CHAPTER 174 An Act to provide for the Education of Blind and Deaf Persons Short title 1 This Act may be cited as The Education of Blind and Deaf Persons Act. R.S.S. 1930, c.139, s.1; R.S.S. 1940, c.174, s.1. Interpretation 2 In this Act, unless the context otherwise requires, the expression minister means the Minister of Education. R.S.S. 1930, c.139, s.2; R.S.S. 1940, c.174, s.2. Compulsory attendance 3(1) Every blind child and every deaf child between the ages of seven and sixteen years, inclusive, certified by a physician as mentally and physically fit to profit by the education provided in a school for the blind or a school for the deaf, shall attend such school for such periods as the minister may in each case determine. (2) A parent or guardian who ref uses to allow any such child under his care to attend a school as required by subsection (1), shall be guilty of an offence and liable on summary conviction to a fine not exceeding $25. Permissory attendance 4(1) The minister may in his discretion permit admission to such institutions of persons under the age of seven and over the age of sixteen but no person shall be admitted thereto except for the purpose of education and instruction. (2) The maintenance and support of such person shall be the duty of the parent or legal guardian requiring his admission. R.S.S. 1930, c.139, s.4; R.S.S. 1940, c.174, s.4. Temporary provision for education 5(1) Pending the lease or construction of buildings necessary for the education of blind and deaf persons, the Lieutenant Governor in Council may make regulations under which that education may be conducted by any school district established under any Act of the Legislature. (2) Such regulations may determine the manner in which any sums voted by the Legislative Assembly for the education of the blind and the deaf may be expended. (3) The details of such expenditure shall be approved by the minister. R.S.S. 1930, c.139, s.5; R.S.S. 1940, c.174, s.5. Buildings 6 Subject to the approval of the Lieutenant Governor in Council, the Minister of Public Works may provide for the lease, construction, furnishing, equipment, maintenance, repair and control of buildings for the education of the blind and the deaf and for acquiring and improving lands to be used for the said purposes. 4 c. 174 EDUCATION OF BLIND AND DEAF Management, administration and supervision 7(1) The minister shall provide for the management and administration of schools for the blind and the deaf including the supervision of such superintendents, teachers, officers and employees as may be appointed from time to time. (2) The officers and employees required for the maintenance of buildings and grounds shall be under the control of the Minister of Public Works. R.S.S. 1930, c.139, s.7; R.S.S. 1940, c.174, s.7. Periods of study 8 The minister may determine the period of operation of such institutions, the hours of study and, subject to the provisions of this Act, the terms and conditions under which persons shall be admitted and discharged. Expenses of maintenance and education of pupils 9(1) The expenses incurred by the minister for the maintenance and education of any blind or deaf person may be collected from the municipality in which the parent or legal guardian of such person usually resides or from such parent or legal guardian, but not more than two-thirds of such expenses may be collected from the parent or legal guardian. (2) In case such expenses are paid by the municipality the municipality may in its discretion collect from the parent or legal guardian a portion not exceeding two-thirds of such expenses. (3) Such expenses may include necessary outlay for clothing to enable a person to attend an institution for the blind or the deaf. R.S.S. 1930, c.139, s.9; R.S.S. 1940, c.174, s.9. Text books and other supplies 10 The minister shall provide the text books, apparatus and supplies which are necessary for properly carrying on the education of persons admitted to such institutions. Superintendents and teachers 11(1) There may be from time to time appointed such superintendents, assistant teachers, caretakers and other employees as are necessary for the conduct of such institutions. (2) The superintendents, assistant teachers, caretakers and other employees shall be subject to the provisions of The Public Service Act and The Public Service Superannuation Act. EDUCATION OF BLIND AND DEAF c. 174 5 Regulations by minister 12 The minister may make regulations governing: (a) the duties of superintendents, staffs and officers of such institutions; and (b) the administration and conduct of such institutions. Power to hold inquiries 13 In case at any time the minister deems it advisable he may appoint any person to make an inquiry into any matter connected with the management or administration of such institutions or the admission or non-admission to the same of blind or deaf persons or into the qualifications or conduct of any person connected in any way with such institutions. The person appointed to make the inquiry shall have power to take evidence under oath and shall have the same power to summon witnesses and to compel their attendance and to compel them to produce documents and give evidence as a court of law has in civil cases. R.S.S. 1930, c.139, s.13; R.S.S. 1940, c.174, s.13. Training of teachers 14 The minister may make provision as he may deem expedient for the training of teachers of the blind and the deaf. Superintendent s reports to minister 15 The superintendent of any institution established under the provisions of this Act shall furnish the minister from time to time with such reports as the minister may deem necessary. Annual report to Legislative Assembly 16 The minister shall make a report annually to the Lieutenant Governor in Council of all institutions established under the provisions of this Act and the same shall be presented to the Legislative Assembly within fifteen days of the opening of the session.
