The commentary notes the absence of a binding global instrument dedicated to the regulation of offshore petroleum E&P activities. Recommendation for adoption of an international convention on offshore petroleum E&P was made with the hope that this is achievable when oil and gas industry operators drive the initiative. The research will have a tremendous impact on the oil and gas industry. 1

In 1982 the Economic Community of West African States (ECOWAS) conceived the idea of the West African Gas Pipeline as a vehicle to promote regional integration and economic development. The body consequently suggested the development of natural gas pipelines that will cover the entire West African sub-region. Following a feasibility study carried out in 1999 a Memorandum of Understanding was signed by Nigeria, Benin Republic, Togo and Ghana in Cotonou while the West African Gas Pipeline (WAGP) implementation agreement was signed in The West African Gas Pipeline (WAGP) which is the first regional gas transmission system in sub-saharan Africa is a pipeline of approximately 678 km that runs from Nigeria s Escravos region of the Niger Delta to the republics of Benin, Togo and Ghana. The construction of the pipeline which started in 2005 will deliver natural gas to markets in the Republic of Benin, Togo and Ghana. It is expected that later the WAGP will be extended to Côte d'ivoire and in longer term 2

This article examined the role of joint development in fostering co-operation and the promotion of the exploration and exploitation of offshore petroleum resources in areas of competing claims between disputing coastal neighbours. An analysis of the legal basis for negotiating a joint development agreement, and an assessment of how treaty provisions and judicial opinions support the concept as a panacea for 3
4 the exploitation of offshore petroleum resources situated in areas of overlapping claims followed. By way of concluded by examining whether a subsisting joint development arrangement, which is serving the economic needs of the parties, will dispense with the need for a settled maritime boundary. 5 Abstract The article examined how the 1982 United Nations Convention on the Law of the Sea (hereinafter referred to as UNCLOS) tried to address the problem of competing maritime boundary claims between coastal neighbours. It gave a general overview of what constitutes maritime boundary delimitation as well as discussed the rights of coastal states in the exclusive economic zone and on the continental shelf and the rules applicable to the delimitation of overlapping exclusive economic zones and continental shelves.
