The active article is designed as a gas permeable but liquid impermeable laminated pad, which is placed within a cap or closure or as an adhesive label on tray lids. The palladium metal is not in direct contact with the food being separated from it by different layers of passive materials. The specific migration of palladium metal into conventional food simulants was not detected at the limit of quantification of 0.6 µg/kg. Palladium was considered to be non genotoxic and of no toxicological concern under a low exposure level resulting from a concentration up to 50 µg/kg food in a previous evaluation (EFSA CEF Panel, 2012). Based on these previously drawn conclusions and given the intended conditions of use leading to non-detectable migration, the CEF Panel concluded that the active substances palladium and hydrogen do not raise a safety concern for the consumer when used as an oxygen scavenger in packages for foods and beverages at room temperatures or below. Palladium should not be in direct contact with food and should be incorporated in a passive structure impermeable to liquids which prevents the migration at detectable levels. SUMMARY According to Commission Regulation (EC) No 450/2009 of the Commission of European Communities of 29 May 2009 on active and intelligent materials and articles intended to come into contact with food, substances responsible for the active or intelligent function need first to be evaluated by the EFSA before their inclusion into a positive Community list. The procedure of the evaluation and the tasks of EFSA are described in the Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with food. In the context of this evaluation procedure following a request from the Food Standards Agency, UK the Panel on Food Contact Materials, Enzymes, Flavourings and Processing Aids (CEF) was asked to deliver a scientific opinion on palladium metal (CAS No 7440-05-3, FCM No 993) and hydrogen gas (CAS No 1333-74-0, FCM No 1038), for use as an oxygen scavenger. The dossier was submitted on behalf of EMCO Packaging Systems Ltd, UK. According to the applicant the active component made of palladium metal and hydrogen gas is intended to be used as an oxygen scavenger in packages of fresh fruit juices, carbonated soft drinks, wines and beers, milk formulation powders, cheeses and cream, delicatessen meats, ready-to-eat and ready-to-cook prepared meal products, at room temperature for long term storage or at refrigeration temperatures for relatively short storage times. The active article is designed as a gas permeable but liquid impermeable laminate pad, which is placed within a cap or closure or as an adhesive label on tray lids. Hydrogen is authorised as a packing gas (E 949) with no specific restrictions. Specific migration of the palladium metal from a worst case testing sample (considering surface/volume ratio and the composition) into 3 % acetic acid, 20 % ethanol, 95 % ethanol and isooctane under adequate contact conditions, was below the limit of quantification of 0.6 µg/kg. The CEF Panel concluded that that the active substances palladium metal and hydrogen gas do not raise a safety concern for the consumer when used as an oxygen scavenger in packages for foods and beverages at room temperatures or below. BACKGROUND AS PROVIDED BY THE LEGISLATION Regulation (EC) No 450/2009 4 of the Commission of European Communities is a specific measure that lays down specific rules for active and intelligent materials and articles intended for contact with foodstuffs in addition to the general requirements established in Regulation (EC) No 1935/2004 5 of the European Parliament and of the Council on materials and articles intended to come into contact with food. Active materials and articles are intended to extend the shelf-life or to maintain or improve the condition of packaged food; they are designed to deliberately incorporate components that would release or absorb substances into or from the packaged food or the environment surrounding the food. The substance(s) responsible for the active and/or intelligent function of the material should be included in a positive list by the Commission following a safety evaluation by EFSA according to the procedure described in the abovementioned regulations. According to this procedure the industry submits applications to the Member States competent Authorities which transmit the applications to EFSA for their evaluation. The application is supported by a technical dossier submitted by the industry following the EFSA guidelines on submission of a dossier for safety evaluation by EFSA of active or intelligent substances present in active and intelligent materials and articles intended to come into contact with food (EFSA, 2009). In this case, EFSA received an application from Food Standards Agency, UK, submitted on behalf of EMCO Packaging Systems Ltd, UK, requesting the evaluation of palladium metal and hydrogen gas. TERMS OF REFERENCE AS PROVIDED BY THE LEGISLATION EFSA is required to carry out an assessments on the risks originating from the migration into food of the substance palladium metal used together with hydrogen gas in oxygen scavenging systems in food contact materials, and deliver a scientific opinion, according to the Regulation (EC) No 1935/2004 of the European Parliament and of the Council on materials and articles intended to come into contact with food. The opinion of EFSA will be considered by the Commission for adoption of a Community list of authorised substances where according to the Regulation (EC) No 450/2009 there will be specified: (a) the identity of the substance(s); (b) the function of the substance(s); (c) the reference number; (d) if necessary, the conditions of use of the substance(s) or component; (e) if necessary, restrictions and/or specifications of use of the substance(s); (f) if necessary, conditions of use of the material or article to which the substance or component is added or into which it is incorporated. 4 Commission Regulation (EC) No 450/2009 of 29 May 2009 on active and intelligent materials and articles intended to come into contact with food. ASSESSMENT 1. Introduction The European Food Safety Authority was asked by the Food Standards Agency, UK to evaluate the safety of palladium metal (CAS No 7440-05-3, FCM No 993) and hydrogen gas (CAS No 1333-74-0, FCM No 1038), which are used as a oxygen scavenger. The request has been registered in the EFSA s register of questions under the number EFSA-Q-2011-00237. The dossier was submitted on behalf of EMCO Packaging Systems Ltd 2. General information According to the applicant, the active component made of palladium metal and hydrogen gas is intended to be used as an oxygen scavenger in packages of fresh fruit juices, carbonated soft drinks, wines and beers, milk formulation powders, cheeses and cream, delicatessen meats, ready-to-eat and ready-to-cook prepared meal products, at room temperature for long term storage or at refrigeration temperatures for relatively short storage times. The active component aims extending the products shelf life by scavenging the residual oxygen in the packages headspace. Foods must be packed under modified atmosphere with hydrogen at a level up to 5.7 %. Palladium catalyses the reaction between hydrogen and oxygen, forming water. The active material containing palladium is inserted in the cap or closure of bottles, and secured as an adhesive label to the lids internal surface of cans, carton containers, heat sealed trays and pouches. The active substance is applied by electron beam deposition, at a loading of 4 to 10 mg/m 2, to a passive part of the packaging composed of polyethylene terephthalate (PET) film coated with silicon oxide (SiO x ). The active material is then placed in the middle of two layers of a nonwoven composite made of polypropylene, polyester and cellulose with an acrylate-based binding aid. This pad is overlaid by a polypropylene (PP) layer in contact with the primary packaging, and a laminate layer in contact with the food made of nonwoven spunbonded polyethylene (PE) with 15 µm polyamide (PA). According to the applicant, the resulting multilayer pad is impermeable to liquids, therefore the palladium is not in direct contact with the beverages or foods. Palladium (CAS No 7440-05-3, FCM No 993) has been evaluated by CEF Panel (EFSA CEF Panel, 2012) for use as a component of an oxygen absorber incorporated in PET bottle wall and/or in its closure liner. The CEF Panel considered that palladium is non genotoxic and that a low exposure to palladium, resulting from a concentration up to 50 µg/kg food, is not of toxicological concern. The palladium species should be behind a barrier layer or should be incorporated into the plastic of the primary packaging material in order to minimise direct contact of palladium with the food and thereby keep its migration within acceptable levels. Hydrogen is listed as approved for use as a packing gas (E 949) with no specific restrictions under Regulation (EC) No 1333/2008 6. 3. Data available in the dossier used for this evaluation The studies submitted for evaluation followed the EFSA guidelines on submission of a dossier for safety evaluation by EFSA of active or intelligent substances present in active and intelligent materials and articles intended to come into contact with food (EFSA, 2009). Evaluation 4.1. Non-toxicological data Palladium metal acts as a catalyst in an oxygen scavenging reaction. The working principle relies on the reaction between the oxygen and hydrogen present in the head-space, catalysed by palladium, and resulting in water. The specific migration of palladium from a sample composed of nonwoven spunbonded polyethylene/pet/siox/palladium/nonwoven spunbonded polyethylene was determined in 3 % acetic acid, 20 % ethanol, 95 % ethanol and isooctane, at 60 ºC for 10 days (surface/volume ratio of 6 dm 2 /kg). Given the surface/volume ratio and the composition of the testing sample (without the nonwoven layers composite made of polypropylene, polyester and cellulose and without the polyamide layer which is in contact with food in the intended use samples), this is considered as a worst case testing sample. Results for all tested simulants indicated no migration at the limit of quantification of 0.6 µg/kg food simulant. Given the chemical nature of the active component and the mechanism of the oxygen scavenging, no formation of volatile by-products is expected from any potential interaction with the passive part of the material. 4.2. Toxicological data Toxicological data were not provided, palladium has been evaluated by EFSA as a part of an oxygen absorbing system in food contact materials (EFSA CEF Panel, 2012). The CEF Panel had concluded that palladium is non genotoxic and a low exposure to palladium resulting from a concentration up to 50 µg/kg food is not of toxicological concern. In the application under evaluation, no migration of palladium was measured at the limit of quantification of 0.6 µg/kg food. Therefore, the use of palladium under the intended conditions of use does not raise a safety concern for consumer. Hydrogen is already approved for use as a packing gas (E 949) with no specific restriction (Regulation (EC) No 1333/2008). Therefore, no toxicological data are required. CONCLUSIONS Having considered the above mentioned data, the CEF Panel concluded that the active substances palladium metal and hydrogen gas do not raise a safety concern for the consumer when used as an oxygen scavenger in packages for foods and beverages at room temperatures or below.
