Government of Himachal Pradesh Department of Ayurveda No.Ayur-Ja (7)-1/97-III Dated, Shimla-2, the 31-8-2009 NOTIFICATION In supersession of this Department s Office Order of even number dated 5 th February, 2004, the Governor, Himachal Pradesh, is pleased to notify following Purchase Policy of Ayurveda Department for procurement of ayurvedic medicines, with immediate effect :- 1. Guiding Principles i) Every Ayurvedic Health Centre should be equipped at least with first aid facilities for all kind of diseases. ii) Sufficient First Aid/Dressing material should be purchased so that people residing in remote and far flung areas may not suffer for want of first aid. iii) Medicines for common diseases like fever, common cold, cough, bronchitis, diarrhea, dysentery, acidity, abdominal pain, joint pains, Anemia, Diabetics, hypertension etc., should be purchased in sufficient quantity. iv) Purchase of other medicines should be guided by an understanding of disease patterns and requirement at local level. v) Each year appropriate targets for medicines to be manufactured in government pharmacies shall be set and procurement of such medicines from the open market shall be made only in case of a shortfall in production. vi) The ratio of classical medicines procured shall be at least 60% of total purchase of ayurvedic medicine. Efforts shall be made to ensure that 70% of purchase is from pharmacies based in H.P.

vii) In drawing up lists of patent medicines required for treatment of specific diseases, preference shall be given to reputed local manufacturers, wherever choice is to be made. Attempt will be made to ensure that at least 70% of the patent medicines purchased are from manufacturers within the State. 2. Based on the above guiding principles, a Technical Committee of the department, comprising such members as are notified from time to time shall draw up the following :- (i) the list of diseases for which ayurvedic medicines are to be procured. (ii) the classical medicines that are appropriate for these diseases. (iii) from among these classical medicines, the ones that will be manufactured by the government pharmacies and the balance which will be procured by calling tenders from manufacturers within the State and from the manufacturers anywhere in India based on approximate value of expected purchases, so as to ensure that atleast 70 % medicines are purchased from local manufacturers. (iv) the patent medicines that are relevant to specific diseases and are to be procured be listed disease-wise and divided again into those for which tenders are to be invited from manufacturers within the State and from manufacturers anywhere in India based on approximate value of expected purchases, so as to ensure that atleast 70 % medicines are purchased from local manufacturers. 3. For the classical medicines to be procured from the market and the patent medicines listed disease-wise rates shall be invited for delivery at any one place in Himachal Pradesh chosen by the manufacturer. The bidding process shall be managed by the HP State Civil Supplies Corporation Ltd., based on the categorization of medicines done by the Technical Committee. Based on the rates finalized on LI basis for both the classical medicines and the groups of patent medicines for the specified diseases, RKSs at district level and at the level of the two large hospitals (Paprola and Shimla) shall place

orders keeping in view the guidelines for stocking medicines given above and the medicines being made available through the government pharmacies. 4. The Technical Committee will finalize medicines to be purchased and rate contracts by the last quarter of each financial year for the ensuing financial year. The list of medicines to be purchased and the rate contracts awarded shall be approved by a Purchase Committee comprising the following:- i) The Principal Secretary (Ayurveda) Chairman ii) The Secretary (Finance) or his nominee. iii) The MD or his representative, HP State Civil Supplies Corpn. iv) The Director, Ayurveda, HP v) Controller of Stores or his representative. vi) Five members of Technical Purchase Committee and vii) ACA/Section Officer (SAS) of the Ayurveda Department. 5. The following guidelines will be followed for the tendering process:- i) Only original Manufacturers will be allowed to participate in the tenders. ii) iii) The manufacturers should have a valid manufacturing license. The manufacturers should have valid GMP certificate at the time of tender. iv) The manufacturers should produce performance certificate of medicines supplied to other Government and Pvt. Dealers for the preceding 3 years. v) The manufacturers should supply authentic proof (balance sheet duly approved by Chartered Accountant) of volume of sales in terms of money both in private and Government Sector.

vi) The manufacturers should submit the drug testing report of quoted medicine from a laboratory recognized by the State government or other Lab accredited by GOI. vii) The manufacturers should also submit a non-conviction certificate from the respective licensing authority stating that there were no market complaints against the manufacturer and he has not been convicted under any clauses of the Drug & Cosmetics Act. viii) The manufacturers will provide the annual sale tax statement alongwith income tax clearance certificate of the previous year. ix) Specified security/earnest money will accompany the tender application which will only be refunded after timely, complete and satisfactory supply of medicines and will be liable to forfeiture in case of failure to comply with the conditions of the contract. x) The Technical Committee notified by the Government for scrutiny of technical bids will shortlist the qualifying bidders separately for each disease and classical medicine related thereto and each disease and patent medicine related thereto based on the qualifying condition and specific parameters of performance specified from time to time in the tender documents. xi) Financial bids will be opened from among the suppliers which qualify in technical bids. After opening of the financial bids, the Technical Committee alongwith officers of HP State Civil Supplies Corporation will list the bidders and medicines disease wise separately for classical and patent medicines alongwith their recommendations which shall keep in mind the need to ensure price competitiveness while giving preference to local manufacturers. Recommendations that deviate from lowest price in the case of both the classical medicines listed against specific diseases and the patent medicines listed against specific diseases will be supported by reasons.. xii) The State level Purchase Committee will approve the rate contract of the classical medicines and patent medicines disease-wise.

xiii) xiv) Successful bidders will execute an agreement with the HP State Civil Supplies Corporation about their rate contract and will abide by any other conditions of the Corporation. After the finalization of the rate contracts of the classical and patent medicines for different diseases, the HP State Civil Supplies Corporation will notify them and copies will be supplied to all concerned. 6. The purchases shall be made by the RKS at district level and the RKS at the level of the two district hospitals. For this purpose, the following procures/guidelines will be followed:- i) The Total available funds for purchase of medicines will be allocated to each district RKS and the RKS at the level of the two large hospitals by the Director (Ayurveda) keeping in view the number of Ayurvedic Health Institutions in each district and requirement of medicines. ii) The concerned major hospitals or district RKS keeping in view the guidelines for stocking of medicines enumerated at para 1 above will place the order for purchase of medicines with the concerned rate contract firm with a copy to the HP State Civil Supplies Corporation Ltd. iii) The RKS will also send requisite funds as specified in the rate contract to the HP State Civil Supplies Corporation Ltd. to secure delivery of the purchase order. iv) The HP State Civil Supplies Corporation Ltd. shall be responsible for securing supplies from the concerned firm at the location specified in the rate contract and for making delivery to the concerned RKS. v) The supply of medicines to the RKS will be made within the maximum period finalized with the HP State Civil Supplies Corporation Ltd. Any delay attributed to the rate contract firm will result in penal action as per the rate contract agreement between the HP State Civil Supplies Corporation Ltd. and the firm. vi) vii) Ltd. will also inform the RKS concerned so that the order is cancelled and the order can be placed with an alternate rate contract firm immediately to ensure that there is no scarcity of medicines in the institutions. If the delay in supply within the stipulated period is attributable to the HP State Civil Supplies Corporation Ltd. then it will be liable to penal action as provided in an agreement between the Ayurveda Department and the Corporation. The responsibilities of the HP State Civil Supplies Corporation Ltd. shall include both logistical arrangements for supply to the RKS as well as drawing of samples when receiving the supply from the manufacturers and sending them to DTL Jogindernagar for testing. Samples shall be drawn for testing as per the medicine and size of order settled in the agreement with the Department of Ayurveda. 7. Payment to the HP State Civil Supplies Corporation Ltd. The HP State Civil Supplies Corporation Ltd. shall be responsible for the provision of two distinct services under this policy, finalizing rate contracts with the assistance of the Technical Committee and ensuring action against default in this regard and ensuring the logistics of testing and supply of medicine from the point of delivery by the manufacturer to the RKS concerned. For the first service, the Department will make available a flat fee of Rs. 5 lakh each year to the HP State Civil Supplies Corporation Ltd. For the second service, each RKS will pay 6 % of the value of the order to the HP State Civil Supplies Corporation Ltd. By Order Pr. Secretary (Ayurveda) to the Government of Himachal Pradesh. Ends.
