r for Upshur County, West Virginia The County Commission of Upshur County, West Virginia does hereby amend the Enhanced 91 1 Ordinance as follows: Replacement of Section 6 with the following: Pursuant to the Code of West Virginia, in particular Chapter 7, Article 1, Section 3cc ($7-1-3cc) as amended, the County Commission of Upshur County hereby imposes a fee of four dollars and fifty cents ($4.50) per month per local exchange service line for residential service (Business andor Centrex lines covered in next paragraph) to finance the actual andor projected costs of the enhanced emergency telephone system. Such fee shall become effective on the 1 st day of July, 20 13. All business account lines and/or accounts serviced by Centrex lines will be charged a fee of six dollars and fifty cents ($6.50) per month per local exchange service line to finance the actual andor projected costs of the enhanced emergency telephone system. Such fee shall become effective on the 1 st day of July, 20 13. These fees will be utilized to cover the following cost areas associated with the enhanced 91 1 system: 1. Payment of wages, related payroll costs and benefits for all employees whose employment is directly associated and connected to the enhanced 91 1 system, including the premium cost of medical and other insurance coverage for employees. 2. All telephone company charges associated to and connected to the providing of services for the enhanced 91 1 system. 3. Costs associated with the providing of training for personnel employed to operate the enhanced 91 1 system. 4. Costs associated with the purchase, replacement, enhancement, repair and/or maintenance of enhanced 9 1 1 telecommunications equipment, including computer and other electronic equipment associated with the enhanced 9 1 1 database, operational facilities or buildings andor other direct operational aspects of the enhanced 91 1 system. 5. Radio equipment, including spare equipment, used in the dispatching of emergency service providers pursuant to calls to 9 1 1 andor transferring or relaying 9 1 1 calls or information related to such calls. 6. Costs associated with emergency power generation, transmission and control equipment. 7. Costs associated with the conversion of rural routes to city-type addressing including any cost to maintain andor update the master street address file or information. 8. Any other reasonable cost(s) associated with the establishing, equipping, furnishing, operating or maintaining a county answering point.

i AN ORDINANCE OF THE UPSHUR COUNTY COMMISSION-PROVIDING FOR THE ESTABLISHMENT OF AN ENHANCED EMERGENCY TELEPHONE SYSTEM, FOR THE ADOPTION OF A FINAL PLAN FOR SUCH SYSTEM, AND FOR THE IMPOSI- TION OF A FEE FOR THE CAPITAL, INSTALLATION AND MAINTENANCE COSTS OF SUCH SYSTEM WHEREAS, section three-cc, article one, chapter seven [g7-1-3-cc]: of the West Virginia code grants the authority to county commissions to establish an enhanced emergency telephone system and impose a fee for the capital, installation and maintenance costs thereof; WHEREAS, article six, chapter twenty-four [324-6-1-- et a11 of the West Virginia Code requires the preparation of a proposal, the holding of a public meeting and the timely placement of an advertisement concerning such proposal and meeting before a final plan for the implementation of such an enhanced emergency telephone system may be adopted; WHEREAS, the County Commission of Upshur County, West Virginia, has satisfied the aforementioned requirements,by the placing of an ad in the The Record-Delta, on Wednesday May 25, 1988, notifying the citizens of Upshur County of a Public Meeting to be held at the Courthouse, on Thursday,June 30, 1988 at 7:30 pm, and by holding the above stated meeting at that place and time as noted in the official minutes of the Upshur County Commission as shown in Law Order Book 16 at Page, and does find the implementation of such an enhanced emergency telephone system to be in the interest of the citizens of Upshur County; NOW THEREFORE BE IT ORDAINED BY THE COUNTY COMMISSION OF UPSHUR COUNTY, WEST VIRGINIA, PURSUANT TO AND HN ACCORDANCE WITH SECTION THREE-CC, ARTICLE ONE, CHAPTER SEVEN [~7-1-3-~~] AND ARTICLE SIX, CHAPTER TWENTY-FOUR [ 24-6-let a1 ] OF THE WEST VIRGINIA CODE, THAT AN EMERGENCY TELEPHON BE ESTABLISHED AS PROVIDED FOR IN THE FINAL PLAN ATTACHED HERETO, THAT SUCH FINAL PLAN BE ADOPTED, AND THAT THE FEE FOR THE CAPITAL, INSTALL- ATION AND MAINTENANCE OF SUCH SYSTEM BE IMPOSED IN ACCORDANCE WITH THE PROVISION OF SUCH FINAL PLAN, FINAL PLAN FOR THE ENHANCED EMERGENCY TELEPHONE SYSTEM OF UPSHUR COUNTY, WEST VIRGINIA SECTION 1 - DEFINITIONS: AS used in this final plan, unless the context clearly requires a different meaning: "County answering point" means a facility to which enhanced emergency telephone system calls for a county are initially routed for response, and where county personnel respond to specific requests for emergency service by ditectly dispatching the appropriate emergency service provider, relaying a message to the appropriate provider or transferring the call to the 2-L- zzl--

-2- (e) (f) "Enhanced emergency telephone system" means a telephone system which automatically connects the person dialing the primary emergency number to the county answering point and in which the telephone network system automatically provides to personnel receiving the call, immediately on answering the call, information on the location and the telephone number from which the call is being made, and upon direction from the personnel receiving the call routes such call to emergency service providers that serve the location from which the call is made. "Local exchange service line" means the same as defined in the contract attached to this final plan as Appendix A. (9) "Telephone Company" means a public utility which is engaged in the provision of telephone service, SECTION 2 - TERRITORY INCLUDED IN SYSTEM (b) All territory in the County, including every municipal corporation in the County, which is served by telephone company central office equipment that will permit an enhanced emergency telephone system to be established, shall be included in the system. The municipal corporation included in the system shall include, but shall not be limited to, the folowing: 1.City of Buckhannon SECTION 3 - COUNTY ANSWERING POINT (b) The county answering point shall be operated constantly. There shall be one county answering point, The location of such answering point is as follows: (c) (d) The Upshur County Courthouse 1st Floor Main Street Buckhannon, WV 26201 The answering point will serve the entire County of Upshur, including the City of Buckhannon and will receive call from the same. The County answering point shall respond to calls as follows : City and County Police - Direct Dispatch State Police - Direct Dispatch & Relay thru Elkins Fire Departments - 6 Rural Depts - Direct Dispatch City Dept. - Relay Ambulance Service - Relay, but can direct dispatch if they are backed up. DNR - Direct Dispatch after normal working hours

',. &"I -3- SECTION 4 - EMERGENCY SERVICE PROVIDERS; HANDLING OF MISDIRECTED CALLS Every emergency provider that provides emergency service within the territory of the County shall participate in the enhanced emergency telephone system. TO State Police from ComCenter: Correction via Radio Transmission if unit is enroute or correction via public service thru their office during the day or thru the Elkins Detachment via public service or by teletype after daytime office hours. To EMS from ComCenter: Correction via radio transmission if unit is enroute or correction via public service to their dispatcher for Radio Transmission. To All Fire Departments from ComCenter: Correction via Radio transmission if unit is enroute. (d) To DNR From ComCenter: Correction via Radio transmission if unit is enroute, or correction via their office by public service or via Braxton County's DNR Radio. Each emergency provider participating in the system shall maintain a telephone number in addition to the one provided in the system. SECTION 5 - PROJECTION OF COSTS The initial capital and installation costs of the enhanced emergency telephone system are projected be as follows: Service Establishment - ANI ANI -- $ 7,345.00 7,560. 00 n ~ nn r to

This will amount to approximately 800.00 per year for ComCenter employees. (c) (d) There will be no cost involved with furnishing or for other equipment in our answering point, since we have had a basic 911 answering point in operation for the past 10 years. There will be no recurring costs such as rent, since our answering point is located in the Courthouse. SECTION 6 - IMPOSITION OF FEE; ADOPTION OF BILLING CONTRACT; ESTABLISHMENT OF SEPARATE E-911 FUND; PAYMENT OF COSTS NOT RECOVERED THROUGH FEE c (a (b) (c) (d) to section three-cc, article one, chapter Pur seven 7-1-3-ccI of the West Virginia Code,.the County Commission of Upshur County hereby imposes a fee of ninety cents (.go$) per month per local exchange service line to finance the projected costs of the capital installation and maintenance costs of the enhanced emergency telephone system. Such fee when collected for six months prior to the start up of the enhanced emergency telephone system shall cover the costs of the initial capital outlay and installation charges. Since the amount of ninety cents (.go$) will only partially offset the cost of monthly maintenance charges and dispatcher salaries and benefits, we do not expect to reduce the charge at this time. Such fee shall become effective on December 1, 1988. The County Commission of Upshur County hereby adopts and ratifies the contract attached hereto as Appendix A for the billing of the enhanced emergency telephone system fee by C & P Telephone Co. of West Virginia. All fees remitted under the contract referred to in subsection (b) shall be deposited in a separate "E- 9 11 Fund. 'I Notwithstanding the foregoing provisions, the following costs, although recoverable through the enhanced emergency telephone system fee, shall not be recovered

-5- SECTION 7 - TELEPHONE COMPANY The terms and conditions of the telecommunications services and facilities provided by the telephone company shall be governed by the applicable tariffs on file with and approved by the Public Service Commission of West Virginia, the rules, regulations and orders of the Public Service Commission of West Virginia and the laws of the State of West Virginia. The telephone company providing the services and facilities identified in subsection is: C & P Telephone Company SECTION 8 - TARIFFS, RULES AND REGULATIONS, AND LAWS This final plan shall be supplemented and superceded by the applicable tariffs on file with and approved by the Public Service Commission of West Virginia, the rules, regulations and orders of the Public Service Commission of West Virginia, and the laws of the State of West Virginia. Such tariffs, rules, regulations, orders and laws shall be deemed invorporated in this final plan as if fully set out herein. SECTION 9 - FILING OF PLAN WITH THE PUBLIC SERVICE COMMISSION Upon adoption of this plan, the County Commission shall send a copy of such plan to the Public Service Commission of West Virginia.
