RATING STATE AND LOCAL TOBACCO POLICIES The purpose of our study is to examine the importance and effectiveness of state and local policies in discouraging youth tobacco use in 50 California cities. The survey has two parts. With your help, we want to understand three related issues. In Part I, we want to understand how important you think each tobacco policy is for discouraging youth smoking, compared to other tobacco policies. In Part II, we want to understand: a) How effective you think each California state tobacco law (where a law exists) is for discouraging youth smoking. b) How effective you think a local policy that is stricter than the California state law is for discouraging youth smoking. Current California state tobacco laws are considered here as baseline policy levels in all of the cities. SALE OF TOBACCO PRODUCTS Retail Licensure: In California, all retailers, distributors, wholesalers, manufacturers, and importers must be licensed by a state board. The law requires vendors to pay a one-time licensing fee of $100 per location; wholesalers and distributors are required to pay $1,000 per year. Tobacco retailers are required to renew their licenses on an annual basis for no fee. A retailer s license is suspended if the retailer has been convicted of selling to minors four times in one year. 13a. How effective do you think this law is for discouraging youth smoking? Question no 13a: 1 2 3 4 5 6 7 8 9 10 Local Retail Licensure: Local jurisdictions can pass local licensing ordinances with stronger public health provisions and include fees and penalties to support enforcement of these ordinances. The American Lung Association defines a strong tobacco retailer licensing as one that includes all the following components: (1) requirements that all retailers that sell tobacco products must obtain a license and renew it annually, (2) a fee set high enough to sufficiently fund an effective program including administration of the program and enforcement efforts. An enforcement plan, that includes compliance checks, should be clearly stated, (3) coordination of tobacco regulations so that a violation of any existing local, state or federal tobacco regulation violates the license, and (4) a financial deterrent through fines and penalties including the suspension and revocation of the license. Fines and penalties should be outlined in the ordinance. 13b. How effective for discouraging youth smoking do you think a local policy would be that requires all of these four components?
