together to deliver services to citizens and local communities. It also makes best use of the resources and information available to the inspectorates and regulatory bodies, whilst at the same time reducing the inspection demands on authorities. 8 Care and Social Services Inspectorate Wales Strategic Plan

11 We are also undertaking a major programme of work with the Care Council for Wales in response to Sustainable Social Services. As with all of our work this is focussing on the needs of citizens and service users. This will deliver a co-ordinated and joined up approach to the regulation of the workforce and regulation and inspection of organisations which commission and provide services, focussing on improving outcomes for service users by driving up the quality of the workforce and services. All national reviews and service inspection reports are published on the CSSIW website. Each year we publish the Chief Inspector s annual report, the annual monitoring report on the use and application of Deprivation of Liberty Safeguards and on the Protection of Vulnerable Adults. Since 2009 we have undertaken a major series of national inspections and service reviews as set out below. This work has a significant impact on policy development and service improvement. The programme has included the following (up to 2010): 2009 A Scoping Study into Infection Control Standards in Care Homes for Older Persons in Wales This report provides detailed information of our findings on infection control in care homes for older persons in Wales. Review of the Impact of the National Service Framework (NSF) for Older People in Wales The National Service Framework for Older People in Wales is a key component of the Welsh Governments Strategy for Older People in Wales. Safeguarding and Protecting Children in Wales The review of local authority social services and Local Safeguarding Children Boards. Improving Practice to Protect Children in Wales An examination of the role of serious Case Reviews. Children in need census circular: WAGC15/2009 This circular outlines what data is to be collected in the 2010 census and how it will be gathered. National review of the Independent Reviewing Officer Services This report provides an overview of the Independent Reviewing Officer (IRO) service across Wales. It aims to inform policy development and promote best practice. Reviewing Social Services in Wales Learning from the journey This report brings together lessons learnt from joint reviews of social services in Wales in the last ten years and highlights key success factors. Services for Children and Young People with Emotional and Mental Health Needs This review set out to establish whether services are adequately meeting the mental health needs of children and young people in Wales. 12 2010 Inspection of CAFCASS CYMRU 2010 CSSIW carried out the inspection of service provision by the Children and Family Court Advisory Support Service in Wales (CAFCASS CYMRU) in the weeks commencing 28 June, 12 July, 19 July and 26 July National Review of Access and Eligibility in Adults Social Care - Overview Report CSSIW undertook this work in response to growing concern from a range of stakeholders. Preliminary Analysis of Dementia in Wales A Preliminary Analysis of Dementia in Wales - Report undertaken by CSSIW. National Inspection of Adult Protection - All Wales Overview This report sets out the findings of the national inspection of adult protection undertaken by CSSIW between July and December We use the information from our work together with other sources to provide professional advice to Ministers and policy divisions on the development and implementation of legislation, policy and practice. This is a key area of activity to ensure that the knowledge we have about service commissioning, provision, delivery and practice is used to best effect in delivering improved services and outcomes for citizens and service users. 13 Delivering Our Core Activities Regulation Registering and inspecting a range of social care and social services We will complete an annual targeted and proportionate programme of inspections to achieve improved outcomes for service users. We will involve service users, staff and commissioners in our regulatory inspections. We will ensure that regulation is carried out effectively and its outcomes communicated to all relevant stakeholders. We will align developments in regulation and inspection with emerging legislation. Review and inspection Assuring the quality of social care and social services through a programme of reviews and inspections We will deliver a programme of reviews designed to provide public assurance that agreed quality standards are being met. We will ensure that all review activity is designed to support continuous improvement and focus on the voice of service users. Safeguarding and protection Delivering a programme of external inspection and review services provided to people who use social care and social services We will focus on appropriate safeguards for people who use services. We will ensure that all review and inspection activity drives service improvement and promotes human rights and wellbeing. We will engage effectively in the development of emerging legislation to ensure independent oversight of safeguarding. 15 Our Priorities Encouraging and promoting improvement in the safety, quality and availability of social care, early years and social services Why is this important? People have a right to expect safe and good quality services. They have a right to expect that if there are problems CSSIW will take prompt action within its remit to tackle them to promote positive outcomes for people. What we already know We review and evaluate local authorities and we regulate settings across Wales. This provides us with a wealth of information about the safety and quality of services which we report on. We produce an annual report on the state of social care and social services. CSSIW will: Keep people who use services and carers as the central focus of our work. Register, inspect, and deal with concerns, compliance and enforcement in regulated settings. Review and evaluate local authority social services. Improve the way we gather and record information, making information more accessible, while keeping positive outcomes for service users at the forefront of its work. Implement our modernisation plan to ensure that we are e-enabled and restructure our workforce to improve the professional focus of our work. Promote and support innovation that makes a positive and sustained contribution to people s lives. We will facilitate the sharing of information and exemplars from commissioner and provider services that can demonstrate they deliver quality services. 16 Safeguarding people Why is this important? Being safe from harm is a basic human right. People who use services have a right to expect them to keep them safe. Where people have been subjected to harm, in whatever form, they have a right to expect that statutory services will take appropriate action to protect them from further harm. All public services, including health and education services also have responsibilities for safeguarding and protecting people. Social services and the police have particular duties as the statutory agencies with responsibility for investigating allegations of harm and abuse. People who use social services are amongst the most vulnerable members of society and need to be properly safeguarded. What we already know We review and evaluate local authorities and we regulate settings across Wales. This provides us with a wealth of information about the safety and quality of services which we report on. We produce an annual report on the state of social care and social services. CSSIW will: Continue to keep safeguarding and the protection of children and adults at the forefront of its review and inspection work at a national level and at a local level. Work closely in partnership with other inspectorates in inspecting and reviewing arrangements to safeguard and protect children and adults at national and local levels. Work closely in partnership with workforce regulatory bodies to promote the highest standards of professional practice in safeguarding children and adults. Apply rigorous safeguarding standards in regulating services. 17 Informing policy by using the intelligence we gather to provide authoritative professional advice Why is this important? CSSIW is in the unique position of having a vast amount of direct contact with service users, providers and commissioners. We inspect settings and local authority social services. The information that we gather provides a broad perspective on what is working well and areas for development. We have a statutory duty to produce an annual report on social care and social services in Wales. We engage at a strategic level with Welsh Government Ministers, and other stakeholders, providing professional evidence based advice. We have an important opportunity with the Social Services White Paper A Framework for Action. This reinforces the commitment to ensuring service users and carers have a stronger voice and control over the services they receive. CSSIW will work to support the commitments within the White Paper to gain better outcomes for service users. What we already know Our reviews, inspections and reports provide an important perspective on social care and social services. These and our inspections of specific issues provide important information to inform policy. CSSIW will: Continue to develop and embed the framework for review and evaluation of local authority social services, working closely with our partners. Implement a new system jointly with other inspectorates and regulators around identifying and publicising good practice. Build our internal capacity through developing roles and structures that will address key issues such as registration, enforcement and complaints. Produce an annual report which reports on our own progress, and that of social care and social services in Wales. 18 Delivering the Strategy and Managing Performance To deliver the strategy CSSIW has developed an annual business plan which links our key activities with our budget. CSSIW performance of our key activities are monitored by our Management Board and reported in the Chief Inspector s annual report. The key strategic activities which relate to the CSSIW modernisation work are monitored by our Executive Board, which includes external challenge and our Stakeholder Board, which has members from within the Welsh Government, Welsh Audit Office, Estyn, Health Inspection Wales, ADSS Cymru, WLGA, Care Council for Wales, Care Forum Wales, Crossroads Care, Older People s Commissioner, Children s Commissioner, Prospect and Public and Commercial Services Union. The strategy will be reviewed annually to ensure that it remains relevant to the changing environment in which CSSIW operates over the next five years. 16 Care and Social Services Inspectorate Wales Strategic Plan
