Confirmation of minutes of the 182 nd meeting of Executive Committee held on 09.09.2013 at New Delhi. It was noted that 182 nd meeting of Executive Committee was held on 09.09.2013 at New Delhi. The minutes of the same have been circulated to all the members of the Executive Committee by post vide letter No. 5-1/2013 (182 nd EC) dated 30.09.2013 to suggest addition/deletion in respect of correctness of the minutes, if any within 21 days from the issuance of the minutes. However, the addition/deletion if any in the minutes, will be placed before the EC at the time of confirmation. Executive Committee confirmed the minutes with following modification- Sl. Agenda Item No.12 Previous decision Executive Committee noted the same, and decided to enquire the matter by Enquiry Committee constituted earlier and reported to EC in its meeting held on 23.08.2013 under agenda. Modified decision Executive Committee noted the same and including denial of complaints submitted by college duly signed by all existing teachers. It is also decided no further action is required in this matter. Further, it is also decided that in future an affidavits has to be asked from the complainant at the first instance prior to initiate any action. 1183ec

Agenda Item No. 2. Letter received from Govt. of India in respect of unauthorized admission in some Ayurved and Unani College of Maharashtra. It was noted that Deptt. of AYUSH vide letter No. Z.16011/20/2011-EP (IM-1) dated 06.08.2013 has forwarded the letter of Shri G.S. Sonawane, Deputy Secretary, Medical Education and Drugs Departments, Govt. of Maharashtra, regarding admission of students in 17 Ayurvedic and 4 Unani Colleges of Maharashtra for the year 2011-12, that failed to get mandatory permissions from AYUSH. The Deputy Secretary, Govt. of Maharashtra has stated that, though the High Court and Supreme Court have disposed of appeals and petitions filed by the college, it is our contention that the State Government has not been barred from taking appropriate steps to provide relief to the students. In order to solve this problem and safeguard the academic career of the said 1,019 students, the State Government has proposed the following a) Allow the said students to continue their education and rename the course they would pursue as Special BAMS / Special BUMS. Since this course is not included in the Schedule to the Indian Medicine Central Council Act, 1970, we believe that section 13 A (1) would not apply and the Government of India s permission would not be required in this case. b) Section 29 (1) of the Maharashtra Medical Practitioners Act, 1961, empowers the Government of Maharashtra to include any qualification in the Schedule to the said Act so that the person possessing this qualification would be eligibility to practice medicine within the State of Maharashtra. In this regard following facts are placed below:- a) As Medical Education falls in the concurrent list of Constitution of India, therefore, Central Act enacted by Parliament of India shall prevail in the case of Education of Ayurveda, Unani and Siddha. Moreover, no other Course other than the prescribed by CCIM can be conducted by any Institution. Provision of special BAMS and BUMS course have not been made by CCIM. b) As per IMCC Act, 1970 the following definition of Recognised Medical Qualification has been defined- Recognised Medical Qualification 2 ecognized medical qualification means any of the medical qualifications, including Post-graduate medical qualification, of Indian medicine included in the Second, Third or Fourth Schedule. In view of the above, practitioner on the basis of special BAMS and BUMS course will not be eligible for registration on State Register of Indian Medicine maintained by the State Boards and Central Register of Indian Medicine maintained by the CCIM and it will be contravention of the Central Act. 2183ec

Executive Committee decided not to allow special BUMS & BAMS course as it is in contravention of the Central Act and the decision is to be communicated to all the concerned including State Govt. of Maharashtra & Govt. of India (Department of AYUSH). Agenda Item No. 3. Appraisal for Increment-regarding. It was noted that a representation of Ms. Lipika Sharma, Legal Consultant, engaged by CCIM on purely contract basis has been submitted to the office. Content of the representation are produced below:- This is to bring to your kind notice that the undersigned joined as Legal Consultant in CCIM on 14.3.2013 and after 3 months my contract was renewed for 11 months i.e. till 16 th May 2014 considering the satisfactory performance. It is further stated that I was directed to supervise all the legal drafting done by other legal consultants, drafted para-wise reply in various writ petitions and has been entrusted to give legal opinions in the matters of office administration. Further vide Office Order dated 25/6/2013 I was made in-charge of Legal section and it was directed that monthly report of progress of work done in Legal Section will be submitted through undersigned. Hence it is requested that in view of the work carried out by undersigned with proficiency, dedication, hard work and expeditiously must be considered and increment of Rs. 10,000/- be granted to undersigned. Executive Committee decided to refix the consolidated remuneration of both Legal Consultants at Rs.40,000/- month. Agenda Item No.4. Consideration of the letter of Government in respect of LOP for the session 2013-14. It was noted that Govt. of India while granting LOI to colleges for issuing LOP for the year 2013-14 has asked to comply certain requisite by the college reads as under:- I. That, the college gets the permission of the Central Government to undertake admission at existing UG courses for the academic year 2013-14. II. Before the inspection by CCIM regarding the matter for consideration of permission for academic year 2013-14 for existing UG and proposed new PG courses, new PG courses., the college should fulfill all the Minimum Standards Requirements of infrastructure and teaching & training facilities as specified in Regulation 3 of the Indian Medicine Central Council (Minimum Standard Requirement of Ayurveda colleges and attached 3183ec

Hospitals) Regulations, 2012 to get non conditional permission or conditional permission. III. All the requirements under the relevant Indian Medicine Central Council (Post-graduate Ayurveda Education) Regulations should be fulfilled in particular for teaching, non-teaching staff including laboratory and hospital staff. 1. The college has also to submit the requisite performance bank guarantee as specified under the Section 6(2) (h) of notified Regulations 2004, failing which the Letter of Intent may be withdrawn. 2. The college administration has to ensure that no student is admitted in the above mentioned courses till the formal permission of the Central Government is granted. 3. In the event, the applicant college fails to comply with or satisfy the conditions of the letter of intent, the letter of intent would automatically lapse and be treated as cancel without further reference to the applicant college. Meanwhile a meeting was held in the Deptt of Ayush in the chamber of Secretary, Deptt. of AYUSH wherein Secretary asked CCIM to send the recommendation of LOP as well to Deptt. of AYUSH on the basis of latest Visitation report as cut off date for admission in approaching fast. Accordingly the recommendation of LOP has been sent to Govt. of India with the approval of President, CCIM. However details are placed below:- Sl. N o. It was noted that Govt. of India had issued LOI for establishment of new Colleges in respect of following proposals and CCIM was asked to furnish the recommendation for issuing/ not issuing after verification of compliance. Accordingly both colleges were proposed for visitation. Raghunath Ayurved Mahavidyalaya & Hospital, Contai, Dist.-Purba Medinipur, West Bengal was visited on 23-24.09.2013 by Dr. R. Veeracholan, Dr. Rajashekher Ganigar and Dr. Prasanta Kumar Sarkar. After assessment of the Visitation report the college has been recommended to Govt. of India for issuing LOP with 50. It was also noted that Government Ayurved College, Shimoga, Karnataka was proposed for visitation on 23-24.9.2013 by Dr. G. B. Patil, Dr. P.C. Chaudhary and Dr. Manoj Mishra. But college shown inability to allow the visitation and asked some more time to fulfill the shortfalls. The Director of AYUSH, Govt. of Karnataka also asked for the same. As Govt. of India was pressing hard to send the recommendation as cut off date of admission for the year 2013-14 approaching fast and matter is already delay, therefore, the same has been informed to the Govt. of India. Above recommendations has been sent to Govt. of India with the approval of the President, CCIM. Executive Committee noted and ratified the same. Further Executive Committee decided that in future at that time of visitation of 13C, if there is a proposal of the college for LOI/LOP and visit for LOI/LOP falls at the same time, the visitation for LOI/LOP should also be conducted simultaneously. Agenda Item No.5. Ratification of the Action taken be President, CCIM on some visitation report of the colleges. It was noted that although Ganga Education Society s Ayurved College, C/o Ganga Hospital,New Building, Rankalaves, Distt. Kolhapur was proposed for visitation and team reached there but college did not allow the visitation on account of death of trustee as informed by College. However, college was again proposed for visitation on 23-24.9.2013 by Dr. Vishwaheet Singh, Dr. Hari Ram Bhadoria and D. Sudhakar Mohite. After assessment to visitation report it has been recommended to Govt. of India for not granting permission for the session 2013-14. It was also noted that as Islamia Zakaria Ayurveda College, Gulbarga, Karnataka had submitted the compliance in view of the letter of the Govt. of India for 2012-13 alongwith the DD of Rs. 50,000/-, therefore, college was proposed for visitation on 23-24.9.2013 by Dr. Prajapti Tripathi and Dr. M. Further, it was noted that DR BNM Rural Ayureda Medical College, Bijapur (Karnataka) had submitted the compliance in view of the letter of Govt. of India for 2012-13, therefore, college was proposed for visitation on 19-20.9.2013 by Dr. Sudharashan Behra, Dr. Ravi Kachiria and Narendra Kumar. After assessment of visitation report, it has been recommended to Govt. of India for not granting permission for the session 2013-14. Above recommendations has been sent to Govt. of India with the approval of the President, CCIM. Executive Committee ratified the same. Agenda Item No.6. Consideration of the letter of Govt. of India in respect of S.S.U.D. Ayurved College & Hospital, Washim. It was noted that a letter has been received from Deptt. of AYUSH vide letter No. V.12013/15/2011 EP (IM-2) dated 28.06.2013 regarding to take appropriate action and policy decision regarding S.S.U.D. Ayurved College & Hospital, Koli Karanja (Lad), District Washim (Maharashtra) forwarding the letter No. MUHS/E- 3/UG/3510/1361 dated 05.04.2013 of Maharashtra University of Health Sciences, Nasik addressed to Department of AYUSH stating that the SSUD Ayurved College & Hospital, Koli Karanja (Lad), District Washim has not fulfilled the Minimum Standards and Requirement prescribed by the CCIM, New Delhi and also no cooperated with Local Inspection team appointed by Maharashtra University of Health Sciences, Nasik. Considering same and various complaints received regarding shortfall of academic facilities. University had placed the matter for discussion and necessary action before the Academic Council of University in its meeting held on 10.01.2013. Considering the various grave irregularities, Academic Council had resolved to initiate the process of Closure/permanent De- Affiliation of said College as per Section 73 of The Maharashtra University of Health Sciences Act, 1998. The chronology of events and present position that has compelled the University to initiate the process of Closure/ permanent De-affiliation of said College is attached herewith for your kind perusal and needful action in the matter. It is pertinent to note that said College and its Management has filed several Writ Petitions in Honorable High Court Bombay, Nagpur Bench. Secondly, students of the said College have also filed several Writ Petitions against said College and other respondents due to non co-operation in student transfer matter (The chronology of events with present position and information of several Writ Petitions is enclosed herewith & marked as Exhibit A, Total Pages 01 to 07). 12183ec

Thus, in light of the factual aspect, I am to submit you that, it will be appropriate to deny the permission to such college, which is not willing to improve the standards as per the required norms and also have gross deficiencies with respect to infrastructure and academic facilities. In this regard it was noted that SSUD Ayurved College, Washim was raided by CBI. However, recently college was visited on 14-15.06.2013 by the visitors namely Dr. Narendra Kumar, Dr. GB Patil and Dr. R. Shailaja Kumari. After assessing the available facilities of teaching & Practical training, the college has not been recommended to Govt. of India for granting the permission for the session 2013-14. Executive Committee decided to conduct a Joint Inspection comprising of one University representative, one state Govt. representative, one representative from Department of AYUSH and two CCIM members and submit the report to EC for further action. Agenda Item No.7. To establish the eligibility of the candidate of Uzbekistan admitted in RA Podar Ayurved College, Mumbai passing the General Secondary School Certificate Examination in 2000 and Diploma from an accredited Medical College on Uzbekistan from 2003-2006. It was noted that MUHS, Nasik vide letter No. MUHS/C.3/UG/2845/2013 dated 28.08.2013 has asked about eligibility for admission in BAMS Course. In this regard, the contents of the letter are as under:- Miss Ashurvoa Nooirahon Mulla Jonavna from Uzbekistan has admitted by R.A. Podar Ayurved College, Mumbai for the BAMS course in the academic year 2012-13 under the AYUSH Scholarship Scheme 2012-13. The said student has passed the General Secondary School Certificate Examination in 2000 which represents 10 years of school education in Uzbekistan. The said candidates after completion of 10 years of school education has pursued 3 years Diploma from an accredited Medical College on Uzbekistan from 2003-2006. It was noted that Association of Indian University vide letter dated 30.10.2012 has observed that a combined assessment of 10+3 qualifications of said student can be accepted as she has completed 3 years Diploma in the field of Medicine. In view of AIU letter, the department of AYUSH vide letter dated 30.05.2013 has informed to the University. Accordingly University has allowed said student to appeared University examination, however result of the student is kept withheld till such time final eligibility granted by the University. 13183ec

Meanwhile, the AIU vide letter dated 19.03.2013 has communicated to the College that, the AIU is unable to issue equivalence certificate to Miss Ashurvoa Nooirahon Mulla Jonavna as her school education in earlier USSR and now CIS countries is of 11 years duration for which AIU do not issue Equivalence Certificate as the corresponding school education in India is of 12 years, which is the minimum eligibility requirement for admission to Bachelor Degree Programme. It is mandatory for the University to enroll students as per statutory criterion prescribed by the Central Council of Indian Medicine. As per norms and eligibility criteria of Undergraduate Ayurved Course prescribe under Section 2 of CCIM notification in Gazette if India, Extraordinary, Part III-Section4 dated 25.04.2012 a candidate must fulfill following norms: 1. ADMISSION QUALIFICATION 12 th standard with science or any other equivalent examination recognized by concerned State Governments and Education boards, provided the candidate passes the examination with 50% aggregate marks in the subjects of Physics, Chemistry and Biology. For foreign students any other equivalent qualification to be approved by the University will be allowed. MUHS, Nasik has asked for views of the CCIM in view of the Regulation prescribed by the CCIM and letter of Association of Indian Universities. Executive Committee decided that as the candidate does not have minimum requirement for admission therefore, she is ineligible for admission to BAMS course and same may be informed to GOI/ MUHS, Maharashtra. Agenda Item No.8. Proposal of RGUHS, Bangalore to start integrated Course of one and half year for AYUSH Doctors. It was noted a letter No. RGUHS:REG:PA:26:2013-14 dated 03.09.2013 received from RGUHS, Bangalore for advise and approval for starting of this course in the affiliated Ayurved Medical Colleges in this regard following facts are placed below. (i) that as CCIM has been constituted by the Govt. of India to prescribe the Minimum Standards of Education in Indian Medicine i.e. Ayurved, Unani, Siddha and Sowa Rigpa System of Medicine. (ii) CCIM with the sanction of Govt. as required under section 36 of IMCC Act, 1970 and after obtaining the comment of the State Govt. under Section 22 of IMCC Act, 1970 has prescribed following courses as UG & PG Level. 14183ec

(iv) CCIM has also added the components of the Modern Medicine in the syllabus of these courses as deemed fit in view of the CCIM to produce good physician, Surgeon, teacher, experts and researches etc. (v) There are abundant occasion where Graduate of Ayurved, Unani and Siddha asking to give the right to practice of Modern Medicine and CCIM has also sent proposal to GOI, Deptt. of AYUSH to allow ISM graduates to use selected allopathic drugs in emergent condition alongwith a list of such medicines whereas there is separate Council of Modern Medicine. The matter has also taken up by Deptt. of AYUSH the matter and now the Govt. of India has asked the CCIM to frame the bridge Course to Graduate of ISM to enable them to prescribe some Modern Medicine under NRHM. However, a meeting was convened with CCIM and recommendation of the same are not available. 15183ec

Now RGHUS, Bangalore has sent a letter to start short term courses of Integrated Medicine for AYUSH Doctors. In this regard following facts are placed below:- (i) Integrated Medicine is not defined under the IMCC Act, 1970. (ii) As Medical Education falls in the concurrent list of constitution of India, therefore, Central Act shall prevail over the State Act. Therefore, no such courses may be allowed by CCIM. Executive Committee decided that the matter will be first examined by the Executive Committee members and thereafter its recommendation will be discussed in the bridge course Committee.
