1 Pursuant to Article 120 Paragraph 5 of the Law on Veterinary Matters ( Official Gazette RS, number 91/05 and 30/10) and Article 12 Paragraph 2 of the Law on Food Safety ( Official Gazette RS, number 41/09); The Minister of Agriculture, Forestry and Water Management hereby legislates RULEBOOK LAYING DOWN TYPES OF LOADS SUBJECT TO VETERINARY-HYGIENE CHECKS AND PROCEDURES OF VETERINARY-HYGIENE CHECKS OF LOADS ON BORDER CROSSINGS Rulebook on the types of consignment that are subject to veterinary sanitary control and methods of veterinary-sanitary examination at the border crossing (O.G. of the Republic of Serbia No. 56/2010) (Published in the Official Gazette of the Republic of Serbia, number 56/10) I. INTRODUCTORY PROVISIONS Article 1 These rules lay down types of loads subject to veterinary-hygiene checks and method for performing veterinary-hygiene checks of loads on border crossings with the existing organized, veterinary-hygiene checking. Article 2 Provisions of these Rules do not refer to loads of pets, transported in company of their owners, dedicated to non-commercial purposes, apart from equidae. Article 3 Terms used in these Rules shall have the following meanings: 1) identity check shall mean visual inspection of the load, for verification of consistency of said load and data stipulated in the documents accompanying such load; 2) gelatin is natural, soluble protein, gelatinous or non-gelatinous, produced through partial hydrolysis of collagen obtained from animal bones, skin, sinews and tendons; 3) collagen is a protein-based product, obtained from animal bones, skin and tendons; 4) person responsible for the load (importer) is natural or legal person responsible for the load; 5) mixed food includes products for human consumption, containing processed products of animal and plant origin, including such products for which processing of primary product represents the constitutive part of the final product; 6) milk products are processed products, obtained by processing raw milk or further processing of such products; 7) processed stomachs, bladders and intestine are stomachs, bladders and intestines which were, subsequent to extraction, cleaning and washing, subjected to processing such as salting, drying or thermal processing; 8) documentary check is review o international veterinary certificate, identification document or other documents accompanying the load; 9) processed products of animal origin are products of animal origin, processed within the technological processing cycle, and shall include: meat products, milk products, egg products, processed fish and fishing products, melted animal fat, pork scratchings, gelatin, collagen, processed stomachs, bladders and intestine;

2 10) processed fish and fishing products are the products obtained through processing fish and fishing products or further processing of said products; 11) meat products are products obtained through processing meat or further processing of such products, in such manner that the surface of cut does not indicate properties of fresh meat; 12) egg products are products obtained through processing eggs or various components or mixture of eggs, or are obtained by further processing of said egg products; 13) third countries are countries other than the European Union Member States, apart from the Republic of Serbia; 14) melted animal fat is fat intended for human consumption obtained by melting fat from the meat, including the bones; 15) physical check of load is check of the load, which includes checking vehicle, package, temperature, documents, organic properties, collecting samples for laboratory testing, and when load contains animals, performing additional examinations for the duration of quarantine, in order to establish if the load meets the prescribed veterinary-hygiene requirements stipulated in accompanying documents; 16) pork scratchings are leftovers after melting protein-containing bacon, after partial separation of fat and water. II. TYPES OF LOADS SUBJECT TO VETERINARY-HYGIENE CONTROL Article 4 Loads, in the sense of these Rules, means loads of animals, animal origin products, animal origin food, animal origin by-products or animal feed, including mixed food loads, containing animal origin products, covered with the same prescribed document, placed in the same vehicle, originating from the same location and intended for the same final destination. Types of loads subject to veterinary-hygiene control on border inspection posts with organized veterinary-hygiene control in place are presented in Annex 1 Types of loads subject to veterinary-hygiene control, printed with and constituting these Rules. Article 5 Load of mixed food shall be subjected to veterinary-hygiene control, namely: 1) in the event when public health preservation requires so; 2) if contents include meat products; 3) if contents include 50 % or more of any processed animal origin product, excluding meat products; 4) if contents do not include meat products, but do include less than 50 % processed dairy, and if the final product is not: (1) sustainable on room temperature or it is unclear if all of its ingredients had passed through complete process of cooking or thermal processing during the production, to denaturize each raw product or ingredient; (2) clearly identified as product or food intended for human consumption; (3) hermetically sealed in the appropriate packaging or clear containers; (4) accompanied by the commercial document and marked in the official language of importing country and country of origin, so that this document and label jointly provide information on nature, quantity and number of packages of mixed food, country of origin, manufacturer and ingredients;

3 5) if contents include any dairy product, regardless of percentage, providing that such milk or processed dairy originates from the establishment certified for import to the Republic of Serbia.

4 Article 6 Load of mixed food shall be subjected to veterinary-hygiene control if it contains less than 50 % of any processed product, excluding meat products, providing that such product is: 1) sustainable on room temperature or it is clear that all of its ingredients had passed through complete process of cooking or thermal processing during the production, to denaturize each raw product or ingredient; 2) clearly identified as product or food intended for human consumption; 3) hermetically sealed in the appropriate packaging or clear containers; 4) accompanied by the commercial document and marked in the official language of importing country and country of origin, so that this document and label jointly provide information on nature, quantity and number of packages of mixed food, country of origin, manufacturer and ingredients Apart from load stipulated in Paragraph 1 herein, the following products shall not be subjected to veterinary-sanitary control: cookies, bread; cakes; chocolate, patisserie products, including candies; empty gelatin capsules; additives for consumables packed for sale to final consumer, containing small quantity of animal products or glucosamine, condroitin or cytosine; meat extracts and concentrates; fish-stuffed olives; pasta and noodles not mixed or stuffed with animal origin products; broths and soups packed for sale to final consumer, containing meat extracts, meat concentrates, animal origin fats or fish oil, fish powder or extracts. II. METHOD FOR VETERINARY-HYGIENE CHECK OF LOAD IN THE EVENT OF IMPORT AND TRANSIT Article 7 Veterinary-hygiene control on border inspection post shall consist of documentation review, load identification and physical examination, pursuant to the law regulating veterinary matters. 1. Documentation review Article 8 Documentation review refers to review of the international veterinary certificate (hereinafter: the certificate), accompanying load of animals, animal origin products, animal origin food, animal origin by-products and animal feed, including laod of mixed food stipulated in Article 5 herein, for the purpose of establishing if the certificate: 1) is original and issued in the language of the country of origin and in Serbian language in the event of import, i.e. in English language and another language officially accepted in international commerce, in the event of transit; 2) refers to the country or part thereof from which the import to the Republic of Serbia or transit over the territory of the Republic of Serbia is permitted; 3) regarding its form and contents, is in line with form and contents of certificate prescribed for each particular country and type of load; 4) is properly completed; 5) is consistent regarding date of loading and date of certificate issuing; 6) originates from one establishment and is intended for one recipient; 7) is signed by the competent veterinarian, i.e. representative of competent organ, contains readable name and position of the competent veterinarian, i.e. representative of competent organ, in print, and, when required, for the official stamp of the country and signature of the competent veterinarian, i.e. representative of competent organ, are of different color than certificate print;

5 8) contains data which were not amended or appended, apart for canceling, with signature and stamp by the competent veterinarian, i.e. representative of competent organ issuing the certificate; 9) had expired, i.e. no more than ten days had passed from the day of veterinary-hygiene check performance on the loading site to the day of review, and if the load is transported by the ship, validity period of the certificate shall be extended for the duration of transport. Apart from review of certificate stipulated in Paragraph 1 herein, review of animal load documentation also includes review of animal transport itinerary, filled by the transporter pursuant to the law regulating animal welfare. For mixed food loads, containing processed meat product, review of documentation refers to review of certificates for meat products, for mixed food products, containing processed dairy produce, review of documentation refers to review of certificate produced pursuant to the conditions of the country of origin, for mixed food products, containing processed fish or animal origin egg products, review of documentation refers to review of the appropriate certificate produced pursuant to separate regulations or review of the commercial document produced pursuant to the conditions of the country of origin. Article 9 For the loads transiting the territory of the Republic of Serbia, review of documentation includes review stipulated in Article 8 herein, and: 1) review of documents permitting transit of load over the territory of the Republic of Serbia, issued by the competent organ, i.e. border official veterinarian; 2) review of documents by which the country to which the load is shipped over the territory of the Republic of Serbia verifies that it will not deny entry or return loads for which import or transit is permitted. 2. Load identification 2.1. Animal load identification Article 10 Animal load identification shall be performed by visual inspection of the load and documentation accompanying the load, to determine if data stipulated in the documentation accompanying that load are correct (number of animals, ear stamp number, microchip number, tattoo number, etc.) Notwithstanding provisions of Paragraph 1 herein, for animals for which separate regulation do not impose obligation of individual marking, load identification shall consist of checking representative number of parcels or containers. In the event of impossibility to obtain necessary results by identification of load stipulated in Paragraph 2 herein, load identification may include checking all parcels or containers in the load. If load stipulated in Paragraph 1 herein contains large number of animals, load identification may be performed on 10 % of animals in the load, but no less than 10 animals typical for the entire load. In the event of impossibility to obtain necessary results by identification of load stipulated in Paragraph 4 herein, load identification may include checking all parcels or containers in the load. If border official veterinarian, on the occasion of load identification, suspects that the animal load does not meet prescribed veterinary-hygiene conditions or if he suspects the identity of an animal, he may request the additional information or perform other examination, at his own discretion.

6 2.2. Identification of load of animal origin products, animal origin food, animal origin by-products and animal feed, including mixed food products Article 11 Identification of load of animal origin products, animal origin food, animal origin by-products and animal feed, including mixed food products stipulated in Article 5 herein shall be performed by visual inspection of the load and accompanying documentation, for the purpose of establishing if data stipulated in the accompanying documents are correct. If the load stipulated in Paragraph 1 herein arrives to the border inspection post in containers, identification of the load shall be performed by controlling data on the seal against data from the certificate and other documents accompanying the load, including seal status, i.e. appearance. If the load stipulated in Paragraph 1 herein arrives to the border inspection post packed in parcels, palettes or in other similar packaging, including if the load had arrived in containers and the inspection establishes that the seal is damaged, load identification shall include checking specific declarations, as prescribed by regulations covering veterinary matters, as well as the existence and correctness of the official stamp or usability stamp, used for load origin identification (country of origin and establishment from which it originates). 3. Physical examination of load 3.1. Physical examination of animal load Article 12 Physical examination of animal load consists of: 1) examination of animals regarding capability to stand travel, where the estimation shall consider previous travel, including previous feeding, watering and rest, and the remaining travel, including intended feeding, watering and rest for that part of the journey; 2) clinical examination of animals, verifying if the load is consistent with data stipulated in the accompanying certificate or other document, and if the animals are clinically healthy, and shall include as a minimum: (1) visual observation of animals to establish general health status of animals, capability of free movement, status of skin and mucous membranes with possible existence of non-physiological secretions from animals; (2) observation of respiratory and digestive system of animals; (3) measuring body temperature by random sampling, except for the animals for which no discrepancy against physiological parameters was noticed during examinations stipulated in Sub-points (1) and (2) herein; (4) palpation, of observation or measuring stipulated in Sub-points (1), (2) and (3) herein had established that there is a deviation from physiological parameters; 3) laboratory examinations deemed necessary or prescribed by separate regulations; 4) examination of vehicle to establish if that vehicle meets conditions for animal load transport, as prescribed by separate regulations on conditions for vehicles for animal transport. Article 13 Notwithstanding provisions of Article 12 Point 2) herein, clinical examination shall consist of evaluation of behavior, holding and appearance of animals in load or representative sample thereof, namely the following animals:

7 1) poultry; 2) birds; 3) aquacultures, including all live fish; 4) rodents; 5) bees and other insects; 6) reptiles and amphibians; 7) fur animals; 8) individual animal species for zoos and circus animals, including ungulates and equidae, which are considered dangerous. Notwithstanding provisions of Article 12 Point 2) herein, clinical examination shall not be performed on experimental animals with verified health status, transported in sealed and controlled transport conditions Physical examination of load of animal origin products, animal origin food, animal origin by-products and animal feed, including mixed food products Article 14 Physical examination of load of animal origin products, animal origin food, animal origin by-products and animal feed, including mixed food products stipulated in Article 5 herein shall include: 1) examination of transport conditions and vehicle, in order to determine any inconsistency and if temperature conditions of transport are consistent with conditions prescribed for each load; 2) comparing real weight of load with weight stipulated in veterinary certificate or other document accompanying the load, including load weighting if needed; 3) examination of packaging and all marks thereon (stamps, labels, veterinary control numbers) and establishing if the prescribed conditions are met; 4) in the event of bulk products, examination of the entire set of parcels or samples, prior to subjecting it to organoleptic examination and physical, chemical and microbiological examinations. Article 15 Physical examination of load stipulated in Article 14 herein shall include checking if the load had changed state during the transport. Checking stipulated in Paragraph 1 herein shall be performed by: 1) laboratory tests on the border inspection post, performed by: (1) organoleptic examination (smell, color, consistency, taste); (2) simple physical or chemical analysis (slicing, unfreezing, cooking); 2) official sampling of load pursuant to monitoring plan, for further laboratory analysis of that load by the competent laboratories, in order to discover: (1) residues (traces of hazardous substances); (2) pathogenic causes; (3) contaminants; (4) evidence of organoleptic changes. Article 16 Physical examination of load stipulated in Article 14 herein shall be performed on certain number of samples collected from the entire load which, if needed, may be partially unloaded in the manner providing that all parts of the load are available for examination. Physical examination of load stipulated in Paragraph 1 herein shall cover 1 % of products or parcels in the load, but no less than two and no more than ten products or parcels in the load, and in the event of load containing bulk products, physical

8 examination includes collecting no less than five samples collected from different parts of the load. In the event of circumstances which may influence human and animal health and the environment, the competent organ for veterinary matters may, depending on type of load, order detailed examination of the load. Minimum and maximum quantities of goods collected as a sample for laboratory testing for health-hygiene and qualitative properties are presented in Annex 2 - Minimum and maximum quantities of goods collected as a sample, printed with and constituting these Rules. Article 17 Upon completion of physical examination of load stipulated in Article 14 herein, the border official veterinarian shall verify that the physical examination of load had been performed by sealing parcels and stamping all opened parcels with the official stamp, i.e. by resealing all containers in the event of bulk goods, having that the number of seal is registered in the document on crossing the border. III. METHOD FOR VETERINARY-HYGIENE EXAMINATION IN THE EVENT OF EXPORTED LOAD RETURN Article 18 In the event of returning load exported from the Republic of Serbia, the border official veterinarian performs review of documents and identification of load on the border inspection post, and physical examination, if needed, shall be performed on the unloading site. Review of documents stipulated in Paragraph 1 herein refers to review: 1) original certificate accompanying load, validated by the competent organ of importing country; 2) detailed rationale by competent organ of importing country on the reasons for rejecting the load; 3) documents verifying that the conditions of storing ant transport had been adhered to. Identification of load stipulated in Paragraph 1 herein shall be performed pursuant to Articles 10 and 11 herein, depending on type of load. IV. REGISTRATION AND KEEPING DATA IN THE PROCEDURE OF VETERINARY-HYGIENE EXAMINATION OF LOAD Article 19 Upon completion of veterinary-hygiene examination, the border official veterinarian presents the person responsible for the load validated copy of original certificate or another veterinary document accompanying the load, together with the veterinary document on load entry (hereinafter: the CVED), and if official sampling of the load had been performed pursuant to monitoring plan for further laboratory analysis of that load, minutes of sampling shall also be delivered to the person responsible for the load. Documents stipulated in Paragraph 1 herein shall contain the number assigned to the load by the border official veterinarian. Border official veterinarian shall retain original certificate or veterinary document accompanying the load and copy of CVED and keep such documents for three years.

9 Article 20 For each load, the following data shall be registered and kept on the border inspection post: 1) registration number of CVED; 2) date of load arrival to the border inspection post; 3) quantity (number, weight); 4) type and production category of animals, age if needed; 5) reference number of veterinary certificate; 6) country of origin; 7) destination country; 8) decision regarding the load; 9) note on sampling, if performed; 10) quantity/mass of goods collected as sample. V. FINAL PROVISION Article 21 These Rules shall come in force on the eighth day after publishing in the Official Gazette of the Republic of Serbia. 10 Annex 1 TYPES OF LOADS SUBJECT TO VETERINARY-HYGIENE CONTROL Types of loads subject to veterinary-hygiene control are listed pursuant to nomenclature of goods prescribed by the law regulating customs tariff. Notes: 1) Column 1 notes Customs Nomenclature (CN) tariff marks. When four-digit mark is noted, and it is not otherwise stipulated, products with prefix or are designated with that four signs shall be subject to veterinary-hygiene control. If veterinary-hygiene control is being performed only for some of the products noted with each heading, and if nomenclature of goods provides no further elaboration of that heading, it is designated as Ex (e.g. Ex 3002: veterinary-hygiene control is required for animal origin products only, not for the entire heading. Numbers in brackets shall not be entered in TRACES system (TRADE CONTROL AND EXPERT SYSTEM), established pursuant to separate regulation on introduction of this system in the Republic of Serbia. 2) Column 2 provides description of goods, pursuant to the law regulating customs tariff. Detailed information on goods covered by individual chapters and tariff marks are presented in explanation of harmonized system of the World Customs Organization, or are available in the explanation of the Combined nomenclature, to be applied on categorization of products in Customs tariffs. Regardless of interpretation of Combined nomenclature, text of product description in Column 2 shall be considered indicative only, considering that it covers established items of this Annex and s from Customs Nomenclature (CN), available on the day of legislating these Rules, for better understanding of loads subject to veterinary-customs control and inspection and custom procedure after the inspection. 3) Column 3 provides qualification and on individual goods. When importing animals (such as reptiles, amphibians, insects, warms and other invertebrates) or animal origin products subject to veterinary-hygiene examination, for which no veterinary conditions for import are defined, i.e. there is no harmonized import certificate, conditions shall be harmonized among the competent organ of importing and exporting country, and such harmonized certificate shall accompany the load in international commerce. The border official veterinarians examine loads and issue common veterinary entry document (CVED), noting that the examination had been performed and that the animals may be traded, or that further proceeding on subject load may be determined. Considering animal origin by-products not intended for human consumption, regardless of degree of processing or treatment, such items are subject to veterinaryhygiene control pursuant to separate regulation of the Republic of Serbia, as noted in Column 3 of this table. The border official veterinarians on border inspection posts determine if the certain product is processed in the manner, according to which, and pursuant to regulations of the Republic of Serbia, such product shall not be subjected to control.

(D) Other, such as bees (whether or not travelling in boxes or cages or hives), other insects, frogs. Heading 0106 excludes animals forming part of circuses, menageries, or other similar travelling animal shows (heading 95.08) Primates All Whales, dolphins porpoises (mammals of the order Cetacea); manatees and All dugongs (mammals of the order Sirenia) Other Domestic rabbits, and mammals other than those part of 0101, 0102, 0103, 0104, and Includes dogs and cats Reptiles (including snakes and turtles). Frogs whether for vivaria to be kept alive, or to be killed for human consumption, are covered by this heading. Sausages are included under heading Chapter 3: Fish and Crustaceans, Mollusks and other aquatic invertebrates This chapter does not cover: (a) Mammals of heading 0106; (b) meat of mammals of heading 0106 (heading 0208 or 0210); (c) fish (including livers and roes thereof) or crustaceans mollusks or other aquatic invertebrates dead and unfit or unsuitable for human consumption by reason of either their species or their condition (Chapter 5); flours, meals or pellets of fish or of crustaceans, mollusks or other aquatic invertebrates unfit for human consumption (heading 2301); or (d) caviar or caviar substitutes prepared from fish eggs (heading 1604) This chapter includes both live fish for breeding and reproduction, live ornamental fish, and live fish or live crustaceans transported alive but imported for human consumption. All products in this section are subject to veterinary checks Live fish All: Includes Trout, Eels, Carp, or any other species or any fish imported for breeding or reproduction. Live fish imported for immediate human consumption are treated for veterinary checks purposes as if they were products Fish, fresh or chilled, excluding fish fillets and other fish meat of heading 0304*.
