1 AGENDA ITEM NO. 20 CITY OF HAWTHORNE CITY COUNCIL AGENDA BILL For the meeting of May 8, 2018 Originating Department: Planning & Community Development City Manager: Arnold Shadbehr Planning Director: Brian James SUBJECT: Airport Noise Compatibility Program directed amendments to the Zoning Map to establish the boundaries of the Airport Overlay Zone (AOZ) and to the Hawthorne Municipal Code (HMC) to add Chapter 17.22C, Airport Overlay Zone (AOZ), which contains use and development standards for the noise-sensitive uses within the AOZ. RECOMMENDED MOTION: Adopt Ordinance 2157 (Second Reading). NOTICING PROCEDURES: Posting of Agenda Only. FISCAL IMPACT: None. REPORT: A. Introduction & Background The Hawthorne Municipal Airport (Airport) is a City-owned general aviation reliever airport located at South Crenshaw Boulevard (Attachment 2). The Federal Aviation Administration (FAA) approved the Noise Compatibility Program (NCP) for the Airport on December 18, 2017 (Attachment 3), which was

2 prepared to comply with Part 150 of Title 14, Code of Federal Regulations (CFR) and to implement the Airport Master Plan. The NCP was created by the City to describe the non-compatible land uses around the Airport based upon Federal regulations, address measures to reduce the impact of noise, and prevent the introduction of new noise-sensitive uses within the 65 CNEL noise contour of the Airport. An additional objective of the NCP is to improve the compatibility between aircraft operations and noise-sensitive land uses in the area, while allowing the Airport to continue to serve its role in the community, state, and nation. The approved NCP identifies amendments to the Hawthorne Municipal Code (HMC) and General Plan that are necessary to implement the NCP, ensure that the City s land use provisions are consistent with the NCP, and prevent the introduction of new noise-sensitive land uses in areas exposed to aircraft noise. B. Project Description Ordinance 2157 (Attachment 6) would accomplish the following: 1. Amend the zoning map to establish the boundaries of the Airport Overlay Zone (AOZ). The AOZ would be divided into two areas as follows: a. AOZ Area #1 (AOZ #1) follows the property borders that contain the boundaries of the CNEL noise contours for the Airport. b. AOZ Area #2 (AOZ #2) roughly follows the property borders that contain the boundaries of the CNEL noise contours for the Airport. 2. Amend Title 17 of the HMC to add Chapter 17.22C, Airport Overlay Zone (AOZ), to add use and development standards for the noise-sensitive uses within the AOZ. The main provisions of the proposed Chapter include: a. AOZ Area #1 (encompassing the 65 CNEL Noise Contour) would: Require any structure that is used by a noise-sensitive use to provide sound insulation within a newly constructed area to meet an interior noise level of 45 db CNEL. This provision would apply to any new structure, new square footage/addition, and replacement of existing habitable building area used by a noise-sensitive use.

3 Clarify that the disclosure of the potential impacts of the Airport is required during all real property transactions per the State of California Disclosure Law (California Civil Code Sections 1353(a)(1) and ). Prohibit new noise-sensitive land uses from being introduced within AOZ Area #1. This applies to the introduction of new land uses other than an existing land use and does not apply to the replacement, reconstruction, improvement, or expansion of an existing noise-sensitive land use. b. AOZ Area #2 (encompassing the 60 CNEL Noise Contour) would: Clarify that the disclosure of the potential impacts of the Airport is required during all real property transactions per the State of California Disclosure Law (California Civil Code Sections 1353(a)(1) and ). c. Make editorial amendments to Section to incorporate AOZ zone, list the RPZ Overlay in the table, and make minor format changes to the zoning summary table. C. General Plan Consistency The Project is consistent with the following goals and policies of the General Plan: 1. Noise Element POLICY 1.1: Provide for measures to reduce noise impacts from transportation noise sources. These measures include: Ensure the effective enforcement of City, State and Federal noise levels by all appropriate city divisions. Mitigate potential impacts for existing or proposed helicopter operations. Explore noise control programs as part of the Hawthorne Municipal Airport Master Plan to minimize noise levels from these operations. To help minimize noise impacts from Los Angeles International Airport, actively support the FAA Part 150 Noise Compatibility Program as described in the "Noise Control and Land Use

4 Compatibility Study, Los Angeles International Airport," (March 1984). POLICY 2.1: Incorporate noise considerations into land use planning decisions. These measures will be achieved through the following programs: Establish acceptable limits of noise for various land uses throughout the community. Zoning changes should be consistent with the compatibility of the projected noise environment. Ensure acceptable noise levels near schools, hospitals, convalescent homes, and other noise-sensitive areas. Encourage acoustical design in new construction. 2. Land Use Element GOAL 2: Every effort shall be made to ensure that both existing and future development will be and will remain compatible with surrounding desirable uses. POLICY 1.3: Hawthorne Municipal Airport and related properties shall be analyzed to explore possibilities for development while ensuring that the airport remains a vital economic asset for the community. The airport master plan shall be incorporated into this analysis. The Project implements the adopted Airport Master Plan and NCP for the purpose of describing the non-compatible land uses around the Airport based upon Federal regulations, addressing measures to reduce the impact of noise, ensuring proper disclosure, and preventing the introduction of new noise-sensitive uses within the 65 CNEL noise contour of the Airport. D. Planning Commission and City Council Hearings On April 4, 2018, the Planning Commission held a duly noticed public hearing and adopted PC Resolution recommending that the City Council approve General Plan Amendment 2018GP01, Zone Text Amendment 2018ZA03, and Change of Zone 2018CZ01. On April 24, 2018, the City Council conducted a duly noticed public hearing and introduced Ordinance 2157 and adopted Resolution 7972, which amended the General Plan Land Use Map to incorporate the Airport Noise Contours and the Noise Element of the General Plan to strengthen noise related information,

5 add policies that address noise-sensitive uses near the airport, and direct the regular update of the Airport Noise Compatibility Study. E. Environmental Analysis The proposed project constitutes a project within the scope of the California Environmental Quality Act (CEQA) and the City s CEQA Guidelines. Staff has determined that the proposed project is exempt from review under CEQA. The proposed project meets the criteria for a Class 21 Categorical Exemption pursuant to Section 15321, (Enforcement Actions by Regulatory Agencies) and a Class 5 Categorical Exemption pursuant to Section (Minor Alterations in Land Use Limitations) of CEQA. These provisions, respectively, exempt projects by regulatory agencies to enforce a general rule, standard, or objective, administered or adopted by the regulatory agency and exempt minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density. The Project would implement the adopted NCP, which was prepared to comply with Part 150 of Title 14, Code of Federal Regulations and the Airport Master Plan. The Project would incorporate the 65 CNEL noise contours and an airport overlay on properties near the Airport with slopes that are less than 20% and will not change the underlying land use or density. The Project will describe the non-compatible land uses around the Airport based upon Federal regulations, address measures to reduce the impact of noise, ensure proper disclosure, and prevent the introduction of new noise-sensitive uses within the 65 CNEL noise contour of the Airport. The ordinance is therefore exempt from the provisions of CEQA. Upon City Council s action, Staff will file the Notice of Exemption with the Los Angeles County Clerk s office in compliance with CEQA (Attachment 4). F. CORRESPONDENCE The City received a letter from Expeditors (Attachment 5) requesting that either the proposed Ordinance or the application form distinguish submittal requirements between AOZ #1 and AOZ #2 to streamline applications. Staff concurs with the comment and intends to implement the request administratively on the application forms. ATTACHMENTS:

37 ATTACHMENT 6 ORDINANCE 2157 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWTHORNE, CALIFORNIA, ADOPTING A CATEGORICAL EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AND APPROVING ZONE AMENDMENT APPLICATION 2018ZA03 TO AMEND TITLE 17 OF THE HAWTHORNE MUNICIPAL CODE TO ADD CHAPTER 17.22C, AIRPORT OVERLAY ZONE, WHICH IMPLEMENTS THE NOISE COMPATIBILITY PROGRAM FOR THE HAWTHORNE MUNICIPAL AIRPORT AND APPROVING CHANGE OF ZONE 2018CZ01 TO AMEND THE CITY S ZONING MAP TO ESTABLISH THE BOUNDARIES OF THE AIRPORT OVERLAY ZONE AND MAKING FINDINGS IN SUPPORT THEREOF WHEREAS, the Hawthorne Municipal Airport ( Airport ), is a general aviation airport that is owned and operated by the City of Hawthorne; and WHEREAS, the Airport Master Plan evaluates the Airport s capabilities and role, forecasts future aviation demand, plans for the development of facilities to meet future demand, and identifies projected noise impacts and runway protection zones; and WHEREAS, on December 18, 2017, the Federal Aviation Administration ( FAA ) approved the Noise Compatibility Program ( NCP ) for the Airport, which was prepared to comply with Part 150 of Title 14, Code of Federal Regulations ( CFR ) and to implement the Airport Master Plan; and WHEREAS, the NCP was created by the City to describe the non-compatible land uses around the Airport based upon Federal regulations, address measures to reduce the impact of noise, and prevent the introduction of new noise-sensitive uses within the 65 CNEL noise contour of the Airport; and WHEREAS, an additional objective of the NCP is to improve the compatibility between aircraft operations and noise-sensitive land uses in the area, while allowing the Airport to continue to serve its role in the community, state, and nation; and WHEREAS, the NCP identifies amendments to the Hawthorne Municipal Code ( HMC ) and General Plan that are necessary to fully implement the NCP, ensure that the City s land use provisions are consistent with the NCP, and prevent the development of new noise-sensitive land uses in areas exposed to aircraft noise; and WHEREAS, amendments to the HMC (Zone Amendment application 2018ZA03) incorporate the provisions of the Airport Overlay Zone into the text of the HMC and incorporate the boundaries of the Airport Overlay Zone onto the official Zoning Map (Change of Zone application 2018CZ01) ( Project ); and Ordinance

38 WHEREAS, based upon the information received and Staff s review and assessment, the proposed amendments are determined not to have a significant impact on the environment and are categorically exempt from the California Environmental Quality Act ( CEQA ) pursuant to CEQA Guidelines Section 15321, (Enforcement Actions by Regulatory Agencies) and Section (Minor Alterations in Land Use Limitations); and WHEREAS, on April 4, 2018, the Planning Commission held a duly noticed public hearing and adopted Resolution recommending that the City Council approve Zone Amendment application 2018ZA03 and Change of Zone application 2018CZ01; and WHEREAS, the City provided published notice of a public hearing on April 12, 2018, and the City Council held a duly noticed public hearing on the Project on April 24, 2018; and WHEREAS, at the public hearing on April 24, 2018, evidence was heard and presented from all persons in favor of the application, from all persons opposed to the application, and from members of the City staff; and that the City Council having heard and received all of said evidence, testimony, and statements and being fully informed of the application hereby approves Ordinance 2157 approving Zone Amendment Application 2018ZA03 and Change of Zone application 2018CZ01 for the Project. NOW, THEREFORE, THE CITY COUNCIL THE CITY OF HAWTHORNE HEREBY FINDS, DETERMINES, RESOLVES, AND ORDERS AS FOLLOWS: SECTION 1. All of the facts set forth in the Recitals are true and correct, and are incorporated herein by reference. SECTION 2. All necessary public meetings and opportunities for public testimony and comment have been conducted in compliance with State law and the HMC. SECTION 3. Based Upon independent review and consideration of the information contained in the Staff Report and the Notice of Exemption for the Project, the City Council has determined that the proposed Project is exempt from the requirements of preparing an Environmental Impact Report (EIR) or Negative Declaration because the project meets the criteria for a Class 21 Categorical Exemption pursuant to Section 15321, (Enforcement Actions by Regulatory Agencies) and a Class 5 Categorical Exemption pursuant to Section (Minor Alterations in Land Use Limitations) of CEQA. 39 SECTION 4. The City Council finds that the Project is consistent with the following goals and policies of the General Plan: 1. Noise Element POLICY 1.1: Provide for measures to reduce noise impacts from transportation noise sources. These measures include: Ensure the effective enforcement of City, State and Federal noise levels by all appropriate city divisions. Mitigate potential impacts for existing or proposed helicopter operations. Explore noise control programs as part of the Hawthorne Municipal Airport Master Plan to minimize noise levels from these operations. To help minimize noise impacts from Los Angeles International Airport, actively support the FAA Part 150 Noise Compatibility Program as described in the "Noise Control and Land Use Compatibility Study, Los Angeles International Airport," (March 1984). POLICY 2.1: Incorporate noise considerations into land use planning decisions. These measures will be achieved through the following programs: Establish acceptable limits of noise for various land uses throughout the community. Zoning changes should be consistent with the compatibility of the projected noise environment. Ensure acceptable noise levels near schools, hospitals, convalescent homes, and other noise-sensitive areas. Encourage acoustical design in new construction. 2. Land Use Element GOAL 2: Every effort shall be made to ensure that both existing and future development will be and will remain compatible with surrounding desirable uses. POLICY 1.3: Hawthorne Municipal Airport and related properties shall be analyzed to explore possibilities for development while ensuring that the airport remains a vital economic asset for the community. The airport master plan shall be incorporated into this analysis. The Project implements the adopted Airport Master Plan and NCP for the purpose of describing the non-compatible land uses around the Airport based upon Federal regulations, addressing measures to reduce the impact of noise, ensuring proper disclosure, and preventing the introduction of new noise-sensitive uses within the 65 CNEL noise contour of the Airport. SECTION 5. Chapter 17.22C, Airport Overlay Zone, is hereby added to Title 17, Zoning, as follows: Chapter 17.22C Airport Overlay Zone Ordinance

40 17.22C.010 Purpose. The purpose and intent of the Airport Overlay Zone (AOZ) is to: A. Implement the Hawthorne Airport Master Plan (Master Plan) and Noise Compatibility Program (NCP) for the Hawthorne Municipal Airport (Airport) as approved by the Federal Aviation Administration (FAA). B. Implement the City s General Plan to ensure that proposed land uses and development within the AOZ are consistent with the NCP. C. Prohibit the introduction of new noise-sensitive uses that are incompatible with existing and future Airport operations. D. Ensure that the Airport remains a vital economic asset for the City of Hawthorne. E. Require noise attenuated construction within the Airport environs. F. Comply with Part 150 of Title 14, Code of Federal Regulations C.020 Definitions. For the purposes of this chapter, the following terms are defined: Airport Influence Area See Airport Overlay Zone. Airport Overlay Zone (AOZ) means an irregularly shaped area depicted on the official Zoning Map that denotes an area influenced by the presence of the Airport and within its and 65 CNEL noise contours. The AOZ is divided into the following two areas: 1. AOZ Area #1 (AOZ #1) follows the property borders that contain the boundaries of the CNEL noise contours for the Airport, as shown on the General Plan Map and the approved NCP. 2. AOZ Area #2 (AOZ #2) follows the property borders that contain the boundaries of the CNEL noise contours for the Airport as shown on the General Plan Map and the approved NCP. Existing Land Use means a land use that either physically exists or else for which government approvals have been obtained through one or more of the following: 1. A valid building permit has been issued; Ordinance

41 2. A legally valid development agreement has been approved and remains in effect pursuant to Government Code Section et seq; 3. A tentative parcel or tract map has been approved and the original period, excluding extensions, has not expired; 4. A vesting tentative parcel or tract map has been approved, pursuant to Government Code Section (b) which confer a vested right to proceed with development standards in effect at the time the vesting tentative map is approved or conditionally approved ; or 5. A parcel or final map has been recorded. Noise Compatibility Program (NCP) means a report prepared for the Airport and approved by the FAA to comply with Part 150 of Title 14, Code of Federal Regulations (CFR). The NCP describes the non-compatible land uses around the Airport based upon Federal regulations, address measures to reduce the impact of noise, and prevent the introduction of new noise-sensitive uses within the 65 CNEL noise contour of the Airport. Noise-Sensitive Use means any of the following: 1. Habitable living, eating, cooking, or sleeping areas of single or multi-family residences, not including enclosed garages/parking structures and unenclosed patios; 2. Hotels and motels; 3. Hospitals and nursing homes; 4. Place of Worship, meeting halls, and mortuaries; and 5. Schools, libraries and museums C.030 Applicability. The provisions of this Chapter shall apply to all lands located within the AOZ, as mapped on the official Zoning Map. The requirements vary depending upon the location of the property as noted below in Section 17.22C.050 (Development Standards) C.040 Permitted and Prohibited Uses. As permitted, conditionally permitted, or prohibited by the underlying zoning designation unless otherwise stated in this Chapter C.050 Development Standards. Ordinance

42 Projects subject to compliance with this Chapter shall comply with the applicable standards of the AOZ Area in which the subject property is located. A. AOZ Area #1. The following provisions shall apply within AOZ Area #1: 1. Interior Noise Standard. Any structure inhabited or used by a noise-sensitive use, as defined in this Chapter, shall be required to provide sound insulation within the newly constructed area to meet an interior noise level of 45 db CNEL or less with all doors and windows closed, consistent with Title 24 of the California Code of Regulations. This provision applies to any new structure, new square footage/addition, and replacement of existing habitable building area used by a noise-sensitive use. 2. Real Estate Disclosure. The presence of the Airport and potential impacts related to the Airport shall be disclosed by the seller at the time that a sales contract is executed for all real property transactions per the State of California Disclosure Law [California Civil Code Sections 1353(a)(1) and ]. The disclosure must state that the property is located within the vicinity of the Airport and may be subject to some of the annoyances and inconveniences associated with airport operations, such as noise, vibration, or odors. 3. New Noise-sensitive Uses. New noise sensitive land uses shall not be introduced within AOZ Area #1. This applies to the introduction of new land uses other than an existing land use, as defined in this Chapter, and does not apply to the replacement, reconstruction, improvement, or expansion of an existing noise-sensitive land use. B. AOZ Area #2. The following provisions shall apply within AOZ Area #2: 1. Real Estate Disclosure. The presence of the Airport and potential impacts related to the Airport shall be disclosed by the seller at the time that a sales contract is executed for all real property transactions per the State of California Disclosure Law [California Civil Code Sections 1353(a)(1) and ]. The disclosure must state that the property is located within the vicinity of the Airport and may be subject to some of the annoyances and inconveniences associated with airport operations, such as noise, vibration, or odors C.060 Procedures. Ministerial and discretionary actions for development in the AOZ shall be reviewed by the City for compliance with the provisions of this Chapter and the NCP prior to approval as follows: A. Supplemental Application Form. A supplemental application, on a form prepared by the City of Hawthorne, shall be submitted with any application for a discretionary permit or building permit on property located in the AOZ. The supplemental application form shall be used to verify that the proposed building permit or change of use complies with the provisions of this Chapter. The Director shall have the authority to waive the requirement where it can be Ordinance

43 determined with certainty that there is no question that the alterations to the property conflict with the standards of this Chapter (e.g., wall sign, reroof, new windows, interior improvements, and landscaping). 1. Application Submittal Requirements: a. Type of land use. b. Applicable underlying zoning designation. c. Applicable AOZ Area (Area #1 or Area #2). d. Complete building or discretionary permit application including information deemed sufficient by the Department of Building and Safety to show that the project complies with the interior noise provisions of this Chapter, if applicable. B. Compliance with the Airport Overlay Zone Project Review Checklist. C. If, during the course of review, the City identifies potential airport related concerns, the Director of Planning and Community Development has the authority to require that the project be referred to the Airport Zoning Commission for review. SECTION 6. Section , Established, of Chapter 17.10, Use Classification, of Title 17, Zoning, is hereby amended as follows: Established. In order to accomplish the purpose of this title, use classifications are established, in each of which regulations are prescribed concerning the permissible uses, the height and bulk of buildings, the area of yards and other open spaces about buildings, and determining the density of population, such classifications to be known as follows: Base Zoning Districts H Horticultural classification Low-density residential classification Medium-density residential classification High-density residential classification R-4 Maximum-density residential Restricted service classification CR Regional Regional commercial use classification Commercial C-2 Local commercial classification General commercial classification CM Mixed commercial M-1 Limited industrial classification M-2 Heavy industrial classification Overlay Zones Ordinance

44 TIO MU FO RPZ AOZ Trucking intensive overlay zone, which shall be those areas within the M-2 zone shown on the official zoning map Mixed-use overlay zone, which shall be those areas within the C-1 or zones shown on the official zoning map Freeway overlay zone, which shall be those areas within any non-residential zones that are within 500 feet of the edge of the I-405 or I-105 freeways, as shown on the official Freeway Overlay Zone Map Runway protection zone, which shall be a trapezoidal area off the end of the runway on the eastern side of airport (Runway 25) that serves to enhance the protection of people and property on the ground. Airport overlay zone, which shall be an irregularly shaped area that denotes an area influenced by the presence of the Hawthorne Municipal Airport and within its CNEL noise contours or safety zones. The AOZ is divided into AOZ Area #1 and AOZ Area #2. SECTION 7. The City Council hereby adopts Change of Zone 2018CZ01, amending the Hawthorne Zoning Map b y creating the Airport Overlay Zone as shown in Exhibit A. SECTION 8. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause a summary of the same to be published once in an adjudicated newspaper in the City of Hawthorne and post a certified copy of the proposed ordinance in the City Clerk s office at least 5 days before the City Council meeting at which the ordinance is to be adopted. Within 15 days after adoption of the ordinance, a summary of the ordinance must be published with the names of the council members voting for and against the ordinance. SECTION 9. If any provision, clause, sentence or paragraph of this Ordinance or the application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions of this Ordinance which can be given effect without the invalid provisions or application, and to this end the provision of this Ordinance are declared to be severable. SECTION 10. This Ordinance shall supersede any and all inconsistent provisions contained in the Hawthorne Municipal Code and any amendments thereto.
