The ability to broadcast audio and video to viewers in real time, via the internet or cellular network, typically using an application on a mobile device such as a phone, tablet, or other device. 5 General Legal Issues with Broadcasting Copyrighted Content Based on Terms of Service user/broadcaster is assuming liability for copyright violations (unlicensed use of music, airing copyrighted programming, liveevent piracy, artwork, etc.) Location, Location, Location Typically no issue broadcasting from public property, provided not obstructive and consistent with usual time, place, manner restrictions for the Property. As for private property, it is easy to forge concerns about trespassing and loitering. Hardware in use If using drones, additional laws and federal regulations at issue (See generally 49 USC40101, et seq. and 14 CFR 107) General Legal Issues with Broadcasting Privacy Concerns Generally no reasonable expectation of privacy at public events, but there are limits Commercial Purpose Likely need releases, location permissions, and other concerns Public Records Archiving 5
6 Livestreaming and the ADA A minefield without a map: little explicit regulation Technology consistently outpaces the law No federal regulations, statute, or agency rules governing ADA and internet accessibility ADA Generally DOJ guidelines generally indicating digital/internet content must be fully accessible, but no specific guidelines re: in what matter and to what degree Different from state to state, as some states (e.g. California) have adopted laws applying the federal guidelines as a matter of state law See generally: 29 U.S.C. Sect. 794d; 36 CFR Section ) Livestreaming and the ADA 21st Century Communications and Video Accessibility ACT (CVAA) Signed into law in 2010 Video programming that is closed captioned on TV must also be captioned when distributed internet If a public meeting is broadcast on tv with CC, so too should the archived version on a City website Does not cover programming exclusively shown on internet 6
7 Best Practices Have a policy in place Be consistent in the implementation of your policy by educating elected officials and staff alike If Livestreaming off-site, consider securing written permission as part of contracts and agreements or crowd releases Plan ahead and check the area surrounding where your stream will take place for copyrighted works such as posters, logos, artwork, and screens Consider transcribing or captioning livestreamed videos that are posted at a later date Introducing Homestead Zackery Good 7

17 ACE 2000 The ACE-2000 converts speech to text and sends that text out with captioning data, either by RS232 (Serial) or TCP/IP. Designed for two through four-line roll-up captions, and compatible with most closed captioning encoders ACE 2000 The ACE-2000 can accept audio by de-embedding the first two channels of audio from a SDI or a HDMI. The Link output is more consistent in its throughput of captioning. There is no pause then release of a flood-gate of captions that are simply displayed too fast to read, as routinely happens with live manual captioning. 17
18 ACE 2000 While live captioning of meetings was the primary reason for the purchase, the city also archives the captioned broadcasts so that they can be viewed at a later date. ACE 2000 The ACE-2000 was a one-time purchase at a cost of $44,380 which includes a year of support and upgrades. Manual captioning in south Florida ranges from $95 to $150 per hour. Using a base rate of $100 per hour, the ACE-2000 will pay for itself in 444 hours. Based on their non-summer meeting schedule of hours of meetings per week, the city of Naples achieved a payback in 18.5 weeks (based on 24 hours of weekly captioning and a cost avoidance of $100 per hour for manual captioning). 18
