1 Intoxilyzer 8000 (OH-5) What You Need to Know
2 Theory of Operation: 1. The Intoxilyzer 8000 uses the method of INFRARED ABSORPTION to analyze the breath sample. 2. The IR light source is a PULSED INFRARED light. 3. The wavelength frequency is 3.4 and 9.4 MICRONS for alcohol and other interfering substances. 4. The decrease in intensity of the JR light due to absorption by alcohol in the breath sample is proportional to the amount of alcohol in the breath. 5. The sample chamber holds 29.4 cc=s of deep lung air for the analysis. This translates into a greater sensitivity of the machines with the longer light paths. Source DataMaster Supervisor Guide p. 2. Both the DataMaster and the Intoxilyzer 5000 EN utilized a spinning wheel containing multiple filters to test specific frequencies for infrared light absorption. The Intoxilyzer 8000 does not use a wheel, but rather pulses the light. The elimination of the wheel eliminates moving parts, hypothetically decreasing the possibility of maintenance, but also requires a slower processor, which results in a reduced number of samples of the breath, which reduces the sensitivity of the machine to errors.
4 In particular, the short light path and slow operating speed, due to the pulsed infrared lamp, makes the Intoxilyzer less able to reliably detect mouth alcohol and flag invalid samples compared to existing older technology.
5 The processor in the DataMaster series of machines runs at 525 megahertz which results in 125 samples per sec of the breath sample. The Intoxilyzer 8000 only takes 4 samples per second of the breath sample. The result is that the Intoxilyzer is not able to detect the negative slope with the same accuracy or reliability as other machines on the market, including the older Intoxilyzer 5000 EN and the DataMaster family of machines. The result is that the Intoxilyzer 8000 is less able to detect mouth alcohol in subjects. This has been verified by testing conducted by the Alaska Department of Highway Safety, which after the testing, has not
6 approved the machine for use in Alaska. Similar testing in Minnesota has caused that state to not approve the Intoxilyzer 8000 for use in Minnesota. The Intoxilyzer does leap ahead in that the test sequence provides for two breath sample and two external calibration checks. This is the dual testing that has been recommended for forensic testing since at least the 1970s and utilized in many other states. This same capability has been available in the existing breath testing machines, but has never been utilized by the Department of Health, although it s implementation would not have increased the cost of breath testing and could have been enabled by the pushing of a few buttons without even having to take the machines out of service. National standards for forensic testing utilizing other testing methods used to test bodily fluids and substances, such as the gas chromatograph, have been required to utilize multiple point calibration checks and quality control samples to be run with at least two samples of the unknown sample for years. Many states has used dual testing for years as a basic check of the accuracy of their breath tests. Another feature of the Intoxilyzer 8000 is that it will automatically report the results of all breath tests and calibration checks to a database maintained by the Ohio Department of Health, which is available on line to
7 the public. Anyone can access the database and review information on all the machines and tests. A similar online data collection has been utilized by several states for several years, with the additional benefit of being able to compare the data by the downloading of the data in spreadsheet format. This feature is not available with the existing Ohio format. The online data collection feature was also available on previous machines approved in Ohio, but ordered either removed or deactivated. This is somewhat paradoxical in that the whole concept of the DataMaster family of machines was the ability to collect test data and report it to a central data base, as is now being done with the Intoxilyzer 8000 (OH-5), but not the (OH-2) version utilized by the Watercraft Division. The Intoxilyzer 8000 also has some bells and whistles not available on the older machines. It has a scanner that can read the magnetic strip on driver s licenses and automatically enter the data on various forms generated by the machine. The machine can also read the operator s access card, which is used to automatically enter the operator s information. The number of forms that the Intoxilyzer prints out is dependent on what the operator requests. Several standard OVI forms, including a BMV 2255 form can be generated.
8 The test record printout also contains a significant amount of information not available on the older machines approved by the Department of Health. The specific information will be presented during the seminar presentation. A wealth of information on the Intoxilyzer 8000 (OH-5) and the tests are available on line. In perusing test results a number of impossible test results have been noted, together with a significant number of incomplete tests with ambient fail results. Some of these tests will be displayed during the presentation.

The first test is well over the legal limit and the second test is just under the legal limit. A single test would only have reported the higher test result. Note that the machine did not report an invalid sample error. This is a good example why single tests should not be admitted in OVI cases.
