Presentation Objectives What is the intent of FDA in regulating CPAs? What specifics does the Act require? Is there an FDA plan to address CPAs?

Excerpt of Remarks to Cooperation Centre for Scientific Research Relative to Tobacco (CORESTA) Congress (Dr. David Ashley, Sept 2010) As you know, we are also requiring tobacco manufacturers to submit detailed lists of ingredients. But there are some in the tobacco industry who have actually told us that they know very little about where the tobacco they use comes from or under what conditions it was grown and stored, let alone what s in it. Quite frankly, that kind of response is a throwback to another age. Today, we take it as a given that manufacturers of all products understand their obligation to make sure they know and consumers know what goes into the products that they are putting on the market.

SEC. 906. GENERAL PROVISIONS RESPECTING CONTROL OF TOBACCO PRODUCTS (e) GOOD MANUFACTURING PRACTICE REQUIREMENTS (1) METHODS, FACILITIES, AND CONTROLS TO CONFORM. (A) IN GENERAL. the Secretary shall prescribe regulations.requiring that that methods used in, and the facilities and controls used for, the manufacture preproduction design validation,, packing, and storage of a tobacco product conform to [cgmp] or [HACCP] methodology, as prescribed in such regulations to assure that the pubic health is protected and that the tobacco product is in compliance with this chapter. Such regulations may provide for the testing of raw tobacco for pesticide chemical residues regardless of whether a tolerance for such chemical residues has been established.

SEC. 907. TOBACCO PRODUCT STANDARDS (a) IN GENERAL (1) SPECIAL RULES.-- (B) ADDITIONAL SPECIAL RULE. Beginning 2 years after the date of enactment of the Family Smoking Prevention and Tobacco Control Act, a tobacco product manufacturer shall not use tobacco, including foreign grown tobacco, that contains a pesticide chemical residue that is at a level greater than is specified by any tolerance applicable under Federal law to domestically grown tobacco.

Federal Law FIFRA -- Under FIFRA Section 3, all new pesticides (with minor exceptions) used in the United States must be registered by the Administrator of EPA. Pesticide registration is very specific; it is not valid for all uses of a particular chemical. Each registration specifies the crops/sites on which it may be applied, and each use must be supported by research data. Ordinarily, the manufacturer (domestic or foreign) of the pesticide files an application for registration. Federal Law Federal Environmental Pesticide Control Act of 1972 (FEPCA) which amended FIFRA by specifying methods and standards of control in greater detail. Subsequent amendments have clarified the duties and responsibilities of the EPA. In general, there has been a shift toward greater emphasis on minimizing risks associated with toxicity and environmental degradation, and away from pesticide efficacy issues. Food Quality Protection Act of 1996 (FQPA) (P.L. 104-170) This Act amends both the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and the Federal Food, Drug, and Cosmetic Act (FFDCA). It establishes a more consistent, protective regulatory scheme for pesticides, mandating a single health-based standard for all pesticides in foods, in addition to advancing other protective provisions. Federal Food, Drug and Cosmetic Act of 1996 (FFDCA) The FFDCA, among other provisions, regulates the establishment of pesticide tolerances (maximum permissible levels) for pesticide residues in or on commodities for human food and animal feed. Considerations for establishing CPA tolerances EPA uses the National Research Council s four-step process for human health risk assessment: Step One: Hazard Identification identify potential health effects that may occur from different types of pesticide exposure (ranges from eye and skin irritation to cancer and birth defects in laboratory animals) Step Two: Dose-Response Assessment "The dose makes the poison. Step Three: Exposure Assessment Inhaling pesticides (inhalation exposure), Absorbing pesticides through the skin (dermal exposure), and Getting pesticides in their mouth or digestive tract (oral exposure). What is FDA s Plan? Sec. 6. MODIFICATION OF DEADLINES FOR SECRETARIAL ACTION. (a) Delayed Commencement of Dates for Secretarial Action.-- (1) In general.-- Except as provided in subsection (c), with respect to any time periods specified in this division (or in an amendment made by this division) that begin on the date of enactment of this Act, within which the Secretary of Health and Human Services is required to carry out and complete specified activities, the calculation of such time periods shall commence on the date described in subsection (b). (2) Limitation.-- Subsection (a) shall only apply with respect to obligations of the Secretary of Health and Human Services that must be completed within a specified time period and shall not apply to the obligations of any other person or to any other provision of this division (including the amendments made by this division) that do not create such obligations of the Secretary and are not contingent on actions by the Secretary. (b) Date Described.--The date described in this subsection is the first day of the first fiscal quarter following the initial 2 consecutive fiscal quarters of fiscal year 2010 for which the Secretary of Health and Human Services has collected fees under section 919 of the Federal Food, Drug, and Cosmetic Act (as added by section 101).

April 2012 H/PH Constituents (e) Data Collection.--Not later than 24 months after the date of enactment of the Family Smoking Prevention and Tobacco Control Act, the Secretary shall establish, and periodically revise as appropriate, a list of harmful and potentially harmful constituents, including smoke constituents, to health in each tobacco product by brand and by quantity in each brand and subbrand. April 2013 H/PH Constituents "(3) Beginning 3 years after the date of enactment of the Family Smoking Prevention and Tobacco Control Act, a listing of all constituents, including smoke constituents as applicable, identified by the Secretary as harmful or potentially harmful to health in each tobacco product, and as applicable in the smoke of each tobacco product, by brand and by quantity in each brand and subbrand. April 2013 H/PH Constituents/Ingredients/Additiives "(a) Testing, Reporting, and Disclosure.--Not later than 36 months after the date of enactment of the Family Smoking Prevention and Tobacco Control Act, the Secretary shall promulgate regulations under this Act that meet the requirements of subsection (b). "(b) Contents of Rules.--The regulations promulgated under subsection (a)-- "(1) shall require testing and reporting of tobacco product constituents, ingredients, and additives, including smoke constituents, by brand and subbrand that the Secretary determines should be tested to protect the public health, provided that, for purposes of the testing requirements of this paragraph, tobacco products manufactured and sold by a single tobacco product manufacturer that are identical in all respects except the labels, packaging design, logo, trade dress, trademark, brand name, or any combination thereof, shall be considered as a single brand; and "(2) may require that tobacco product manufacturers, packagers, or importers make disclosures relating to the results of the testing of tar and nicotine through labels or advertising or other appropriate means, and make disclosures regarding the results of the testing of other constituents, including smoke constituents, ingredients, or additives, that the Secretary determines should be disclosed to the public to protect the public health and will not mislead consumers about the risk of tobacco-related disease. http://www.fda.gov/tobaccoproducts/guidancecomplianceregulatoryinformation/ucm237052.htm

April 2015 Validation "(2) Consumer research.-- The Secretary shall conduct periodic consumer research to ensure that the list published under paragraph (1) is not misleading to lay persons. Conclusion If a new or revised CPA standard comes into existence, it will do so with a suitable amount of warning and period for comment. There remains a duty of care obligation to conduct surveillance on incoming raw materials.
