BEFORE THE NORTH CAROLINA MEDICAL BOARD In re: Nick Rohit Patel, M.D., NON-DISCIPLINARY CONSENT ORDER Respondent. This matter is before the North Carolina Medical Board ("Board") on information that Nick Rohit Patel, M.D. ("Dr. Patel), committed unprofessional conduct within the meaning of N.C. Gen. Stat. 90-14(a)(6). Dr. Patel admits, the Board finds concludes, that: Whereas, the Board is a body duly organized under the laws of North Carolina is the proper party to bring this proceeding under the authority granted it in Article 1 of Chapter 90 of the North Carolina General Statutes the rules regulations promulgated thereto; Whereas, Dr. Patel is a medical doctor licensed by the Board on or about February 15, 2012, license number 2012-00208; Whereas, during the times relevant herein, Dr. Patel practiced medicine in a locum tenens capacity for a company located in Greensboro, North Carolina; Whereas, on February 9, 2012, Dr. Patel tested positive for cannabinoids on a pre-employment drug screen; Consent Order - Nick Rohit Patel, M.D. Page 1 of 7
Whereas, on March 4, 2012, in a drug screen, Dr. Patel tested negative for cannabinoids; Whereas, on March 8, 2012, in two (2) drug screens, Dr. Patel tested positive for cannabinoids; Whereas, as a result of the positive drug screen, Dr. Patel self-referred to NCPHP on March 28, 2012, underwent an assessment by NCPHP at which time Dr. Patel tested negative for cannabinoids; Whereas, NCPHP recommended that Dr. Patel obtain an evaluation at a professional's center; Whereas, Dr. Patel complied with the NCPHP recommendation completed an assessment at the Talbott Recovery Campus on April 16, 2012 through April 19, 2012, during which assessment both urine hair screens tested negative for cannabinoids; Whereas, the Talbott assessment team's diagnosis relative to improper drug use by Dr. Patel was "Rule out cannabis abuse"; Whereas, subsequent to the February 9, 2012 drug screen, Dr. Patel, except for approximately 30 days, has been actively employed in medical practice without incident with the knowledge of his supervising physician of the referenced drug Consent Order - Nick Rohit Patel, M.D. Page 2 of 7
screens, Talbott assessment, involvement of NCPHP the Board; Whereas, commencing May 10, 2012, Dr. Patel, voluntarily, has been undergoing providing drug screens to NCPHP the Board, all of which screens have been negative for cannabinoids; Whereas, Dr. Patel denies use of marijuana or other illegal drugs; Whereas, Dr. Patel acknowledges agrees that the Board has jurisdiction over him over this subject matter; Whereas Dr. Patel knowingly waives his right to any hearing to any judicial review or appeal in this matter; Whereas, Dr. Patel acknowledges that he has read understs this Non-Disciplinary Consent Order enters into it voluntarily in order to resolve this matter without the need for formal proceedings; Whereas, the Board has determined that it is in the public interest to resolve this matter as set forth below. NOW, THEREFORE, with Dr. Patel's consent, it is ORDERED that: 1. Dr. Patel shall maintain a six (6) month diagnostic monitoring contract with NCPHP shall abide by its terms, including the timely payment of any all fees required by Consent Order - Nick Rohit Patel, M.D. Page 3 of 7
NCPHP. Dr. Patel also agrees to extend the diagnostic monitoring contract with NCPHP if they recommend such an extension. 2. Upon request by the Board, Dr. Patel shall supply urine, blood, hair, or any other bodily fluid or tissue sample the Board might reasonably require for the purposes of analysis to determine if he has consumed any of the substances mentioned above. All costs of obtaining analyzing such samples shall be borne by Dr. Patel. 3. Dr. Patel shall obey all laws. Likewise, he shall obey all rules regulations involving the practice of medicine. 4. Dr. Patel shall notify the Board in writing of any change in his residence or practice addresses within ten (10) days of the change. 5. Dr. Patel shall meet with the Board or members of the Board for an informal interview at such times as requested by the Board. 6. If Dr. Patel fails to comply with any of the terms of this Non-Disciplinary Consent Order, that failure shall constitute unprofessional conduct within the meaning of N.C. Gen. Stat. 90-14(a)(6) shall be grounds, after any required notice hearing, for the Board to annul, suspend, or Consent Order - Nick Rohit Patel, M.D. Page 4 of 7
revoke his license to practice medicine surgery, to deny any application he might make in the future or then have pending for a license. 7. This Non-Disciplinary Consent Order shall take effect immediately upon execution by both Dr. Patel the Board, it shall continue in effect until specifically ordered otherwise by the Board. 8. Dr. Patel hereby waives any requirement under law or rule that this Non-Disciplinary Consent Order be served upon him. 9. Upon execution by Dr. Patel the Board, this Non-Disciplinary Consent Order shall become a public record within the meaning of Chapter 132 of the North Carolina General Statutes shall be subject to public inspection dissemination pursuant to the provisions thereof; 10. This Non-Disciplinary Consent Order is not an admission by Dr. Patel that he has committed any act that would constitute unprofessional conduct, is not an adverse nor disciplinary action, nor a negative action or finding, by the Board, is not reportable to the National Practitioner Data Bank, the Federation of State Medical Boards, or any other entity, except for publication on the Board website, shall not otherwise be voluntarily reported or disseminated.
