In this context EFSA s scientific views on the specific points raised during the commenting phase conducted with Member States, the applicant and EFSA on the confirmatory data and their use in the risk assessment for Straight Chain Lepidopteran Pheromones (SCLPs) are presented. The current report summarises the outcome of the consultation process organised by the rapporteur Member State Austria and presents EFSA s scientific views and conclusions on the individual comments received. Outcome of the consultation on confirmatory data used in risk assessment for Straight Chain Lepidopteran Pheromones (SCLPs) Summary Straight Chain Lepidopteran Pheromones (SCLPs) was included in Annex I to Directive 91/414/EEC on 1 September 2009 by Commission Directive 2008/127/EC, and has been deemed to be approved under Regulation (EC) No 1107/2009, in accordance with Commission Implementing Regulation (EU) No 540/2011, as amended by Commission Implementing Regulation (EU) No 541/2011. In 2014 the approval has been amended by Commission Implementing Regulation (EU) No 918/2014, following the peer review performed by EFSA (EFSA, 2014). It was a specific provision of the approval that the applicant was required to submit to the European Commission a second batch of confirmatory data as regards exposure of humans and the environment resulting from the different ways of application of Straight Chain Lepidopteran Pheromones as plant protection product, in comparison with natural background levels of those pheromones. EFSA finalised a technical report on the first batch of confirmatory data on 13 May 2016. In accordance with the specific provision, the applicant, IBMA SCLP Task Force, submitted an updated dossier in December 2016, which was evaluated by the designated rapporteur Member State (RMS), Austria, in the form of a revision to the draft assessment report (DAR). In compliance with guidance document SANCO 5634/2009-rev.6.1, the RMS distributed the revised DAR to Member States, the applicant and EFSA for comments on 30 January 2017. The RMS collated all comments in the format of a reporting table, which was submitted to EFSA on 22 March 2017. EFSA added its scientific views on the specific points raised during the commenting phase in column 4 of the reporting table. The current report summarises the outcome of the consultation process organised by the RMS, Austria, and presents EFSA s scientific views and conclusions on the individual comments received. For the representative product Isomate-CLR that is a retrievable passive dispenser and its associated straight chain lepidopteran pheromone active substances: (E,E)-8,10-dodecadien-1-ol, 1-tetradecanol, 1-dodecanol, (Z)-9-tetradecen-1-yl acetate, (Z)-11-tetradecen-1-yl acetate sufficient information was available to finalise the human and animal health and environmental risk characterisation. However the information provided did not address the confirmatory data requirement set, as the calculations only covered one way of application (passive dispenser). For the second representative formulation Checkmate CM-F (a microencapsulated spray application), an exposure assessment comparison with natural releases from the target lepidopteran insects was not available. www.efsa.europa.eu/publications 3 EFSA Supporting publication 2017:EN-1213

Background and Terms of Reference as provided by the requestor Straight Chain Lepidopteran Pheromones (SCLPs) was included in Annex I to Directive 91/414/EEC 1 on 1 September 2009 by Commission Directive 2008/127/EC 2, and has been deemed to be approved under Regulation (EC) No 1107/2009 3, in accordance with Commission Implementing Regulation (EU) No 540/2011 4, as amended by Commission Implementing Regulation (EU) No 541/2011 5. EFSA previously finalised a Conclusion on this active substance on 13 December 2013 (EFSA, 2014). Following the peer review performed by EFSA, the approval has been amended by Commission Implementing Regulation (EU) No 918/2014 6. Interpretation of the Terms of Reference On 22 December 2014 the European Commission requested EFSA to provide scientific assistance with respect to the risk assessment of confirmatory data following approval of an active substance in accordance with Article 6(1) of Directive 91/414/EEC and Article 6(f) of Regulation (EC) No 1107/2009. EFSA s scientific views on the specific points raised during the commenting phase conducted with Member States, the applicant and EFSA on the risk assessment of confirmatory data for Straight Chain Lepidopteran Pheromones (SCLPs) are presented. To this end, a technical report containing the finalised reporting table is being prepared by EFSA. The deadline for providing the finalised report is 20 April 2017. Assessment The comments received on the pesticide risk assessment for the active substance Straight Chain Lepidopteran Pheromones (SCLPs) in light of confirmatory data and the conclusions drawn by the EFSA are presented in the format of a reporting table. The comments received are summarised in column 2 of the reporting table. The RMS considerations of the comments are provided in column 3, while EFSA s scientific views and conclusions are outlined in column 4 of the table. The natural release rate of 9.1 mg/h/ha is 3-fold the value stated in SANTE/12815/2014 as the occupancy was then assumed to be of one larvae per fruit, not taking into consideration the study published by Ferro and Hardwood in 1972 (Ferro, D.N. and Harwood, R.F. 1972: Intraspecific larval competition by the Codling Moth, Laspeyresia pomonella. Environmental Entomology. 2(5): 783-789) that shown that the carrying capacity for a 4-cm-diameter apple is approximately three larvae per apple. Please note that this is a conservative approach since such a small apple has been used for laboratory studies with not further growing. EFSA: Please refer to the EFSA comments for the exposure assessment under section B.8. (3) Vol. 3, B.6.13, Exposure DE: For the spray application of the microencapsulated formulation a realistic exposure assessment for operator, worker, bystander and resident is still missing. A relevant updated environmental risk assessment for this representative use is being conducted considering, among others, the endpoints of new ecotoxicology studies (for a full list please refer to the SCLPs Renewal Application submitted by Suterra on 30th August 2016), appropriate calculated PEC values and a new literature search/review.
