1 Introduction Kier Group is committed to providing a safe and healthy working environment for all employees and individuals affected by our activities. Kier are committed to ensure, so far as is reasonably practicable, that the health, safety or condition of any person or property will not be adversely affected through the misuse of drugs or alcohol. The misuse of drugs or alcohol by individuals can lead to an increased risk of accidents or incidents; the Group aims to reduce these risks by means of our commitment, standard and processes set out in this document. The purpose of this Standard is to:- Ensure that the Group complies with relevant legislation relating to substance abuse at work (including without limitation The Health and Safety at Work Act 1974, The Transport and Works Act 1992, The Misuse of Drugs Act 1971 and The Railways (safety critical work) Act 1994). Take a proactive approach to ensure that our workplace is a drug and alcohol free environment as part of our commitment to ensuring a safe and productive workplace, by ensuring that all relevant individuals are aware of this Standard and that anyone who declares (pre-testing) a drug, alcohol or substance related addiction or habit is offered the necessary support. Undertake measures to prevent persons attending work under the influence of illegal drugs, misused prescribed or over the counter medication or alcohol, using a testing regime; and provide information, instruction and awareness training to all relevant individuals on the health effects of alcohol and illegal drug use, the principles of this Standard and the repercussions of a breach of it (including disciplinary action and dismissal). This Standard will be communicated to all relevant Individuals and reviewed on a regular basis. All amendments or updates will be communicated. 2 Scope The scope of the SHEMS covers all persons, workplaces and operations in our Construction & Infrastructure Services Division (CIS), Development, Property and Business Services Division (DPS) and our Strategic and Corporate Development Division (SCD). Exceptions will be documented through a SHEMS appendix B process (SHEMS-FOR-GR-999), jointly authorised by Group SHE Director and Business Stream Director responsible for co-ordinating SHE. Kier SHEMS Manual (SHEMS-STD-GR-003) provides guidance and signposting for the compliance, implementation, monitoring, audit and review of our systems, demonstrating continual improvement and achievement of Vision 2020 objectives. Confidentiality All results and information in relation to drug and alcohol testing will be dealt with in strict confidence and released only to the relevant individual themselves, the line manager of the relevant individual tested, and the relevant HR and SHE departments. Support Kier is committed to offer appropriate support to those who give notice of a drug, alcohol or substance misuse/dependency. This support can be accessed through Human Resources (HR) and/or Occupational Health (OH). Any employee, who refuses help, fails to respond to appropriate support, or fails to co-operate with an agreed action plan and whose performance is adversely affected as a result will be managed in line with the disciplinary process. 3 Kier Requirements 3.1 UK Alcohol Limits For the purpose of this Standard, under the influence of alcohol is defined as detection by testing of: Breath (μg/100ml) Blood (mg/100ml) Urine (mg/100ml) 9 20 27 14 30 40 Cut off levels in industry sectors or national drink driving limits International air transport sector Highways and UK Rail sector 18 40 54 Maritime and Oil sectors 22 50 67 35 80 107 Scotland & Most EU countries Drink Driving Limit England, Wales & N. Ireland Drink Driving limit Unless testing is subject to specific sector or client requirements, the failure level for an alcohol test will be at or above the relevant national drink driving limit. These requirements apply to all UK workers working and operating within the UK or whilst working overseas, where the relevant country limits will apply if lower than those shown above. 3.2 Prohibited Substance Use The substances for which relevant individuals may be tested include: Amphetamines including ecstasy Cocaine Benzodiazepines Barbiturates Opiates including heroin Methadone Cannabis Propoxyphene Phencyclidine The drugs referred to above are examples only and are not an exhaustive list of the substances for which a relevant individual may be tested. 3.3 Prescription and over the counter medication Also prohibited are any legal substances which may affect performance at work, which include but are not restricted to, antidepressants, sleeping pills, tranquilisers, antihistamines and medicines for coughs, or colds, where these are used at, or in excess of, legitimate usage levels as prescribed. This prohibition includes medication prescribed by medical practitioners or purchased over the counter. Individuals who are prescribed medicines or are taking over the-counter purchased legal drugs should bear in mind that they may affect their working performance and in particular their ability to drive or to work with machinery safely. It is the responsibility of the relevant individual to determine whether any medication is likely to affect performance at work e.g. instructions from their GP or Pharmacist. The relevant Individual must inform their line manager immediately and complete SHEMS-FOR-GR-154 the Prescribed and Over the Counter Medicine form and contact the chemist-on-call service either by telephone or online. It is designed for any workforce that needs to ensure workers are not dizzy, drowsy or suffering other adverse side effects from medication whilst at work that could have the potential of causing accidents. This is particularly useful for safety critical rail staff, machinery operators and persons needing to drive for their job role. The relevant employees are required to declare and check all medication they are taking to the Chemist-on - Call service. Chemist-on-Call is operated by a team of specialist pharmacists. Instant advice can be provided by the online database, which is backed up by a call centre service. Once completed please ensure that the medication form and outcome details are forwarded to occupational health to add to the employees OH record. If the line manager requires further advice on the action/next steps required, they should seek support from OH or askhr. Relevant individuals will always be asked to declare any recent medication use prior to the time of testing. There are no acceptable levels of drugs in the workplace other than those prescribed by a doctor or obtained from a pharmacist where these are used in accordance with legitimate usage levels and do not affect performance at work. For the purposes of this Standard, under the influence of drugs is defined as detection by testing of any prohibited substance. 3.4 Responsibilities All relevant individuals have a responsibility under this Standard with regard to the detection and prevention of the misuse of alcohol and drugs as follows: 3.4.1 Group SHEA Director: Shall have overall responsibility for the implementation of this Standard, the appropriateness of the testing regimes and will monitor and report on the results and effectiveness of such testing on an ongoing basis. 3.4.2 Business Stream (BS)/Business Unit (BU) Senior Management Team (SMT): Shall ensure that this Standard and testing regimes are implemented throughout their BS/BU and that suitable communication of this Standard is provided to all relevant individuals. 3.4.3 Line Managers/Supervisors shall: Ensure they understand and are familiar with this Standard and that it is communicated to all relevant individuals under their control; Monitor work performance, attendance, sickness absence and accidents/incidents and take appropriate action where necessary in line with this Standard; Ensure that appropriate adjustments are made for relevant individuals who have declared the use of a medication which may have an impact on their ability to perform their current tasks. 3.4.4 Relevant Individuals (including Directors and Senior Management) shall: Not come to work under the influence of drugs or alcohol or attempt to drive or operate any machinery at work if they believe they may be under the influence of any substance, including legally prescribed or over the counter medication, which could impair their abilities; Not bring any illegal drugs or alcohol on to the premises or sites under the control of any Kier Business Stream/unit or company/alliance, (Unopened alcohol purchased as normal shopping or provided as a Christmas gift or similar with no intention of use during working hours will be exempt); Check with their pharmacist or chemist-on-call or OH as to whether any prescription or over-the-counter medication may impair their ability to perform their duties and make the required notification (SHEMS- FOR-GR-154) to their line manager. Give notice to their manager/hr or OH if they believe they have a problem related to drugs or alcohol In such instances, the worker will be offered appropriate support, counselling and rehabilitation; Note that giving notice of a dependency issue after a relevant individual has been asked to undergo a test, or on the day that random or for cause test takes place, will not grant the individual immunity from being tested or from any disciplinary action that may take place in the event of a positive result for either drugs or alcohol. Not discontinue an agreed course of treatment or rehabilitation for a drug or alcohol related problem without good reason and will notify their manager and HR of such discontinuance. Undergo testing for drugs and alcohol as described in this Standard. Refusal to undergo testing will lead to disciplinary action and could lead to dismissal. Shall not cover up or collude in breach of this Standard. Whilst Kier Group does not condone, encourage or recommend the consumption of alcohol in excess of the recommended guidelines, it recognises that as part of business life at events such as corporate entertaining, alcohol may occasionally be consumed that causes the worker to be beyond the limits described for alcohol in paragraph 4.1 of this Standard. In cases such as these, it is the duty of the relevant Individual not to go to any Kier Group office, premises/project office or operational site until such time as she/he is below the limits referred to in section 4.1. This paragraph does not apply to the use and/or possession of illegal drugs or the misuse of prescription or over the counter medication. 4 Testing 4.1 Facilities required by our D&A testing partners When a representative from our D&A partners arrives the following shall be provided to complete the sample collection:- A private room A room with a table and chairs so that their collecting officer can have a private conversation with the donor and complete the Chain of Custody form. Specimen collection area, e.g. a toilet cubicle for urine collections In exceptional circumstances, the minimum requirement is for a room in which to undertake testing, as described above, with a dedicated portaloo with hand-washing facility nearby A single collecting officer/tester can test up to 20 people in a day. Should larger numbers be required to be tested in a day an additional collecting officer will be required. No specific additional requirements are required for the testing of females 4.1.1 Frequently asked questions (FAQs) Can the donor be accompanied? Unless the donor has requested a witness, nobody should be present during the testing and collection process unless the collecting officer requests it. The name and contact details of all witnesses should be recorded to assist with any post-incident investigations, should they be required. Can they refuse to give a sample? If the individual donor refuses to give a specimen, the collecting officer will ask them to sign a Refusal declaration form, a copy of which will be given to the site contact. What if the donor needs medication before the test? Medical attention should be provided if required, but a note kept of any medications taken. Can the donor eat and drink before the test? Food and drinks can be consumed but drinks must be non-alcoholic and ideally from an identifiable source (e.g. canteen or vending machine). Keep a note of anything consumed. Some foods may affect the tests. 4.1.2 Responsibilities of Kier s representative The Kier representative (site manager/site supervisor or similar) will need to be available for the entire duration that the D&A partner s collecting officer is on site. They shall; Meet the collecting officer and check their identity pass Accompany the collecting officer to meet the donor(s) and provide safe conduct Prepare the facilities required Formally identify the individual to be tested by using photographic ID Witness the breath alcohol calibration check Witness the second breath test for any positive breath samples Answer any queries and resolve any issues where possible. Contact OH or SHE manager if unable to resolve Sign the call out form once the specimens have been collected and send to OH 4.2 Outline testing regime and classifications: An outside agency will be employed to conduct tests, which will be carried out in controlled conditions. On site testing will generally be by calibrated alcometer and urine sample, but this may vary depending on the circumstances. The external collection officer will brief those being tested and a representative from Kier will be present at the testing session. In cases of positive outcomes, Kier reserves the right to consider and request the use of further separate laboratory testing where appropriate. A relevant individual will be deemed to have tested positive and therefore failed a drugs test where the detectable level exceeds the internationally recognised pass/fail levels for a banned substance. In the case of alcohol, the limits outlined in paragraph 4.1 will be applied. A relevant individual who refuses to undertake a test when requested, attempts to tamper with, or avoids any part of the drug and alcohol Standard will be treated as having received a positive result. When drug and alcohol testing is required as part of a third party s requirements the appropriate standard and process will be complied with and the more stringent testing limits and regimes will apply. 4.3 Types of testing Random and Pre-placement testing will involve sample collection on site with all testing undertaken off site in the laboratory. For Cause testing will involve a sample being tested initially on site at the point of collection. Any sample shown on the day to be non-negative will be sent back to the laboratory by the collecting officer for further analysis specialist interpretation. 4.3.1 Pre-placement testing Pre-placement testing is undertaken:- Where the relevant individual is being transferred to safety critical work, for example, the rail or nuclear environment; or A new employee recruited for safety critical work, for example, the rail or nuclear environment; or Kier reserves the right to review what constitutes a safety critical role that requires pre-placement testing. 4.3.2 For cause testing For cause testing is undertaken:- Where a Kier Business Unit or Alliance receives information or a Whistleblow relating to an individual, which leads to the business reasonably concluding that there may be a potential alcohol or substance abuse or addiction. In these cases, to protect confidentiality, the details of the information, which it reasonably believes has been provided in good faith, is unlikely to be revealed to the relevant individual; or Where there is suspicion that a relevant individual may either be under the influence of drugs or alcohol or has an addiction or substance abuse habit; or When a relevant individual has been involved in an accident or a near miss incident; to be determined by the business unit or Where a relevant individual has agreed with Kier to participate in a rehabilitation programme, Kier reserves the right to submit the employee for periodic for cause testing; or Where the Client Contract, Regulatory body or Joint Venture specifies a bespoke drug and alcohol testing regime. 4.3.3 Random testing Kier reserves the right to undertake a programme of random testing to ensure compliance with this Standard and will aim to test up to 20% of the workforce annually. Safety Critical activities, such as HGV or other drivers and machine operators, may be subjected to more regular random testing. The determination of who is to be tested on the day under a random test is to be specified by the external testing company and not influenced by Kier Group employees. 4.4 Actions following the test results Where individuals are found to be in breach of this, appropriate action will be taken. In the case of employees, breaches will be dealt with under the relevant disciplinary procedures. For third parties, this will be dealt with under the relevant commercial contractual arrangements. Ultimately the decision is a BU MDs Business unit /streams decision as to the outcome. Authorised By: John Edwards Page 9 of 16 SHEMS-STD-GR-086

Sub-Contractors: Those who have tested positive for alcohol following a random or for cause test will be suspended from site by the site workplace management and his/her employer made aware. They will not be able to return to work on any site or premises under the control of the Group. The responsibility for ensuring that the relevant individual travels home safely remains with his/her employer. They will not be permitted to drive away from site; If positive results are returned from the laboratory or are found to be at a level inconsistent with declared medication, with respect to a subcontracted employee, the respective employer will be advised that the individual will not be able to return to work on any site or premises under the control of the Group; and OH will inform the site/workplace manager of the results once they are returned from the laboratory. If drug test results show a negative result or are found to be at a level consistent with declared medication, site/workplace management must discuss the individual s return to work with the subcontractor s management. If a positive result is received, the subcontractor s management should be advised that their employee will be unable to return to site by the site/workplace manager. HR will liaise with the site workplace manager and arrange to send out a notification of positive D&A test to the sub-contract management with copies of testing documentation in support of their own disciplinary proceedings. Decision on whether an individual can return to working for Kier following a positive to drugs or alcohol test in the future is solely at the discretion of the BU MD or BU Stream. Kier directly employed persons:- The disciplinary procedure will be instigated by HR in respect of any confirmed positive results. In the case of negative results, the individual will be thanked for their cooperation, suspension lifted if instigated and be returned to work. Employees who have tested positive for alcohol following a for cause or pre-placement test or random test will be subject to disciplinary action, which may include summary dismissal. If positive results are returned from the laboratory, or are found to be at a level inconsistent with declared medication, with respect to an employee, the individual will be subject to disciplinary action, which may include summary dismissal. The results of these tests are confidential. The site/workplace manager will be aware of any initial positive results, having made arrangements for the safe removal of these individuals from the site/workplace. The results of tests should remain strictly confidential. 5 Testing Arrangements 5.1 How to book random testing Alere Toxicology is the current D&A partner approved by Kier to carry out D&A testing. In order to arrange a Random drug test please contact Occupational Health on 01767-355733 or 01767-355727 or email occupational.health@kier.co.uk You will need the following information to hand: Full address, including postcode of where the test is to be carried out, Date of testing Time you want the testing to commence The number of people to be tested The name of the site contact (representative) for the day The telephone number(s) of the site contact. All costs of D&A testing will be recharged to the Kier Business Unit requesting the test. 5.1.1 In hours testing during office hours During office hours any requests for both random and for cause D&A testing should be through Occupational Health:- Telephone 01767-355727 or 01767-355733 email Occupational.health@kier.co.uk Note If Urgent i.e. collecting required with 2 hours of callout then please contact Alere direct 24 hour on call service 5.1.2 Testing outside of office hours For cause only where a For cause test is required out of the normal office hours then you should contact Alere direct using the 24hr on call service on 020 7538 1133. You will be asked which company you are from and for your PIN number and PO number if known. Please ensure you have the correct PIN number for your business This service should only be used for tests that are required within 2 hours of placing a call with the D&A provider Our pin numbers are:- 7907 for England and Wales 9995 for Scotland. 6451 for Highways & Rail ONLY Please ensure your call remains PRIVATE. PLEASE DO NOT DISCLOSE THIS PIN TO ANYONE OTHER THAN THE ALERE OPERATOR.: Once the operator has taken all of the details, please ask for a reference number and make a note of it. You must then please send an email immediately to OH (occupational.health@kier.co.uk) confirming the For cause test has been ordered and the details of it. 5.2 Organising and implementing the test In the case of random testing, ensure that the MD, HRBP & SHE Manager are aware of the proposed test regime, in the event of any potential impact on business of non-negative results of random testing. As much notice as possible, (at least 7 days) is required by Alere, to ensure they are able to provide collection officers for the required date(s). Alere will email OH to confirm that the collection officer(s) have been organised as requested. Once received, confirmation of the arrangements will be emailed to the person organising the test. The individual responsible for arranging the test, is to agree and confirm date with HR and the Kier representative who will be at site on the day of proposed testing. The Kier representative shall be informed as late as possible, ideally the day before the test and asked to keep the information confidential. They will arrange for a room and toilet facilities as detailed in Section 5.1. The Kier representative shall complete an attendance sheet of all individuals who have been selected for testing and indicate if they are a Kier employee or a sub-contractor. The completed attendance sheet shall be sent to OH preferably by email once the testing is completed. The Kier representative shall collect the yellow copies of the test paperwork from the collection officer at the end of the test. The Kier representative should ensure that the forms identify if the individual(s) is (are) a sub-contractor. The Kier representative will forward all test/sample information and documentation including a list of those tested highlighting those who are sub-contractors immediately to the Group OH department marked as PRIVATE and CONFIDENTIAL. Results of all D&A testing undertaken shall be returned to Occupational Health from the D&A test provider. Occupational Health will then disseminate the results to the relevant parties. 5.2.1 Implementing the test: Briefing Notes The tester(s) is met on site by the nominated company representative The tester confirms to the manager that the facilities provided for test meet their needs Where more than one tester is to work concurrently, the company representative liaises with the lead tester to ensure that satisfactory arrangements are in place In the case of for cause or pre-placement testing, the company representative confirms with the site/workplace manager a list of those persons requiring testing In the case of random testing, the Kier representative for the duration of the testing obtains separate lists of all Kier directly employed, sub-contractors etc. present on site and hands these to the tester, who selects at random those to be tested. Unless specified otherwise this will be 10% of those present on that day It is important that, other than establishing that representative sampling will be achieved, no other influence is placed on the collecting officer s selection The Kier representative liaises with the site/workplace manager to facilitate effective execution of the testing, whilst minimising disruption to the site/workplace and service delivery Typically those being tested will be gathered up in small groups and brought to the waiting room/area In the case of random testing, individuals should not be made aware at this stage that D&A testing is to be carried out. The company representative briefs each group upon arrival at the waiting room/area as to the purpose of the day s testing The company representative introduce themselves to the assembled group The group are advised that a random, for cause or pre-placement D&A test is taking place in compliance with this Standard The company representative introduces the collecting officer/tester to the group The company representative advises the donor (person to be tested) that the process will be managed by the independent tester. Once selected no one should leave the site That the tester will explain again on an individual basis, in more detail, as they take their turn for the test That all donors need to provide photographic evidence of their identity to the tester and if they are unable to do so, a formal identification will be sought from their supervisor The collection officer tester will provide individuals with a copy of the briefing notes and asked to read them outlining the procedure whilst they are in the waiting room/area Individuals identified as having reading and/or English-speaking issues are to be offered assistance, typically their supervisor or a work colleague acting as an interpreter, with test documentation annotated accordingly Individuals refusing to take part in D&A testing are to be informed that such a refusal will be treated as a positive test result and that disciplinary action may follow. Any individual refusing to undertake a test will be asked to leave the site or premises. Individuals indicating to the company representative that they believe that they have a problem with drugs and alcohol, but have not previously chosen to advise the business of such problems, will be asked to give details to the tester at the point of test. The independent tester will take the lead during the actual test. A minimum of one company witness is required per tester, requiring the presence of the company representative in the testing area at all times whilst testing is taking place. 5.2.2 How the testing is carried out The alcohol test is carried out via a breathalyser which gives an instant result. The drugs screening is as follows: The tester confirms the identity of the individual. (This should be done by way of photographic ID but, in the absence of this, the individual s identity verified by their supervisor) The tester asks the individual a series of questions regarding any over the counter or prescription medication. (The person being tested has the right to declare their medication in confidence to the tester, in which case other witnesses will be asked to leave the room briefly) The testers use a sealed testing kit for each person tested The tester accompanies the individual to the designated toilet facilities to ensure that the sample is not tampered with The individual is required to provide a urine sample into a pot Random testing, the samples are split into A and B samples and both are sent directly to the laboratory for detailed analysis. Random testing confirmation of results typically take 3 to 7 working days (excluding weekends). For cause, when carrying out For Cause testing, the tester uses a sealed test kit to screen sample provided for evidence of drugs. The test shows an instant result. Should the test prove non negative, the preparation of the sample for detailed laboratory analysis will follow. The samples are split into A and B samples and both are sent directly to the laboratory. Sample A will go for laboratory analysis for confirmation of the initial on site test. Sample B is retained for positive tests at the laboratory for 12 months In the event that there is a challenge to the laboratory result. Authorised By: John Edwards Page 13 of 16 SHEMS-STD-GR-086

5.3 Post-test Actions Immediate actions following test result For Alcohol A negative result will be advised to the relevant individual and the employer and a record made; If the alcohol in breath reading is at or above the levels set out in paragraph 2.1 of this Standard above the Relevant individual will be deemed to have tested positive and they will immediately be suspended from work. If the relevant individual is not a direct employee, the employer will be notified for the appropriate disciplinary action to be taken through that employer process. The employer will arrange for the relevant individual s safe transport home; the relevant individual will not be permitted to drive away from the workplace. For those relevant individuals directly employed by Kier, disciplinary procedures will then be instigated which may result in summary dismissal. Line Management shall arrange for the relevant individual s safe transport home; the relevant individual will not be permitted to drive away from the workplace. An alcohol in breath reading above 50% of any of the levels set out in Section 4.1 of this Standard will result in the Line Manager (or the Site Manager in the case of a subcontracted relevant individual) having a conversation with the relevant individual about the result and educating the relevant individual about the safety risks of consumption of alcohol before presenting at work. Immediate actions following test result Drugs ( For cause ) If the initial urine reading is indicative of recent drug use, the relevant individual will be advised that the urine sample needs to be analysed in a laboratory. The sample, provided under controlled conditions, will be handled in a formal chain of custody including maintenance of a split sample. If the relevant individual is not an employee, their employer will be informed of the initial non negative result and advised that more definitive results will be forthcoming from the more detailed laboratory analysis. The relevant individual will then be suspended from working on any Kier site or Kier premises, pending the result of the further laboratory analysis; In the case of a Kier Group employee, the same suspension will apply, with the individual s line manager and HRBP being informed; If a relevant individual declares, either prior to or post testing, that they have been taking illegal drugs or misusing non-prescribed medication that may cause a positive result, the relevant individual will be suspended from site, pending the further laboratory analysis. If a relevant individual declares, either prior to or post testing, that they have been taking prescribed or over the counter medication that may cause a positive result, further advice should be sought from OH or askhr as to the next steps. Options may include suspension from site pending the further laboratory analysis, or suspension from high risk duties dependant on the medication. Immediate actions Drugs ( Random and Pre-placement ) Where urine samples are taken for the detection of drugs as part of a random or pre-placement test, they will not be subject to an initial on-site test at point of contact. They will be tested at a laboratory and the relevant individuals will be allowed to continue work unless a positive result is confirmed by the laboratory. If a relevant individual declares, either prior to or post testing, that they have been taking illegal drugs or misusing non-prescribed medication that may cause a positive result, the relevant individual will be suspended from site, pending the further laboratory analysis. If a relevant individual declares, either prior to or post testing, that they have been taking prescribed or over the counter medication that may cause a positive result, further advice should be sought from OH or askhr as to the next steps.
