1 SECTION: Community Services #: ADMIN2O17-OI : Alcohol Risk Management Policy PURPOSE: The Township of Manitouwadge owns and manages facilities where alcohol consumption is permitted under the authority of a Special Occasion Permit issued by the Alcohol and Gaming Commission of Ontario, and other facilities where alcohol consumption is not permitted. The Township has developed an Alcohol Risk Management Policy to prevent problems that arise from alcohol consumption within its facilities and to promote a safe, enjoyable environment for those who use these facilities. A range of problems can arise from excessive and inappropriate consumption of alcohol. These problems can affect drinkers themselves, other people who use the facilities, and the public at large, and include: vandalism and destmction of property; police being called to municipal property; injuries to drinkers or other individuals; liability action against the municipality; increased insurance rates or loss of insurability arising from alcohol-related injuries or death; charges laid against the municipality or Special Occasion Permit holders under the Liquor Licence Act; suspension or loss of alcohol permit privileges by the Alcohol and Gaming Commission of Ontario

2 loss of employment by non-drinkers and moderate drinkers using municipal facilities; complaints lodged by offended parties; and increased public concern about excessive alcohol consumption. In most instances, these problems are not caused by moderate drinkers or those who respect the mies regarding alcohol consumption. Most problems are caused by drinkers who engage in four specific drinking practices: a. drinking to intoxication; b. drinking and driving; c. underage drinking; and d. drinking in prohibited areas To the extent that these four drinking practices are reduced or eliminated, the likelihood of alcohol- related problems will correspondingly diminish. For those who do not engage in the targeted drinking practices, the policy will be minimally intrusive, and in many cases, not noticed at all. The policy is neither designed nor intended to stand in opposition to legal or responsible drinking. Purpose of the Policy The Alcohol Risk Management Policy consists of measures designed to prevent alcohol related problems and to increase the enjoyment of those who use the facilities. By reducing the potential for alcohol related problems, the Township of Manitouwadge increases user enjoyment of the facilities, reduces the risk of injury and death, and reduces the risk of liability action. In this context, the purpose of the policy is to introduce bathers which impede the adoption of the targeted drinking practices. 3

3 Organization of the Policy The policy is divided into four sections: I. designation of areas where alcohol use is prohibited; 2. designation of areas where the conditional use of alcohol is permitted; 3. specification of conditions under which alcohol use is permitted; and 4. enforcement procedures for violations of the policy. : Section Rationale 1: Areas Where Alcohol Use is Prohibited The Township injured in relation to events of Manitomiadge recognizes its ihere potential/br liability should anyone be alcohol is served bi its facilities. Accordingly, the following conditions are intended to prevent participants at such events from drinking under age, becoming intoxicated, or engaging in potential/v hannful activities. By controlling the entrance to the event, the Permit Holder can prevent intoxicated, rout/v. or zu,authorized persons fiwix gaining entn, thereby reducing the likelihood subsequent problems. The Liquor Licence Act of Ontario prohibits the consumption of alcohol in public places unless a licence or a Special Occasion Permit has been issued by the Alcohol and Gaming Commission of Ontario. In accordance with the Liquor Licence Act, the consumption of alcoholic beverages is prohibited in all areas, including parks, parkettes, sports facilities, recreation facilities and service facilities in the Township of Manitouwadge. unless specifically designated othenvise. Township Council may change the designation of any site at its discretion Users who seek permission to use these facilities will be required to sign a form agreeing that people included in the activity or organizing the event will not be intoxicated and will not consume alcohol during the period of use. (See Appendix A.) Section 2: Areas Designated for the Conditional Use of Alcohol There are areas currently designated for alcohol use under the authority of a Special Occasion Permit issued by the Alcohol and Gaming Commission of Ontario. The Township of Manitouwadge Council or its authorized agents may change the designation of any site at their sole discretion. Areas designated for the conditional use of alcohol include: Manitouwadge Arena Community Centre Auditorium Manitouwadge Ballfield Manitouwadge Curling Club 4

5 Manitouwadge Golf Course Kiwissi Ski Centre Golden Age Center Section 3: Conditions Under Which Alcohol Use is Permitted The Township of Manitouwadge is under no legal obligation to allow alcohol to be served on its property, but has elected to allow alcohol to be served as long as certain conditions are met. In addition to obtaining a Special Occasion Permit from the Alcohol and Gaming Commission of Ontario, the person or organization responsible for the event (hereafter referred to as the Permit Holder) is required to meet the following conditions. 3.1 Category: Control Thc Permit Holder will attempt to retain the set-vices of two paid duty police officers through the Manitouwadge OPP detachment to assist with the safe running of events where attendance exceeds 300 people Section above does not apply to events held by invitation only (ie. weddings) The Permit Holder will accept one of the following forms of identification; a military card, a citizenship card, a drivers licence, a LCBO BYID photo card, a Secure Indian Status Card, a Permanent Resident Card, a passport or a photo card issued under the Photo Card Act as identification for alcohol purchase or consumption. The Permit Holder or designated assistants will ask for proper identification from all persons who appear to be under the age of 19. Notification regarding this procedure will be posted at the entrance. (See Appendix C.) At events where under age persons are allowed entry (ie. weddings), those persons who are not of legal age will be identified. 5

6 3.1.5 A sign will be posted at the door stating the law on the entry of underage individuals. Another sign will be posted at the bar, and if applicable, at the ticket counter, stating that it is unlawful for under age individuals to obtain or consume alcoholic beverages. (See Appendix C) Individuals who appear to be intoxicated or who are rowdy will be refused entry to the event. If a dispute arises from someone denied access, the Permit Holder will make the final decision about who is permitted to enter The Permit Holder will ensure that bartenders and servers do not provide alcohol to under age or intoxicated persons at the event. Any underage person found to be consuming or in possession of alcohol must be ejected from the event immediately The Permit Holder will provide monitors to assist with the running of the event. There will be at least I monitor per 150 participants. Monitors will supervise the event, encourage responsible drinking, and address problems which arise Monitors, bartenders, and servers will not consume or be under the influence of akohol while on duty during the event Bartenders and ticket sellers will hold Smart Serve Certification. SIP certification prior to 1995 will be accepted The Permit Holder will submit a list to the Community Services Department (at least one week before the event) of the bartenders and servers who will be on duty during the event. 6

7 The Permit Holder will be responsible for recognizing the need for assistance during the event, in relation to denying access, denying alcohol service, removing individuals from the event, and any other situations where there is misconduct or foreseeable risk of harm, and requesting it from the appropriate Township of Manitouwadge staff or Police. 3.2 Category: Sale of Alcohol Rationale By limiting the number of tickets or drinks that can be obtained at one time, ticket sellers and bartenders are provided with more opportunth to observe participants for signs of intoxication. The elimination of volume discounts removes any financial incentive to overdrink. Eliminating last call and closing ticket sales well before the end oft/ic event reduces the likelihood ofparticipants overdrinking toward the close of the event, a time where nanv incidents related to intoxication develop When tickets are sold for alcoholic beverages, there will be a limit of 4 tickets per person for any purchase. Discounts will be not offered for the volume purchase of tickets (eg. 5 tickets for the price of 4). given for remaining unused tickets if requested. At the end of the evening reftmds will be When there is a cash bar or when alcohol is supplied with no cost to participants, each person will be limited to 2 alcoholic drinks at a time. Discounts will not be offered for the volume purchase of alcoholic beverages Alcoholic drinks will be sold only in soft plastic cups, and will be limited to a single standard serving (12 ounces of beer, no more than I V2 ounces of spirits, and no more than 5 ounces of wine). Glass wine glasses may be used during a dinner and must be removed immediately after the dinner A sign will be posted at the bar and, if applicable, at the ticket counter stating the law on serving to intoxication. Signs will be provided by the Township of Manitouwadge to the Permit Holder at the time of approval for use of the facility or area. (See Appendix C for sample text.) 7

8 3.2.5 There vi11 be no last call for purchasing alcoholic beverages, and the sale of tickets will cease at 1:30 am. The Permit Holder will post a sign to this effect. (See Appendix C for sample text.) 3.3 Rationale Category: Low Alcohol and Non-Alcoholic Options Lou alcohol beverages help prevent intoxication by providing responsible consumers with an opporumitv to consume less alcohol per drink, (hereby reducing the likelihood of becoming intoxicated. A light beer (at 4% alcohol,) represents a 20% rethiction in alcohol content over a regular beer (at 6% alcohol). Beer with 5.5% and 5.6% alcohol should be avoided as they represent a 10-12% increase in alcohol per drink. Sin,ilarlj, beers with 7% alcohol should be avoided as they represent a 40% increase in alcohol per drink The Permit Holder will ensure that a portion of the beer offered consists of low alcohol options (ie. 4% alcohol by volume). Low alcohol options will be highlighted by either displaying containers (bottles or cans) or by posting their availability on a sign either at the ticket counter or the bar No beer with an alcohol content greater than 5% by volume will be available to participants The Permit Holder is encouraged to provide non-alcoholic drinks throughout the event and to provide such drinks at no cost to designated drivers. 8

Concerns related to alcohol consumption will be dealt with by the Permit Holder or the facility manager on duty. The Pennit Holder will post a sign directing participants who have a complaint to approach the Permit Holder, the facility manager, or the Director of Community Services, in that order. (See Appendix C for sample text.) The Permit Holder will obtain liability insurance for a minimum of two million dollars, and submit proof of insurance to the Community Services Department two weeks prior to the event. Coverage in this policy will be extended to both the event organizers and to the Township of Manitouwadge The Pennit Holder will advise the Township should the insurance coverage be cancelled after submitting proof of insurance. The Permit Holder will not hold the event without satisfactory insurance coverage In the event of an incident (accidents or mishaps in relation to alcohol consumption or facility safety), the Permit Holder will complete an incident report, supplied by the Township of Manitouwadge, and submit it immediately to the facility manager on duty. 9

10 3.5 Category: Safe Transportation Rationale The risk of liability action is increased when an impaired driver leaves an alcohol related event. For this reason, event organizers must assume responsibility for promoting safe transportation for all drinking participants, and in particular for those who are legally impaired. Safe transportation options are essential since the only way to reduce impairment levels is with time The Permit Holder shall provide, at his or her expense, safe transportation within the municipality for drinking participants, and this service shall be advertised at the event. Examples of safe transportation options are: a) designated drivers provided by the sponsoring group; b) taxis paid by the sponsoring group: c) bus service organized by the sponsoring group. 3.6 Category: Other The Township of Manitouwadge reserves the right to introduce other conditions which reduce the likelihood of alcohol-related harm, or to make exceptions to these conditions to accommodate extraordinary events or circumstances. Section 4: Enforcement Procedures for Policy Violations 4.1 Areas Where Alcohol is Prohibited A violation of this policy occurs when individuals consume alcohol in an area where alcohol consumption is prohibited. Group organizers or members, municipal staff, or the OPP may intervene if there is a policy violation Group organizers or members may intervene by infonning the offending individual(s) that the alcohol policy prohibits alcohol consumption and asking that the violation stop. They should feel encoñraged to manage situations in this 10

11 way because a response by other authorities could result in a loss of privileges or legal charges Upon witnessing a violation, staff members of the Township of Manitouwadge will take steps to ensure that the policy violation stops. Staff members will ask that the consumption of alcohol stop, and may ask the individual or organized group to leave the facility or area, depending on the circumstances and the nature of the violation (paying particular attention to the potential for harm, for loss of enjoyment by non-drinkers, or for complaints). Should the individuals or group members fail to comply, the staff member will call the police for enforcement. If the event in question is a tournament, the offending team will be disqualified immediately. It is the responsibility of the host team(s) to make guest teams aware of this policy User groups which have violated the policy will receive a registered letter identifying the violation and indicating no further violations will be tolerated. The letter will specify penalties should a second violation occur Should a second violation occur; the group will have its contract for use of the area suspended for a period of one week. Should the group be part of a league (ie. a sports team), the suspension may be applied to the entire league, at the sole discretion of the Director of Community Services Should a third violation occur; the group will have its contract for use of the area suspended for the remainder of the season or time period specified in the contract. Should the group be part of a league, the suspension may be applied to the entire league, at the sole discretion of the Director of Community Services A member of the OPP detachment may intervene in a violation of this policy, either on his or her initiative or in response to a request from staff or the general II

The police officer may order the individuals or organized group to leave the facility or area, and may. at his or her discretion, lay charges against the offending individuals under the Liquor Licence Act of Ontario or any other relevant legislation. The police have the right to seize any alcohol that is used in the commission of an offence under the Liquor Licence Act. 4.2 Areas Where Alcohol is Permitted A violation of this policy occurs when the Special Occasion Pennit Holder fails to comply with the condition of the Liquor Licence Act of Ontario or the Township of Manitouwadge Alcohol Risk Management Policy. Event organizers, municipal staff, OPP officers, or an Inspector of the Alcohol and Gaming Commission of Ontario may intervene if there is a policy violation The Permit Holder, one of the event organizers, or a designated monitor may intervene by informing the offending individual(s) of the policy violation and asking that it stop. These individuals should feel encouraged to manage situations in this way because a response by other authorities could result in a loss of privileges or legal charges At ffinctions where Township of Manitouwadge staff may not normally be on duty, they have the right to visit the event to ensure adherence to the Liquor Licence Act and the Township of Manitouwadge Alcohol Risk Management Policy Upon witnessing a violation, staff members of the Township of Manitouwadgc will take steps to ensure that the policy violation stops. In addition, depending upon circumstances and nature of the policy violation, the Permit Holder maybe asked to close down the event. In making this judgement. staff members will consider the potential for harm, the willffil nature of the violation, and the potential for complaints. Should the Permit Holder fail to comply, the Police will be called for enforcement. 12

13 4.2.5 Permit Holders who have violated the Township of Manitouwadge Alcohol Risk Management Policy will be sent a registered letter advising of the violation, and indicating that no further violations viil be tolerated, and specifying penalties for a second violation. Some violations are serious enough to warrant immediate denial of future use of municipal facilities. This decision will be made by the Director of Community Services Should a second violation occur; the group will be notified by registered letter that they are suspended from use of the facility or area for a period to be determined by the Director of Community Services A member of the OPP detachment or an Inspector from the Alcohol and Gaming Commission of Ontario may intervene in a violation of this policy at his or her initiative, or in response to a request from a staff member or a member of the general public. Charges may be laid under the Liquor Licence Act of Ontario or any other relevant legislation, and any alcohol used in the commission of an offence under the Liquor Licence Act of Ontario may be seized. 14 S4 Township of Manitouwadge Alcohol Risk Management Policy Special Occasion Penn it Holder Checklist This checklist is designed to help you and your group comply with the conditions of the Liquor Licence Act and the Township of Manitouwadge Alcohol Risk Management Policy. H H Proof of liability insurance (minimum $2 million) submitted. List of bartenders, servers, and ticket sellers submitted one week prior to the event. Safe transportation options have been arranged. Police services have been requested (for non-invitational events of 300 or more participants). H H H H The appropriate number of monitors have been secured (1 monitor per 150 participants). A copy of the Special Occasion Permit is posted. A sign is posted regarding no announced last call and the closure of ticket sales at 1:30 a.m. The appropriate signs regarding unlawful entry and consumption are posted at the door and bar ticket counter respectively. (See Appendix C of the Township of Manitouwadge Alcohol Risk Management Policy for sample text.) A sign is posted stating the availability and price of non-alcoholic beverages. A sign is posted which indicates who should be contacted if a participant wishes to lodge a complaint. Optional: Signs maybe supplied by the Township of Manitouwadge.

15 I Appendix A Township of Manitouwadge Alcohol Risk Management Policy FacilTh Use Agreement Form Non-Licensed Event As the designated contact person for:. I understand that use of facilities owned by the Township of Manitouwadge is conditional upon acceptance of the following conditions: I. Alcohol cannot be consumed in the facility or area for which use has been requested. No person participating in our activities will be permitted to consume alcoholic drinks. No person who is intoxicated or who is otherwise unable to participate safely as a result of drinking alcoholic beverages will he permitted to participate. 2. If any member of our team/group violates the conditions stipulated in Item 1 above, I understand that any of the following actions may be taken by the Township of Manitouwadge, at its sole discretion: a. the game or event in which the infraction occurs may be closed down at the time of the infraction; b. the team/group that I represent may have its privileges for use suspended for the remainder of the season or period of the contract. 3. Prior to use of the requested facility, I will submit to the Community Services Department, the names and addresses of team captains, coaches, or other responsible contact persons so that a brochure outlining the above conditions can be sent directly to them. All persons who appear to be under 19 years of age must produce a photo driver s licence or other government issued photo identification. (to be posted at the door) 2. It is illegal for persons under 19 years of age to purchase or consume alcoholic beverages. (to be posted at the bar(s) and ticket counter(s)) 3.
