3 VISION, MISSION & PURPOSE OF AYURVEDIC MEDICAL COUNCIL Vision:- Make Ayurvedic Medical Council the Apex body of Ayurveda in Sri Lanka equipped with All required facilities Mission:- Protect the legal foundation necessary for qualitative development of the Ayurvedic field, providing maximum service to the public through Ayurveda under professional ethics. Purpose:- Confer the legal authority on professionals who have the knowledge, attitudes, skills and experience necessary to provide qualitative services in the field of Ayurveda in accordance with provision of the Ayurveda Act No.31 of 1961 Ayurvedic Medical Council Annual Report
4 Objectives:- 1) To put into enforcement the power entrusted to the Ayurvedic Medical Council by the act No.31 of ) To decide and maintain objectives and standards in order to uplift the professional competencies in the Ayurvedic field. 3) Implementation of Ethics and standards in order to maintain the professional behavior of the Ayurvedic professionals properly. 4) Control and ascertain professional conducts in Ayurvedic field. 5) To enhance the productivity of the Ayurvedic Medical Council by renewing and updating it's resources. Main functions and Introduction of the Ayurvedic Medical Council established under the Ayurvedic Act No.31 of 1961 shall be as follows. Indigenous Medical Board established in 1928 on a recommendation made by a Sub Committee of the state Council of 1927 was the first legally authorized establishment in the Sri Lankan Ayurvedic field. Subsequently the Ayurvedic Medical Council was established in terms of the Ceylon Ayurveda Medical Council Ordinance No.46 of 1935 was reestablished under the provision of the Indigenous Medical Council Ordinance No. 17 of 1941 (amended by No 49 of 1945 and No. 49 of 1949) The Ayurveda Medical Council functioning how is an organization established under the Ayurveda Act No.31 of Main functions of the Ayurvedic Medical Council (a).recommending to the Minister whether any Ayurvedic teaching institution should be approved by him in terms of the purposes of Ayurvedic Act No 31 of (b).the Registration of persons as Ayurvedic Practitioners; (c). The Registration of persons as Ayurvedic Pharmacists: (d).the Registration of persons as Ayurvedic nurses: (e).the Cancellation, or suspension, of such registration : and (f).the Making of rulers for :- (i).the Regulation and control of the professional conduct of Ayurvedic practitioners, Ayurvedic pharmacists and the Ayurvedic nurses and (ii).any of the matters referred to in paragraphs (b)to (e) the section. 7 Performance of the Ayurvedic Medical Council Financial Formulation:- A Provision of Rupees for Million (Rs.3,900,000/-) has been granted to the Ayurvedic Medical Council for the year During the year 2011 the Ayurvedic Medical Council received an income of Rs.1,900,666/- and the expenditure was Rs.7,223,011/-. A report regarding the performance of Ayurvedic Medical Council of 2011 has been given in the income and Expenditure Account and the Balance sheet provides the financial position of the Council as at In addition, the Cash Flow Report provides an illustration of inflow and out flow of the Council s money in The annual income and expenditure of the Ayurvedic Medical Council for the years 2007 to 2011 are as indicated in table 1.1 below. The difference had been met by other income of the council. Policy Formulation:- In 2011, two sub committees and programs functioned in the Ayurvedic Medical Council as follows; Examination Management Board - Standing Sub Committee. 9 Examination Management Board - Standing Sub Committee The Written Examination for registering the Traditional Ayurvedic Practitioners was held on 12th and 13rd of November 2011 at WP/Co/C.W.W.Kannangara Vidyalaya, Maradana under the overhaul supervision of the examination Control Board. The number of candidates qualified the written examination 319 The number of candidates who attended 193 The number of absentees 126 This Written examination was held on 12th and 13rd of November 2011 and therefore it was not possible to release results before the end of the year The answer sheets have already been handed over to the examiners for corrections. 10 03. Sub committee for determining the additional qualification of registered Ayurvedic practitioners. In terms of section 62 of the Ayurvedic Act No. 31 of 1961, any registered Ayurvedic practitioner. has powers to include in the Register of Ayurvedic practitioner any qualification relating to his profession which he has received after the registration, as an additional qualification, on its being accepted by the council. Accordingly, this additional qualification gives him the legal entitlement to had a certificate issued by the council for such additional qualification and to display the same along with his name and also to use that additional qualification for his professional activates. As to the decision of the Ayurvedic Council and according to the provisions of the section, the registration of additional qualification has already commenced and relevant parties have been made aware of this. During 2011 the council has given approval for the inclusion of additional qualification of 09 practitioners and 09 out of them have been issued with certificates. 11 The additional qualifications have been approval and issued by the AMC in 2011 in below. Investigations Ayurvedic medical council has set up a public Investigation Unit to inquire into and institute legal actions regarding the professional misconducts of persons who pretend to be registered or unregistered Ayurvedic practitioners. The prime objective of this unit is to investigate the irregularities professional misconducts and unethical activities of the Ayurvedic medical practices. These activities are investigated by the council under two categories such as press complaints and public complaints. Preliminary investigations have been completed in respect of 14 complaints during the year We have prepared complaints from the following Departments National Housing Development Authority 2. Sri Jayawardhanapura General Hospital 3. Zonal Education Office, Chilaw 4. University of Ruhuna 5. Department of Ayurveda ( Central Province ) 6. Sri Lanka Medical Council 7. Police Superintend Office, Kandy 8. Colombo Municipal Council 9. Castle St Hospital for Women 10. Criminal Investigation Department 05. Special Medical Board. Conducting of relevant special Medical Boards in respect of the issuance of Ayurvedic medical certificates in parallel to the Medical Boards which are conducted by the Director General of the Medical Services in view of the 2nd paragraph of the chapter xxvi of the Establishment code regarding the issuance of medical certificate by the Ayurvedic Medical Practitioners for the members of the government and private sector. To examine those complaints common 142 paper is to be completed and sent to the Ayurvedic Medical Council. In 2011 five such special medical boards have been held. Registration of government recognized Ayurvedic Medical Graduates, those who hold diplomas and certificated practitioners, according to their educational qualifications. Registration of qualified traditional Ayurvedic practitioners on the result of an interview and on recommendations, according to the Constitution adopted by the Ayurvedic Medical Council. At the interview the applicants would be graded depending on the mark they scored and those who failed at the interview will be subjected to a period of evaluation as three month, six month and one year considering to value of their marks and called for a interview once again. 17 Chart 6.2 Pass Candidates as % of total Present Candidates Registation of Ayurvedic Nurses and Dispensers:- During the year 2008 for the first time 32 were recruited to train as Ayurvedic Nurses and after completion of the training actions have been completed to register the relevant service with effect from In respect of training the Ayurvedic Pharmacists the courses have already been commenced after making selections through conducting the Indigenous Medical Institute University. 08. Formulation of Legislations:- Sub Committee regarding registration of new nurses. According to the section 56 of Ayurveda act, legal powers for registration new nurses are under the Ayurvedic Medical Council. Accordingly the Ayurvedic Medical Council appointed a new subcommittee pertaining to registration of nurses along with for making legal and other documents. 18 09 Helaveda Rewanara Programmer 5 Stage :- In parallel to the Hela weda punaruda project operating by the Ministry of Indigenous Medicine under the Mahinda Chinthana programmer. The Hela weda Ruwanara project has been operated in the under privileged areas of provincial Secretary's divisions under the direction of the Ayurvedic Medical Council. Under this, following activities are being done. 1. Following Functions are being attended to at a Mobile services Counter of the Ayurvedic Medical Council. i. Issue of applications for the registration of traditional Ayurvedic Practitioners. ii. Receipt of applications for the registration of traditional Ayurvedic Practitioners. iii. Corrections of shortcomings of the application received. iv. Settling of problems of practitioners who seek registration. v. Issue of Ayurvedic Medical Certificate Books. 2. Conducting interviews for the registration of Traditional Ayurvedic Practitioners. 3. Implementation interviews for the professional development programmer for the registered Ayurvedic Practitioners. 4. Taking initial actions to call over the Ayurvedic Practitioners who are over 70 years of age and who have not yet been registered for offering them the registration. 5. Getting the Medical Pratitioners to contribute to the pension scheme, Helaweda Rekawarana if they are not still contributing to it. This programme was conducted with the assistance of the Provincial Ayurvedic Commissioners and the Ayurvedic conservation councils and it was a great assistance to strength the professional standards of the indigenous medical system. Official website of the Ayurvedic Medical Council During this period, the attention of both government and the private sector has been placed on Ayurvedic practitioners. Therefore to facilitate them it has been granted in 2009 to start a website including necessary guidance legal matters and other connected information useful for both registered and registration expecting doctors. The website was opened on bearing the address Additional steps implemented in conformity with the decisions taken by the Ayurvedic Medical Council in In accordance with section 81 of the Ayurvedic Act no 31 of 1961 the names of 27 Ayurvedic Practitioners have been removed from the register hence the Registrars of Birth and Deaths have informed that there Ayurvedic Medical Practitioners have been passed away. 2. Conducting of Primary Professional Development Programs in respect of the newly registered Ayurvedic Medical practitioners with the support of the National Institute of Traditional Medicine. 23 3. The relevant confirmation was granted to 250 medical certificates issued by the Ayurvedic Medical Practitioners during 2010 for the offices of the public and private sector services. 4. The information as respect of the Registered Ayurvedic Medical practitioners have been Computerized and at the they are being verified. Out of the computerized information Ayurveda Doctors the information of doctors have been updated. 5. In 2011, 409 Ayurvedic doctors have applied for identity cards and out of them 406 have been issued. 6. Registration application from for Ayurveda doctors has been amended and updated and this has been approved by the Ayurveda Medical Council on The necessary arrangements are being made for printing of this new application. Report of the Auditor General on the Financial Statements of the Ayurvedic Medical Council for the year ended 31 December 2011 in terms of Section 14(2)(C) of the Financial Act, No. 38 of This refers to the Report of the Auditor General No. HW/C/AMC/FA/2011 dated send to me by you. I give below the explanations in respect of the matters raised mentioned therein. 2. Financial Statements 2.2 Comments on Finical Statements Accounting Deficiencies (a) The Cost and the accumulated depreciation of the office equipments which have been identified as disposable items during the board of survey have been removed from the accounts and settled as follows. Action will be taken to include these items to the 2011 annual auction sale of the Department of Ayurveda and the income derived will be debited to the revenue when the 2011 annual auction sale of the office equipment of the Department of Ayurveda is conducted. (b) Action will be taken to rectify these during (c) The council has approved on to make a payment of R.s 2,000/- per month in respect of entertaining the visitors coming to meet the registrar in accordance with the Council Paper No. 17/01/08. In order to make these selections the Registrar of the medical council should provide the list of Ayurvedic practitioners to the Commissioner. Under clause 11(1) (e) of the Ayurvideic Act No. 31of 1961 the selection of these three medical practitioners have to be elected from more than registered medical practitioners. 39 (b) Financial RegulationsManual FR.772 Since the Ayurvedic Medical Council is a small institution auction sales could not be conducted due to lack of items to be auctioned and therefore these items being kept aside for the inclusion when the department of Ayurveda arranged an auction sale. It is mentioned here that a date of auction has not been informed to us by the Department of Ayurveda. The items such as 9 Clerks Iron Tables, 8 Computer Chairs, 15 Iron Chairs, 2 Revolving Chairs and 5 Computer Tables which have been condemned by the Board of Survey have been handed over to Department of Ayurveda to be given to the other institution of the Department if they needed. (c) Management Circular No.19 dated Since the establishment of the Council the payment of overtime has been calculated on the basis on this manner and since there is no council paper to be traced on this matter is a council paper has been forwarded on to the council on this matter an during the time of tabling this council paper the representative of the treasury Mr.K.A.U.S.K Tilakarathne Assistant Director of the Department of Budget was present at the meeting and has given his consent. Therefore it is believed there is no purpose of obtaining the treasury approval since the representative of treasury has given his approval. (d) Clause 35 of 12 of the Establishment Code. On this matter a clarification has been sort from the Ayurvedic Drugs Corporation regarding their practice on this matter. Since it is found that they are following the establishment code the necessary instructions have been given to the officers concerned to follow the instructions given in clause 35 of the Chapter 12 of the Establishment Code on this matter. 3 Financial and Operating Review. 3.1 Financial Results. 40 3.2 Operating Review. (a) Noted for compliance (b) Actions could not be taken due to a legal obstacle created in respect of the implementation of the decision of the council regarding the council paper No 14/13/8(3) dated 15 July 2005 to the effect that all the registered Ayurvedic Practitioners should renew their registrations every five year period on payment of 1/4 of the registration fee. Action will be taken to obtain the opinion of the Attorney General in this matter. (c) (1) Preparation of a Hand Book for Registered Medical Practitioners. The necessary primary information has been collected and drafted in respect of the preparation of the hand book. After getting the clearance of the legal consequence pertaining to these collected information it is planned to start the preparation of the Hand Book. (2)The program for the Development of Professional Indigenous Methods of Medical Treatment for fractures and dislocations. The National Institute of Traditional Medicine is in the process of conserving the knowledge and the methods of treatments applied by the indigenous medical practitioners for fractures and dislocations in view of the request made by the Medical Council. (3) Establishment of Data Base Committee in respect of indigenous traditional knowledge. The data and information collected in respect of the indigenous traditional practitioners have been computerized and actions have been taken to provide such information to the interested institutions and individuals as the necessity arises. (4)Sub Committee for conservation of the methods of medical treatments for burns and scalds which are in the verge of nonexistence. 41 (5) Sub Committee in respect of the revision of the syllabus for the registration of Traditional Ayurvedic Medical Practitioners. Under this 8 subjects have to be revised and at present 5 subjects have been revised. This committee is not functioning with effect from Actions will be taken to commence the revision works of the remaining subjects. (6) Sub Committee for the conservation of Veterinary Medical System. The information in respect of the Ayurvedic Veterinary Medical Practitioners have been collected on the basis of Provincials Secretaries Divisions but the registration could not be carried out at present due to the legal obstacles. The Attorney General has informed us the legal aspects on this matter by his letter No E/35/2011 dated In view of this the Medical Council has no provisions to register the Ayurvedic Medical Veterinary Practitioners. (d) (1) Action for the improvement of the legal frame work of the Ayurvedic Medical Council and for the formulation, implementation of the regulations under the Ayurvedic Act. Due to the changes occurred in respect of the Registrars of the Medical Council during 2011 the actions planned for 2011 could not be achieved. Actions will be taken to achieve this in (2) The process of making improvements for the procedure of granting Professional Accreditation. Policy matters such as prescribing the criteria for granting the specialist grade in respect of the medical practitioners and establishment of an institution for the same should be implemented under the direction of the Ministry of Indigenous Medicine / Ministry of Higher Education and relevant university institutions. The Medical Council could not involve on this directly. The university authorities have been enlightened on this matter. The Medical Council could be able to make the registration once this relevant matters initiated. (3) Implementation of the code of ethics and standards in order to maintain the conduct of Ayurvedic Medical Practitioners. Please refer to the explanation given at (4) for below on this matter. 42 (4) Determination and control of the Professional Ethics and conduct of the Ayurvedic Sector. While action being taken to safe guard the professional ethics existing at present action has also been taken as a first step to revise the existing professional ethics to suite the present day and forwarded the same to the Department of the Legal Draftsmen on via the Department of Attorney General. The Sinhalese version of same has been received on Further action on this draft is under process. (5) Through updating of the assets and facilities of the Ayurvedic Medical Council the functions and the duties of the Medical Council could be improved. It is mentioned that the medical council would able to function independently securing its image due to the reason that by handing over to the Council to stories of a building own by the Department of Ayurveda. Actions being taken to discuss with the treasury the possibility of obtaining the necessary provision to construct a building for the council during the coming years. (6) Professional Development program. (1) Printing and launching of a Hand Book prepared by the Medical Council in respect of the registered Ayurvedic Medical Practitioners. The necessary basic information has been collected and drafted for the preparation of the hand book. After finding the legal involvements in this collected basical data and information it is planned to prepare the hand book after receiving the necessary provision. (2) Operating of awareness program in respect of public and Private Institution regarding the false Medical Certificates. The medical council is in the process of finding the accuracy of the medical certificates issued by Ayurvedic Medical Practitioners. The Council daily in touch with such institutions and make them aware of this certificates issued by the Medical Practitioners. During the last few months due to t certain problems created in respect of the relevant server with the ICTA permission was not granted to update the web site.
