4 The mission of the Billings Adult Misdemeanor Treatment Court is to protect society by identifying and treating addicted, non-violent substance abusing offenders in a more efficient and effective way in the Criminal Justice System. Through improved communication and collaboration among area stakeholders, we intend to reduce alcohol and drug abuse in the community, lower recidivism rates, lessen the financial impact on society, and help those so identified to lead productive lives as law-abiding citizens.

5 WELCOME TO TREATMENT COURT Billings Adult Misdemeanor Treatment Court is designed to support adults accused or convicted of misdemeanor crimes who have substance abuse problems. As a participant, you will be required to address your chemical dependency issues as well as your legal obligations. By deciding to enter treatment court, you have taken the first step towards changing your life. This handbook will provide you information about Drug Court and what is expected of you as a participant. You are encouraged to share this handbook with your family and friends. We welcome you to Treatment Court, and look forward to your success!

6 BENEFITS OF PARTICIPATING IN TREATMENT COURT you will be clean and sober. you will have a stable, productive lifestyle. you will have obtained employment or be furthering your education. you will have improved your physical and mental health. you will be a contributing member of society. you will have addressed and concluded all of your legal obligations in the Billings Municipal Court.

7 You Will: RULES OF BEHAVIOR Not violate any city, county, tribal, state or federal law. All arrests or police contact must be reported to your probation officer within 24 hours. Notify treatment counselor and probation officer of relapse ASAP! Not threaten anyone or commit any act of violence. Not have mood altering drugs in their possession or be in the company of those who, use, sell, distribute or have under their control any paraphernalia or drug except as prescribed by a licensed physician and approved by their treatment provider. Not use or possess any alcoholic beverage or go into any establishment where alcoholic beverages are the primary sale.

8 Not possess a weapon of any form, including firearms or knives. Not miss any counseling appointments, Treatment Court appearances, drug screens, compliance (probation) meetings or any other required appearance. Not leave Yellowstone County without permission of the court Not refuse to comply with any reasonable program requirement. Advise the court if moving to a different address/location Maintain gainful employment Allow the probation officer to search the participants and/or belongings with reasonable suspicion Follow all rules of probation and treatment

10 1. Be on time. 2. Dress appropriately. COURTROOM RULES No bare feet No flip flops No tank tops, muscle shirts, crop-tops No pictures showing drug/alcohol logos No sweat pants No sagging pants No underwear or bra straps showing No hats, caps, bandanas, or do-rags No gang attire No short shorts (even summertime) No body piercings, except appropriate earrings No new tattoos No sunglasses

11 3. Do not approach the bench unless okayed by the Judge or asked by the Judge. 4. Do not sit on the counsel table or lean on the podium. 5. It is forbidden to be under the influence of any beverage and/or illicit drug. 6. Be respectful. Address the Judge as Your Honor and stand when speaking to or being addressed by the Court. Do not argue or speak when the Judge is speaking. 7. Courtroom staff, Treatment Court team members and other Treatment Court participants are also to be addressed and treated with respect. 8. Food and beverages including gum are not allowed in the courtroom. 9. All phones in the courtroom must be turned off!

12 TREATMENT COURT CONFIDENTIALITY Your privacy will be respected in Treatment Court. We will make every effort to make certain your identity is protected by not using your name in research or evaluation activities. Your participation in Treatment Court does give permission to your counselor to provide treatment information to the Drug Court team. Because Drug Court is open to the public, we cannot predict whether or how the news media may use your identity and cannot prevent them from disclosing it or other information which is public record.

13 MINIMUM REQUIREMENTS Treatment Court Appearances You must appear in Treatment Court as ordered; weekly, bi-monthly, or monthly. Court sessions provide you the opportunity to report and discuss your progress or any concerns. The Judge will encourage you if you are doing well and may reward you with incentives. Sanctions will be given if you are non-compliant If you do not appear in Court when required, a warrant may be issued for your arrest, and you may be terminated from the Treatment Court.

14 MINIMUM REQUIREMENTS (cont d) Drug and Alcohol Testing You will be required to give urine and/or breath tests on a random basis. These tests are used to prove compliance and to help you stay away from using alcohol and drugs. Results of these tests are reported at each Court appearance and may be used for giving rewards or sanctions by the Judge.

15 MINIMUM REQUIREMENTS (cont d) Counseling: You will be placed into group counseling. Remember every participant needs a different level of counseling Everyone heals and learns at a different level and participants may progress faster than you. You will participate in individual counseling Individual sessions are used to update your treatment plan and goals. Individual counseling can also be used to deal with any personal issues not appropriate for group discussions. The Judge may also want additional counseling sessions as seemed appropriate.

16 MINIMUM REQUIREMENTS (cont d) Program Fees You will make arrangements to pay $30.00 per week to Treatment Court. These fees are used to pay probation costs, including drug testing. If at any time you reach an unpaid balance of $ you will be required to pay the total balance of $ within two weeks. If not paid in full you may be terminated from Treatment Court. All program fees must be paid in full to move phases and graduate.

17 MINIMUM REQUIREMENTS (cont d) Additional Requirements You are required to complete a 30 hour volunteer project. This project will be approved and checked regularly by the Treatment Team. If convicted of a DUI, you may apply for provisionary license & interlock 45 days into your programming May be asked to be a mentor to a new participant of the program BE AN EXAMPLE OF BILLINGS ADULT MISDEMEANOR TREATMENT COURT

18 Incentives When you appear for your Court session, you may be given an incentive. This happens when you have done everything required. This includes treatment compliance, showing up for probation appointments, being drug free, and paying your weekly fee. Incentives may include: Applause Probation Reporting Decreased Basket Court Appearances Decreased Gift Cards Drug Testing Decreased Travel Permit Judicial Praise Gift Drawings Phase Advancement Sobriety Coins Dismissed Early From Court

19 Sanctions Sanctions happen when you are not compliant with your program. This includes, not doing homework, being positive for drugs, not attending self-help meetings, or not showing up for scheduled appointments. Sanctions may include: Jail Increased Drug Testing House Arrest Increased Court Appearances Phase Demotion Increased Probation Reporting Job Search (50/50) Community Service Imposed Curfew Suspended Jail Time SCRAM Letter of Apology Verbal Warning Sobriety Time Taken Writing Assignments Increased Self-help Meetings

20 Termination Termination from the program happens if you become noncompliant. This includes: failure to participate in treatment continuous failure to complete all program requirements tampering with the drug/urine test. being excessively positive for U/A and B/A s Termination may also happen if you are charged with any of these crimes: Drug sales, including trafficking. Multiple DUI offender or convicted of a DUI with property damage or personal injury. Possession of firearm or other prohibited weapon. Violent crimes such as assault, partner or family member assault, robbery, and sexual offenses.

21 Phases Your drug court plan has three-four phases. Each phase helps you grow and heal and is very structured. In order for you to move from phase to phase, you must complete treatment, attend court, be compliant with your probation officer, and have all fees up to date. All phases must be successfully completed for graduation. REMEMBER: Everyone moves forward at a different pace!!

27 GRADUATION REQUIREMENTS In order to graduate from Treatment Court, you must: Successfully complete the assigned treatment program. Have at least 90 days of sobriety Be working and/or going to school full-time. Be living in a stable, drug-free environment Have your relapse prevention plan accepted by the team. Complete your 30 hour volunteer project.
