Chemical Code: 044312. The New York State Department of Environmental Conservation (Department) has completed its technical review of the above product application received on November 10, 2006. Dinotefuran is currently registered in New York State as a technical product for formulation of insecticides and for indoor commercial use to control cockroaches in a gel crack and crevice use. This application was submitted as a major change in labeled use pattern (MCL) due to the addition of homeowner use for control of cockroaches in households. A homeowner gel product was registered in New York State on July 16, 2007. Hot Shot Ultra Liquid Roach Bait (EPA Reg. No. 9688-239-8845) contains 0.05% dinotefuran in a sweetened aqueous formulation contained in a bait station. The product is labeled for control of cockroaches in homes and can be placed in out-of-the-way places near walls, in cabinets, behind appliances, or anywhere control of cockroaches is needed. The product formulation has been determined to be a toxicity category IV pesticide and thus the bait station does not require child resistant package testing. The Department did request samples of the product and determined that the design of the bait station was appropriate to limit contact with the contents if a child were to handle the bait station. Also, the labeling clearly states Do Not Allow Children or Pets to Play with the Bait Stations in both English and Spanish text. This new homeowner product can also be a replacement for older more toxic cockroach bait products. The application package and additional information were determined to be complete for purposes of technical review on March 21, 2007. Pursuant to the review time frame specified in ECL 33-0704.2, a registration decision date of August 17, 2007 was established. The Department had concerns regarding the bait station being child resistant and requested product samples for evaluation. The registration decision was waived until September 17, 2007 in order for Spectrum Brands to submit the requested samples. Department has conducted the

following technical review for impacts to human health as a result of potential increased exposure to homeowners from application/use of the Hot Shot Ultra Liquid Roach Bait product and its active ingredient dinotefuran. The following review summary is provided below. Ms. Kelly Clendenny 2. Human Health Risk Assessment: The New York State Department of Health (DOH) reviewed the application and supporting data submitted by Spectrum Group, Division of United Industries to register the pesticide product Hot Shot Ultra Liquid Roach Bait (EPA Reg. No. 9688-239-8845). The United States Environmental Protection Agency (USEPA) permitted the registrant to submit results from acute toxicity studies conducted on a formulation that contains a 20-fold higher level of the active ingredient dinotefuran (i.e., 1% versus 0.05%) for required acute toxicity data on the Hot Shot Ultra product. These surrogate acute toxicity data indicate that the Hot Shot Ultra product should not be very toxic to laboratory animals by either the oral, dermal or inhalation routes of exposure. The formulated product should also not be very irritating to the eyes or skin and should not cause dermal sensitization. DOH previously reviewed dinotefuran in the manufacturing use product Dinotefuran Technical (registered on December 20, 2006 in New York State). Dinotefuran was not very acutely toxic in laboratory animal studies. In addition, this chemical did not demonstrate developmental toxicity, genotoxicity or carcinogenicity, and the USEPA classified it as not likely to be a human carcinogen. Dinotefuran caused some toxicity in chronic feeding studies in laboratory animals, and data indicate that this chemical has the potential to cause some neurotoxic, immunotoxic and reproductive effects. The USEPA Office of Pesticide Programs calculated an oral reference dose (RfD) of 0.02 milligrams per kilogram body weight per day (mg/kg/day) for dinotefuran based on the lowest-observed-effect level (LOEL) of 20 mg/kg/day in a one-year dog feeding study (decreased thymus weights in males) and an uncertainty factor of 1,000 (100x to account for intraspecies and interspecies differences and an additional 10x to account for using a LOEL instead of a no-observed-effect level). A current search of the toxicological literature did not find any significant new information on the toxicity of dinotefuran. The available information on dinotefuran and the formulated product Hot Shot Ultra Liquid Roach Bait indicates that they were not very acutely toxic in laboratory animal studies. Also, dinotefuran did not demonstrate developmental toxicity, genotoxicity or carcinogenicity. The registrant did not submit either an occupational exposure risk assessment or a postapplication residential exposure risk assessment for this product. However, because -8 dinotefuran has a low vapor pressure (1.28 x 10 millimeters mercury at 20 degrees Celsius) and the formulated product does not contain volatile organic components, inhalation should not be a significant route of exposure. Product Registration Summary: The Department will register Hot Shot Ultra Liquid Roach Bait (EPA Reg. No. 9688-239-8845) for general use in New York State. The product demonstrates low toxicity to humans and samples of the bait station have been evaluated for pesticide spillage. The bait station adequately

contains the liquid pesticide product and is labeled Do Not Allow Children or Pets to Play with Bait Stations to help ensure that potential contact with this pesticide product does not occur. Please note that a proposal by Spectrum Group or any other registrant, to register a product that contains dinotefuran, and whose labeled uses are likely to increase the potential for significant impact to humans, nontarget organisms, or the environment, would constitute a major change in labeling (MCL) application. Such an application must be accompanied by a new application fee and meet the requirements listed in Appendix 1.B. of New York State Pesticide Product Registration Procedures (September 2005).
