The additional levies shall be on Class I property, 9.83 cents; on Class H property, 19.66 cents, on Class Ill property, 39.32 cents; and on Class IV property, 39.32 cents. Whenever, in any of said five (5) fiscal years any annual appraisal or general valuation of property produces property assessments that would cause an increase in the total property tax: revenues that would be realized by the imposition of the foregoing levy rates, and which increase in property tax revenues would exceed the projected needed revenue for that year, The Board of Education of the County of Upshur reserves unto itself as the levying body the right and authority to reduce such excess levy rates in such year in accordance with the provisions of Section 6g, Article 8, Chapter 11 of the Code of West Virginia, 1931, as amended. Nothing herein shall affect any special levy or levies for the retirement of bonded indebtedness. Additional assessments due to new construction or improvements to existing real property, including beginning recovery of natural resources, and newly acquired personal property shall not be included in determining whether to reduce excess levy rates or in calculating the new levy rates or in calculating the new levy rates for any such fiscal year. After full consideration thereof, The Board of Education of the County of Upshur, being of the opinion that the maximum levies for current expenses authorized by Article 8, Chapter 11 of the Code of West Virginia, 1931, as amended, will not provide sufficient funds for the payment of the general current expenses of public schools in Upshur County, including expenditures for the purposes hereinafter stated, during the fiscal years beginning July 1, 2014, July 1, 2015, July 1, 2016, July 1, 2017, and July 1,2018, and having ascertained the amounts hereinafter shown in excess of the amounts raised by regular levies will be needed by The Board of Education of the County of Upshur during each of the said five (5) fiscal years and that an election should be held to continue such additional levies, in conformity with law, it is hereby ORDERED and DECLARED: 1. The purposes for which additional funds are needed are: instructional programs, supplies, materials and equipment; technology access and improvement; capital improvements and preventive maintenance; substitute employees; extracurricular activities and extended employment agreements; contracted services; and student related community services. 2. The amounts considered necessary for each of said purposes in said five (5) fiscal years are as follows: instructional programs, supplies (including $200 per classroom teacher), materials and equipment approximate I. yls_ 22 a00annually; technology access and improvement approximately

such year in accordance with the provisions of Section 6g, Article 8, Chapter 11 of the Code of West Virginia, 1931, as amended. Nothing herein shall affect any special levy or levies for the retirement of bonded indebtedness. Additional assessments due to new construction or improvements to existing real property, including beginning recovery of natural resources, and newly acquired personal property shall not be included in determining whether to reduce excess levy rates or in calculating the new levy rates or in calculating the new levy rates for any such fiscal year. 6. The years to which the additional levy rates shall apply, if authorized by the voters, are the fiscal years beginning July 1, 2014, July 1, 2015, July 1, 2016, July 1, 2017, and July 1, 2018. 7. The question of the continuation of such additional levies shall be submitted to a vote in the Upshur County School District, which embraces Upshur County, West Virginia, at a special election to be held in said county on the 8 th day of February, 2014. 8. If at least a majority of the voters of the election to be held on February 8, 2014, approve the continuation of the additional levies for the fiscal years beginning July 1, 2014, July 1, 2015, July 1, 2016, July 1, 2017, and July 1, 2018, The Board of Education of the County of Upshur will not issue bonds as provided by Section 16, Article 8, Chapter 11 of the Code of West Virginia, 1931, as amended. 9. Notice of said Election to Continue Additional Levies shall be given by publication of notice thereof at least once each week for two (2) successive weeks within fourteen (14) days preceding the election in the Record Delta, a newspaper of general circulation in the Upshur County School District. 10. The election officials to conduct the said special election shall be appointed by The Board of Education in accordance with Section 17, Article 8, Chapter 11 of the Code of West Virginia, 1931, as amended. The persons who shall serve as such clerks and commissioners shall be nominated and appointed in accordance with the provisions of Section 30. Article 1, chapter 3 of the Code of West Virginia, 1931, as amended. Canvassing of the returns from said levy election shall be by the Board of Education as provided by law. All other provisions of the laws concerning general elections shall apply as far as they are practicable. The Secretary of the Board of Education of the County of Upshur is hereby authorized and directed to acquire and to furnish to election officials all proper election supplies, attend to the publication of the relevant parts of this order, to do all things necessary to present the elections proposed by this order to the voters in the Upshur County School district at said special elections. 11. In the event that The Board of Education of the County of Upshur shall obtain money by grant or otherwise from the State of Federal Government, or from any agency of either, or from any other

source, including but not limited to, additional assessments due to new construction or improvements to existing real property, including recovery of natural resources, and newly acquired personal property, for any of the above purposes in any of said fiscal years, such additional money may be used rather in substitution for or in addition to the funds received from said additional levies. 12.
