1 ITEM NO. : 10.2 Town Council Meeting Date: May 17, 2017 TOWN OF WINDSOR AGENDA REPORT To: From: Subject: Mayor and Town Council Ken MacNab, Community Development Director Adoption of an Ordinance Prohibiting Smoking in Multi-Unit Buildings and Common Areas Recommendation to Council: Hold a second reading, by title only, and adopt an ordinance amending Title III, Chapter 20 of the Town of Windsor Code to prohibit smoking in multi-unit buildings and common areas. Background and Discussion: Smoking and secondhand smoke (SHS) are harmful to the health of smokers and nonsmokers. SHS exposure increases the risk of Sudden Infant Death Syndrome and makes childhood asthma worse. SHS exposure is the sixth leading cause of death in the U.S. The California Air Resources Board declared SHS smoke to be a toxic air contaminant, putting it in the same classification as diesel exhaust, benzene, and arsenic. The United States Surgeon General has concluded that there is no risk-free level of exposure to SHS and neither separating smokers from nonsmokers nor installing ventilation systems eliminates exposure to secondhand smoke. There are numerous studies that document the health harm caused by exposure to secondhand smoke. In 2008, the Town of Windsor adopted an Ordinance prohibiting smoking in public places. Windsor Municipal Code Chapter 20 - Prohibition of Smoking was enacted to provide for the health, safety, and welfare by discouraging the inherently dangerous behavior of smoking around nonsmokers; by protecting children from exposure to smoking while they play; by protecting the public from smoking and smoking-related litter and pollution; and, by affirming and promoting the family atmosphere of the Town of Windsor parks and public places. Currently, Chapter 20 prohibits smoking in all recreational areas, playgrounds, outdoor dining areas, within 20 feet of a building entrance, opening, crack, or vent of a business. The definition of smoking in Chapter 20 includes inhaling or exhaling from, or possessing, a lighted pipe, lighted cigar, operating electronic smoking device, or lighted cigarette of any kind, or the lighting of a pipe, cigar, electronic smoking device, or cigarette of any kind, including but not limited to, tobacco, or any other weed or plant. As part of the direction provided to staff with respect to the implementation of Proposition 64, the Council included development and implementation of regulations extending the ban on smoking to include multi-family residential units as part of a larger goal addressing recreational marijuana. As such, the Town held two community workshops to receive public input on an ordinance prohibiting smoking in multi-unit buildings. Specific outreach was made to apartment owners and apartment residents. In response to the input received at these workshops, and in consultation with local experts and other communities who have adopted similar ordinances, staff prepared a draft ordinance that 1 of 2

2 would prohibit smoking in multi-unit buildings. The draft ordinance was presented to the Town Council at a noticed public hearing held on May 3, The draft ordinance amends Title III entitled Public Welfare of the Town of Windsor Municipal Code by modifying Chapter 20, entitled Prohibition of Smoking to prohibit smoking of tobacco, cannabis or any other substance in multi-unit residential buildings. Multiunit residential buildings are defined as residential properties containing two or more units with one or more shared walls, floors or ceilings, including but not limited to apartments, residential cooperatives, residential condominiums, residential care facilities licensed by the State, duplexes, and other attached housing. The draft ordinance would prohibit smoking in all existing and new units that are located in a multi-unit residential building, including any associated exclusive use enclosed area or unenclosed area, such as, for example, a private balcony, porch, deck, or patio. The draft ordinance would also prohibit smoking in any shared common area located on a multi-unit building property and increase the reasonable distance standard from 20 feet to 25 feet. At the May 3, 2017 Council meeting, staff noted that two condominium properties in Town which would be subject to the new ordinance currently allow smoking. The two properties were identified as the Town Green Village and Courtyards East, and both were notified of the proposed ordinance. The remainder of the units affected (mostly apartments) already have a nosmoking policy in place. After receiving a staff report, public testimony and deliberating on the draft ordinance, the Town Council took action to introduce the ordinance as drafted and hold a first reading, by title only. The motion to introduce was carried by a 4 to 1 vote in favor (Vice Mayor Foppoli voting no). Fiscal Impact: Based upon the experiences of other communities in Sonoma County, staff estimates that enforcement of an ordinance prohibiting smoking in multi-unit buildings will require one to three hours of existing staff time per month at an estimated annual cost of $2, A portion of this cost may be recovered through fines. Environmental Review: An ordinance prohibiting smoking in multi-unit buildings is general policy and procedure making and has no potential for resulting in a direct physical change in the environment, and is therefore not a project for purposes of the California Environmental Quality Act (CEQA) and Title 14 of the California Code of Regulations. No further environmental review is required. Attachments: 1. Ordinance Prohibiting Smoking in Multi-Unit Buildings Clean Version 2.
