WHAT IS THE CODE OF EXCELLENCE POLICY Our members demnstrate n a cntinuing basis skills and prfessinalism that are the industry standard. While we have and cntinue t recgnize the cmmitment f these individuals, ur Cde f Excellence Prgram is designed fr SMWIA lcal unins t prmte and establish a unifrm best practices frmat that will instill a sense f pride in the unin and bring ut the best frm all ur members. The SMWIA Cde f Excellence Prgram is ur actin plan t establish plices designed t demnstrate and shwcase the skills and prfessinalism f SMWIA members. In essence, the Cde f Excellence Prgram is a marketing and actin plicy designed t develp a pride f wnership in ur members that demnstrates the prfessinal wrkmanship and prductivity prvided by SMWIA members every wrkday n every jbsite. The basic tenets f the Cde f Excellence Prgram shall be t prvide t the SMWIA, the emplyer and client: Members f the SMWIA wh prvide the highest level f quality at the highest level f perfrmance; Wh use superir craft skills; and Wh have prven best wrk practices. The Cde f Excellence Plicy is therefre a written plicy f the culture f the SMWIA designed t instill a sense f pride and prfessinalism in ur membership. When adpted and implemented, the unifrmity f this Cde f Excellence Plicy shall demnstrate t emplyers and their clients that cntracting the services f SMWIA members is synnymus with cntracting excellence. The Cde f Excellence Prgram is an internal SMWIA prgram and therefre nt dependent n external frces. This allws the success f the Cde f Excellence Prgram t rest slely within the cntrl f the SMWIA leadership and members. The Cde f Excellence Prgram, therefre, must have the ttal supprt f the lcal unin membership at all levels, and in particular the full cmmitment f lcal unin leadership wh must set the example in prmting the plicies set frth. With adptin and implementatin at the lcal unin level, it shall be incumbent upn the Business Manager with the assistance f their Business Representatives t participate actively in enfrcement f all prvisins set frth in the Cde f Excellence Prgram. 1

CODE OF EXCELLENCE PROGRAM DESIGN COMPONENTS The Cde f Excellence Prgram is designed t be flexible and t be used in every lcal unin within the SMWIA. Specific issues f cncern t lcal unin leaders and memberships can be incrprated int the Cde f Excellence Prgram; hwever, the key cmpnents f the Cde f Excellence Prgram must be cnsistently applied if the prgram is t be successful. The key cmpnents f the Cde f Excellence Prgram and which must remain cnsistent are: 1. Cmmitment- The Cde f Excellence Prgram requires a cmmitment by the lcal unin at every level f leadership, with membership acceptance, t abide by the respnsibilities stated within the prgram. 2. Business Manager- The Business Manager r his/her designee is empwered t address wrkplace issues with members and t cmmunicate t emplyers the individual wrkplace needs requiring management invlvement. 3. Member Prfessinalism- SMWIA members have a respnsibility t their unin and fellw members t present themselves and represent their lcal unin in a prfessinal manner. This includes meeting emplyer and end user expectatins abut the wrk we perfrm. 4. Member Respnsibility- If a member is failing t meet the standards we have set fr urselves, it is incumbent upn each member t assist each ther in meeting ur standards. 5. Cnsequences f Failure- SMWIA members must clearly understand the cnsequences if we fail t meet the custmer s needs. Our ability as a unin t ensure gd wages and wrking cnditins is directly related t ur ability t perfrm. 2

IMPLEMENTATION OF THE CODE OF EXCELLENCE The Cde f Excellence Prgram is an internal SMWIA prgram. Therefre, implementatin f the prgram shall be accmplished at the lcal unin level using the fllwing steps: 1. Presentatin t all Lcal Unin Officers - The prgram shall be presented by an SMWIA Internatinal Representative t the fficers and leaders f the lcal unin. 2. Adptin by Officers - Lcal unin fficers and leadership shall discuss the prvisins f the prgram and develp necessary lcal prvisins fr inclusin int the dcument. Lcal unin leadership then cmmits thrugh a recmmendatin by the lcal unin executive bard that implementatin f the Cde f Excellence Prgram be adpted by the full membership. 3. Presentatin t Membership - Fllwing adptin by lcal unin leadership, the prgram is presented t lcal unin membership fr apprval. 4. Lcal Officers and Leadership Training Upn request f the lcal unin, the Internatinal will assist in training lcal unin leadership n the gals and implementatin f the prgram. 5. Lcal Membership Training Training will be prvided t the membership by the lcal unin with assistance frm the Internatinal. Thrugh the training prcess, the expectatins necessary t achieve the acceptable level f prfessinalism and prductivity fr each SMWIA member will be discussed and defined. 6. Presentatin t Emplyer- Once the lcal unin adpts the Cde f Excellence Prgram, the Business Manager r his/her designee presents the prgram t the Emplyer. 3

SMWIA MEMBERSHIP COMMITMENT As we face unprecedented cmpetitin fr the services prvided by the membership f the SMWIA, we must recgnize ur primary marketable qualities are ur skills, prductivity and prfessinalism. T succeed we must present t the end user, be it cntractr r end user clients, the value in using SMWIA members. This requires that each member cnfrms t and supprts the Cde f Excellence Prgram respnsibilities set frth belw. As a result, ur prmise f prfessinalism and prductivity is met everyday by every member. The future f ur membership and the SMWIA is dependent upn ur ability t establish ur added value t the emplyers and end users within the sheet metal industry. SMWIA RESPONSIBILITIES: The Business Manager f the lcal unin will have ultimate respnsibility fr implementatin and administratin f the Cde f Excellence Prgram. The prgram structure is designed t insure that the Business Manager r his/her designee shall be the first pint t reslve Cde f Excellence Prgram issues quickly and effectively. Our respnsibilities include the fllwing: Wrking Time First and fremst, ur members shall adhere t ur cre principle f prductivity, eight hurs wrk, fr eight hurs pay. All members shall adhere t established cntractual starting and quitting times and shall meet their respnsibility t their fellw members and emplyers by arriving t wrk n time and ready t wrk. Break and lunch perids are limited t the time allwed by the cntract, r agreement(s). Members shall meet their respnsibility nt t leave the jbsite withut prper apprval. When absent the member shall cntact supervisin in advance f their established starting time t cnfirm such absence. All members shall be prductive and efficient, with idle time kept t a minimum. 4

Persnal cell phne usage shall be limited t apprpriate break times r lunch perids, r emergency use as defined by the lcal unin Business Manager. Members shall meet their cntractual respnsibility t eliminate wrk disruptins n the jb. All members shall wrk tward the gal f cmpletin f prjects n r under the alltted time. Safety Safety, being a primary cncern fr bth ur members and cntractrs, members shall meet their bligatin t perfrm wrk safely and effectively, fllwing emplyer and industry established rules. Members will meet their cntractual and persnal respnsibility t utilize prper safety equipment and safety methds. Members will participate in OSHA 10 curses as ffered by the lcal unin and when required by their cllective bargaining agreements. Tls In meeting their respnsibility as highly skilled and qualified craftsmen, all members shall carry the necessary and prper tls as required by the cllective bargaining agreement. Members shall meet their respnsibility in taking care f the equipment and tls prvided by the emplyer. Fitness fr Duty Members shall meet their respnsibility f being fit fr duty by accepting wrk fr which they have the requisite skills and training. Members shall exhibit and maintain a level f craftsmanship recgnized t be within the industry standard. Members shall meet their respnsibility t be fit fr duty, with zer tlerance plicy fr substance abuse. 5

As representatives f their lcal unin and the emplyer, all members will be prfessinal in appearance. The wearing r display f inapprpriate materials shall nt be tlerated. The Business Manager r his/her designee and leaders n the jb shall wrk with ther members wh have displayed unacceptable wrk habits s that each member n the jb meets a standard f quality and prductivity secnd t nne. Labr/ Management Relatins Members shall respect the prperty f the cntractr and end users, and graffiti and ther frms f destructin and waste will nt be tlerated. Members shall respect all legal facility rules f the client and r end user. Activities which cast the Internatinal Assciatin r the lcal unin in disrepute shall nt be tlerated. Any inapprpriate behavir tward anther member r grup f members shall nt be tlerated. Inapprpriate behavir tward custmer representatives r emplyer representatives shall nt be tlerated. The gal f the SMWIA Cde f Excellence Prgram is t prmte prfessinalism within the ttal membership f the SMWIA and a sense f pride in ur membership. EMPLOYER RESPONSIBILITIES; The ultimate respnsibility f managing the wrk and prjects falls within the cntrl f the emplyer. With such respnsibility ur signatry emplyers, and if applicable ur emplyer assciatins, have a respnsibility t manage their jbs effectively. Therefre, t build cnfidence and trust in the Cde f Excellence Prgram, the emplyer must meet its respnsibilities in addressing jb perfrmance issues, including the fllwing: T address ineffective supervisrs, including superintendents, general fremen, and fremen. 6

T insure prper jb planning, supervisin and layut, t minimize dwn time. T make available the prper types and quantities f tls, equipment and materials t ensure jb prgress. T ensure prper maintenance, care, strage, and security fr emplyerprvided and emplyee-prvided equipment and tls. T demnstrate t the custmer the efficiency f ur partnership, the emplyer will ensure there are adequate numbers f emplyees t perfrm the wrk efficiently and, cnversely, t limit the number f emplyees t the wrk at hand. T prvide the necessary jbsite leadership t eliminate prblems and prvide effective slutins. T instill in supervisrs the necessary psitive attitude that the SMWIA lcal unin, their members and the emplyer are wrking tgether. T ensure that jbsite leadership takes the necessary wnership f mistakes created by management decisins. T eliminate unsafe wrk cnditins and ensure that prper safety training, equipment, and methds are utilized. T address cncerns brught frth by the Business Manager r his/her designee. If the prblem is nt reslved at the lwest level f management, the Business Manager r his/her designee may chse t address the issue with higher levels f management. If the issue is nt reslved, the lcal unin r emplyer may call fr a labr-management meeting t reslve cncerns r issues. 7

MEMBERSHIP DISPUTE RESOLUTION CRITERIA Overview The success f the Cde f Excellence Prgram is dependent upn the acceptance and understanding by each member f the scpe f their respnsibilities as established within the prgram. It must be understd that a truly successful wrkplace envirnment can nly be achieved by participatin f bth the SMWIA and the Emplyer in meeting their respnsibilities. The unin s rle is t address with its members any individual prblems that are brught t its attentin t ensure the Unin s bligatin t live up t the prmise f prviding a skilled and prfessinal wrkfrce t the emplyer and the end user is maintained and imprved. UNION RESPONSIBILITIES: The Business Manager r his/her designee will wrk with members thrugh a prcess f mentring t crrect and slve prblems related t jb perfrmance. On a regular basis, the Business Manager r his/her designee will cmmunicate with management n Cde f Excellence Prgram issues. This will then be cmmunicated t SMWIA members thrugh the lcal unin leadership and wrkplace stewards. If an individual member is nt meeting established respnsibilities under the prgram and the crrectin f such adverse behavir cannt be achieved thrugh mentring between the lcal unin leadership, member peers and the individual member, the lcal unin Executive Bard shall have the respnsibility t review, evaluate, and address such prblems with the individual member. If the member is unwilling r unable t meet his/her bligatin under the Cde f Excellence Prgram, the lcal unin Executive Bard shall be empwered t take necessary actin up t and including filing f apprpriate charges under the Cnstitutin and Ritual f the SMWIA. The fllwing is incnsistent with the cnduct required under the Cde f Excellence Prgram. 8

1. Refusal f jbs r unavailable (n returned call) upn call frm the dispatcher fr wrk shall upn the third vilatin result in remval frm the ut f wrk list and placement in the inactive file. 2. Nt shwing fr wrk when dispatched, which shall be deemed t be a vilatin f the Cnstitutin, and may, subject the member t lcal unin charges and trials. 3. Acceptance f emplyment r jb under false pretenses, n adequate skills fr the jb, which shall als be deemed a vilatin f the Cnstitutin, and may, subject the member t lcal unin charges and trials. 4. Cnduct resulting in terminatin by an emplyer fr cause, which shall be dcumented upn the attached frm which is t be supplied by the lcal unin. If the emplyer indicates that a terminated emplyee is nt eligible fr rehire, such designatin shall be hnred by the dispatch ffice fr a minimum f 180-days. Prvided that, if the lcal unin determines t prcess a grievance cntesting such a terminatin, such terminatin shall nt be cnsidered as being fr cause until a Lcal Jint Adjustment Bard, a Panel, the Natinal Jint Adjustment Bard (r any alternative prcedures negtiated by the lcal parties) determines that such terminatin was fr cause, r the grievance prcess is therwise cmpleted withut invalidating the terminatin. The Business Manager and r his/her designee, as well as the emplyer, must endeavr t crrect perfrmance prblems with individual members at the wrkplace, s that their perfrmance meets the standards f the Cde f Excellence Prgram. Hwever, there will be instances where the lcal unin ultimately must withhld cntractual referral privileges frm thse emplyees that have demnstrated that they are either unwilling, r incapable, f meeting acceptable standards f wrkplace behavir. In such circumstances, emplyers have a reciprcal bligatin t terminate such emplyees fr cause, rather than merely laying them ff, s that such emplyees are nt simply referred fr emplyment with anther emplyer. A disciplinary actin plan shall be implemented which establishes a Three Strikes Plicy fr vilatin f the Cde f Excellence Prgram prvisins. Such plan shall prvide that, in any case where there are three separate instances within a 24-mnth perid where the emplyee has been cnvicted f cnstitutinal vilatin under pints 2 r 3 r has been subject t terminatin under pint 4, in any cmbinatin, the emplyee s referral privileges shall be suspended indefinitely. The emplyee may appeal the suspensin t the Lcal Jint Adjustment Bard, a Panel, the Natinal Jint Adjustment Bard (r any alternative prcedure 9

negtiated by the lcal parties), which shall have authrity t reduce the perid f any suspensin f referral privileges, if it determines that fairness and equity require such actin under the circumstances f the particular case r t terminate the suspensin when it determines that the underlying causes fr the suspensin have changed s that the emplyee deserves t be restred t referral privileges.
