From 6 April 2015 relevant NHS bodies should only be using the risk-share agreement with commissioners in the case of treatment deemed by clinicians to be immediately necessary or urgent. If the care required is non-urgent, relevant NHS bodies must seek the full estimated costs upfront from the patient and not begin treatment until this is received. In these circumstances, the risk of non-payment is removed and therefore sharing this with commissioners is no longer necessary. Relevant NHS bodies and their commissioners should review their invoicing and payment flows for Charging category D and F patients to reflect the new legal obligation. As it is not always possible to know these fees at the time of treatment payments can be sought in advance for non-urgent treatments. This tariff is presented showing both a standard rate and the Non-EEA rate of 150%. As of the 23rd of October 2017 where treatment is non-urgent or elective, this means that the relevant NHS body must obtain full payment or collect a deposit equivalent to the full estimated cost of care in advance of providing treatment. Although relevant NHS bodies are reminded that, regardless of the lack of advance payment, they must not withhold treatment that is medically considered immediately necessary or urgent in that it cannot wait until the patient can reasonably be expected to return home.
